MEMORANDUM SALING PENGERTIAN ANTARA SADAN PENGAWAS OBAT DAN MAKANAN REPUBLIK INDONESIA DENGAN KOREA FOOD AND DRUG ADMINISTRATION TENTANG KEAMANAN DAN KUALITAS PANGAN OLAHAN, PRODUK OBAT, OBAT TRADISIONAL, KOSMETIK DAN SUPLEMEN MAKANAN
Sadan Pengawas Obat dan Makanan Republik Indonesia (Sadan POM) dan Korea Food and Drug Administration (KFDA) untuk selanjutnya disebut "Para Pihak",
BERKEINGINAN untuk memperkuat hubungan persahabatan antara kedua
negara,
BERMAKSUD untuk meningkatkan manfaat dari kepentingan bersama dalam
bidang pengawasan keamanan dan kualitas pangan olahan, produk farmasi (termasuk Active Pharmaceutical Ingredient (API), vaksin dan produk biologi), obat tradisional, kosmetik dan suplemen makanan (untuk selanjutnya disebut sebagai "pokok kerjasama"), dan
MERUJUK pada Persetujuan Mengenai Kerjasama Ekonomi dan Teknik Serta
Pengembangan Perdagangan Antara Republik Indonesia dan Republik Korea, ditandatangani di Jakarta, 24 April 1971;
BERDASARKAN hukum ,standar dan peraturan yang berlaku di kedua negara;
TELAH SAMPAI pada saling pengertian sebagai berikut :
Pasal 1 TUJUAN
Tujuan Memorandum Saling Pengertian ini adalah untuk menciptakan dan mengkonsolidasikan kerjasama dalam bidang pengawasan keamanan dan kualitas dari pokok kerjasama.
Pasal2 RUANG LINGKUP KERJASAMA
Para pihak: a.
akan bertukar informasi mengenai hukum, peraturan dan standar yang relevan dari
masing -masing negara serta informasi lain yang terkait
dengan pengawasan keamanan dan mutu dari pokok kerja sama;
b. akan bekerja sama dalam bidang-bidang peraturan,standar, evaluasi dan teknik pengujian untuk pokok kerjasama dari para Pihak;
c.
Apabila terjadi
masalah keamanan terkait
produk impor dari pokok
kerjasama yang menimbulkan risiko yang berarti bagi kesehatan konsumen dari para Pihak, akan memberitahukan Pihak lainnya mengenai produk dimaksud.

informasi yang relevan
termasuk nama produk, potensi risiko yang
terdeteksi, metode inspeksi dan hasilnya,
nama produsen,
eksportir, tanggal pembuatan.

mengenai
nomor batch
nama
ekspor akan disediakan; d. saat diterimanya pemberitahuan oleh Pihak
adanya masalah keselamatan dan mutu yang terdeteksi dalam produk impor dari subjek kerjasama, Pihak pengekspor akan segera melakukan investigasi, mengambil langkah-langkah korektif, dan memberitahukan kepada
Pihak pengimpor. Jika diperlukan,
inspeksi bersama ditempat
pada perusahaan di mana masalah terjadi, dapat dilakukan dengan
persetujuan bersama Para Pihak sesuai dengan prinsip-prinsip
praktek
terbaik internasional; e.
Dapat menyelenggarakan simpos1um dan I atau menawarkan kursus pelatihan bersama dan juga pemeriksaan (peer-inspection), tergantung pada
memperhatikan ketersediaan dana dan sumber daya masing-
masing Pihak.
Pasal3 PELAKSANAAN
Para pihak sepakat untuk membuat Rencana Aksi untuk jangka waktu 2 (dua) tahun. Setelah penandatanganan Memoradum Saling Pengert1an, Rencana Aksi akan disusun berdasarkan butir-butir khusus kerjasama, aspek keuangan dan pengaturan pelaksanaan lain yang perlu. Pemantauan dan evaluasi dari pelaksanaan Rencana Aksi akan dilakukan oleh Para Pihak secara berkala.
Pasal4 PEMBATASAN KEGIATAN PERSONEL
Tiap-tiap pihak akan menjamin bahwa tiap-tiap personel yang terlibat dalam kegiatan-kegiatan yang diatur oleh Memorandum Saling Pengertian ini tidak akan terlibat dalam urusan politik dan/atau kegiatan-kegiatan dagang komersial di kedua negara di luar program kerjasama dibawah Memorandum Saling Pengertian ini.
Pasal5 PENGATURAN KEUANGAN
1.
Tiap - tiap pihak akan menanggung biaya yang timbul dari kegiatan kegiatan kerjasama di bawah Memorandum Saling Pengertian ini.
2.
Kecuali diputuskan lain oleh Para Pihak secara bersama, Pihak yang memohon bantuan di bawah Memorandum Saling Pengertian ini akan menanggung seluruh biaya bantuan yang disediakan oleh Pihak lain.
Pasal6 PENGUNGKAPAN INFORMASI
Tidak satu pihak pun boleh rnembuka atau rnenyebarluaskan kepada pihak ketiga

