Kata Pengantar Preface
Proyek DEKLARASI ILO/USA di Indonesia ditugasi untuk mempersiapkan sejumlah laporan bagi diskusi dan bahan pertimbangan dalam sebuah lokakarya tripartit nasional untuk merumuskan rencana tindakan guna pengembangan suatu sistim hubungan industrial yang baru di Indonesia, selain juga untuk mensosialisasikannya kepada para unsur tripartit dan masyarakat secara umum.
Salah satu laporan penting yang dicanangkan pada awal Proyek adalah sebuah analisa kuantitatif dan kualitatif dari penggunaan praktis akan mekanisme hubungan industrial yang hams mencakup kesepakatan kolektif, isinya dan santunan bagi pekerja; pencegahan perselisihan industrial serta penyelesaiannya, caranya, isinya dan jangka waktunya; pertemuan badan-badan bipartit dan tripartit, agenda komposisinya, keefektifan dsb.
Laporan ini telah dipersiapkan untuk Proyek oleh Bpk. Soewarto, seorang pakar terkemuka mengenai hubungan industrial, mantan Direktur Jendral Hubungan Industrial dan Standar Perburuhan serta Sekretaris Jendral di Departemen Tenaga Kerja dan Transmigras!.
Disiapkannya laporan ¡ni adalah sejalan dengan tujuan Proyek untuk membantu para unsur tripartit Indonesia dan organisas! relevan lainnya agar mendapatkan pengetahuan dan pemahaman yang lebih baik akan hak-hak dan kewajiban yang terkandung dalam perundangan baru dibawah program pembaruan hukum perburuhan, serta kemampuan melaksanakan hak dan tanggung jawab tersebut.
The ILO/USA DECLARATION Project in Indonesia is tasked to prepare a number of reports for discussion and consideration in a national tripartite workshop to formulate action plans for the development of a new industrial relations system in Indonesia as well as for dissemination to the tripartite constituents and the public at large.
One of the important reports envisioned at the start of the Project is a quantitative and qualitative analysis of the practical utilization of industrial relations mechanisms which should include collective bargaining agreements, their contents and coverage of workers; industrial disputes prevention and settlement, their methods, contents and time-frames; meetings of bipartite and tripartite bodies, their composition agendas, effectiveness, etc.
The present report has been prepared for the Project by Mr. Soewarto, a respected expert on industrial relations and former Director General of Industrial Relations and Labor Standards and Secretary General of the Ministry of Manpower and Transmigration.
The preparation of the report is in line with the Project objective of assisting the Indonesian tripartite constituents and other relevant organizations in having a better knowledge and understanding of the rights and responsibilities contained in the new legislation passed under the labor law reform program, as well as the ability to exercise these rights and responsibilities.
ANALISIS KUANTITATIF DAN KUALITATIF TENTANG PRAKTEK MEKANISME HUBUNGAN INDUSTRIAL
I.
PENDAHULUAN
1.
Informas! Latar Belakang Hubungan Industrial Indonesia
Sejarah perkembangan hubungan industrial di Indonesia mengalami berbagai perubahan sejalan dengan perubahan politik yang terjadi. Pada awal kemerdekaan sampai awal tahun tujuh puluhan diwamai dengan sistem hubungan industrial yang liberalistis.
Pada kurun waktu tersebut pekerja/buruh memperoleh
kebebasan
berserikat yang seluas-luasnya, bahkan sebagian besar serikat buruh merupakan bagian partai politik yang ada.
Pada era Orde Baru, demi menjaga stabilitas politik,
seluruh sistem
kemasyarakatan di bawah kendali pemerintah, termasuk sistem hubungan industrial. Mulai saat itu hubungan industrial berlandaskan pada falsafah negara Pancasila dimana inti pelaksanaan hubungan industrial bersemangatkan prinsip-prinsip non konflik
(cooperative
industrial
relations)
diantara
para
pelakunya,
yang
diterjemahkan ke dalam kaidah-kaidah kekeluargaan, gotong royong dan musyawarah untuk mencapai mufakat. Sistem ini juga dilandasi oleh filosofi sosial seperti : kerja juga merupakan bentuk pengabdian kepada Tuhan Yang Maha Esa, dan buruh bukan sekedar faktor produksi, tetapi
juga manusia dengan harkat dan martabatnya.

Gerakan serikat pekerja yang ada digiring untuk bergabung menjadi satu dalam bentuk federasi yang kemudian merupakan satu-satunya yang diakui oleh pemerintah.
Sayangnya prinsip yang baik tersebut dimanipulasi sebagai sarana menekan buruh untuk mengikuti kehendak pengusaha dan penguasa, melalui pengebirian hakhak dasar mereka, seperti hak berserikat, hak bemegoisasi dan hak mogok.
Sejak tahun 1998 dengan adanya gerakan reformasi
terjadi perubahan
mendasar dalam sikap po.litik bangsa Indonesia. Gerakan tersebut mengedepankan semangat demokrasi dan penghargaan terhadap hak azasi manusia. Sejalan dengan itu, Pemerintah juga menegaskan tentang kebebasan berserikat bagi masyarakat, termasuk bagi pekeija / buruh yang dibuktikan dengan meratifíkasi konvensi ILO no.87 th 1948 tentang Kebebasan Berserikat dan Perlindungan Hak Berorganisai, yang diikuti dengan dikeluarkannya UU No.21 th 2000 tentang Serikat Pekerja / Serikat Buruh. Undang-undang
tersebut
memberikan
kebebasan
yang
seluas-luasnya
bagi
pekerja/buruh untuk berserikat, sebagai penjabaran pasal 8 ayat 1 dan 2 dan konvensi ILO No.87/1948.
Sejalan dengan perubahan kebijakan tersebut, maka serikat buruh/serikat pekeija tumbuh dengan pesat, terutama di tingkat nasional.Pertumbuhan ini belum diikuti dengan perkembangan serikat buruh/serikat pekerja di tingkat perusahaan.
Pada dasamya sistem hubungan industrial yang diterapkan di Indonesia menganut prinsip tripartisme. Kerja sama dan konsultasi tripartit merupakan inti dari berbagai penetapan kebijakaan ketenagakerjaan, termasuk dalam bidang hubungan industrial. Dalam bidang ini Lembaga Kerja Sama Tripartit (LKS Tripartit) baik tingkat nasional
maupun tingkat daerah (propinsi dan kabupaten) telah lama
terbentuk dan pada umumnya telah melaksanakan fungsinya sebagai lembaga konsultasi. Dalam bidang lain, prinsip tripartisme juga diterapkan, misalnya lembaga penyelesaian perselisihan (P-4D dan P-4P) keanggotaannya juga mencerminkan unsur tripartit ini. Demikian pula berbagai badan ketenagakerjaan yang lain, seperti Dewan 2

Nasional,
dan
Dewan
Ketenagakerajaan
Daerah
keanggotaannya juga
mencerminkan tripartisme.
Dengan perkembangan serikat buruh/serikat pekerja yang pesat akhir-akhir ini, tripartisme di semua kelembagaan tersebut juga sedang dalam proses perubahan. Perubahan ini menyangkut
keanggotaan khususnya unsur yang mewakili serikat
pekerja/serikat buruh, sebagai akibat perkembangan serikat pekerja/serikat buruh yang terjadi.
2. Ruang Lingkup
Data yang dikumpulkan yang kemudian dianalisis adalah data sekunder untuk hal-hal tertentu dari 6 propinsi, ialah Sumatra Utara, Riau, DKI Jakarta, Jawa Barat, Jawa Timur, dan Kalimantan Timur. Bidang yang dianalisis meliputi perkembangan serikat
pekerja/serikat
buruh,
lembaga
kerja
sama
Bipartit
dan
Tripartit,
perkembangan perselisihan hubungan industrial dan penyelesaiannya, pemogokan dan PKB.
3. Keterbatasan dan Hambatan
Dengan adanya berbagai keterbatasan, maka hanya melakukan análisis terhadap data sekunder yang terkumpul di Depnaker Pusat dan P-4 Pusat. Namun demikian untuk melakukan cek silang (cross check) dilakukan pula pengolahan data tertentu yang dilakukan dengan sampel pada kantor Dinas Tenaga Kerja Kabupaten Tangerang, Kabupaten Bogor, Kabupaten Bekasi, Kota Jakarta Selatan, dan Kota Jakarta
Utara,
yang
masing-masing

seluruhnya 250 perusahaan atau sekitar 3% dari jumlah populasi 7.870 perusahaan. Di samping itu juga diolah data dari Kantor Dinas Tenaga Kerja Propinsi DKI Jakarta.

