National Highlights
Legislation
The structure of the Belgian federal state is very complex. The stated is composed of 3 Regions 1: the Flemish Region (which is the biggest one and the most advanced in the EPBD implementation), the Walloon Region (which is the second one is size) and the Region of Brussels-Capital (which is the city of Brussels only). The EPBD implementation is under the responsibility of the Regions, and we have therefore potentially 3 different sets of certificates.
Methodology
Contrary to what happened in other Member States, there are many different methodologies. Indeed, the following cases must be distinguished: Types of building

Implementation For what concerns the certificates themselves, the following layouts are already published: - Flemish Region: new dwellings, new offices and schools, existing dwellings sold or rented, public buildings, - Region of Brussels-Capital: new dwellings, new offices and schools Requirements
The global energy performance required by EPBD is expressed as a so-called E-level, which is defined as the ratio between the characteristic annual primary energy consumption of the building and a reference value for the characteristic annual primary energy consumption, multiplied by 100 2. At first glance, the requirement seems not to be very strict, compared to other Member States 3. The evolution of the requirement in the next year seems really not very ambitious to what it is expected in other Member States.

Legal Framework
2.1. National distinctions of legislation Belgian is a Federal State composed of 3 Regions. The implementation of the EPBD is under the responsibility of the Regions. Due to several factors, including the pressure to implement the EPBD as soon as possible (as the dead line is already passed) and the fact that the Regions want to exercise the responsibility they have received – which is absolutely normal –, there will be many differences between the 3 Regional regulations. It must be said that collaboration between the 3 Regions remains. They talk together about various aspects of the EPBD implementation, including about the necessary changes in the calculation procedures, in order to have as much harmonisation as acceptable for them. At this time, almost the only thing that is common is the calculation procedure of the energy performance of new office buildings and schools. All the rest varies from Region to Region (even if the differences are some times very small, or if sometimes only one Region has adopted different rules), including the calculation procedure of the energy performance of new dwellings, the softwares used, the administrative procedures, the certificates, the calculation procedure applicable to existing dwellings, and so on. Due to this fact, it is particularly difficult to summarise the Belgian situation. Similar to the Belgian legal framework (at federal level), the regional legal frameworks generally include four types of documents: 1)
A Regional Decree 4 voted by the Regional Parliament. This Decree only gives the general framework and gives authority to the Government to fill in this framework. The sanctions are included in the Decree.
2)
Governmental Decrees that gives further details and gives authority to the Ministry of Energy to precise more rules. The requirements for new buildings and the calculation procedures are given in a Governmental Decree.
3)
Ministerial Decrees that gives further details. The certificate layouts might be given in Ministerial Decrees.
These official documents 1 to 3 have to be published in the national law gazette (Moniteur belge - Belgisch Staatsblad). 4)
Unofficial documents can be published to explain things that might be unclear, but there legal status is uncertain.
The list of documents is quite long (currently more or less 20 documents, from 1 page to 444 pages). 2.2. History of energy related requirements -
In 1984, the Walloon Region introduced a regulation on the global building insulation level, called the K-level in Belgium. The name of the K-level comes from the fact that at that time, the U-values were called the kvalues, with a small k.

In 1992, the Flemish Region has introduced similar requirements.

The Walloon regulation was modified in 1996. An alternative requirement to the requirements on the K-level was introduced: the so-called be-level, which is the net demand for heating. This was one step closer to the holistic approach required by EPBD than the K-level, as it takes into account not only the global insulation level, but also the ventilation losses, the internal gains and the solar gains. This be-level did not require much effort to be calculated; however, it was not very popular among architects.

In 2000, the Region of Brussels-Capital has introduced similar requirements, based on K-level only.
2.3. Overview on EPBD implementation In 1998, in other words long before that the EPBD was published, the Flemish Region started a project to draft a regulation similar to the Dutch EPC regulation. For this reason, the Flemish Region was (almost) ready for what concerns new buildings before the deadline set by EPBD, as the EPB regulation for new dwellings and office buildings and schools came into force on 1st January 2006, three days before the deadline. For what concerns certificates, the process was slower. The two other Regions are late. It must be said that the Walloon Region had already regulations for a long time (1984) and that only a few buildings are erected each year in the Region of Brussels-Capital. 4

