I. Origin of the "Austrian case" LA. LB. Bilateral sanctions It should be stated right at the beginning that these sanctions were not measures

tuken by the European Union as such but only by fourteen partner countries against the Rfteenth. Although the Fourteen made, for this purpose, use of the President of the I nuncii, it was not in this capacity that he could act; rather was he to be regarded the common spokesman of the Fourteen. Moreover, the sanctions were declared to be of a bilateral nature and not intended to affect the sphere of the European U n i o n or of the European Community, respectively. ř1)

II. The catalogue of "European values" Yet, we may ask two questions: Are these sanctions legally admissiblc? A n d if the answer should be affirmative, for which reason? A r e they admissible becausc they are legally neulral, remaining in an area not governed by law and not interťering with rights of Austria? Or are they permissiblc because - although legally not neutral (not remaining outside the area governed by law and interfering with Austrian rights) they are justified? In order to provide answers, it seems necessary first to answer the following (so-tosay preliminary) question: Do legally neutral sanctions exist at all? This seems to be an issue of distinguishing between legal matters on the one hand and political matters on

the other hand. A l l these questions lead us to the very core of the p r o b l é m : If the sanctions taken by the Fourteen should not be neutral írom a legal point of view, if they should interiére with the rights of Austria - on which grounds could they be regarded justified?

U.B. European values and participation in government of the F P Ó

I I . A . The notion of " E u r o p e a n values" The main argument of these supporting the sanetions against Austria has been that Austria, by permitting the F P Ó to enter the government, has violated the eatalogue of values of the European U n i o n . N o w the notion of "values" oř "eatalogue of values" appears, if taken in abstraet, not to be suffieiently preeise, allowing everyone to understand it in a different manner. Moreover, in any legal s y s t é m - and therefore also in U n i o n and Community law - only those values ean be of legal relevance which are either expressly oř by implication - contained in, and reflected by, the law. Otherwise we would have an unacceptable conťusion of law and morals.*' 7)

II.A.l. Legal basis Thus, we have to infer the values of the European U n i o n from U n i o n and C o m m u ­ nity law itself. In doing so we have to bear in mind that we are not dealing here with a notion of values in a broad sense, comprising all kinds of valuable objectives and, in partieutar, economic principles. Otherwise, object and purpose of the constitutional treaties would form, in their entirety, the values of the U n i o n , quite independently of the hierarchical pláce the various objectives take in the s y s t é m of U n i o n and C o m m u ­ nity law. In connection with the sanctions of the Fourteen against Austria, the issue ís the alleged violation of fundamental values of the European U n i o n .

ILA.2. The fundamental values of the European Union The EU Treaty contains, in article 6, a definite eatalogue of values * whose viola­ tion may be sanctioned pursuant to article 7. The values listed in this eatalogue and called "principles" of the European U n i o n , are identical with the traditional notion of the common good and thus characteristic for that kind of State which is today regarded as providing the best conditions for its realization, n á m e l y the liberal and demoeratic State under the rule of law. It is exclusively these values the violation of which - if serious and persistent - is sanctioned by the EU Treaty. 1 1) The fact that sanctions are provided for in such a case demonstrates that the European U n i o n regards these values as fundamental and their violation as incompatible with the status of Membership in the U n i o n ; and the fact that sanctions are provided for only in such a case indicates that other values, i. e. goals and principles of the U n i o n , are not equally fundamental for it, and that for this reason it has not been considered necessary to sanction their violation through the p r o c e d u ř e laid down in article 7. 9

Since the Fourteen invoked the participation of the F P Ó in the new Austrian go­ vernment as the ground for the imposed sanctions, the decisive question can only be Whether Austria has violated, by the inclusion of the F P Ó in the government, the values listed in article 6 EU Treaty, or at least other values embodied in Community law.