Hambatan pokok yang dihadapi dalam pengumpulan data adalah dipecahnya Kandep Tenaga Kerja menjadi Dinas Tenaga Kerja Kabupaten dan Kota, terutama di Tangerang, Bogor dan Bekasi. Di samping itu dengan kebijakan otonomi daerah, laporan dari daerah tidak berjalan sebagaimana yang diharapkan.
Secara umum disetiap tingkatan kator tidak melakukan pengolahan data secara baik dan akurat, sehingga tidak mudah untuk melakukan análisis. Sehingga análisis yang dilakukan juga tidak sepenuhnya akurat.
Data yang terkumpul kemudian diolah, yang hasilnya diwujudkan dalam tabulasi dasar. Analisis
dilakukan oleh sebuah tim yang didahului dengan diskusi
intensif yang membahas masalah-masalah tersebut sehingga menghasilkan laporan ini.
IL
PERKEMBANGAN SERIKAT PEKERJA/SERIKAT BURUH
A. Landasan Hukum dan Praktek Keserikatpekerjaan / Keserikatburuhan
Selama lebih kurang 30 tahun, Indonesia menganut serikat pekerja tunggal, baik di tingkat nasional maupun di tingkat perusahaan. Sejak diratifikasinya konvensi ILO no.
87
th.
1948
tentang Kebebasan Berserikat dan Perlindungan Hak
Berorganisasi dengan Keputusan Presiden no. 83 th
1998, maka Pemerintah
memberikan kebebasan seluas-luasnya bagi pekerja / buruh untuk berserikat.
Implikasi ratifikasi tersebut telah dirasakan terutama dengan pesatnya petumbuhan serikat pekerja / serikat buruh, khususnya di tingkat nasional. Pada saat ini tercatat 58 serikat pekerja / serikat buruh yang menyatakan diri sebagai federasi nasional. Jumlah serikat pekerja / serikat buruh tingkat perusahaan sekitar 11.000 dengan jumlah anggota lebih kurang 10 juta orang. Namun demikian belum

seluruhnya tercatat di instansi pemerintah ybs, sehingga belum sepenuhnya dapat melakukan fungsinya termasuk pembuatan PKB.
Dengan terbitnya UU no.21 th 2000 tentang Serikat Pekerja/Serikat Buruh, maka hak pekerja / buruh untuk berserikat lebih kuat lagi. Kesulitan pembentukan serikat pekerja di masa lalu sudah tidak lagi terjadi. Kesulitan yang mungkin timbul adalah persaingan di antara serikat pekerja / serikat buruh baik di tingkat perusahaan maupun tingkat yang lebih tinggi.
B.
Data Statistik Serikat Pekerja / Serikat Buruh
Dengan reformasi hukum keserikatpekerjaan / keserikatburuhan, maka terjadi pertumbuhan serikat pekerja tingkat nasional yang cukup besar. Tabel di bawah menunjukkan angka-angka perkembangan tersebut.

Dari data tersebut menunjukkan bahwa perkembangan federasi nasional serikat pekerja / serikat buruh mulai
terjadi
pada
tahun
1998,
ialah
tahun
diratifikasinya konvensi ILO no.87 th.1948. Hal ini menunjukkan bahwa para pekerja benar-benar memanfaatkan hak berserikat dengan diratifikasinya konvensi tersebut. 5
Selama 4 dari tahun 1997 - Juni th. 2001 federasi serikat pekerja / serikat buruh nasional berkembang dari 1 (pada saat itu FSPSI) menjadi 58 atau 5.800%.
Di lain pihak serikat pekerja / serikat buruh di tingkat perusahaan pada tahun 1998 sepertinya terjadi penurunan yang sangat drastis. Hal ini disebabkan terbitnya Peraturan Menteri Tenaga Kerja no.05/1998 tentang Pendaftaran Serikat Pekerja, sehingga angka 2.836 adalah jumlah serikat pekerja tingkat perusahaan yang terdaftar pada tahun tersebut, demikian pula pada tahun 1999 menunjukkan angka 6.360, dimana angka tersebut tidak menggambarkan angka yang sebenarnya. Pada tahun 2000 serikat pekerja / serikat buruh yang mendaftarkan telah mulai meningkat ialah menjadi 11.647 banyak dan tahun 2001 tercatat 15.725 yang merupakan angka yang realistis. Dengan demikian, pertumbuhan serikat pekerja / serikat buruh tingkat perusahaan selama 4 tahun dari tahun 1997 adalah 12.839 (pada saat itu hanya anggota FSPSI) menjadi 15.725 (22,48%). Perkembangan ini sangat jauh dari pertumbuhan serikat pekerja / serikat buruh nasional.

Perkembangan serikat pekerja / serikat buruh di wilayah DKI Jakarta dalam 3 tahun terakhir cukup besar, ialah dari 501 pada tahun 1998 menjadi 1.409 pada Juni 2001, atau naik 181,24%. Sebagai perbandingan, disajikan pula perkembangan serikat pekerja / serikat buruh yang terjadi di Kabupaten Tangerang.

Dari data tersebut menunjukkan bahwa perkembangan serikat pekerja / serikat buruh di Tangerang juga cukup pesat, ialah 240 pada tahun 1998 menjadi 602 pada Juni 2001 atau bertambah 150,83%.
III.
PERJANJIAN KERJA BERSAMA (PKB) DAN TRIPARTISME
A.
Lembaga Kerja Sama (LKS) Bipartit
1. Tugas dan Fungsi Tugas dan fungsi Lembaga Kerja Sama (LKS) Bipartit adaiah melakukan konsultasi dan komunikasi membahas tentang permasalahan dan mengantisipasi keluhan-keluhan dari para pekerja dan keinginan perusahaan. Tingginya jumlah kasus pemogokan dan perselisihan industrial menunjukkan belum atau kurang berfungsinya LKS Bipartit sebagai forum komunikasi dan konsultasi menyebabkan pekerja atau serikat pekerja cenderung menuntut daripada merundingkannya dengan pcngusaha apabila ingin meningkatkan kcscjahteraan.

Saat ini jumlah perusahaan yang mempunyai LKS Bipartit masih relatif rendah, tidak terkecuali di 6 propinsi yang menjadi target sasaran dari survey ini. Dibandingkan dengan jumlah perusahaan yang ada di 6 propinsi tersebut, rata-rata belum mencapai 20% yang memiliki LKS Bipartit.
Sementara LKS Bipartit yang telah terbentuk di perusahaan belum berfungsi sebagaimana yang diharapkan. Hai ini menunjukkan bahwa para pengusaha dan pekerja belum menyadari dan memahami tentang pentingnya peran LK Bipartit dalam rangka menumbuhkembangkan komunikasi antara pengusaha dan pekerja.
Dari data tersebut diatas, dapat dikemukakan bahwa jumlah LKS Bipartit telah terbentuk di 6 propinsi sebanyak 4.039 (atau 19,68%) dari 20.522 perusahaan. Tetapi tidak diketahui apakah lembaga tersebut melaksanakan fungsi dan tugasnya secara efektif. Tidak terdapat laporan kegiatan dari masing-masing propinsi. Data yang diperoleh di kantor pusat Depnakertrans hanya sekedar data kuantitatif. Secara presentase dari jumlah perusahaan, LKS Bipartit paling banyak di daerah Kaltim (33,19%), dan yang paling sedikit terdapat di daerah Jabar (14,52%).