Note for non residential buildings: currently, there are global EP requirements only for new offices buildings and schools; for other types of buildings, there are only requirements on U-values, K-levels and ventilation provisions. Methodologies
Article 3: M em ber States shall apply a m ethodology, at national or regional level, of calculation of the energy perform ance of buildings 3.1. New buildings The energy performance of a building is expressed by a calculated energy rating called the E-level 5. This E-level is based on 12 monthly steady states calculations (no dynamic simulations). It includes all aspects mentioned in the EPBD annex I, including : -
heating energy consumption, depending on heating losses, ventilation losses (including those due to building airtightness), internal gains, solar gains, building thermal mass…
-
cooling energy consumption, real of even fictive (= when there is a cooling demand but no cooling installed),
-
hot water production, in case of dwellings only,
-
lighting, in case of office buildings and schools only,
-
active solar systems, both thermal and PV,
-
electricity produced by CHP.
There are therefore two E-level calculation procedures: one for dwellings and one for offices buildings and schools. If the calculation procedures do not include a particular technology, it is possible to use to so-called "principle of equivalence" 6, but at this time, only one system has pass through this process. Moreover, the legal framework is still under development. For what concerns cooling: For new residential buildings: 1.
In a first step, an overheating indicator is calculated (considering there is no active cooling); this indictor is based on a steady-state heat balance above 18°C and is expressed in Kh (it comes from a German approach). There is a requirement on this indicator: it must be below a certain limit.
2.
In a second step, a probability that an active cooling is installed is calculated, based on the overheating indicator; if a cooling is installed during the construction of the dwelling, this probability is of course equal to 1.
3.
In a third step, the cooling demand is calculated, based on a steady-state heat balance above 23°C.
4.
In a forth step, the cooling consumption is calculated by multiplying the cooling demand by the probability, and by considering only default values to assess the performance of the installed or fictive cooling system.
For new offices and schools: 1.
In a f irst s tep, t he c ooling dem and i s c alculated, ba sed o n a s teady-state heat balance above 18°C. If a cooling is installed during the construction of the building, this cooling demand is multiplied by 1.5.

In a second step, the cooling consumption is calculated by assessing the performance of the cooling system. If there is no cooling installed, the performance of the fictive cooling is equal to 1.0; if cooling is installed, the performance depends of the actual system type (in other words, the performances are assessed by a very simplified approach).

3.2. Existing buildings As said previously, the energy performance of existing buildings is calculated: -
in some cases (but not all - see 4.2) if the building undergoes a major renovation : in that case the methodology is the same than for new buildings,
-
if the building is sold or rented (see 3.3.2)
-
if the building is a public building (see 3.3.3)
3.3. Energy certificates
3.3.1
New building
The certificate for new dwellings and new offices buildings and schools is based on the calculations of the E-level. For other type of buildings, there are no E-level calculation procedures yet, and therefore no certificate is issued.
3.3.2
Existing buildings when sold or rented
For existing dwellings when sold or rented, the methodology is also based on a calculated energy rating. However, the methodology will be different in the Flemish Region than in the two other Regions. In the Flemish Region, the methodology is based on the methodology applicable in the Netherlands, whereas in the two other Regions, the methodology will be based on the E-level calculation procedure, with some adaptations for existing buildings. For existing non-residential buildings when sold or rented, the three Regions have recently launched an European call to adapt a methodology and a software from another Member State to Belgium.
3.3.3
Public building
For public buildings, the methodology is operational rating, but the procedures are expected to be different in the Flemish Region and the Region of Brussels-Capital; for the Walloon Region, no information available yet. 3.4. National software In the three Regions, the softwares are provided by the Regional authorities; there is no room for software competition. (This is a source of criticism for the people designing a passive house building, as they would like to use the PHP software. However, as the softwares are quite ambitious 7, BBRI believes that this is the best option, even if would be preferable that only one common software was developed for the 3 Regions (at least one for each type of certificate).) Currently, the following softwares are available: •

Software for existing non-residential buildings when sold or rented (based on a software from another Member State)

The Energy Advice Procedure (EAP) is a voluntary auditing system that can be applied on single family houses only. This EAP is however not in line with the EPBD requirements. This scheme is mainly based on asset rating, but includes some operational rating elements. 4.

limitation of the energy performance of the building, expressed as an E-level, which is the ratio between the characteristic annual primary energy consumption of the building and a reference value for this energy consumption,

limitation of the global insulation level, the K-level,
-
limitation of the U-values of the building components,
-
limitation of the risk of overheating, for dwellings only,
-
ventilation requirements,
-
moreover, in the Walloon Region, solar panels to produce hot water are compulsory, but the Minister has not yet decided how to implement this obligation, which is therefore not effective.
For other type of buildings, the requirements on the K-level and/or the U-values and ventilation requirements are applicable. See http://www.energiesparen.be/epb/overzichteisen for the Flemish Region (in Dutch). Requirements on E-level and K-level: -
new dwellings in the Flemish Region: E ≤ 100 and K ≤ 45,

In summary: the requirements in the Region of Brussels-Capital are a little more severe 9 than those in the Flemish Region and the requirements of the Walloon Region can not directly be compared, as they can be more or less severe, according to the building shape.