informasi
yang
disampaikan
oleh
Pihak
lain
('Pihak
Pengungkap") dalam proses kegiatan kerjasama di bawah Memorandum Saling Pengertian, kecuaii dan sepanjang ada otorisasi secara tertulis
untuk
mengungkapkan oleh Pihak Pengungkap.
Pasal7 PENYELESAIAN SENGKETA
Setiap
sengketa
yang
timbul
dari
penafsiran
dan/atau
pelaksanaan
Memorandum Saling Pengertian ini akan diselesaikan secara bersahabat melalui konsultasi atau perundingan antara Pihak - pihak.
Pasal8 PERUBAHAN DAN TINJAUAN
Memorandum Saling Pengertian ini dapat ditinjau kembali atau diubah setiap saat atas kesepakatan bersama secara tertulis oleh Para Pihak. Setiap revisi atau perubahan mulai berlaku pada waktu yang ditentukan oleh Para Pihak dan merupakan bagian tak terpisahkan dari Memorandum Saling Pengertian ini.
Pasal9 MASA BERLAKU DAN PENGAKHIRAN

Memorandum Saling Pengertian ini mulai
berlaku sejak tanggal
penandatanganan 2.
Memorandum Saling Pengertian ini akan tetap berlaku untuk masa 3 (tiga) tahun dan dapat diperbaharui selama 2 (dua) tahun , kecuali bila sa lah satu pihak mengakhirinya dengan pemberitahuan tertulis 6 (enam)

Pengakhiran Memorandum Saling Pengertian ini tidak mempengaruhi lamanya atau berlakunya kegiatan-kegiatan kerjasama yang diatur sebelum Memorandum Saling Pengertian ini.
Ditandatangani dalam rangkap dua di Jakarta pada tanggal 12 bulan Juli tahun 2012 dalam Bahasa lnggris, Bahasa Indonesia dan Bahasa Korea. Dalam hal terjadi perbedaan penafsiran atas Memorandum Saling Pengertian ini, naskah berbahasa lnggris yang berlaku.