//./*./. Infringement of the fundamental values of the European Union? The provision which has to be considered First is article 7 EU Treaty (as amended by the Treaty of Amsterdam). Para. 1, applicable here, speaks however of "a serious • mel persistent breach by a M e m b e r State of principles mentioned in article 6 ( 1 ) " ; it is only in this case that the C o u n c i l , acting under article 7 (2), may decide to suspend l ertain rights deriving for the State concerned from membership in the U n i o n . It follows from the wording of the article 7(1) that not each and every breach of the fundamental principles of the Union warrants the sanctions envisaged in para. 2; the breach has to be serious and persistent. For a breach to be serious, the conduct w h i c h .ilíccts these principles o r a n ý one of them as well as the consequences of this conduct have to be considered as serious. As regards the conduct of the Member State concerned, the test to be applied for its characterization as serious will be similar to that which the European Court of Justice has worked out in its case law on M e m b e r State responsibility for breach of C o m m u nily law; according to the Court, the breach must be a qualified one. As regards the Consequences, the breach, for qualifying as serious, has to touch the very essence of the principles in question; merc violation of one of their peripheral aspects w i l l not be sufficient. Moreover, a suspected threat of a breach of any of the said principles can nevěr come under article 7 ( 1 ) . because a threatening violation is a violation that has not yet been committed; and a violation that has not even yet been committed can nevěr be a persistent violation.

The character of the F P Ó Yet, the question of how article 7 EU Treaty is to be correctly interpreted has no decisive bearing upon the Austrian case because the Fourteen have not anyway ever claimed that there existed, in Austria, a situation as envisaged by that provision. In fact, a sober consideration of all the circumstances which permit a judgment of the character of the F P Ó and of its leading personalities w i l l come to the conclusion that 15

the party's participation in the new government does not constitute a violation of the U n i o i ť s fundamental values by Austria. In the past, i. e. during the period when it was the biggesl opposition party in the Austrian National C o u n c i l , the conduct of the F P Ó could be characterized as populist; and since it regarded as its main political opponcnt the Sociál Democratic Party ( S P Ó ) , a grouping o ť t h e left, it might be correct to say that the F P Ó has been right (or even right-wing) populist. However, as regards the criteria generally required for characterization of a party as e x t r é m e or radical (whcther right or left), viz. Parteiengeselz (law on political parties), Verbotsgesetz (law prohibiting neo-faschist activities), A r t i k e l 9 und 20 Staatsvertrag von W i e n 1955 (treaty of V i e n n a ) , none of them can be said to apply to the F P Ó . l 5 )

worthy, as part of a government. We may content ourselves with a few examples participation of the A l l e a n z a Nazionale, the successor to the neo-fascist party, in the [talián cabinet of Berlusconi from 11 M a y 1994 to 22 December 1994, participation Ol the Communist Party in the present cabinet Jospin in France since 1997, the sup­ port for, and participation in, the governments of various component states of the Federal Republic of Germany of the Party of the Democratic Socialism ( P D S ) , a blatant lUCcessor to the former S E D in the G D R - in order to show that no high-level requirements exist for qualification as a governing party, especially in the " b i g " M e m bei States of the European U n i o n . The only eriterion seems to be the claim not to aspire to power through other than democratic means; a claim the credibility of which has, so far, nevěr been verified or l.ilsified, be it for the fortunate lack of opportunity to act otherwise. 2S)

Political Parties in the liberal and democratic "Rechtsstaat" As the case may be, any dispule about such characterization of the F P Ó is at any rate besides the point.

Theoretical requirements - a European minimum standard A liberal and democratic State under the rule of law (a State aptly called ''Rech­ tsstaat" in German legal writing) does not, by its very nature, know of any party which could at the same time be legally acceptable and politically so objectionable that it would be permissible to impose sanctions upon the State where this party forms part of the government. What is required from a party can be derived from the idea of the liberal and democratic State under the rule of law itself. The European Court of Human Rights has repcatedly had the opportunity to deal with the question of when a party could be said to be compalible with the systém of values as contained in the European Convention of Human Rights ( E C H R ) . A c c o r d i n g to this Court it suffices for a party to submit to the democratic rules and does not put in question the democra­ tic and liberal systém and the rule of law. ' 17)

A party which seeks the power through other than democratic means and which makes it sufficiently clear, either expressly or by implication, that it has the intention to do away with democracy, frecdom, and the rule of law, leaves the common ground constituted by the political consensus necessary even in a plurálistic society, and thereby loses the protection of the very systém it wants to abolish.

