Deze schorsing duurt tot de bouwverg~ning definitief is verleend of i8 ge~igerd in laatste sanleg. De vergunninghouder dient her definitief verkrijgen van de bouwvergunning te melden san de bestendige dep~tatie bij tar post aangetekende zending. §2 De geschorste mi1ieuvergunning vervalt van rechtswege op de dag waarop de bouwvergunning in 1aarste aanleg definitief zou geweigerd worden. §3

Under the conditions set forth in the present decree, the N. V. Indaver, established at Poldervlietweg (no number), 2030 Antwerp, is granted a permit to continue operating a waste .processing plant located at 2030 Antwerp, Poldervlietweg (no number), cadastral data (divisionsection - parcel number) 18-D-80b, 18-D-28c, including: Dump: (2.3.6.c./l ap.d 2) '. .... " .. ';.,' .' A category 1 dumpsite for non-hazardous industrial waste"prodlicts ~rtd comparable waste products and for hazardous industrial waste products. The dumpsite has an authorised surface area of ca. 8.4 hectares and an authorised dumping capacity of ca. 1,350,000 m3 . This dumpsite includes 2 dump zones which are operated as 1 dump. Rotary drum furnace No.1 and 2 (pTO 1 and 2) : (2.3.4./ b, c3, d, £: g, h, j, k and 17.2.1.1) 2 waste incineration installations for. solid, liquid, pasty, industrial and special waste products, each with a cilpacity of ca. 7 tonnes ofwaste products per hour. and with a nominal thermal power of ca. 29 MW. The total installed power for pumps, fans, mixers, compressors, etc. amounts to ca. 2,345 kW for DTO 1 and ca. 1,400 kW for DTO 2. This environmental permit is suspended if, for the facility which forms its object, a building permit is also required pursuant to the Law of 29 March 1962 on the organisation of spatial planning and urban development, and this building permit has not been definitively granted. This suspension will continue until the building permit is definitively granted or is refused in the last instance. The permit holder must report the definitive obtainment ofthe building permit to the provincial executive by registered letter.

Dump: , - The following waste products may be dumped under salt cell conditions·: 1. waste products which, with regard to the water-soluble part, do not satisfY article 5.2.4.1.3§3,,4° ofVlarem II. 2. waste products which contain ~s (ill) and are pre-treated with the soliroc process or a comparable solidification technique, making use of specific additives, and from which the end product has a leachability of more than 1 mg/litre of As. - The salt cell conditions are achieved through the following technique : the salt cell consists of a stable bottom layer around which a stable embankment is built and on which HDPE film at least 1.0 -1.5 mm thick is applied (or alternative materials with the same k-factor); if necessary, an access way is provided in one of the sides of the salt cell; the cell is fIlled with salts and when completely filled it is definitively sealed; the salt cell is definitively closed by applying an HDPE film or equivalent film on top of the cell, and then both of the contact edges are fastened together, so that the entire cell is made watertight; during the operation of a salt cell, water is prevented from penetrating the cell by permanent covering,'or any water which does penetrate is removed and processed in the physico-chemical installations; - The specific waste products which contain As (III) are pre-treated in accordance with the best available techniques and the immobilisation result must amount to at least 99 % for the highly arsenic-contaminated waste products; . The necessary measures are taken to prevent the highly arsenic-contaminated solidified waste products from corning into contact with percolating water or rqinwater. - The residual waste products deriving from the physico~chemicalprocessing installation (physico-chemistry 2 - solidification/immobilisation) may, with a view to the curing ill pulp or paste form, be dumped at the dumpsite; provided that the stability and the safety of the dumpsite is not threatened and provided that one satisfies the provisions included in the approved work plan. Condition 1:
SCOPE
This Facility Permit is issued under the Waste Management (Facility Permit and Registration) Regulations 2007 and the Waste Management (Facility Permit and Registration) (Amendment) Regulations 2008 to Irish Lamp Recycling Ltd, Woodstock Industrial Estate, Athy, Co. Kildare for a recovery facility at Woodstock Industrial Estate, Athy, Co Kildare
1.2
This permit is granted for a period not exceeding 60 months from the date of issue.
1.3
Should environmental pollution occur at the site, this permit may be reviewed by Kildare County Council.
1.4
For the purposes of this waste facility permit, the facility is the area outlined in red on the Site Location Map titled UrbanlRural Place Map, scale 1:2500, received on the 11/12/2008, except where altered or amended by conditions of this waste permit.
1.5
For the purposes of this waste permit, the waste activities shall be carried out as shown on the Ground Floor Plan submitted on the 11/12/2008, except where altered or amended by conditions of this waste permit.
1.6
The waste permit is for the purposes of waste permitting under the Waste Management Act 1996 to 2008 and nothing in this waste permit shall be construed as negating the permit holders statutory obligations or requirements under any other enactments or regulations.
1.7
Only those Waste Types specified in Appendix A of this waste permit, shall be accepted at the facility.
1.8
The permit holder shall give notice in writing to Kildare County Council of any significant changes in the information furnished in the application for the permit. Such notice shall be given within three weeks of any such change arising. On receipt of this information Kildare County Council may require a new waste permit application to be submitted.
1.9
The permit holder shall be responsible for ensuring that the waste activities are controlled, operated and maintained in strict accordance with the terms of the application as modified and/or controlled by the conditions attached to the Waste Permit and conditions attached to Planning Permission 04/300022. The permit holder shall establish procedures to ensure that corrective action is taken should any condition of this permit not be complied with. Kildare County Council shall be notified of any such breach by telephone/fax and full details shall be forwarded in writing on the next working day.
1.10
Where Kildare County Council considers that a non-compliance with the conditions of this permit has occurred, it may serve a notice on the permit holder specifYing;

that only those wastes as specified, if any, in the notice are to be accepted at the facility after the date specified in the notice; and that the permit holder shall undertake the works stipulated in the notice, and/or otherwise comply with the requirements of the notice as set down therein, within any time-scale contained in the notice.
When the notice has been complied with, the permit holder shall provide written confirmation to the local authority that the requirements of the notice have been carried out. No waste, other than that which is stipulated in the notice, shall be accepted at the facility until written confirmation is received from the Council that the notice is withdrawn.
Condition 2: MANAGEMENT OF THE ACTIVITY The permit holder shall acquaint all staff, employees, lessees and agents, including replacement personnel, of the provisions and conditions of this permit.
2.2
A copy of the permit must be kept at the facility at all times.
2.3
Kildare County Council shall have unrestricted access to the premises at all reasonable times on production of identification, if required, for the purpose of their functions under the Waste Managements Act 1996 to 2008. The site shall be adequately manned and supervised at all times.
2.4
A suitably qualified and experienced Facility Manager shall be designated as the person in charge. The Facility Manager or a suitably qualified and experienced Deputy shall be present during the operation of the facility. The Permit Holder shall ensure that the Facility Manager or the Deputy shall be available on site to meet with authorised persons of Kildare County Council at all reasonable times.
2.5
The permit holder shall establish and maintain Awareness and Training Procedures for identifying training needs and for providing appropriate training, for personnel whose work is related to the permitted facility. Written records of training shall be maintained.
2.6
The site shall only operate between the hours of 08.00am to 18.00pm, Monday to Friday inclusive (excluding Bank and National Holidays) and 08.00am to 13.00pm on Saturday.
2.7
Recovery activities shall only be undertaken by persons authorised to do so by the permit holder. Employees with responsibilities in the waste control area shall receive training adequate to enable them to execute their tasks in relation to pollution control.
2.8
The permit holder shall ensure that all waste activities at the facility are consistent with the objectives of the Waste Management Plan for the county of Kildare and the current National Hazardous Waste Management Plan.