Data yang terhimpun di Kabupaten Tangerang dari 50 sampel perusahaan, telah terbentuk lembaga Bipartit di 14 perusahaan (28%). Namun demikian hanya 3 perusahaan (21,43%) dari LKS Bipartit dan 6% dari jumlah perusahaan sampel yang cukup aktif melakukan pertemuan ialah 4 sampai 5 kali selama VA tahun terakhir. Materi yang dibahas juga cukup relevan dengan fungsinya, ialah deteksi dini masalah, produktifitas dan efisiensi, kualitas tempat kerja,, dan disiplin kerja. « B.
Lembaga Kerja Sama (LKS) Tripartit
Secara nasional di Indonesia terdapat dua jenis LKS Tripartit yaitu Tripartit (Umum) dan Tripartit Sektoral. Kedua lembaga tersebut seharusnya juga dibentuk di tingkat propinsi, tingkat kabupaten dan tingkat kota.
1. LKS Tripartit (Umum) Lembaga ini dibentuk berdasarkan Surat Keputusan Menteri Tenaga Kerja No.258 tahun 1984 yang keanggotaannya terdiri atas wakil-wakil pemerintah, pekerja, dan pengusaha. Pada awalnya wakil dari unsur pekerja dan pengusaha adalah masingmasing dari FSPSI dan APINDO. Dengan adanya perkembangan serikat pekerja sejak tahun 1999, ada pemikiran untuk menyempurnakan keanggotaan yang mewakili unsur pekerja, namum sampai saat ini belum dapat terlaksana.
Tugas LKS Tripartit adalah sebagai forum komunikasi dan konsultasi untuk meaimuskan kebijakan dibidang ketenagakerjaan. Hasil perumusan diajukan kepada pemerintah sebagai suatu masukan/saran untuk menetapkan kebijakan dibidang ketenagakerjaan.
Di 6 propinsi sampel LKS Tripartit (Umum) tclah tcrbcntuk di 98 kabupaten/ kota. Hasii-hasil kcgiatan konsultasi diajukan kepada kcpala dacrah masing-masing sebagai masukan/saran dalam menetapkan kebijaksanaan di bidang ketenagakerjaan.

Dengan adanya otonomi daerah maka kegiatan LKS Tripartit tidak dapat dipantau oleh pusat karena masing-masing daerah telah memiliki kewenangan sendiri.
2. LKS Tripartit (Umum) Tingkat Kabupaten/Kota Menurut data Direktorat BLHI Depnakertrans di tiap Kabupaten/Kota yang telah ada Kantor Departemen Tenaga kerja (lama) telah terbentuk LKS Tripartit (Umum), sehingga di seluruh Indonesia telah terbentuk sebanyak 98 LKS Tripartit (Umum). Untuk melengkapi informasi mengenai LKS Tripartit (Umum) ini telah dilakukan penelitian di 5 Kabupaten/Kota dengan hasil sebagai berikut:
a). Keanggotaan: Jumlah keanggotaan di tiap Kabupaten/Kota bervariasi namum tetap mewakili unsur-unsur pemerintah, pekerja, dan pengusaha. Di Kabupaten Bekasi yang mewakili pekerja, pengusaha, dan pemerintah masing-masing sebanyak 7 orang, ditambah 1 orang dari unsur lain-lain, sehingga seluruhnya berjumlah 22 orang. Di Kabupaten Tangerang, unsur pekerja dan pengusaha masing-masing 4 orang, dan unsur pemerintah 8 orang, sehingga jumlahnya 16 orang. Di Jakarta Selatan tidak diperoleh data mengenai keanggotaan ini. Di Jakarta Utara, keanggotaan LKS Tripartit masing10
masing 5 orang dari pekerja dan pengusaha, dan 10 orang dari pemerintah. Sedang di Kabupaten Bogor belum terbentuk LKS Tripartit karena merupakan pemerintahan bam dalam otoda.

b). Kegiatan: Dalam tahun 2000, di Kabupaten Bekasi melaksanakan persidangan lebih dari 5 (lima) kali, di Kabupaten Tangerang hanya 2(dua) kali dalam setahun, dan Jakarta Utara lebih dari 5 kali.
c). Materiyang Dibahas: Materi yang dibahas dalam persidangan LKS Tripartit, pada umumnya meliputi kebijakan membina ketenangan bekerja, inventasi dan perluasan kesempatan kerja, peningkatan produktifitas dan kualitas SDM, upah minimum serta antisipasi dan menyelesaikan unjuk rasa. Dengan demikian maka LKS Tipartit pada daerahdaerah tsb cukup aktif dan efektif.

3. LKS Tripartit Sektoral
a). Latar Belakang : Lembaga ini dibentuk berdasarkan surat Keputusan Menteri Tenaga Kerja No. 09 tahun 1994, sebagai suatu forum komunikasi dan konsultasi antara pemerintah, pekerja dan pengusaha sesuai dengan sektor masing-masing, baik di tingkat nasional, propinsi maupun kabupaten dan kota.
Berbeda dengan LKS Tripartit (umum) keanggotaan serikat pekerja dalam lembaga ini lebih beragam, bukan hanya diwakili oleh FSPSI saja, tetapi juga diwakili oleh serikat pekerja / serikat buruh yang sudah terbentuk di masing-masing sektor yang bersangkutan. Demikian pula dengan pengusaha, selain APINDO diwakili juga oleh asosiasi perusahaan lain dari sektor yang bersangkutan atas pengajuan dari Kadin.
b). Pembentukan LKS Tripartit Sektoral : Walaupun Keputusan Menteri Tenaga Kerja yang mengatur lembaga ini berlaku sejak 1994, namun kenyataannya LKS Tripartit Sektoral baru terbentuk pada tahun 2000 di tingkat pusat pada 7 sektor yaitu 1. perindustrian dan perdagangan, 2. perhubungan, 3. pemukiman dan prasarana wilayah keuangan, 4. pariwisata dan budaya, 5. pertambangan dan sumber daya energi, 6. pertanian, 7. perkebunan.

1. Latar Belakang Pemikiran Hak dan kewajiban yang timbul dalam setiap hubungan kerja, antara lain meliputi masalah perlindungan dan syarat-syarat kerja. Secara umum, perlindungan tenaga kerja telah diatur dalam berbagai peraturan perundang-undangan yang harus dilaksanakan oleh perusahaan. Hak dan kewajiban dalam lingkup syarat-syarat kerja diatur dan ditetapkan sendiri oleh masing-masing perusahaan.
Undang-undang No.21 tahun 1954 tentang Perjanjian Perburuhan mengatur bahwa syarat-syarat kerja dituangkan dalam bentuk Perjanjian Perburuhan yang dirundingkan oleh serikat buruh dengan pengusaha yang berlaku paling lama 2 tahun. Pada perusahaan yang belum berdiri serikat buruh, pengaturan syarat-syarat kerja dituangkan dalam bentuk Peraturan Perusahaan (PP), sesuai dengan Peraturan Menteri Tenaga Kerja Per-02/Men/1993.

rata-rata di 6 propinsi baru 64,71% dari 33.455 perusahaan yang
memiliki pekerja lebih dari 25 orang mengatur syarat-syarat kerja baik dengan PKB maupun peraturan perusahaan. Sebagian besar (50,88%) diatur dengan peraturan perusahaan, sedang sebagian kecil (13,83) dengan PKB. Hal ini menunjukkan bahwa perundingan PKB masih sangat sedikit, yang disebabkan serikat pekerja belum cukup mampu dan manajemen juga kurang menaruh perhatian.
Sebagai perbandingan disajikan data perkembangan PP dan PKB di wilayah DKI Jakarta.