However, it does not say how the study must be done. Walloon Region: the Decree of 19-04-2007 gives the right to the Government to precise the content of the feasibility study. Region of Brussels-Capital: the Ordinance of 07-06-2007 gives the right to the Government to precise the content of the feasibility study. However, an important point for Brussels is that the feasibility study scope is wider than the one required by EPBD as it includes the study of passive cooling technique instead of air conditioning. 4.2. Existing buildings
Article 6: M em ber States shall tak e the necessary m easures to ensure that w hen buildings w ith a total useful floor area over 1 000 m 2 undergo m ajor renovation, their energy perform ance is upgraded in order to m eet m inim um requirem ents in so far as this is technically, functionally and econom ically feasible. Flemish Region: the requirements for new buildings are applicable. Walloon Region: the requirements on maximum U-values and ventilation provisions are applicable. Region of Brussels-Capital: the requirements on maximum U-values and some ventilation provisions are applicable.

Definition “major renovation”
Flemish Region (Governmental Order 11-03-2005): renovation of a building with a heated volume bigger than 3000 m³, where the building structure remains but the building HVAC installations are changed and at least 75% of the building envelope is changed. Walloon Region (Decree 19-04-2007): if at least 25% of the building envelope is renovated or if the renovation cost of the building envelop or HVAC installations is at least equal to the building value, without the ground value. Region of Brussels-Capital (Ordinance 07-06-2007): renovation of at least of 25% of the building envelope of a building bigger than 100 m² or renovation of the HVAC installations of a building bigger than 1000 m² and if the power of the installation is higher than 500 kW and if a environmental permit is required.

Energy performance certificates
Article 7/ 1: M em ber States shall ensure that, w hen buildings are constructed, sold or rented out, an energy perform ance certificate is m ade available to the ow ner or by the ow ner to the prospective buyer or tenant, as the case m ight be. 5.1. General description The certificates will be different in each Region, and for each type of buildings. The general layouts of the Flemish certificates for new buildings, existing dwellings and public buildings are however similar, but the content are different. The way to evaluate the building area also differs in each certificate. The Flemish certificates do not include an A-G scale, but a linear scale. The layout of the Brussels certificate for new buildings is under development. It should include an A+-G scale. In the Walloon Region, nothing is decided yes, as far as we know. 5.2. New buildings The Flemish Certificate includes the following items: Page 1: -

Once a rapporteur submits an EPB-declaration to the Flemish Energy Agency, the certificate is automatically sent to him by email, as a pdf file. A certificate is only delivered when there is a requirement on the E-level. In other words, only new dwellings, office buildings, new schools will get such a certificate. New hospitals, new commercial buildings,… are not submitted to a requirement on the E-level (as there is no calculation procedure yet), and therefore will not get a certificate. The -

It should be accompanied by a standard text with explanations and recommendations. 5.3. Existing buildings The Flemish Certificate has a layout similar to the one for new dwellings, see Annex 2. 5.4. Public buildings The Flemish Certificate includes the following items: -

Article 7/ 3 M em ber States shall tak e m easures to ensure that for buildings w ith a total useful floor area over 1 000 m 2 occupied by public authorities and by institutions providing public services to a large num ber of persons and therefore frequently visited by these persons an energy certificate, not older than 10 years, is placed in a prom inent place clearly visible to the public. Flemish Region (Governmental Order 20-04-2007): building ≥ 1000 m² that is frequently visited by the public because it is occupied by a public organisation; public organisations are : the Federal authorities (including agencies), the Flemish authorities (including agencies), de provincial authorities, the municipal authorities, the public company (like e.g. railways), the schools and universities, the hospitals and homes. 5.5. For existing residential buildings: yes. For public buildings: yes. In the Flemish Region, the assessor must fill-in a check-list about potential recommendations. For new buildings: not formally, but because the rapporteur is often the architect himself, he will go to the construction site. If the assessor is not the architect, he takes a big risk if he never goes to the construction site, as financial penalties are foreseen if it appears that the declaration is not correct.

