PROGRAM KERJASAMA TEKN IS ANTARA BADAN STANDARDISASI NASIONAL INDONESIA (BSN) DAN ORGANISASI STANDAR, METROLOGI DAN MUTU ARAB SAUDI (SASO)
Sadan Standardisasi Nasional (BSN) Republik Indonesia dan Organisasi Standar, Metrologi dan Mutu (SASO) Kerajaan Arab Saudi untuk selanjutnya secara sendiri disebut sebagai "Pihak" dan secara bersama disebut sebagai "Para Pihak";
BERTEKAD, untuk memperkuat hubungan persahabatan dan kerjasama
antara dua negara dan rakyatnya ;
MEMPERTIMBANGKAN,
mempromosikan
dan
kepentingan
meningkatkan
bersama kerjasama
kedua teknik
negara dalam
untuk
semangat
kesetaraan dan manfaat bersama;
MENGAKUI
kebutuhan
kerjasama
teknis
yang
akan
meningkatkan
pertumbuhan ekonomi melalui fasilitasi perdaganan antara kedua negara;
MENGACU, kepada Perjanjian
Kerjasama Ekonomi dan Teknis antara
pemerintah Indonesia dan Pemerintah Kerajaan Arab Saudi, yanq telah ditandatangani di Riyadh pada 19 Mei 1981 .

BERKEINGINAN untuk menggantikan Program Kerjasama Teknis antara
Badan Standardisasi Nasional (BSN) dengan Organisasi Standar Arab Saudi (SASO) yang ditandatangani di Jakarta tanggal 8 Januari 2009 untuk meningkatkan kerjasama saling menguntungkan antara Para Pihak;
BERDASARKAN hukum dan peraturan perundang - undangan yang berlaku di
masing -masing negara;
TELAH MENYETUJUI hal-hal sebagai berikut:
PASAL 1 DEFINISI
Dalam Program Kerjasama Teknis (PKT) ini: 1. Singkatan
dari
BSN
memiliki
arti
dan
mengacu
pada
Badan
Standardisasi Nasional Indonesia, Republik Indonesia. 2. Singkatan dari SASO memiliki arti dan mengacu pada Organisasi Standar, Metrologi dan Mutu, Kerajaan Arab Saudi. 3. Singkatan dari PKT mengacu pada Program Kerjasama Teknis ini.
PASAL 2 TUJUAN DAN LINGKUP
Para Pihak akan bekerjasama dalam hal-hal sebagai berikut: a.
Mendukung peningkatan Kerjasama ekonomi antar kedua negara melalui fasilitasi
perdagangan
dengan
mengeliminasi
hambatan
teknis
kerjasama
teknis
perdagangan (TBT) dalam area Standardisasi. b.
Menyediakan
kerangka
dan
mekanisme
untuk
Standardisasi, penilaian kesesuaian, informasi teknis, pelatihan dan bidang lain yang dimungkinkan dengan persetujuan para pihak.

PASAL 3 AKTIVITAS KERJASAMA
Para pihak akan berkolaborasi pada hal-hal sebagai berikut: 1.
Pertukaran informasi untuk kepentingan bersama yang mencakup, tapi tidak terbatas pada: a. Produk yang diperdagangkan antara kedua Negara, termasuk di dalamnya: daftar produk, standar, regulasi teknis, prosedur penilaian kesesuaian, dan informasi lainnya untuk memfasilitasi perdagangan dari produk-produk tersebut. b. Katalog Standar Nasional dan publikasi penilaian kesesuaian ..
2.
Pertukaran para ahli dalam kegiatan - kegiatan standardisasi dan penilaian kesesuaian
3.
Pelatihan personil didasarkan pada bidang pengembangan standar dan penilaian kesesuaian.
4.
Berpartisipasi pada konferensi, simposium, workshop, pameran, dan pertemuan lainnya yang diorganisasi oleh salah satu pihak.
5.
Menyertakan
aktifitas yang
berhubungan
dengan
perjanjian
saling
mengakui dalam penilaian kesesuaian. 6.
Berupaya untuk tetap dalam kerangka dan aturan WTO serta selaras dengan kerangka dari standar internasional termasuk di dalamnya ISO, IEC dan CODEX, untuk meningkatkan kesolidan dan posisi para pihak pada aktivitas internasional di bidang Standardisasi.
PASAL 4 PENDANAAN
Pendanaan dari Kerjasama ini harus efektif didasarkan pada persetujuan antar kedua belah pihak.