Dari data tersebut menunjukkan bahwa perusahaan yang mengatur syarat kerja dengan PP maupun KKB masih sangat rendah ialah di bawah 50% dari jumlah perusahaan yang memiliki lebih dari 25 orang pekerja, walaupun dari tahun ke tahun mengalami peningkatan. Pengaturan syarat kerja dengan PKB sangat rendah ialah masih di bawah 5%. Hal ini juga menunjukkan bahwa serikat pekerja belum dapat melaksanakan fungsinya dengan baik.
Berdasarkan data sampel sejumlah 250 perusahaan dalam 5 wilayah kota Jakarta Selatan, Jakarta Utara, kabupaten Tangerang, Bekasi dan Bogor, pembentukan 14
PKB/PP terlihat lambat. Di perusahaan sampel tersebut telah terbentuk serikat pekerja / serikat buruh di 105 perusahaan dan dari jumlah tersebut baru terbentuk PKB 34 buah (32,38% dari jumlah SP). Sedang perusahaan yang baru membuat peraturan perusahaan sejumlah 45 buah (18% dari jumlah perusahaan).

Dari data pembentukan PKB tersebut dapat diperoleh gambaran bahwa serikat pekerja / serikat buruh belum sepenuhnya melaksanakan fungsi utamanya ialah merundingkan PKB. Sejumlah 171 perusahaan (68,4%) belum mengatur syarat-syarat kerja sehingga pekerja pada perusahaan tersebut belum memperoleh kepastian syarat kerjanya.
Sebagian besar perusahaan belum menyadari pelaksanaan peraturan
perundangan khususnya pembuatan peraturan perusahaan dan penegakan hukum juga lemah.
3. Proses Perundingan Pembuatan PKB Dari 34 PKB di perusahaan sampel wilayah Jabotabek, secara keseluruhan terbentuk dengan melalui perundingan secara Bipartit dan tercapai kata sepakat tanpa bantuan perantara. Kondisi tersebut menggambarkan bahwa antara pihak perusahaan

dengan serikat pekerja/serikat buruh telah terjalin komunikasi timbal balik dengan cukup baik. Secara rinci tergambar sebagai berikut:

4. Kualitas dan Isi PKB Dari sejumlah 34 PKB pada 5 (lima) Kota / Kabupaten di wilayah Jabotabek bila diteliti secara mendalam kualitasnya sudah cukup memadai karena hampir seluruhnya telah memuat barbagai syarat-syarat kerja yang tidak normatif, antara lain skala upah, peninjauan upah, upah sundulan, bonus, jaminan hari tua dan berbagai fasilitas kerja serta program pelatihan. Masih terdapat sebagian kecil yang memuat ketentuan peraturan perundangan-undangan, hal tersebut dimaksudkan sebagai penegasan, antara lain: waktu kerja, upah lembur, masa percobaan, THR, Jamsostek, dan lain-lain.
IV. PENYELESAIAN PERSELISIHAN HUBUNGAN INDUSTRIAL
A. Peraturan Perundang-Undangan dan Sistem Penyelesaian Perselisihan
Walaupun hubungan industrial di tingkat perusahaan sudah secara maksimum diusahakan sebaik-baiknya, tetapi harus dianggap wajar apabila masih terjadi perselisihan atau adanya ketidaksepahaman terhadap sesuatu. Untuk itu maka telah dibuat aturan penyelesaian, agar perselisihan tidak berkembang.

Perburuhan
memberikan gads tentang bagaimana menyelesaikan perselisihan yang timbul. Pada intinya, apabila timbul perselisihan harus diselesaikan oleh pihak yang berselisih, ialah serikat buruh dan majikan (pengusaha ybs) atau penyelesaian secara bipartit. Apabila dengan cara demikian tidak berhasil, maka penyelesaiannya dibantu oleh pagawai perantara atau melalui proses mediasi. Pegawai perantara hanya benvenang sebatas memberikan saran jalan penyelesaian, keputusan tetap berada pada pihakpihak yang berselisih.

Apabila satu atau kedua belah pihak yang berselisih tidak menerima keputusan tersebut, maka pegawai perantara meneruskan perselisihan ini ke Panitia Penyelesaian Perselisihan dan Perburuhan Dacrah (P-4D). Apabila keputusan P-4D tidak diterima maka mereka atau salah satu pihak dapat mengajukan
banding
ke Panitia
Penyelesaian Perselisihan Perburuhan Pusat (P-4P) untuk diambil keputusan. Menurut undang-undang ini keputusan P-4P adalah final kecuali memperoleh veto dari Menteri Perburuhan untuk dibatalkan atau ditunda dengan diberikan alasan yang kuat. Apabila tidak diveto, maka keputusan harus dilaksankan, apabila perlu dengan eksekusi pengadilan negeri.
Dengan berlakunya UU No.05 th 1986 tentang Peradilan Tata Usaha Negara, maka keputusan P-4P tidak lagi final karena dianggap sebagai keputusan tata usaha negara, sehingga salah satu pihak atau kedua belah pihak yang berselisih dapat megajukan gugatan ke Peradilan Tinggi Tata Usaha Negara (PTTUN). Keputusan PTTUN juga masih terbuka untuk diajukan kasasi ke Mahkamah Agung.
Di samping itu, untuk menyelesaikan kasus khusus tentang pemutusan hubungan kerja dilakukan dengan menggunakan UU no. 12 th
1964 tentang
Pemutusan Hubungan Kerja di Perusahaan Swasta.
B. Data Statistik dan Analisis

Data tersebut menunjukkan bahwa selama 1 Zi tahun dari Januari 2000 s/d Juni 2001 terjadi 2243 kasus yang masuk ke P-4P, terdiri dari 85 kasus (3,79%) banding tentang penyelesaian perselisihan hubungan industrial (PHI) dari P-4D 6 propinsi (Sumut, Riau, DKÍ Jakarta, Jabar, Jatim, dan Kaltim), dan 1468 kasus

(65,45%) banding tentang pemutusan hubungan kerja (PHK) perorangan dari 6 propinsi tersebut. Sebanyak 690 kasus (30,76%) adalah kasus PHK massai (meliputi 10 orang atau lebih). Dengan demikian maka sebagian besar atau 2.158 kasus (96,21%) kasus yang masuk ke P-4P adalah tentang PHK sehingga P-4P praktis bertugas menyelesaikan kasus PHK.
Dari 2243 kasus, sampai akhir Juni 2001 telah diputus 2143 (95,54%), dan sisanya 100 kasus (4,46%) masih dalam proses, dan tidak ada satupun yang diveto oleh Menteri Tenaga Kerja dan Transmigrasi. Hal ini menunjukkan bahwa menteri sepenuhnya

menganggap bahwa keputusan P-4P sudah dianggap wajar. Namun demikian, 264 (12,32%) keputusan P-4P digugat ke Peradilan Tinggi Tata Usaha Negara (PTTUN). Dengan kata lain masih ada sebagian kecil yang tidak puas atas keputusan P-4P.
Dari jumlah yang digugat ke PTTUN, 71 kasus (26,89%) diajukan oleh pekerja, sisanya
193 kasus (73,11%) diajukan oleh pihak pengusaha. Dengan
demikian maka yang paling tidak puas terhadap keputusan P-4P adalah pihak V pengusaha.
C. Perselisihan Hubungan Industrial
Data perselisihan di Kabupaten Bekasi dan Kabupaten Tangerang adalah sbb:

Dari 2.935 perusahaan tingkat menengah dan besar di kabupaten Bekasi dan kabupaten Tangerang, selama tahun 2000 - Juni 2001 terjadi 176 kaus perselisihan atau 5,99%. Secara keseluruhan dari jumlah kasus tersebut, 131 (74,43%) dapat diselesaikan oleh pegawai perantara. Dengan demikian dapat diambil kesimpulan bahwa pegawai perantara cukup efektif dalam menyelesaikan kasus perselisihan yang terjadi.
Sisa 41 kasus dari Kabupaten Bekasi (26,28%) tidak selesai di tingkat perantara dan diteruskan ke P-4D untuk mendapatkan keputusan. Dari 41 kasus yang tidak selesai tersebut 15 kasus (36,56%) tidak diterima oleh pekerja, sisanya 26 kasus (63,44%) tidak diterima oleh pengusaha. Dengan data tersebut menunjukkan bahwa saran yang diberikan oleh pegawai perantara,
pengusaha lebih banyak menolak
dibandingkan dengan pekerja (15 dibanding dengan 26).

Selama th 2000 - Juni 2001 di tiga daerah Bekasi, Tangerang, dan Bogor terjadi 158 kali pemogokan dimana 155 kasus (98,10%) dapat diselesaikan melalui

perundingan yang dibantu oleh pegawai perantara. Hal ini menunjukkan bahwa pegawai perantara sangat efektif membantu menyelesaikan pemogokan.
Data dari 3 kabupaten tersebut menunjukkan bahwa penyebab dominan terjadinya kasus pemogokan adalah hak-hak normatif pekerja, seperti: UMR, pembentukan SP, pembuatan PKB, upah lembur, Jamsostek, dan cuti, dan hal-hal non-normatif seperti: kenaikan upah, tunjangan makan, dan tunjangan transport. Dapat diambil
kesimpulan bahwa para pengusaha masih
belum
sepenuhnya
melaksanakan peraturan perundang-undangan.

Selama Januari - Juli 2001 terjadi 942 kasus pemutusan hubungan kerja di kabupaten Bekasi dan Tangerang, dimana 540 kasus (57,32%) dapat diselesaikan oleh pegawai perantara. Hal ini menunjukkan bahwa peranan pegawai perantara masih cukup
besar,
walaupun
tidak
seefektif penyelesaian
kasus
perselisihan
dan
pemogokan. Sedangkan P-4D memiliki peranan cukup, karena dapat menyelesaiakn 179 kasus (19,00%). Sisanya 15 kasus (1,59%) diselesaikan oleh P-4P dan 208 kasus masih dalam proses penyelesaian. 22

KESIMPULAN DAN SARAN
A. Kesimpulan
Sistem hubungan industrial di Indonesia senantiasa berubah, sebagaimana di negara lain tergantung antara lain dari sistem politik yang merupakan subsistem penyelenggaraan
ketatanegaraan.
Hal
ini juga
membawa
pengaruh
terhadap
keserikatpekerjaan. Pada era reformasi di mana kebebasan berserikat memperoleh kesempatan yang seluas-luasnya, terutama setelah diratifikasinya konvensi ILO no.87 th. 1948, maka serikat pekerja tumbuh dengan sangat pesât, terutama di tingkat nasional. Pertumbuhan serikat pekerja semakin didorong dengan terbitnya Undangundang no. 21 th. 2000. Dari tahun 1998 - Agustus 2001 federasi serikat pekerja nasional atau yang menyatakan diri sebagai federasi berkembang dari 1 menjadi 58 atau 5.800%.Namun demikian pertumbuhan serikat pekerja di tingkat perusahaan sangat jauh tertinggal dibanding dengan pertumbuhan serikat pekerja di tingkat nasional atau federasi. Serikat pekerja tingkat perusahaan justru menurun dari ±12.000 menjadi ±11.000 (-8,33%) pada période yang sama.
Lembaga kerja sama Bipartit yang dibentuk ditingkat perusahaan seharusnya dapat dimanfaatkan untuk mengembangkan komunikasi antara pekerja dan pengusaha dalam rangka membina hubungan yang serasi serta untuk mengantisipasi dan menyelesaikan berbagai masalah yang timbul temyata belum dapat berfungsi dengan baik. Lembaga ini telah terbentuk sebanyak 4.039 (19,68%) dari sejumlah 20.522 perusahaan di 6 propinsi (Sumatera Utara, Riau, DKI Jakarta, Jawa Barat, Jawa Timur, dan Kalimantan Timur). Tidak diperoleh informasi tentang efektivitas lembaga tersebut.
Diperoleh informasi bahwa LKS Tripartit tingkat propinsi yang besar umumnya telah berfungsi. Demikian pula LKS Tripartit kabupaten besar, seperti Bekasi dan Jakarta Utara dengan masing-masing melakukan sidang 5 kali, dan kabupaten Tangerang 2 kali dalam tahun 2000.

Perjanjian Kerja Bersama (PKB) jauh di bawah jumlah serikat pekerja. Pada tahun terakhir di wilayah Jabotabek dari 250 perusahaan sampel, telah berdiri serikat pekeija / serikat buruh di 105 perusahaan, tetapi jumlah PKB hanya 34 (32,38%) dari jumlah serikat pekerja / serikat buruh. Hal ini disebabkan serikat pekerja / serikat buruh belum memiliki kemampuan yang cukup untuk berunding membuat PKB. Kualitas PKB yang ada temyata cukup baik, terbukti dari data yang diolah dikawasan Jabotabek isi pasal-pasal yang ada cukup luas memuat syarat kerja, seperti: skala upah, peninjauan upah, upah sundulan, bonus, jaminan hari tua, dan lain-lain, dan hanya sebagian kecil yang memuat peraturan perundang-undangan. Perundingan PKB dapat diselesaikan secara bipartit,
dan tidak menimbulkan perselisihan yang
memerlukan bantuan pegawai perantara.
Sebagian besar perselisihan yang dibantu penyelesaiannya oleh pegawai perantara dapat diselesaikan. Dari 176 kasus perselisihan di Tangerang dan Bekasi % dapat diselesaikan oleh pegawai perantara sejumlah 131 kasus atau 74,43%. Mengenai pemogokan dari 158 kasus di Bekasi, Tangerang, dan Bogor pegawai perantara
dapat
menyelesaikan

98,10%.
Sedangkan
dalam
menyelesaikan kasus pemutusan hubungan kerja relatif peranan pegawai perantara lebih kecil, di Bekasi dan Tangerang dengan 942 kasus hanya dapat diselesaikan oleh pegawai perantara sebanyak 540 kasus atau 57,32%.
Kasus yang masuk ke Panitia Penyelesaian Perburuhan Pusat (P-4P) temyata sebagian besar mengenai penyelesaian PHK. Dari 2243 kasus yang masuk tahun 2000 - Juni 2001, diantaranya 690 (30,76%)) adalah kasus PHK massai. Sedangkan kasus banding dari P-4D mengenai pemutusan hubungan kerja perorangan adalah 1468 kasus (65,45%)). Sehingga seluruh kasus PHK yang masuk ke P-4P berjumlah 2158 kasus (96,21%)). Sisanya 85 kasus (3,79%) adalah banding perselisihan industrial dari P-4D.
Dengan berlakunya Undang-undang tentang Peradilan Tata Usaha Negara, maka keputusan P-4P dapat digugat ke PTTUN. Dari 2143 kasus yang diputus oleh P-4P, 264 kasus (12,32%) digugat ke PTTUN. Sebagaian besar dari gugatan yang 24
meliputi 193 kasus (73,12%) dilakukan oleh pengusaha yang merasa dirugikan oleh keputusan P-4P, dan sisanya yang 71 kasus (26,88%) dilakukan oleh pekerja. Sementara ini tidak ada keputusan P-4P yang diveto oleh menteri.
Pemogokan dan perselisihan hubungan industrial masih sering terjadi, di Bekasi, Tangerang dan Bogor, dengan penyebab dominan adalah UMR, pembentukan SP, pembuatan PKB, upah lembur, Jamsostek, dan cuti, dan hal-hal non-normatif seperti: kenaikan upah, tunjangan makan, dan tunjangan transport. Dapat diambil kesimpulan bahwa para pengusaha masih belum sepenuhnya melaksanakan peraturan perundang-undangan, dan pekerja menuntut perbaikan kesejahteraan.
B.
Saran