Practical requirements - the minimalist standard of the European Union This is certainly a deplorable fact; but it must be taken into account when establishing the minimum standard existing in the various M e m b e r states of the European U n i o n with regard to the question of whether a party might be acceptable, or even 16

The Austrian case and the European double standard Compared with the reservations that could be made against the participation in government by parties of the e x t r é m e right and left in Italy, France, and Germany, participation of the F P Ó in the new Austrian government has to be considered as completely innocent; for so far nobody has reproached it with seeking power by other than democratic means or with the intention of abolishing democracy, freedom, and the Mile of law, if it should come into power. By setting the above-mentioned precedents, Italy, France, and Germany have lost Rol only the mora] but also the legal right to call participation in government by the PPČ a violation of the fundamental values of the European U n i o n ; these States have to face not only the well-known principle of international law of tu quoque ' but also the generál legal conclusion a maiori ad minus. 29

Moreover, the pact between the Spanisch Socialist Party and the Spanish C o m m u nisls, an abortive attempt to win the parliamentary elections of 2 0 0 0 , has not even i Rised official protest on the part of any other Member State of the European U n i o n , let .ilonc the threat of sanctions in case the Spanish government should be formed with participation of the Communist Party. And the statement by the German Federal Chancellor Gerhard Schroder Italy would have to reckon with similar sanctions if the Neo-Fascists should again become part of the Italian government roused such a storm of indignation in Italy that Schroder, who \\,is not seconded by any other Head of State or Government in the European U n i o n , li.nl quickly to retract his statement. ( riícriafor legality From all this it may be concluded that the Member States of the European U n i o n have so far not developed any standard which would permit the questioning of the participation in government by a certain party with regard to "European values", as long as this party has not violated the democratic rules. A n d participation in government !-\ a party seems to constitute already in itself a presumption for its e l i g i b i l i t y . 33)

The observance of democratic rules of p r o c e d u ř e on the domestic level For these reasons the only criterion for deciding whether a party which has attained participation in government fulfils the necessary requirements is the actual effect its participation has on the compliance with the obligations of the M e m b e r statě con­ cerned under EU or EC law including, of course, the obligation to respect the princi­ ples of the European U n i o n as embodied in article 6 ( 1 ) . The observance of the obligations under the E U / E C Treaties on the Community level Consequently, participation in government by a party is not unlawful as long as such participation does not lead to an actual violation of the EU or EC law. A n d none of the fourteen partner countries of Austria in the European U n i o n has alleged so far that participation in government by the F P Ó would constitute in itself a violation of the fundamental principles contained in article 6 EU Treaty or of any other Austrian obligation under the constitutional treaties. Actually, if such had been the case, recourse could have been had to the proceduře laid down in article 7 EU Treaty or articles 225 and 227 EC Treaty, respectively; it would then not have been necessary to resort to sanctions outside the framework of EU and EC law, the so-called bilateral sanctions of the Fourteen. But none of them has even alleged that participation in government by the F P Ó would per se warrant instituting of proceedings under article 7 EU Treaty; and the same applies to the proceedings under articles 226 and 227 EC Treaty. This is an (at least indirect) recognition of the fact that a Member State which does not violate the eatalogue of principles as contained in article 6(1) may not be reproached with a breach of fundamental values of the European U n i o n ; and a Member State which, moreover, does not violate any other obligation under communi­ ty law may not be reproached with the violation of values of the European Union at all. 34)

Nowhere can be found, in Community law, a link between alleged violations of v ftlues of the European U n i o n or the European Community and (bilateral or any other l llld of) sanctions taken (or to be taken) by M e m b e r States. Moreover, such sanctions cannot be based on generál international law either, for if exists no violation of such (fundamental or "simple") values, the basis for sanc­ tions is equally lacking here.

International morals are based on certain values common to all (civilized) States. The example usually given is the moral duty to render assistance to a State in a case of emergency. Of course, not all of these values are really generally recognized by all members of the international community; this is a consequence of the fact that society - the national as well as the international - is pluralist. '

The "rule of law" demands that freedom and democracy are fintily embodied in the national legal order (and especially in the constitution ', and that the funda­ mental rights of the individual, both civic and political, may be enforced by legal means. A State under the rule of law (Rechtsstaat) has therefore also to be a State where the necessary legal institutions and proceedings for the enforcement of those fundamental rights exist (such a State being aptly called Rechtswegestaat in German legal terminology.