2.9
The permit holder shall prepare a Waste Management Programme which shall assess all operations which produce waste on site. The programme shall study the use of cleaner technologies and production which could maximise waste recovery. The programme should also document any such measures which have already been assessed or implemented by the permit holder. A report shall be submitted to Kildare County Council detailing the results of this study within 12 months ofthe issue of this permit. The report shall address the following topics as a minimum, a) Process modifications and control; b) Cleaning procedures and materials used; c) Reuse, recovery and recycling of wastes. Within two months from the date of grant ofthis waste permit, the permit holder shall submit written details ofthe management structure ofthe facility for the agreement of Kildare County Council. .

The permit holder shall immediately notify Kildare County Council of any incident which occurs as a result ofthe activity on the site and which:(i) Has the potential for environmental contamination of surface water or ground water, or (ii) Poses an environmental threat to air or land, or (iii) Requires an emergency response by Kildare County Council. This notification shall be by both telephone and facsimile, if available, as soon as is practicable after the occurrence of the incident. The permit holder shall include as part ofthe notification, date and time of the incident, details of the occurrence, and steps taken to avoid reoccurrence. The notification given to the Council shall include details of the circumstances giving rise to the incident and all actions taken to minimise the effect on the environment and minimise wastes generated. The permit holder shall make a record of any incident as set out above.

3.3
The permit holder shall compile and maintain specified records for each load of waste arriving at and leaving the facility for a period not less than 7 years. The permit holder shall include as a minimum the following.

Origin of the load; Description of the material in each load (including the European Waste Catalogue Code(s) and description(s) pursuant to Commission Decision 2001/l18/EC of 16 January 2001 or subsequent amendments); The quantity of the materials, estimated in tonnes and recorded in loads; The treatment, recovery, or disposal activity to which the waste is subject, including the compilation of commercial documentation for all collected waste deposited at the facility; Where loads are removed or rejected, details ofthe date and time of occurrence, the type of material, and the place to which they were removed; The date and time of all waste deliveries to the site; The names of the carriers and the vehicle registration numbers; a consignment note number(including TFS notification and movement / tracking form numbers as appropriate); the destination of outgoing waste (including a facility name and waste licence or permit number as appropriate) and any other information which might be required from time to time by Kildare County Council.

The dockets/records must be maintained at the principal place of business for a period not less than 7 years. These records shall be available for inspection at the principal place of business during normal working hours by authorised officers of Kildare County Council and any other person authorised under Section 14 of the Waste Management Acts 1996 to 2008. The permit holder shall comply with the provisions of this condition unless otherwise agreed in writing by Kildare County Council. The permit holder shall maintain a written record of all complaints of an environmental nature related to the site. Each such record shall give details of the following. a) b) c) d) e)
Date and time of complaint; Name of complainant; Details of the nature of the complaint; Action taken on foot of the complaint and the results of such actions; Response to each complainant.
3.5
The permit holder shall submit a report to Kildare County Council, which shall include the information compiled in 3.2 and 3.3 above. In addition, the permit holder shall include in the report a written summary of compliance with all of the conditions attached to the permit. This report shall be submitted for the preceding calendar year by no later than 28 February of each year and within one month of waste activities ceasing on the site. The report shall be called The Annual Report (AR).
3.6
The permit holder shall make all records maintained on site available to Kildare County Council staff at all reasonable times, and shall provide any relevant WFP-KE-08-0348-0 1

information when so requested by an authorised person of Kildare County Council. The information compiled in 3.2 and 3.3 shall be maintained at the principal place of business for a period of not less that 7 years
3.7
The permit holder shall notify Kildare County Council within five working days of(i) the imposition of any requirement on that person by order under the Waste Management Acts 1996-2008 or (ii) any conviction of that person for an offence prescribed under the Waste Management Acts 1996-2008 Within one month of waste activities ceasing on the site, the permit holder shall submit a report to Kildare County Council which shall include the information contained in the written records described above, and details of any impositions or convictions imposed under the Waste Management Act, 1996 to 2008. In addition, the permit holder shall include in the report a written summary of compliance with all of the conditions attached to the Waste Permit

I Condition 4: MATERIALS ACCEPTANCE AND HANDLING Only waste types specified in Appendix A are permitted at the facility.
4.2
All waste arriving at the facility shall be subject to a visual inspection by the permit holder, or hislher staff, employees, lessees or agents. The permit holder shall remove immediately any waste placed at the facility other than waste permitted in condition 4.1. This waste shall be placed in a quarantine area. This waste material shall be removed from the facility within 2 weeks of arrival to the facility and shall be disposed of (or recovered) at an alternative facility with an appropriate waste permit! certificate of registration or waste licence.
4.3
No waste shall be stored at the facility in other than designated storage areas. The storage areas shall be marked on the floor or otherwise delineated within six months of receipt ofthis waste permit.
4.4
The lamp crushing machine shall have full water recirculation and there shall be no effluent discharge from the machine. The sludge/sediment from the machine shall be disposed of in accordance with the Waste Management (Movement of Hazardous Waste) Regulations, 1998 (S.1. No. 147 of 1998), the Council Directive 91/689/EEC