Melakukan pembenahan sistem pencatatan, pengolahan dan análisis data di setiap tingkat kantor yang menangani ketenagakerjaan.
2. Melakukan program pendidikan bagi pembekalan mereka yang terkait dengan masalah perburuhan, khususnya para pimpinan serikat pekerja tentang berbagai
subjek
keserikatburuhan,
terutama
tentang
PKB.
Pendidikan
semacam ini juga diperlukan bagi kalangan pimpinan perusahaan dan aparat pemerintah yang menangani masalah ini. 3. Menerbitkan buku pegangan dan petunjuk tentang Lembaga Kerja Sama Bipartit untuk dimanfaatkan oleh pekerja dan pengusaha. 4. Meningkatkan penegakan hukum untuk mencegah terjadinya pelanggaran peraturan perundang-undangan. 5. Mendorong pembentukan lembaga tripartit sektoral di tingkat Propinsi dan Kabupaten/Kota

AN ANALYSIS OF THE PRACTICAL UTILIZATION OF INDUSTRIAL RELATIONS MECHANISM
I.
INTRODUCTION
1. Background Information on Industrial Relations
The history of industrial relations in Indonesia is illustrated by many changes from time to time. The influences of political and economical environment are so closely inter-related. Since the early of independence period of this country up to the early of 1970's, industrial relations system in Indonesia was coloured by liberal approach. During this period, workers enjoyed their freedom of association in wide term; moreover most labour unions belonged to the existing political parties.
During the new order period, in order to maintain political stability, all community system, including industrial relations system was under control of the government. Since then industrial relations was based on the state philosophy, Pancasila (Five Principles) in which implementation of industrial industrial
relations relations)

inspired
by
transformed
non-conflict principles into
brotherhood
(cooperative
norms,
mutual
cooperation, and deliberation to reach a consensus. This system was also based on social philosophy that work is form of dedication to the God Almighty, and workers are not merely production factors but human being with their sovereignty and dignity. The existing trade union movement was » to be unionized into federation that was the only union acknowledged by the government.

Unfortunately these good principles were manipulated to depress workers so as meet interests of employers and the executive executors by ignoring their basic rights such as right to negotiate and to strike.
Since 1998, in line with reformation movement, basic changes of Indonesian political approach are transpired. This movement situates spirits of democracy and respect to basic right of human being into priority. In line with this condition, the government emphasizes right to organize of the people, including workers/labour. This is proved by ratification of ILO Convention
No.
87/1948
concerning
Freedom
Of
Association
And
Protection Of The Right To Organize and issuance of Act No. 21 of 2000 on Workers' Union/Trade Union. The Act secures freedom of association in wide term for workers/labour, as transformation of Article 8, paragraph (1) and (2) of he ILO Convention No. 87/1948.
In line with the mentioned changes of policy, workers' union/trade union is growing fast, particularly at national level. The growth of workers' union/trade union is not accompanied yet by development of workers' union/trade union at company level.
Basically, industrial relations system implemented in Indonesia is based
on
tripartite
mechanism
principle.
Tripartite
cooperative
and
consultative mechanism is the main principle of various manpower policies, including policies on industrial relations.
In this respect, Cooperative
Tripartite Body (LKS Tripartit) at national and regional levels (provinces and districts) has been established long time ago and in general speaking, has carried out its function as consultative body.
Tripartite mechanism principle is also implemented in other aspects or by existing manpower institutions such as by Central/Regional Committee for Industrial Dispute Settlement (P4P/P4D), National Council for Wages 2
Research (DPPN), National Council for Job Training (DLKN) and Regional Council for Manpower Matters (DKD)
in which the membership is
represented by tripartite constituents.
Tripartite mechanism principle in all institutions is changing in line with the fast growing of workers' union/trade union recently, particularly in respect with membership representing their interests.
2. Scope
The analyzed data in this study are based on secondary source that collected from 6 provinces namely Riau, North Sumatra, Jakarta, West Java, East Java, and East Kalimantan. The analysis is focused on certain fields covering development of workers' union/trade"union; Bipartite and Tripartite Cooperative Body; industrial dispute settlement; strikes; and Collective Labour Agreement.
3. Limitation and Hindrance
Due to various constraints, this survey analysis the secondary data compiled
in
the
Head
Quarter
of the
Ministry
of
Manpower
Transmigration and in the Central Committee for Industrial
and
Disputes
Settlement (P4P). However, for the purpose of cross check, this survey analysis sampling data collected from the Manpower District Offices of Tangerang, Bogor, Bekasi, Manpower Municipality Offices of South Jakarta, and North Jakarta. The sample is 250 companies consisting of 50 companies of each district or totally 3% of the population of 7,870 companies. This survey also analysis data collected from Manpower District Office of DKI Jakarta.

The District hindrance in collecting data is expanded Manpower District Office into Manpower Office at District and at Municipality levels, particularly in Tangerang, Bekasi, and Bogor. Furthermore, in line with implementation of regional autonomy, report by each region does not run as expected.
In general, each office does not carry out well data compilation and analysis, so as analysis carried out in this project seems to find difficulties.
Analysis on the collected data in this project is presented in basic data tabulation carried out by a team prior to intensive discussion on the related matters.
II.
TRADE UNION DEVELOPMENT
A. Legal Basis and Practices of Trade Unions
For more than 30 years, Indonesia had been experienced with single trade union at both national and plant levels. After ratification of ILO Convention No. 87 of 1948 on Freedom of Association and Protection of Right to
Organize
under Presidential
Decree
No.
83
of 1998,
the
government secures freedom of association in wide term to workers.
Implication of the ratification can be seen from the fast growing of trade union, particularly at national level. Recently, it is recorded that a number of 58 federations of trade union and exist at national level. Meanwhile, there is a number of 15,725 plant level trade unions with about 10 millions members. However, since the number of plant level trade unions is not completely recorded yet at the government institutions concerned,

they are not fully able to carry out their functions, including function to establish Collective Labour Agreement.
Issuance of Act No. 21 of 2000 on Workers' Union/Trade Union strengthens the workers' right to organize. There is no more constraint to establish trade union as before. However, problem that might arise is high competitive atmosphere among trade unions themselves at plant or higher level.
B. Basic Statistics on Workers' / Trade Unions