This pluralism, based on a variety of philosophical and other convictions (what is properly designated by the German term Weltanschauung), ' has its counterpart in political pluralism: there exists a variety of conceptions about the shaping of policies, partly as regards the extent and the ways and means of political interference in sociál affairs, partly over the objectives to be pursued. That it is legitimate to have different views and to hold different beliefs in sociál matters is recognized in all democratic and liberal States with the rule of law, although it may not yet have been understood and accepted by all members of society. It follows for the domestic domaine that it is essential for a pluralist society to respect different positions, with regard to Weltanschauungen as well as with regard to politics. This kind of State is characterized by fundamental rights which are recognized by the State's legal order ' and which may be enforced by legal procedures provided for therein. Where the necessary legal protection of these rights does not exist we may speak of a police State; and where pluralism as such is negated, we are confronted with a totalitarian s y s t é m . 46)

The nature of the liberal and democratic "Rechtsstaat" If we describc the liberal and democratic State under the rule of law more dosely, the adjective "liberal" indicates that different opinions, but also different political movements and objectives may coexist. In this connection we may refer in particular to freedom of religion, ' of opinion (including the freedom of speech), and of assembling and forming associations. 49

Political freedom as an international fundamental right Of course, every State and every group of States possesses a considerable margin Of political diseretion concerning its international relations with another State. termination of policies is free in principle but finds its limits in the fundamental rights just mentioned. Thus, a balance between a necessary margin for policies and the scope of existential liberties for the individuals is established.* 20

To enforce a particular policy against another State which pursues another political course only without breaching any international obligation would not be justified and therefore legally illicit.

III. B . Retorsions

No negative attitude taken by Austria We have already demonstrated that internal politics in a M e m b e r State which do | O l go beyond what is permissible in a liberal and democratic State under the rule of l.iw may not be regarded an unfriendly act against the other M e m b e r States. * TherefoM\ the conduct of Austria towards its partners in the European U n i o n is not adversely iffected by the F P Ó ' s participation in government. 73

No relevant consequences for the Fourteen

Besides the reprisal, international law provides also another answer to an illegal, or at least unfriendly, act by State, n á m e l y retorsion. The retorsion (sometimes also called retortion or retaliation) is itself an unfriendly act which thus does not interiére with the rights of the other State. As just said, the condition for it is an act by another State that has to be characterized at least as unfriendly; * as an answer to an illegal act, retorsion may be considered also as a sanction of international law, albeit in the broader sense of the term only. 6S)

Sometimes it is argued that various other Member States - and especially those \\ hic h had played a leading role in connection with the sanctions imposed on A u s t r i a would have problems of their own with right-wing extremism * and would therefore I Onsider themselves negatively afťected by participation in government of the F P Ó . I lowever, this argument is not valid because of at least two reasons. 74)

No negative example First of all, the F P Ó - as we have already s h o w n - cannot be considered an IKtremist party, but (at the most) a populist one. Thus, its participation in government tfoes a priori not set any negative example for extremist movements in other M e m b e r Slales. 7M

IV. The sanctions imposed by the Fourteen as retorsions? There can be no doubt that the sanctions taken by the Fourteen against Austria constitute at least an unfriendly act. This is not even disputed by them but explicitly intended: through international unfriendliness pressure shall be exercised on Austria. To be qualified as retorsions these unfriendly acts would have to be the answer to an (at least) unfriendly conduct on the part of A u s t r i a . ' 72

The sanctions as unfounded presumption by the Fourteen In conclusion it can be said that mere differences of political opinions, i. e. diffe rences which are not related to a breach of the principles contained in article 6 EU Treaty or to any other violation of E U / E C law do not offer a basis for sanctions as provided for in article 7 EU Treaty or for proceedings under articles 226 and 227 EC Treaty. Sanctions against a M e m b e r State taken outside these provisions do not have any basis at all in E U / E C law. Both article 7 EU Treaty and articles 226 and 227 EC Treaty are exhaustive; they leave no leeway for discretionary measures. For this reason the so-called bilateral sanctions imposed upon Austria are an unwarranted assumption of legal authority by the other fourteen M e m b e r States, a pre­ sumption which, at the best, may be regarded irrelevant (only if limited to unfriendly acts, and only i ť s u c h unfriendly acts were legally tolerable, but which constitutes when infringing upon Austria's rights deriving from the E U / E C Treaty - a violation of the law of the European U n i o n and/or the European Community. 1()S)