with the Waste Management (Transfrontier Shipment of Waste) regulations, 2007(S.l. No. 419 of 2007) and with Council Regulation (ED) No. 1013/2006 of 14th June 2006 on the supervision and control of shipments of waste within, into and out of the European Community. Accordingly, no movement of hazardous waste from point to point within the state should take place without a C1 form being completed. Where waste is to be exported, a transfrontier shipment of waste authorisation should be in place. A movement tracking form should be submitted three days in advance of individual shipments taking place. The used lamps and tubes shall be stored in a secure container, prior to crushing, in such a manner as to prevent breakages. The container shall be located in a compound or building adequately secured to prevent unauthorised access. Waste batteries shall be stored in a covered bunded area.
4.6
No processing of batteries shall occur at the facility.
4.7
All tanks and containers shall be labelled clearly to indicate their contents.
4.8
The permit holder shall ensure that different categories of hazardous wastes are kept separate. No mixing of hazardous wastes shall occur unless specifically authorised by Kildare County Council.
4.9
The used filters of the lamp crushing machine and any sediment or residue from the process shall be considered hazardous waste and shall be stored in a covered area in sealed containers, prior to being collected for appropriate disposal 1 recovery. This waste shall be stored and disposed of in accordance with the Waste Management (Movement of Hazardous Waste) Regulations, 1998 (S.l. No. 147 of 1998), the Council Directive 911689/EEC with the Waste Management (Transfrontier Shipment of Waste) regulations, 2007(S.l. No. 419 of 2007) and with Council Regulation (ED) No. 101312006 of 14th June 2006 on the supervision and control of shipments of waste within, into and out of the European Community. Accordingly, no movement of hazardous waste from point to point within the state should take place without a C1 form being completed. Where waste is to be exported, a transfrontier shipment of waste authorisation should be in place. A movement tracking form should be submitted three days in advance of individual shipments taking place.
4.10
All waste from the facility shall be disposed or recovered in accordance with the Waste Management Acts 1996 to 2008, and furthermore shall be recovered, reused or recycled were possible at an alternative facility with an appropriate waste permitl certificate of registration or waste licence.

4.5
4.11 The permit holder shall maintain a register of full records, open to inspection by authorised persons at all reasonable times, of matters relating to the waste management operations and practices at this facility. The records shall contain at a minimum the following information: a) b) c)
the types and quantities of all waste received at the facility; the types and quantities of all waste sent off site for treatment, recovery and disposal; the names of the agents and transporters of waste arriving and leaving the facility;

the tonnage's or volume's of the waste material sent off site for treatment, recovery or disposal; the ultimate destination of the waste; details of any rejected consignments.
The above register shall be kept up to date at all times. The information compiled shall be maintained at the principal place of business for a period of not less that 7 years
All containers accepted at the facility shall be whole and sound. Any leaking or otherwise ruptured containers shall immediately be overdrummed or the contents transferred to a sound container in a manner which will not adversely affect the environment.
4.13
All spillages of liquid waste shall be cleaned up so as to prevent spilled fluid draining to sewerage system or flowing beyond the boundary ofthe permitted facility in order to prevent pollution to the enviromnent.
4.14
All hauliers importing or removing waste from the facility shall hold a valid waste collection permit in accordance with the relevant Waste Management (Collection Permit) Regulations from the relevant local authority.
4.15
The permit holder shall ensure that all batteries and accumulators are collected, handled, transported and stored in a manner so as to avoid damage that would prevent equipment or components from being reused or recovered in accordance with Council Directive 9J1157/EEC on batteries and accumulators (as amended by Commission Directive 93/86/EEC and by Commission Directive 98/10 JlEC) and by Council Directive 2006/66/EC on batteries and accumulators and waste batteries and accumulators and repealing Directive 9J1157/EEC.
4.16
Where a permit holder collects waste containing fluorinated greenhouse gases care must be taken to ensure to that the waste is collected and stored in accordance with Regulation (EC) No. 842/2006.
4.17
The permit holder shall ensure that Waste Electrical and Electronic Equipment (WEEE) is collected, treated and recycled in accordance with the WEEE Directive 2002/96 EC as amended by Directive 20031108 EC.

I Condition 5:
SITE INFRASTRUCTURE
A site notice board shall be provided and maintained on site by the permit holder, so that it is legible to persons outside the main entrance to the facility. The minimum dimensions of the identification board shall be 1200mm by 750mm. The board shall clearly show: a) the name and telephone number of the facility; b) the normal hours of operation; c) the name, address and telephone number of the waste permit holder; d) an emergency out of hours contact telephone number; e) the name address and telephone number of the operator of the facility; f) the waste permit reference number; g) where and when environmental monitoring information relating to the facility can be obtained.
5.2
The facility shall be secured at all times and shall be kept locked shut when unsupervised.
5.3
The permit holder shall provide and maintain an office on the facility including a working telephone and facsimile machine, and the office shall be suitable for processing and storing of documentation.
5.4
All waste storage areas shall be rendered impervious to the material stored in them. All overground oil, chemical storage tank(s) shall be adequately bunded to protect against spillage. Bunding shall be impermeable and capable of retaining a volume equal to 1.5 times the capacity of the largest tank. Filling and off-take points shall be located within the bunded area(s).

5.1

Condition 6: NUISANCES, EMISSIONS and ENVIRONMENTAL IMPACTS 6.1

6.3
No potentially polluting substance or matter shall be permitted to discharge to ground or groundwater.
6.4
The permit holder shall, at a minimum of one week intervals, inspect the facility and it's immediate surrounds for nuisances caused by vermin and odours. Written records shall be maintained of all inspections and any actions taken as a result of these inspections.
6.5
The permit holder shall ensure that all operations on site shall be carried out in a manner such that noise levels do not cause any significant impairment of the amenities beyond the site boundary. The noise level from the facility shall not exceed 55 dBA Leq, at any point along the boundary of the development between 8.00 am and 6.00 pm Monday to Friday inclusive, but excluding Bank Holidays. At all other times, including Bank Holidays, the noise level from the development shall not exceed 45dBA Leq, at any point along the development boundary.
6.6
The operator shall ensure that the activities at the site shall be carried out in a manner such that emissions do not result in significant impairment of, or significant interference with the environment beyond the site boundary.

ENVIRONMENTAL MONITORING
7.1
The permit holder shall grant immediate and unhindered access to the site, including sewers and pipes to any authorised personnel representing any Statutory Body having responsibility for environmental pollution control at all reasonable times to carry out such inspections, monitoring and investigations as the body deems necessary.
7.2
The permit holder shall carry out such monitoring and at such locations and frequencies as set out below: A)

CONTINGENCY ARRANGEMENTS
Adequate fire extinguishers and emergency response equipment shall be maintained on site.
8.2
The permit holder shall ensure that an Emergency Response Procedure (ERP) is in place, which shall address any emergency situation which may originate on site. This procedure shall include provision for minimising the effects of any emergency on the environment. This ERP is to be submitted to the LA not more than six months after date of permission.
8.3
The permit holder shall have in storage an adequate supply of containment booms and suitable absorbent material to contain and absorb any spillage at the facility. Once used the absorbent material shall be disposed of in an appropriate manner. Any significant spillages occurring at the facility shall be treated as an emergency and immediately cleaned up and dealt with so as to alleviate their effects.
8.4
No waste shall be burnt within the boundaries of the facility. A fire at the facility shall be treated as an emergency. Immediate action shall be taken to extinguish it and the appropriate authorities notified.
8.5
The permit holder shall carry out a risk assessment to determine the requirements at the facility for fire fighting and firewater retention facilities and within six months from the date of grant of this licence, submit a report, including recommendations, on the risk assessment to Kildare County Council for it's agreement. The Chief Fire Officer of Kildare County Council shall be consulted during this assessment.
8.6

I Condition 9: 9.1
CHARGES AND FINANCIAL PROVISIONS
The permit holder shall pay an annual contribution of EUR1500 to Kildare County Council towards the cost of inspecting, monitoring, auditing, enforcing or otherwise performing any functions in relation to the permitted activity concerned. The Permit Holder shall pay to Kildare County Council this amount within 30 days of receipt of this permit and thereafter on an annual basis. In the event that the frequency or extent of monitoring or other functions carried out by Kildare County Council needs to be increased for whatever reason the permit holder shall contribute such sums as are determined by the LA to defray costs.