PASAL 5 PERJANJIAN TEKNIS
1
Dalam rangka pelaksanaan PKT ini, Para Pihak akan membentuk Kelompok
Kerja
yang
terdiri
dari
perwakilan
Para
Pihak
untuk
memformulasikan program pelaksanaan dibidang-bidang yang disepakati bersama.
Program-program

harus
diimplementasikan
setelah
persetujuan dari lembaga otoritas yang terkait dari Para Pihak. 2
Dalam rangka memfasilitasi Kerjasama yang dimuat dalam PKT ini, pengaturan teknis dapat dibuat yang mencakup spesifikasi rinci dalam bidang-bidang yang disepakati bersama dan hal-hal lainnya, termasuk jika diperlukan, program pengaturan keuangan
PASAL 6 ISU YANG TIDAK TERCAKUP OLEH PKT
Dalam hal pengaturan-pengaturan, program-program atau proyek-proyek yang dilaksanakan atas dasar PKT ini akan menghasilkan hal-hal yang tidak tercakup dalam PKT, termasuk hak kekayaan intelektual, Para Pihak sepakat untuk mendiskusikan hal tersebut dalam pengaturan-pengaturan terpisah sesuai dengan peraturan yang berlaku dimasing-masing negara.
PASAL 7 KERAHASIAAN
1.
Setiap Pihak wajib menjaga kerahasiaan dokumen , informasi dan data lainnya yang diterima atau diberikan oleh Pihak lain selama periode pelaksanaan PKT ini atau perjanjian lainnya yang dibuat berdasarkan PKT 1rn,

Para Pihak setuju bahwa ketentuan Pasal ini akan terus berlaku dengan tidak mengabaikan adanya pengakhiran atas Program Kerjasama Teknis ini
3.
Ketentuan Pasal ini tidak mengabaikan hukum dan peraturan yang berlaku di masing-masing negara.
PASAL8 PEMBATASAN AKTIVITAS PERSONIL
Setiap orang yang terlibat dalam kegiatan terkait dengan PKT ini wajib menghormati kemerdekaan politik, kedaulatan dan integritas teritorial dari negara tuan rumah , dan akan menghindari kegiatan-kegiatan yang tidak sesuai dengan tujuan-tujuan dan maksud dari PKT ini.
PASAL 9 PENYELESAIAN SENGKETA
Perbedaan atau sengketa yang timbul dari interpretasi atau pelaksanaan ketentuan-ketentuan PKT ini akan diselesaikan secara bersahabat melalui konsultasi atau negosiasi oleh Para Pihak.
PASAL10 AMAN DEM EN
PKT ini dapat diamandemen dan ditambah sewaktu-waktu dengan persetujuan tertulis dari Para Pihak.

PASAL 9 PEMBERLAKUAN, DURASI DAN PENGAKHIRAN
1.
PKT ini mulai berlaku pad a tanggal penandatangan .
2.
PKT ini akan berlaku selama jangka waktu 3 (tiga) tahun dan secara otomatis akan diperpanjang untuk jangka waktu 3 (tiga) tahun berikutnya, kecuali salah satu Pihak memberitahukan secara tertulis kepada pihak lainnya untuk maksud mengakhiri PKT ini sekurangkurang nya 3 (tiga) bulan sebelum berakhirnya masa berlakunya.
3.
Pengakhiran PKT ini tidak akan mempengaruhi keabsahan dan jangka waktu dari segala kegiatan-kegiatan yang berlangsung atas dasar PKT ini sampai selesainya seluruh kegiatan-kegiatan tersebut, kecuali Para pihak memutuskan lain.

TECHNICAL COOPERATION PROGRAM BETWEEN THE NATIONAL STANDARDIZATION AGENCY OF INDONESIA (BSN) AND THE SAUDI STANDARDS, METROLOGY AND QUALITY ORGANIZATION (SASO)
The National Standardization Agency (BSN) of the Republic of Indonesia and The Saudi Standards, Metrology and Quality Organization (SASO) of the Kingdom of Saudi Arabia hereinafter individually referred to as "the Party" referred to as "the Parties":
DETERMINED to strengthen the existing friendly relation and cooperation between the two countries and their people; CONSIDERING their common interest to promote and foster technical cooperation in spirit of equality and mutual benefit; RECOGNIZING the need for technical cooperation which will enhance the economic development through trade facilitation of both countries; REFERRING to the Economic and Technical Cooperation Agreement between the Government of the Republic of Indonesia and the Government of the Kingdom of Saudi Arabia, signed in Riyadh on 19 May 1981; DESIRING to supersede the