Independent experts
Article 10 M em ber States shall ensure that the certification of buildings, the drafting of the accom panying recom m endations and the inspection of boilers and air-conditioning system s are carried out in an independent m anner by qualified and/ or accredited ex perts, w hether operating as sole traders or em ployed by public or private enterprise bodies 6.1. Who are the independent experts? Flemish Region: For new buildings, the expert is not necessarily independent. The building owner has to appoint a "rapporteur", who declares the performances of the building (by using the EPB-software®). The declaration is sent to the Flemish Energy Agency (VEA) that issues the certificate. This rapporteur must be an architect or an engineer (civil engineer, architect-engineer, industrial engineer or bio-engineer); it might be the architect of the building (which is probably the easiest way). The rapporteur must not be accredited ; he must only register to the Flemish Energy Agency. In June 2008, there were 2.854 registered rapporteurs ; 533 of them had already submitted an EPBdeclaration. For existing dwellings, the expert is independent, as it is an assessor that has followed a training and is accredited by the Region. For public buildings, the expert might be independent or not, as it might be an external assessor that has followed a training and is accredited by the Region, or it might be an internal assessor that as sufficient energy competences and that is recognised by the Region. As usual, the situation will be different in the other Regions. The function of rapporteur exists in the three Regions, but the name of this function is different in each Region! 6.2. Training Training is available for rapporteurs and assessors, as defined here above.

6.3. Accreditation Flemish Region: Accreditation is necessary for assessors, as defined here above. Region of Brussels-Capital: For new building: the EPB adviser (which is equivalent to the Flemish "rapporteur") must be accredited by the Region. To be accredited, the adviser must follow a training, but without exam. 6.4. Quality assurance The Regions can make controls of the declaration/certificates, including on-site controls. As far as we know, the Flemish Region does random paper checks as well as random on-site visits. The number of controls is unknown. 6.5. Organisational aspects The Flemish Region has fully delegated the training and the exams to training institutes. In a first phase, the Walloon Region will probably ask to the developers of the certification methodology to organise the training. In a second phase, the training will probably be delegated to training institutes and good assessors. 6.6. Number of experts available The only number officially published is the following: currently, in the Flemish Region, there are 435 external experts for public buildings (but a public organisation may use an internal expert for its own buildings). For information, there are currently 239 auditors for the voluntary scheme EAP in the Walloon Region, 6 in the Region of Brussels-Capital (but the auditors in one Region can be recognised by the other Region.) and 694 in the Flemish Region (might be the same than the external experts for public buildings). 6.7. Transboundary certification Considering how it is already difficult to have similar scheme at Belgian level, international certification seems to be illusory. If the schemes of some Region is similar to the scheme of another Region, some interregional recognition of the assessor might be expected (especially between the Walloon Region and the Region of BrusselsCapital), as it this is the case for the voluntary scheme EAP.

The Regions may however communicate them for analysis or studies, after having removed all information that might be used to identify buildings or assessors. 7.2. 8.4. Effort and costs of energy performance assessment
8.4.1
Time and costs
One day is the (minimum) time necessary to carry out an EAP voluntary audit. The official certification scheme of existing residential buildings in Flemish Region should go faster. The cost is fixed by the market only. In the Walloon Region, the average price for a voluntary audit EAP is more or less 700 EUR (all taxes included). The price seems to depend on the building complexity. The assessor themselves estimate that the price of a compulsory certificate should cost less, about 575 EUR (all taxes included).
8.4.2
Subsidies
Subsidies can be given to voluntary schemes, but not for compulsory certificates. The certificates should in the future be the basis for receiving subsidies, or for lowering some building taxes. Note for the voluntary scheme EAP: In the Walloon Region, the voluntary audit EAP can be free if its price is lower than 600 EUR, all taxes included, as the Regions gives a subsidies of 60% limited to 360 EUR and as the Federal state gives a tax reduction of the remaining 40% of energy saving measures, included audits (this tax reduction is limited to 2600 EUR). 9.
Acceptance of the energy performance certification
As the schemes for existing and public buildings are not launched at this time, this is difficult to say anything about certification acceptance by the public. 10.

Annex 1 Overview relevant legislation The complete list of the EPB regulations is quite long, due to the fact that this is a regional competency, the number of issues to be addressed and the fact that the EP calculation procedures have not been published as standards, but as regulation. Some of the documents are translated in the two main national languages (Dutch and French), some of them are event translated in the third national language (German), and some of them are not translated at all. The length of the documents varies from a few pages to more than 400.