REASON FOR THE DECISION Dublin City Council is satisfied, on the basis of the information made available by the applicant, that subject to compliance with the conditions of this permit, the activity will not cause environmental pollution and the grant of this permit is consistent with the objectives of the Waste Management Plan for the Dublin Region and all other relevant Waste Management Plans applicable to the local authority areas listed in Appendix D and the current National Hazardous Waste Management Plan. In reaching this decision, Dublin City Council has considered the application and supporting documentation received from the applicant and valid submissions received from the relevant local authorities, the Environmental Protection Agency (EPA) and other parties.
INTERPRETATION Unless otherwise specified, all terms in this permit should be interpreted in accordance with the definitions in the Waste Management Acts 1996 to 2008 (the Act), and its associated regulations (as may be amended or replaced from time to time) or as defined in this permit. References to any enactment, statutory instrument (including any bye-law), each as defined by the Interpretation Act 2005, or a regulation, directive or decision of a European Union institution in this permit shall include amendments and replacements.

References in this permit to Dublin City Council shall be taken to mean Dublin City Council as nominated authority for the Dublin Region under section 34(1)(aa) of the Waste Management Act, 1996 to 2008 and pursuant to article 5(2) of the Waste Management (Collection Permit) Regulations, 2007 and the Waste Management (Collection Permit) (Amendment) RegUlations, 2008 or such other authority as may be nominated for the Dublin Region under this provision.
INSTRUCTIONS
Sections 1 - 5 of this collection permit sets out for the permit holder general conditions relating to the collection of waste.

Section 6 of this collection permit sets out for the permit holder general conditions for the collection of specific waste streams. All conditions set out in this section are to be complied with in conjunction with the conditions set out in section 7. Section 7 of this collection permit sets out for the permit holders regional specific conditions for the collection of particular waste streams in accordance with the relevant Waste Management Plan for that region. In the event of any inconsistency or conflict between the conditions in section 1 - 6 of this permit and the conditions in section 7, the conditions in section 7 shall prevail.

CONDITIONS
Scope of permit
1.1
The permit holder is authorised to collect only the wastes specified in condition 1.3 in the corresponding local authority areas specified in Appendix A or such later revision of Appendix A as DUblin City Council may issue in accordance with condition 1.3.
1.2
The permit shall be read in conjunction with such bye-laws for the time being in force as referred to in condition 2.6 of this permit.
1.3
The permit holder shall only collect such wastes which are listed in Appendix A of this permit or such iater revision to the said appendix as Dublin City Council may issue by way of revised Appendix A, following an application in writing by the permit holder and subsequent agreement in writing by Dublin City Council.
1.4
The conditions of this permit are based upon the information provided by the permit holder in writing to Dublin City Council during the application process. The permit holder shall notify Dublin City Council in writing of any proposed changes in the information furnished during the application process and shall obtain written approval from Dublin City Council prior to these changes occurring.
1.5
The permit holder shall give notice in writing to Dublin City Council of any proposed changes in the waste collection activity in advance of any such change coming into effect. The permit holder shall obtain the written agreement of Dublin City Council before implementing any such change. Should the submission identify a material or significant change in:

1.
(a) the nature, focus or extent of the waste activities; or (b) the nature or extent of any emission from such activity(ies) A waste collection permit review may be reqUired before the proposed change can be assessed. Dublin City Council may, in accordance with article 23 of the Waste Management (Collection Permit) Regulations, 2007 and the Waste Management (Collection Permit) (Amendment) Regulations, 2008, at any time review, and subsequently amend the conditions of, or revoke this permit.
1.7
This permit and any condition imposed therein shall not relieve the permit holder of any statutory obligations.
1.8
Any non-compliance with the conditions of this permit is an offence under the Waste Management (Collection Permit) RegUlations, 2007 and the Waste Management (Collection Permit) (Amendment) Regulations, 2008 and Section 34(1) of the Waste Management Act, 1996 to 2008.
1.9
This permit is non-transferable.
2.
Management of the activity
2.1
The permit holder shall ensure that where waste collected under this permit is transferred to a facility for the purpose of a recovery or disposal activity

(a) there is in force a waste licence, facility permit, certificate of registration or IPPC licence in relation to the carrying on of the activity concerned at that facility; unless such activities are exempted from regulation under the Waste Management Acts 1996 to 2008.

(b) that planning permission, or a certificate of exemption from such permission, is in place for such a facility. 2.2
The permit holder shall not transfer waste to a facility under condition 2.1 of this permit unless the waste activity at that facility is authorised under: (a) section 39(1) of the Act, In the case of a facility subject to licensing; or (b) section 82 of the Environmental Protection Agency Acts, 1992 to 2007; or (c) article 4 of the Waste Management (Permit Regulations), 1998 in the case of an activity specified in Part I or part II of the First Schedule of the said Regulations; or (d) article 6 of the Waste Management (Facility Permit and Registration) Regulations, 2007 and the Waste Management (Facility Permit and Registration) (Amendment) Regulations, 2008, in the case of an activity specified in Part 1 and Part 11 of the Third Schedule, or other facilities as agreed by Dublin City Council.
2.3
The permit holder shall only transfer waste to the facilities which are listed in Appendix B to this permit or such later revision to the said appendix as Dublin City Council may issue and to no other facilities whatsoever, subject to condition 2.4 below.
2.4
Where the permit holder proposes to transfer waste to facilities other than those set out in Appendix B, the permit holder shall submit the following details in to Dublin City Council for inclusion in Appendix B prior to transferring any waste to such facilities in accordance with condition 2.3 above: origin of waste material; description of waste including European Waste Catalogue (EWC) code; location, ownership details, and contact number of the facility; waste permit or licence details of the facility; written confirmation from the operator of the facility that the said waste will be accepted there; (f) planning permission reference' number or a certificate of exemption from such permission for the facility.