MEMORANDUM OF UNDERSTANDING BETWEEN THE. NATIONAL AGENCY OF DRUG AND FOOD CONTROL OF THE REPUBLIC OF INDONESIA AND THE KOREA FOOD AND DRUG ADMINISTRATION OF THE REPUBLIC OF KOREA REGARDING THE SAFETY AND QUALITY OF PROCESSED FOOD, MEDICINAL PRODUCTS, TRADITIONAL MEDICINES, COSMETICS AND FOOD SUPPLEMENT The National Agency of Drug and Food Control ("NADFC") of the Republic of Indonesia and the Korea Food and Drug Administration ("KFDA") of the Republic of Korea (hereinafter referred to as "the Parties"),
DESIRING to strengthen friendly relations existing between the two countries ,
INTENDING to promote the benefits of mutual interest in the field of controlling
the safety and quality of the processed foods, medicinal products (including Active Pharmaceutical Ingredient (API), vaccines and biological products), traditional medicine, cosmetics and food supplement, (hereinafter referred to as "the subject of cooperation"),
REFERRING
to
the
Agreement
Regarding
Economic
and
Technical
Cooperation and Trade Promotion Between the Republic of Indonesia and the Republic of Korea, signed at Jakarta, on 24 April 1971 ;and
PURSUANT to the prevailing laws. standards and regulations of the two
countries,
HAVE COME to the following Understanding:
Article
1
Objective
The objective of this Memorandum of Understandingis to create and consolidate cooperation in the field of safety and quality control of the subject of cooperation.
Article 2 Areas of Cooperation
The Parties: a.
will exchange information on the relevant laws, regulations, and standards ofeach country as well as other information related to safety and quality control of the subject of cooperation ;
b.
will cooperate in the areas of regulations , standards, evaluation and examination techniques for the subject of cooperation of the Parties;
c.
where a safety problem occurs in the imported products of the subject of cooperation which poses a significant risk to consumer health of the Parties will notify other Party of the product information. When providing such notification, relevant information including the name of the product, potential risk detected, inspection methods and results, manufacturer, exporter, manufacturing date, lot/batch cude and import and export dates will be provided;
d.
upon the receipt of notification by the importing Party of safety and quality problemsdetected in imported products of the subject of cooperation , the exporting Party will conduct an investigation promptly, take corrective measures, and so notify the importing Party.

a jointon-site inspection on the company where the problem occurred may be conducted with the mutual consent of the Parties in accordance with international best practices principles; ·

may hold symposiums and/or offer joint training courses and also peer inspection, subject to the availability of the funds and resources of each Party.
Article 3 Implementation
The Parties agreed to conclude a Plan of Action for a period of 2 (two) years. Upon signing the Memorandum of Understanding, the Plan of Action will be defined by specific items of cooperation, financial aspects. and other necessary implementation arrangements. Monitoring and evaluation for the implementation of the Plan of Action will be done by Parties periodically.
Article 4 Limitation of Personnel
Each Party will provide assurance that each personnel engaged in the programs under this Memorandum of Understandingwill not involve in any political affairs and/or any commercial ventures or activities in both countries outside the programs of cooperation under this Memorandum of Understanding.
Article 5 Financial Arrangements
1.
Each Party will bear its own costs arising from cooperative activities under this Memorandum of Understanding;
2.
Unless otherwise jointly decided by the Parties, the Party that requests assistance under this Memorandum of Understandingwill bear all costs of any assistance provided by the other party.
Article 6 Disclosure of Information
Neither Party may disclose or distribute to any third party any confidential information transmitted by the other Party ("the disclosing Party") in the process of cooperative activities under this Memorandum of Understanding, except as and to the extent authorized in writing to do so by the disclosing Party.
Article 7 Resolution of Disputes
Any disputes arising from the interpretation and/or 1mplementat1on of this Memorandum of Understandingwill be resolved amicably through consultations or negotiations between the Parties.
Article 8 Amendments and Review
This Memorandum of Understandingcan be reviewed or amended at any time by mutual written consent by the Parties. Such revisions or amendments will come into effect on such date as may be determined by the Parties and will form as an integral part of this Memorandum of Understanding.
Article 9 Validity and Termination 1.
This Memorandum of Understanding will come into effect on the date of its signing;
2.
This Memorandum of Understandingwill remain in effect for a period of 3 (three) years and may be renewed for subsequent period of 2 (two) years, unless it is denounced in writing by either Party, 6 (six) months prior to the expiration of this Memorandum of Understanding;
3.
The termination of this Memorandum of Understandingwill not affect the duration or validity of any on-going cooperative activities arranged prior to this Memorandum of Understanding.
Signed in duplicate in Jakarta, on 12 July 2012, in the Eng lish, Indonesian and Korean lang uages, each version being equally va lid. In case of any divergence of interpretation, the English text will prevail.