The figure shows that development of national federation of trade union began in 1998, the year of ratification of ILO Convention No. 87 of 1948. This illustrates that workers fully utilized their right to organize as after ratification of the convention. Within 4 years period of 1997 - June 2001 trade union has been developed significantly from only 1 trade union (only FSPSI at the time) to a number of 58 trade unions or increased by 5,800 %. 5
On the other side, number of workers' union/trade union at plant level in 1998 decreased drastically caused by issuance of manpower Ministerial Regulation No. 05 of 1998 on Registration of Workers' Union that resulted only number of 2,836 trade unions at plant level registered in this year as well as a number of 6,360 trade unions at plant level registered in the year of 1999, these numbers are not realistic. In 2000, number of workers' union/trade union registered increased remarkably to 11,647 and in 2001 the number increased to 15,725, these are realistic numbers.
The figure shows that number of workers' union/trade union at plant level within 4 years increased from 12,839 in 1997 (only members of FSPSI at the time) to 15,725 in 2001 or by 22,48%. Table 2 Development of Trade Union in Jakarta 1998 - June 2001

The above data shows that number of workers' union/trade union in Tangerang also increased noticeably from 240 in 1998 to 602 in 2001 or by 150,83 %.
III.
COLLECTIVE BARGAINING AND TRIPARTISM
A. BIPARTITE COOPERATIVE BODY 1.
Duties and Functions Duties and functions of Bipartite Cooperative Body is to carry out
consultation and communication; discussion on related matters; and to anticipate complaints of workers as well as interests of the companies. High number of strikes and industrial disputes shows that ^his body does not yet function as a forum of communication and consultation. This condition caused workers or trade union tends to demand their right rather than to discuss their interests with employers.

Number of Bipartite Cooperative Body established in companies recently is relatively small, including those are in six provinces as the target group of this survey. Compared to number of companies in those provinces, number of Bipartite Cooperative Body established is less than 20%.
Meanwhile, the existing Bipartite Cooperative Body do not yet function
as
expected.
This
condition
shows that both workers
and
employers do not fully realize and understand the important role of Bipartite Cooperative Body in extending and developing communication between employers and workers.
The above data shows that a number of 4,039 Bipartite Cooperative Bodies (or 19.68%) of a number of 20,522 companies at 6 provinces has been
established.
However,
do
they
function
effectively
is
still
a
questionable. There is no record available on their activities in each province. The data compiled in the head quarter of Department of Manpower and Transmigration
is
merely quantitative
in
sense.
The
percentage shows that the biggest number of Bipartite Cooperative Body exists in East Kalimantan (33.19%) and the smallest number exists in West Java (14.52%)
Data
available
in
district of Tangerang
shows
that Bipartite
Cooperative Body established in 14 companies (28%) among 50 sampling companies. However, only 3 or 21.4% of the existing number of Bipartite Cooperative Body and 6% of number of the sampling companies those actively conduct 4 to 5 meetings during the last one and half years. Meanwhile issues of discussion are considerable relevant to their functions, those are relating with early detection of problems,
productivity and
efficiency, working place quality/condition, and working discipline.

B. Tripartite Cooperative Body
In Indonesia Tripartite Cooperative Body is classified into two different types those are Tripartite Cooperative Body (in General term) and Sectoral Tripartite Cooperative Body. By ideal concept, this body should also be established at the levels of province, district and municipality.
1. Tripartite Cooperative Body (in General term)
This
body
of
which
the
membership
consists
of
tripartite
constituents, the government, workers, and employers is established on the base of Manpower Ministerial Decision No. 258 of 1984. At the beginning, representative of workers derived from FSPSI and representative of employers derived from APINDO. In line with development of trade union since 1999, development of membership representing workers side comes into re-consideration, however, this idea is not materialized yet.
Tripartite Cooperative Body is a forum of communication and consultation on employment issues that provides inputs to the government for further policy formulation on manpower.
A number of 98 Tripartite Cooperative Bodies (in General term) has been
established
in

Inputs

through
consultation in each province were submitted to the head of region concerned for further manpower policy formulation.

Membership Number of member is varied from one District/Municipality to
another, but the composition remains representing tripartite constituents, the government, workers, and employers. Number of member of this body in the District of Bekasi is 22 people consist of each 7 representatives from the 10
government, workers, and employers and 1

constituent. In the district of Tangerang, a number of 16 members consist of 8 representatives from the government and, 4 representatives from each constituent of workers and employers. Meanwhile the membership of this body in North Jakarta consists of 5 members from each constituent of workers and employers, and 10 members from the government. Tripartite Cooperative Body in the districts of Bogor and Tangerang is not established yet as these two districts are in new regional autonomy. Activities Within the year of 2000, it is noted that this body in the district of
Bekasi and in North Jakarta conducted more than 5 meetings; meanwhile the District of Tangerang only held 2 meetings.

Issues of Discussion Issues of discussion in the Tripartite Cooperative Body meetings in
general include policies on industrial peace, investment, and extension of employment opportunity,
improvement of productivity and
of human
resources quality, minimum wage and anticipation as well as settlement of strikes.
It can be concluded that Tripartite Cooperative Body in the 11
mentioned regions is active and effective in carrying out its function and activity.
3. Sectoral Tripartite Cooperative Body
a)
Background This body is established on the base of Manpower Ministerial
Decision No. 09 of 1994 as forum of communication and consultation among government, workers and employers of each sector, at the levels of national, province, and district and municipality.
This body is different from Tripartite Cooperative Body (in General term); membership of this body is more various, not represented by only FSPSI, but also by trade union/workers' union of each sector concerned.
The same goes for membership of employer's constituent, other than represented by APINDO, this body is also represented by companies' association of the concerned sector on prior application of KADIN (Chamber of Commerce and Industry).
b)
Establishment of Sectoral Tripartite Cooperative Body. Although
the
Manpower
Ministerial
Decision
regulating
the
existence of this body has come into force since 1994, however, Sectoral Tripartite Cooperative Body has just been established in 7 sectors at central level in 2000, namely: 1. 2. 3. 4. 5. 6. 7.
sector of industry and trade; sector of communication; sector of regional development and financial facilities; sector of tourism and culture; sector of mining and energy resources; sector of agriculture; sector of plantation.

C. Collective Labour Agreements 1. Basic Idea
Right and obligation/duty arisen by existence of industrial relations among others are concerning with protection of workers and working conditions. In general, protection of workers is regulated under various pertaining legislations to be complied by companies. Right and obligation / duty concerning working conditions is regulated by the company concerned.
Act No. 21 of 1954 on Labour Agreement regulates that working conditions shall be stipulated under Labour Agreement prior to negotiation
between
trade
union
and
the »company
concerned
(Collective Labour Agreement) that comes into force for 2 years. In the company where trade union is not established yet, working conditions shall be stipulated under Company Regulation as regulated under Manpower Ministerial Regulation No. Per-02/Men/1993.

The above statistics show that although number of companies regulating their working conditions under Company Regulation and Collective Labour Agreement is increasing almost every year, however, it is still very small, less than 50% of number of companies employing more than 25 workers. Meanwhile, regulation of working conditions under Collective Labour Agreement is also very small, less than 5%. This gives a figure that trade union is not able yet to fully carry out its function. 14

A number of 171 companies (68.4%) do not regulate their working conditions so as workers of the companies concerned are not yet obviously secured. Most of companies are not yet aware on implementation of the existing legislation, particularly on establishment of Company Regulation and enforcement of this regulation is weak.