V I L B . L a c k o f due process o f law under the E U Treaty Against a violation of its rights under the EC Treaty Austria may turn to the E C J with a good prospect of success. The fact that there does not exist a comparable legal protection under the EU Treaty has to be regarded a deplorable gap in EU law; this cannot, ofcourse, serve as a justification of, or an excuse for, the unlawful sanctionsi taken by the Fourteen. To fill this gap and to provide for proceedings which guarantee comprehensive due process of law should be a primary objective of the present negotiation process for an institutional reform of the European U n i o n . A n y M e m b e r State opposing the necessa­ ry amendments to article(s 6 and) 7 EU Treaty could hardly plead to be in good faith and it would certainly lose any moral right to reproach another M e m b e r State with the breach of fundamental European values. , ( , y )

As regards an action against Austria under articles 226o r227EC Treaty for violation of( "simple ") Community law, no one has even venturedsuch an idea. Article 7 EU Treaty is the only provision in the EU Treaty that providesfor sanctions in the case ofa violation of "values " vet limited to a breach ofthe principles contained in article 6. w /[ ober consideration ofall relevant circumstances reveals thefact that no violation ofoav obligát ion under the EC Treaty can be imagined which would have to be re­ garded the direct consequence of mereparticipation in government by the FPÓ. • We refei; when speaking of Community law to the EC Treaty only on the understanding that the relevant provisions concerning the violation of that Treaty have their párallels in the European Coal and Steel Community (ECSC) Treaty and the Euro­ pean A tom i c Community (EAC) Treaty. Il.lt. I. Porušení základních hodnot Evropské unie?

Hlavním argumentem zastánců sankcí proti Rakousku je to, že Rakousko povolením vstupu F P O do vlády porušilo katalog hodnot Evropské U n i e . Pokud bereme pojetí „ h o d n o ť ' nebo „katalogu hodnot " abstraktně, pak nebudou dostatečně přesné, protože každý je m ů ž e chápat rozdílným způsobem. Navíc, v každém právním systému - a tedy i v právu Unie či Společenství - mají právní relevanci pouze ty hodnoty, které jsou, ať výslovně nebo implikované, obsaženy v zákonech a zákonem reflektovány. V opačném případě bychom se dostali do nepřijatelného zmatení práva a morálky.*'

S k u t e č n o s t , že v těchto případech je přistupováno k sankcím, demonstruje to, že E v r o p s k á unie považuje tyto hodnoty za základní a jejich porušení za neslučitel­ né s členstvím; a skutečnost, že k sankcím se přistupuje pouze v t a k o v é m t o případě, indikuje to, že ostatní hodnoty, což jsou cíle a principy Unie, pro ni nejsou tak základní - z tohoto d ů v o d u nebylo p o v a ž o v á n o za nezbytné jejich porušení sankcionovat podle procedury u v e d e n é v článku 7. Co se týče porušení práva Společenství, bylo m o ž n o použít články 226 a 227 Smlou-j vy, které umožňují podniknout kroky při „nesplnění povinností vyplývajících ze Smlouv y " nebo při „nedodržení závazku vyplývajících ze Smlouvy."

Střízlivým zhodnocením všech relevantních okolností dojdeme k faktu, že si nelze přec stavit jakékoliv nesplnění závazků daných Smlouvou ES, přímo způsobené pouhou účastí FPÓ ve vládě.

Když hovoříme o právu Společenství, míníme tím pouze Smlouvu ES s tím, že reh vantníustanovení týkající se porušení Smlouvy má své paralely ve smlouvách o uh^ a oceli (ECSC) a o evropské atomové komunitě (EAC). Pro vypovězení nebo omezení platnosti smlouvy zde tedy není možno uplatnit žádn ustanovení Vídeňské konvence o právu dohod (VCLT) z roku 1969, včetně článku č (vážné porušení smlouvy) ani článku 62 (podstatná změna okolností). 1 kdyby vši tyto články použity byly, musely by být dodrženy principy uvedené v článku 65 VCL% které nařizují alespoň pokus o urovnání vzájemně odsouhlasenými prostředky mezi národní rozpravy Toto minimum Iry v našem případě znamenalo zahájit jednání ^ státem, který byl obviněn z porušování smlouvy.