The permit holder shall carry or cause to be carried at all times a copy of this permit including the latest revision of all appendices on each vehicle listed in Appendix C.
2.6
Where any local authority, for the purposes of the proper management of waste and the prevention and control of environmental pollution, has made bye-laws relating, inter alia, to the storage, presentation and/or segregation for the purpose of and in the course of the collection of waste or for the recovery or disposal of waste in accordance with Part 19 of the Local Government Act, 2001 (in substitution for Part VII of the Local Government, 1994) or in accordance with Section 35 of the Waste Management Act 1996 to 2008 (hereinafter referred to as 'bye-laws'), the permit holder shall not collect waste in the functional area of the said local authority unless it has been stored, presented and/or segregated in accordance with the requirement of the said bye-laws.
2.7
Where household or commercial waste has been segregated prior to collection in accordance with any bye-laws referred to in condition 2.6 or by RegUlations, or by any requirements of the Waste Management Plan for the Dublin Region and all other relevant Waste Management Plans applicable to the local authority areas listed in Appendix D, the permit holder, if collecting the recyclable fraction of the waste, shall ensure that this fraction is separately collected in its entirety, not mixed or remixed with any other waste fraction, and transferred to a facility as referred to in condition 2.3 of this permit. Similarly, the permit holder, if collecting the biodegradable fraction of the waste, shall ensure that this fraction is separately collected in its entirety, not mixed or remixed with any other waste fraction, and transferred to a facility as referred to in condition 2.3 of this permit.
2.8
The permit holder shall identify all hazards associated with the waste being collected, and shall be familiar with best practice regarding its safe movement and handling and shall adopt all necessary, reasonable and practicable safety measures accordingly.

2.9
The permit holder shall have in place a documented Emergency Response Procedure (ERP), which shall address any emergency incident that may arise. This procedure shall provide for as a minimum, an emergency response unit, replacement vehicles and clean-up equipment in order to minimise the effects of the emergency on the environment. The permit holder shall maintain a copy of the ERP at the principal place of business of the permit holder.
2.10 The permit holder shall ensure that all operatives employed in the waste collection activity are familiar with and comprehend the conditions of this permit and the ERP. 2.11 The permit holder shall clean up immediately any spillage of waste, which occurs in the course of the collection operation, in a manner, which will not cause environmental pollution. The permit holder shall carry an emergency spillage kit on each vehicle listed in Appendix C, of this permit or such later revision of the said appendix as Dublin City Council may issue, at all times, to deal with minor spillages. 2.12 The permit holder shall not cause environmental pollution during the course of the waste collection activity to which this permit relates. 2.13 The permit holder shall include their permit number and name of issuing authority in all of their promotional material.

2.14 The permit holder shall collect, transport, store, dispose of and/or recover waste in a manner so as to prevent pollution, contamination and deterioration of groundwater in accordance with Council Directive 80/68/EEC on the protection of groundwater against pollution caused by certain dangerous substances and Directive 2006/118/EC of the European Parliament and of the Council on the protection of groundwater against pollution and deterioration and also with Council Directive 2000/60/EC of the European Parliament and of the Council establishing a framework for community action in the field of water policy.

2.15 The permit holder shall ensure that where biowaste collected under the waste collection permit is transferred to a composting or biogas facility for the purpose of treatment and where animal by-products form all or part of that biowaste, that the facility has been approved in writing by the nominated authority for use by the permit holder and there is in force an appropriate veterinary authorisation issued by the Minister for Agriculture and Food in accordance with article 10 (6) of the European Communities (Transmissible Spongiform Encephalopathies and Animal ByProducts) Regulations 2006 (S.1. No. 612 of 2006). 2.16 The permit holder shall take steps to ensure that all or a specified proportion, of waste collected by the permit holder, or class or classes of such waste, is source-segregated, treated or recovered, in such manner so as to secure the objectives of the Waste Management Plan for the Dublin Region and all other relevant Waste Management Plans applicable to the local authority areas listed in Appendix D and all National and EU targets for the recovery, recycling and treatment of waste. In particular the permit holder shall ensure that waste is: (a) where practicable and having regard to the waste hierarchy, delivered to facilities which reuse, recycle or recover waste; (b) presented, collected, handled and transported in a form which enables the facilities to which the waste is delivered to comply with specific conditions contained in, as the case may be, the waste licence, IPPC licence, waste facility permit or certificate of registration in relation to performance targets established for the levels of recycling or recovery of waste. 2.17 The permit hoider shall ensure that where waste that has been source segregated by the waste producer, it shall not be sent for disposal or collected, transported, mixed or handled so as to make it, in the opinion of the nominated authority, unsuitable for recycling or recovery by the permit holder.

2.18 Without prejudice to its obligations under this permit, the permit holder shall at all times ensure that it carries on its waste coliection activities in a manner that is consistent with the objectives of the Waste Management Plan for the Dublin Region (as may be varied or repiaced from time to time) and all other relevant waste management plans (as may be varied or replaced from time to time. 2.19 The permit holder shall ensure at all times that waste collection activities are carried out in accordance with the provisions of Council Directive 75/442/EEC of 15 July 1975 on waste as amended by Council Directive 91/156/EEC of 18 March, 1991 and codified under Directive 2006/121EC of the European Parliament and of the Council of 8 December 2003 and Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 as applicable.
3 Vehicles, Skips, Containers, Trailers and Receptacles The permit holder shall only use the vehicles as have been notified in writing to Dublin City Council and subsequently agreed, which are listed in Appendix C to this permit or such later revision of the said appendix as Dublin City Council may issue, for the purposes of the activity to which this permit relates. Vehicles listed in Appendix C may not be included in any other waste collection permit at anyone time other than a waste collection permit issued to the same legal entity in a different region.
3.2
The permit holder shall notify Dublin City Council in advance of the type and identifying mark of any collection vehicle to be owned or hired/leased and used for the collection of waste under the terms of the permit, including particulars of the relevant vehicle registration document.
3.3
In the case of an emergency where the permit holder is obliged to hire/lease a vehicle at short notice and for a temporary period not to exceed 10 working days, the permit holder shall notify Dublin City Council of the type and identifying mark of any collection vehicle which is being hiredlleased in on a temporary basis from a third party by the permit holder and used for the collection of waste under the terms of the permit, within 1 working day of the hire/lease of such a vehicle, including particulars of the relevant vehicle registration document.
3.4
Ali vehicles used by the permit holder for the purposes of the activity to which this permit relates, shall be fit for purpose.
3.5
All vehicles used by the permit holder for the purposes of the activity to which this permit relates shall be washed down as required in an appropriate manner and at an appropriate facility so as not to cause environmental pollution.
3.6
Each vehicle used for the purposes of the activity to which the permit relates and that is listed in Appendix C of this permit or such later revision of the said appendix as Dublin City Council may issue, shall be marked with the following information in clearly legible indelible lettering at least 75 millimetres high:

3.1
(a) name of the permit holder; (b) waste collection permit number. 3.7
Each skip, tanker, trailer or container used for the purposes to which this permit relates shall be marked on at least two sides with the following information in visible, legible and indelible lettering at least 75 millimetres high: (a) name of the permit holder; (b) waste collection permit number; (c) a unique identification number for the skip, tanker or container.
3.8
The permit holder shall ensure that all consignments of waste are appropriately covered during transit to prevent spillage, dust, litter or other nuisance.