Standards Organization (SASO), signed in Jakarta on 8 January 2009 to enhance a mutual cooperation between the Parties; PURSUANT to the prevailing laws and regulations in their respective countries; HAVE AGREED as follows:
ARTICLE 1 DEFINITION
In this Technical Cooperation Program (TCP): a.
The term BSN shall mean and refer to The National Standardization Agency of Indonesia;
b.
The term SASO shall mean and refer to The Saudi Standards, Metrology and Quality, Org. (SASO) of the Kingdom of Saudi Arabia;
c.
The term TCP shall refer to this Technical Cooperation Program.
ARTICLE 2 OBJECTIVES AND SCOPE
The Parties shall cooperate in the following matters:
a.
To support in enhancing the economic cooperation between the two countries through trade facilitation by eliminating the technical barriers to trade (TBT) in the area of standardization .
b.
To provide a framework and mechanism for technical cooperation in standardization , conformity assessment, technical information, training and other field as may be mutually agreed upon by the Parties.

ARTICLE 3 COLLABORATIVE ACTIVITIES
The Parties shall collaborate in the following matters: 1.
Exchange of information on mutual interest, which shall include, but not limited to: a. Products being traded between two countries, which shall include lists of products, standards, technical regulations, conformity assessment procedures, and any other information to facilitate the trade of these products. b. Catalogue
of
national
standards
and
conformity
assessment
publication. 2.
Exchange of experts in the activities of standard development and conformity assessment.
3.
Training
of personnel on mutual basis 1n the fields of standard
development and conformity assessment. 4.
Participation in conferences, symposium , workshops, exhibitions and other relevant meetings organized by either party.
5.
Carrying out activities related to mutual recognition arrangement on conformity assessment.
6.
Operate within the framework and guidelines of WTO as well as in close contact
within
the
framework
of the
international
standardization
organizations including ISO, IEC and CODEX to promote consolidation of their positions and increase the role of both Parties in international activities in the field of standardization.
ARTICLE 4 FUNDING
Funding of co-operation shall be effective on the basis of agreement between the Parties.

ARTICLE 5 TECHNICAL ARRANGEMENT

In order to implement this TCP, a working group shall accordingly be set up of the representatives of both parties to formulate implementation programmes in the fields mutually agreed. These programmes shall be implemented after the approval of relevant authorities of both parties.

In order to facilitate cooperation envisaged by this TCP, technical arrangement may be concluded covering detailed procedures in the fields mutually agreed and other appropriate matters including, if it is deemed necessary, the financial arrangement of programs.
ARTICLE 6 ISSUES NOT COVERED BY THE TCP
In case specific arrangements, programs or projects, implemented under this TCP may result in issues that are not covered by the present TCP, including intellectual property, the Parties agree to discuss such issues 1n separate arrangements in accordance with their respective legislations.
ARTICLE 7 CONFIDENTIALITY 1.
Each Party shall undertake to observe the confidentiality and secrecy of documents, information and other data received from or supplied to the other Party during the period of the implementation of this TCP or any other agreements made pursuant to the TCP.

The Parties agree that the provision of this Article shall continue to be binding between the Parties notwithstanding the termination of this TCP.

3.
The provision of this Article shall not prejudice the prevailing laws and regulations of the Parties. ARTICLE 8 LIMITATION OF PERSONNEL ACTIVITIES
Any persons engaged in activities related to this TCP shall respect political independence, sovereignty, and territorial integrity of the host country, and shall avoid any activities inconsistent with the purposes and objectives of this TCP.
ARTICLE 9 SETTLEMENT OF DISPUTES
Any difference or dispute that may arise out from the interpretation or application of the provisions of this TCP shall be settled amicably through consultation or negotiation between the Parties.
ARTICLE 10 AMENDMENT
This TCP may be amended and supplemented at any time in writing by mutual consent of the Parties.
ARTICLE 11 ENTRY INTO FORCE, DURATION AND TERMINATION
1.
This TCP shall come into force and be implemented by the Parties on the date of its signing.
2.

shall be in force for a period o1 3 (three) years and shall be
extended for subsequent period of 3 (three) year, unless either Party

terminate it by giving a written notification through diplomatic channel to the other Party at least 3 (three) months prior to such termination. 3.
The termination of this TCP shall not affect the validity and duration of any on-going activities made under this TCP until the completion of such activities unless the Parties decide otherwise.