3.9
The permit holder when using a skip or other such receptacle for the purposes of the activity to which this permit relates shall provide the hirer with a written agreement detailing: (a) that the hirer shall not allow the placement of hazardous waste in the skip; (b) the types of wastes, which may be placed in the skip as, listed in condition 1.3 of this permit; (c) that the skip will be removed within one working day of it being fully loaded unless otherwise agreed in writing with the local authority.
3.10 The permit holder shall ensure that skips and other such receptacles left in a public place (as defined in the Litter Pollution Acts 1997 (as amended)) shall carry reflectors or lighting so that they are clearly visible during a period when vehicles are required to be lighted. 3.11
The permit holder shall notwithstanding the provisions of any bye-law made under section 72 of the Roads Act 1993 ensure: (a) that skips and other such receptacles left on a public road shall be sited or deposited for no more than 3 days; (b) that waste collected in skips is in accordance with the requirements of the said bye-laws.

3.12 No skip, tanker, trailer or container used by the permit holder for the purposes of the activity to which this permit relates and which contains waste shall be left in a public place (as defined in the Litter Pollution Acts 1997 and 2003), other than where it is initially filled, unless it is on or attached to a mechanically propelled vehicle, which is in transit to a facility listed in Appendix B of this permit or such later revision of the said appendix as Dublin City Council may issue.

3.13 The permit holder shall ensure that all wheeled bins used for the collection of municipal waste shall comply with standard IS EN840 parts 1-6. 3.14 Ail waste receptacles used for the collection of municipal waste (including separately collected fractions) shall be identified with the name, address and telephone number of the permit holder in clearly legible lettering and a unique customer reference number. The permit holder shall supply the name and address of a customer to whom a reference number applies on request. The permit holder shall submit written details of the identification system to Dublin City Council for approval on request.

3.15 Where the permit holder provides segregated collections for different types of recyclable, compostable or recoverable materials, they shall provide waste recycling receptacles, which are designed for reuse.
4 Notification and Record Keeping 4.1
The permit holder shall notify Dublin City Council in relation to any conviction for an offence prescribed under article 21 of the Waste Management (Collection Permit) Regulations, 2007 and the Waste Management (Collection Permit) (Amendment) Regulations, 2008 or any requirement of an order under the Waste Management Act 1996 to 2008, within 5 working days of such conviction or the imposition of such a requirement.
4.2
The permit holder shall notify the relevant local authority (i.e. the local authority in whose area the incident occurs) Immediately after the occurrence of any incident connected with the waste collection activity that caused or has the potential to cause environmental pollution or a threat to human health. The permit holder shall include as part of the notification the date, time, location and a full description of the incident. The permit holder shall also send a written record of the incident to Dublin City Council within 1 week of the incident. This written record of the incident shall include the following information: (a) the date, time and location of the incident; (b) a full description of the incident;

(c) details of any measures taken to prevent or reduce environmental poliution or harm to human health which was caused or may be caused by the incident; and (d) details of steps taken to avoid recurrence of similar incidents. 4.3
The permit holder shali compile and maintain specified records for the coliection of waste, for a period not less than 7 years, records shali include as a minimum the foliowing: (a) European Waste Catalogue (EWC) code for each waste type and indicate whether or not the waste is hazardous; (b) description of waste; (c) quantity (in units of tonnes or litres) of waste coliected; (d) the local authority area of origin of the waste; (e) the source of the point of coliection of waste; (f) the name, address and licence, permit or certificate of registration number of the waste facility to which the consignment of waste wili be delivered; (g) the nature of the activity carried on at the waste facility to which waste is delivered (Le. Treatment, recovery or disposal); (h) the name and waste coliection permit number of the permit holder; (i) date of waste coliection; U) waste coliection vehicle registration number; (k) customer name and address; (I) signature of the vehicle driver; (m) signature of a representative of the waste facility. The permit holder shali use a docket system to compile the records as outlined in condition 4.3. An individual docket record shali accompany each waste load on the vehicle that the waste docket refers to until control of the waste is transferred to a facility specified in Appendix B of this permit. The permit holder shali also maintain up-to-date summaries of the information in condition 4.3 in respect of waste coliected by the permit holder in each calendar month. The dockets/records must be maintained at the principal place of business for a period not less than 7 years. These records shali be available for inspection at the principal place of business during normal working hours by authorised officers of any relevant local authority and any other person authorised under Section 14 of the Waste Management Acts 1996 to 2008. The permit holder shali comply with the provisions of this condition unless otherwise agreed in writing by Dublin City Council.
4.5
Dublin City Council may at any time serve a notice on the permit holder specifying the format and layout of dockets that the permit holder shali use in accordance with condition 4.4 of this permit. The permit holder shali comply with the provisions of any such notice.
4.6
The permit holder shali furnish to the nominated authority, not later than 28'h February in each year an Annual Report (AR), in such form as may be specified by the authority, summary information in relation to the nature and quantities of waste coliected by the permit holder in the preceding calendar year or part there of, as the case may be, and delivered to individual facilities or otherwise transferred to other persons for the purpose of recovery or disposal. The AR shali at a minimum contain the follOWing information in relation to the permitted waste collection activities:

the total number of households served with kerbside collection for residual, mixed dry recyclable and organic wastes from which the permit holder collected waste per each local authority functional area; (k) the nature of the activity carried on at the waste facility to which waste is delivered (i.e. disposal or recovery). The information specified above shall be filled in on the AR form which is available on the Dublin City Council website at the following Internet address: http://www.dublincity.ielWaterWasteEnvironmentlWastelWasteCollectorslWasteRegulationsOffi ce/PageslWastePermits.aspx The completed form shall be submitted by the 28'h February each year in respect of the preceding calendar year to Dublin City Council bye-mail

The information specified above shall be used to produce community statistics on the generation, recovery and disposal of waste as set out by Regulation (EC) 2150/2002. 4.8
All communications from the permit holder to Dublin City Council shall be addressed in writing by the permit holder to the following address: Executive Manager, Dublin City Council, Waste Management Services, 68-70 Marrowbone Lane, Dublin 8 unless otherwise specified. Permit holders are reqUired to include their Waste Collection Permit Number on all correspondence. 4.7
5 Charges and Financial Provisions
The permit holder shall defray or contribute towards any costs as may reasonably be incurred by Dublin City Council or any relevant local authority as prescribed in articles 14 and 20(3)(d), other than required under article 8 in accordance with the third schedule of the Waste Management (Collection Permit) Regulations, 2007 and the Waste Management (Collection Permit) (Amendment) RegUlations, 2008, and which costs shall not exceed the actual expenditure reasonably incurred by the authority in inspecting, monitoring, auditing, enforcing or otherwise performing any functions in relation to the activity.
5.2
The permit holder shall effect and maintain appropriate and adequate policies of insurance insuring him or her as respects any liability on his or her part to pay damages or costs on account of injury to person or property arising from the activities concerned.
5.3
Without prejudice to the foregoing, the minimum level of indemnity to be maintained by the permit holder shall be to the value of €6,500,000 for Public Liability Insurance including cover for sudden and unforeseen pollution and €6,500,000 for third party property damage Motor Insurance. In both cases noting an indemnity to all relevant Local Authorities in the Republic of Ireland.

6.2
Batteries and Accumulators Batteries and accumulators shall only be collected, handled, transported and stored in a manner so as to avoid damage that would prevent equipment or components from being reused or recovered in accordance with Council Directive 91/157/EEC on batteries and accumulators (as amended by Commission Directive 93/86/EEC and by Commission Directive 98/101/EC) and by Council Directive 2006/66/EC on batteries and accumulators and waste batteries and accumulators and repealing Directive 91/157/EEC.
6.2.2
Where batteries and accumulators collected by the permit holder are of a hazardous nature as defined in the European Waste Catalogue (EWC) the permit holder shall adhere to the conditions relating to the collection of hazardous waste.
6.2.3
Where the permit holder is collecting batteries or accumulators independently of an obligated producer or approved scheme a record of the quantities, by weight or, as appropriate, by number of units, and categories of batteries shall be maintained in accordance with article 29 of the Waste Management (Batteries and Accumulator Reguiations 2008 (S.1. No 268 of 2008).
6.2.4
The permit holder shall maintain records of the batteries and accumulators collected for a period of 6 years and make these records available to the local authority, EPA or other appropriate authority for inspection upon request.
6.2.5

6.2.1
The permit holder shall, in accordance with this permit and in particular in accordance with the provisions of condition 2.7 hereof, implement and maintain a separate system for kerbside collection of dry recyclables from commercial and industrial premises. Details of compliance with this requirement shall be submitted to Dublin City Council within 1 month from the date hereof.
6.3.2
Source separated waste shall not be mixed or remixed during collection.
6.3.3
Where a local authority has made bye-laws requiring the separate collection of the biodegradable fraction of municipal waste from commercial and industrial premises, the permit holder shall implement and maintain a separate system for the kerbside collection of biodegradable waste from commercial and industrial premises within the functional area of that local authority and shall ensure that this fraction is separately collected in its entirety, not mixed or remixed with any other waste fraction, and transferred to a facility as referred to in condition 2.3 of this permit. Details of compliance with this requirement shall be notified in writing to the said local authority within 1 month of the adoption of the said bye-laws or in the case of existing bye-laws within 1 month from the date hereof.
6.3.4
The permit holder shall provide separate receptacles for packaging waste, which has been segregated in accordance with the Waste Management (Packaging) Regulations, 2007 or as amended, and in accordance with the Packing Directive 94/62/EC as amended by Directive 2004/12/EC of the European Parliament and of the Council of the 11 th FebrUary 2004.
6.3.5
The permit holder shall not collect packaging waste for disposai from a producer, without first receiving a written declaration as required under article 31(1)(b) of the Waste Management (Packaging) Regulations, 2007 or as amended.
6.3.6
The permit holder shall notify the local authority in advance, within a period of not less than 1 month, of any proposal to alter/extend the materials for separate collection of dry recyclables under 6.3.1 above and shall obtain approval in writing before implementing such alteration/extension.

6.6.1

The permit holder shall transport fluorescent tubes in suitable containers to prevent damage in transit.
Hazardous Waste The permit holder is only permitted to deliver hazardous wastes to facilities that have been notified to Dublin City Council and which were subsequently agreed, and to no other facilities whatsoever, subject to condition 2.3 and as listed in Appendix B.
6.7.2
The permit holder shall not mix hazardous waste with other hazardous or non-hazardous waste types prior to or during collection and transportation.
6.7.3
The permit holder shall maintain records of all hazardous waste movements and shall comply with the Waste Management (Movement of Hazardous Waste) Regulations, 1998 (5.1. No. 147 of 1998), the Council Directive 91/689/EEC with the Waste Management (Transfrontier Shipment of Waste) regulations, 2007(5.1. No. 419 of 2007) and with Council th Regulation (EU) No. 1013/2006 of 14 June 2006 on the supervision and control of shipments of waste within, into and out of the European Community. Accordingly, no movement of hazardous waste from point to point within the state should take place without a C1 form being completed. Where waste is to be exported, a transfrontier shipment of waste authorisation should be in place. A movement tracking form should be submitted three days in advance of individual shipments taking place.
6.7.4
A European Waste Catalogue (EWC) code and waste description shall be assigned to each hazardous waste consignment collected, in accordance with the requirements of the Waste Management (Movement of Hazardous Waste) Regulations, 1998 (5.1. No. 147 of 1998).
6.7.5
The permit holder shall ensure that all movements of hazardous waste comply with the requirements of the Carriage of Dangerous Goods by Road Regulations 2007 (5.1. 288 of 2007) and the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR) 2007.
6.7.6
All receptacles used for the collection of hazardous waste should be clearly identified as containing hazardous waste. This labelling shall be maintained in legible condition at all times. Permit holders should also be aware of the labelling requirements for transporting hazardous wastes under the Waste Management (Movement of Hazardous Waste) Regulations, 1998 (5.1. No. 147 of 1998), Carriage of Dangerous Goods by Road Regulations 2007 (5.1. 288 of 2007) and the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR) 2007.
6.7.7
The permit holder shall include in their emergency response procedure a backup plan (called the rejection procedure) to deal with an event that a hazardous waste load is rejected at a facility listed in Appendix B. Any load of hazardous waste that is rejected shall be treated as an incident and reported as per condition 4.2.
6.7.8
All vehicles used for the collection and transport of hazardous material shall be clean, dry and residue-free prior to commencement of loading of any new consignment of hazardous

waste. If vehicles are to be used for the collection of any other waste types, they shall be decontaminated at an appropriate facility prior to use. Where the permit holder collects waste containing asbestos fibres or dust, care must be taken to ensure that the waste is treated and packaged so as to prevent the release of asbestos particles into the environment in accordance with Council Directive 87/217/EEC.
6.7.10
The permit holder shall at all times ensure that all waste collection activities are carried out in a manner that is consistent with the objectives of the current National Hazardous Waste Management Plan.
6.7.11
Where a permit holder collects waste containing ozone depleting substances care must be taken to ensure that the waste is collected and stored in accordance with Regulations (EC) No. 2037/2000, as amended by Council Regulations (EC) Nos. 2038/2000, 2039/2000, 1804/2003, Commission Regulation (EC) No. 2077/2004, Commission Regulation (EC) No. 29/2006 and Commission Regulation (EC) No. 1784/2006.

The following conditions apply for the collection of wastes in the functional areas of Dublin City Council, Dun Laoghaire Rathdown County Council, Fingal County Council and South Dublin County Council, hereafter known as the Dublin Region. Without prejudice to its obligations under this permit, the permit holder shall at all times ensure that it carries on its waste collection activities in the local authority areas of the Dublin Region in a manner that is consistent with the objectives of the Waste Management Plan for the Dublin Region 2005-2010 (as may be varied or replaced from time to time).
7.4.2
The permit holder shall ensure that all, or such specified proportion, of waste or a type thereof, collected by the permit holder in the local authority areas of the Dublin Region is delivered to and deposited with and treated and/or reused and/or recovered and/or recycled at such facHities or types of facilities so designated by the relevant local authority in whose functional areas the waste collection activities are being carried out in accordance with the Waste Management Plan for the Dublin Region 2005-2010 (as may be varied or replaced from time to time).
7.4.3
The permit shall be read in conjunction with such bye-laws for the time being in force as referred to in condition 2.6 of this permit.

7.4.1
Household Waste 7.4.4
Notwithstanding any other condition in this permit, the permit holder shall not collect household waste from single dwelling househoids (other than those in purpose built apartment blocks) in the local authority areas of the Dublin Region other than under and in accordance with a contract with the relevant local authority. For the avoidance of doubt, this does not appiy to the occasional collection of bUiky waste and/or construction and demolition wastes from single dwelling households that is presented in skips or skip bags by the householder and collected by the permit holder in accordance with section 3 of this permit.
7.4.5
The permit holder shall provide any apartment complexes it collects from with a source separated collection system in accordance with the policy objectives of the Waste Management Plan for the Dublin Region 2005 - 2010. Separate wheelie bins are to be provided for the source separate collection of dry recyclables, and mixed residual wastes.
7.4.6
Permit holders collecting from apartment complexes are requjred to provide a separate collection of organic waste provided the waste storage arrangements at the apartment complex are suitable. The permit holder is required to complete a suitability assessment of

each apartment complex from which the permit holder collects. Guidance on the nature of the assessment to be undertaken is provided in the EPA Report, Organic Waste Management in Apartments, and the permit holder must submit details to Dublin City Council for review and approval. 7.4.7
Where the permit holder is providing door-la-door collection services to householders, the permit holder is required to implement an education and awareness programme in accordance with condition 6.8.7. The programme shall be submitted to the nominated authority for review and approval within 3 months of the grant of this permit.
7.4.8
The permit holder shall not collect glass co-mingled with other dry recyclable type wastes from households (including apartments) in the green bin. The policy of the local authorities in the Dublin Region for the collection of glass from households in terms of environmental performance and ranking is as follows: (a) bring banks (with separate banks for clear, green and brown glass); (b) kerbside collection of glass with colour separation at source; (c) kerbside collection of mixed glass. Where the permit holder intends to introduce a separate kerbside collection of glass they are required to submit prior to the commencement of the scheme details of the collection system to Dublin City Council for approval.
7.4.10
The permit holder shall not collect hazardous wastes from households (including apartments) in the green bin in the local authority areas of the Dublin Region.
7.4.11
The permit holder shall not collect Waste Electrical and Electronic Equipment (WEEE) in the green bin from households (including apartments) in the local authority areas of the Dublin Region.

7.4.15
Where the permit holder provides a commercial or industrial premise with a door-to-door collection service for residual waste they shall make available to that premises a separate collection service for dry recyclable wastes from the date of grant of this permit.
7.4.16
By the end of 2009, a separate collection of organic waste is required by the permit holder from relevant business such as restaurants, hotels, bars, pubs, kiosks, cafes, canteens, food processing industries, institutions (such as schools, hospitals, universities, prisons, military barracks, training facilities) with canteens/kitchens, and from all other similar business where organic waste arises unless otherwise agreed with Dublin City Council.
7.4.17
Details of compliance with the requirement for a separate organic waste collection system must be submitted in writing to Dublin City Council for approval within six weeks of the grant of this permit. SUbsequent phases must be submitted three months in advance of the target deadline.
7.4.18
The charging system for organic waste shall incentivise businesses to participate in source segregation of organic waste. The frequency of collection must ensure the organic waste is suitable for further biological treatment.
7.4.19
No commercial and industrial waste may be collected six months after issue of this permit unless Dublin City Council has approved, in writing the organic waste collection system of the permit holder.
7.4.20
The permit hoider is required to comply with the relevant obligations of the bye-laws for the storage, separation at source and presentation for collection of commercial waste in force in the local authority areas of the Dublin Region.

7.4.21 Where the permit holder provides services for the collection of commercial waste streams from businesses in the local authority areas of the Dublin Region, they shall provide bins of the appropriate colour accordance with colour coded guidelines provided in the Waste Management Plan for the Dublin Region 2005-2010 (as may be varied or replaced from time to time). Construction and Demolition Wastes 7.4.22
Where the permit holder proposes to use a local authority permitted or certificate of registration 'facility for the disposal of construction and demolition wastes in the Dublin Region, the permit holder shall comply with the objective of the Waste Management Plan for the Dublin Region 2005-2010 which restricts the placement to clean soil only. The soil material should be uncontaminated and not contain other construction materials such as metal, plastics, glass, bulky wastes and hazardous wastes. APPENDIX INSTRUCTIONS AND INTERPRETATION Appendix A is divided into 3 tables; A1, A2 and A3. Table A1 lists the household wastes types permitted to be collected door-to-door. Table A2 lists the household waste types permitted to be collected from bring banks, bring centres, recycling centres, mobile collection schemes, WEEE collection depots, skips and bulky waste collections. The permit holder is permitted to collect waste types identified in Tables A1 and A2 provided the requirements of all conditions are complied with including household specific conditions in sections 6 and 7. In the DUblin Region the door-to-door collection of household wastes from single dwelling households is not permitted by permit holders as set out in condition 7.4.4. Table A3 iists all other waste types permitted to be collected. The permit holder is permitted to collect waste types identified in Table A3 provided the requirements of all conditions are complied with.

The quantities to be collected by the permit holder and the local authority areas where the collection of household wastes (e.g. door-to-door or other) are to take place have been assessed by Dublin City Council. The permit holder is required to notify DUblin City Council prior to any significant change in the collection activity or quantity of material to be collected in accordance with condition 1.5. Tables A1, A2 and A3 specify the corresponding local authority areas where each specified waste type can be collected. References in these tables to "All Local Authority Areas" shall mean all local authority areas as specified in Appendix D. Appendix B lists the facilities, which the permit holder is permitted to transfer waste to.