3. Negotiation Agreement
Process
of
Establishment

Labour
All of 34 Collective Labour Agreements of the sampling companies in the regions of Jakarta, Bogor, Tangerang and Bekasi are established through Bipartite negotiation/consultation to reach a consensus without any assistance by mediator. This condition shows that two-way communication between employers and trade unions is sufficiently effective. Further detail description is as presented in the Table 10 and Table 11 below. There is no available data in the provinces of Riau and North Sumatera. The above data also shows that establishment of 24 Collective Labour Agreements in the sampling provinces done without assistance by mediators.
4. Quality and Content of Collective Labour Agreement
Based on deep assessment, quality of 34 Collective Labour Agreements
in
5
sampling
districts/municipalities
of Jakarta,
Bogor,
Tangerang, and Bekasi is considered sufficient as they contain various working conditions, which among others are wage scale, wage review, wage level, higher than the minimum wage, bonus, old-age benefit, and other working facilities as well as training programmes. A few of them include certain provisions of legislation that is intended as accentuation to their regulations such as working hours, overtime payment, probation period, feast-day allowance, social security, and so forth.
SETTLEMENT OF INDUSTRIAL DISPUTE
A.
Legal Basis and System of Dispute Settlement Although
industrial
relations
at
plant
level
have
been
well
implemented, but it has to be recognized that dispute may be occurred due to miss-understanding on a certain subject. For this reason, there should be regulation on dispute settlement to avoid dispute become expanded or serious.
Act no. 22 of 1957 on Settlement of Labour Dispute gives guidance on how to settle labour dispute. The essential content is, if dispute happens it has to be settled by the disputing parties, that is trade union and employer concerned, or called as settlement through bipartite

mechanism. If this kind of settlement is failed, the next step is helped by mediator. The function of mediator is only limited in giving advice for the settlement of dispute, and the decision has to be made by both disputing parties.
In the case of one or both disputing parties could not accept the advice given by the mediator, the mediator has to submit the dispute to the Regional Committee for the Settlement of Labour Dispute (P-4D). If the decision made by the P-4D is not acceptable, one or both disputing parties could appeal to the Central Committee for the Settlement of Labour Dispute (P-4P) for decision. According to this law, the decision of P-4P is final, provided it is vetoed by the Minister of Labour for being cancelled or postponed with strong justification. In case the Minister does not veto, the P-4P decision has to be implemented,
if it is felt necessary, the
implementation of this decision can be brought to Civil Court for execution.
Since the time when
the
law
no.05
year
1986
on
Public
Administration Court came into effect, the decision of P-4P is not final any more, it is due to the consideration that the decision is the decision of administration authority. There fore, one party or both parties could charge the decision to the Administration High Court (PTTUN). The decision of PTTUN is still possible to be appealed to the Supreme Court.
Beside
that,
for the
settlement
of case
on
termination
of
employment, act no. 12 of 1964 on The termination of Employment in Private Company has to be implemented.

This data shows that during 1 V* years from January 2000 - June 2001 there were 2,243 cases which had to be solved by P-4P, consisting of 85
(3.79%) cases
of appeal on labor disputes from P-4D of 6
provinces (North Sumatra, Riau, Jakarta, West Java, East Java, and East Kalimantan), and 1,468 (65.45%) cases of appeal on individual termination of employment from the said 6 provinces. There fore, most of cases (2,158 cases or 96.21%)
brought to the P-4P were cases on termination of
employment, and practically, the major function of P-4P is to settle cases on termination of employment.
Out of 2,243 cases in P-4P up to the end of June 2001, 2,143 cases (95.54%) has been decided and the remaining of 100 cases (4.46%) are still in process, and there is no decision made by P-4P is vetoed by the Minister. It shows that the Minister fully rely on the P-4P in making decision, and it is meant that there is no intervention from the government, or the Minister recognizes that the decision made by the P4P has been fair enough. But in reality, there are still 264 (12.32%) of P4P decision are charged to the PTTUN. In other words, there are minor parts of those decision did not satisfy the disputing parties.
Out of the 264 total cases which were charged to the PTTUN, 71 cases (26.89%) were charged by workers and the rest 193 cases (73.11%) by employers. It means that the disputing party who were more unsatisfied with the decision made by P-4P were the employers.

Out of the total 2,935 medium and big companies in District of Bekasi and District of Tangerang there were 176 cases (5.99%) of labour disputes in the year of 2000 up to June 2001. Out of those cases, 131 cases (74.43%) were able to be solved through mediation process. The conclusion is that the role of mediators were effective enough in helping the settlement of labour disputes.
The remaining 41 cases in District of Bekasi (26.28%) can not be settled through mediation process and then be brought to P-4D for decision. Out of 41 cases above, 15 cases (36.56%) were unacceptable by workers, and the other 26 cases (63.44%) were rejected by employers. The data shows that advice given by mediator were mostly unacceptable by employers instead of workers (26 compared to 15).

During the year 2000 - June 2001 in three districts of Bekasi, Tangerang, and Bogor happened 158 cases of strikes, out of them 155 cases (98.10%) were able to be solved through negotiation which were assisted by mediators. It shows that the mediator functioned effectively in helping solve cases of labour strikes.
Data from the 3 districts proved that labour strikes were caused mainly on violation of labour legislation and regulations, such as : minimum wage, establishment of trade union, formation / negotiation of collective agreement, over time payment, social security, and leave, and other condition of employment, such as : wage increase, meal allowance, and transportation allowance. The conclusion is that the employers did not fully
implement labour laws and regulations.

From January - July 2001 there were 942 cases on termination of employment in District of Bekasi and District of Tangerang, out of them 540 cases (57.32%) can be solved through mediation process. It also the other evidence that the role of mediators still significant although they were not as effective as their role in the case of labour disputes and labour strikes. The role of P-4D still important, it could settle 179 cases (19.00%), and the other 15 cases (1.59%) were solved by P-4P. The remaining 208 cases were still in process of settlement.
V. CONCLUSIONS AND RECOMMENDATIONS
A.
Conclusions
The industrial relations system in Indonesia is always changed, as in other countries depends on the practice of political system, which is the subsystem of the state policy. This condition also influences the labour union movement. In the era of reformation, freedom of association is fully guaranteed and respected especially after the- ILO Convention no.87 of 1948 was ratified, the labour union grows rapidly at the national level. The growth of labour unions have also been encouraged by the Law No.21 of 23
2000 on Trade Union. Since 1997 until August 2001, the national federation of trade unions have grown
from 1 become 58 or 5,800%.
However, the growth of trade unions at company level is left behind compare to the labour union at national or federation level. The number of labour union at company level grows from 12,839 became 15,725 (22,48%) during the period.
Ideally, Bipartite body, which is established at company level, can be used as a means for effective communication between workers and employers for developing
and
maintaining
good
relation
and
also
anticipating and solving problems. But in reality, this body is unable to function well. This bodies have already been established in 4,039 (19.68%) out of 20,522 companies in 6 provinces (North Sumatra, Riau, Jakarta, West Java, East Java, and East Kalimantan). There is no information about the activity of those bodies.
On the other hand, the Tripartite body in big provinces
have
already functioned well. This well functioning of this body also happened in certain big districts and municipal level, such as Bekasi, and North Jakarta, which respectively conducted five times meetings, and this body of Tangerang carried out two times of meeting in the year of 2000.
The number of collective labour agreements is far bellow the number of trade
unions. During the last year in the area of Jabotabek
there had been formed 105 plant level unions out of 250 companies of sample, but there were only 34 collective labour agreements (32.38%) out of the total
105 trade unions. It is due to the lack of capability of trade
unions in negotiation for collective labour agreement. The quality of the collective labour agreements contents were good enough, it is evident that according to the processed data of
Jabotabek, most of the articles of
collective labour agreements stipulate a wide range of condition of 24
employment, such as : wage scale, wage review, amount of wage above the minimum wage, bonus, old age benefit, etc. and only a minor part of collective labour agreements mention about labour legislation. All of the collective labour agreements could be accomplished through bipartite negotiation, without creating dispute which need to be helped by mediator.
Most of the settlement of labour disputes
which were helped by
mediators could be well solved. Out of 176 dispute cases happened in Tangerang and Bekasi, 131 cases (74.43%) were able to be settled by mediators. In the case of labour strikes, out of 158 cases in Bekasi, Tangerang and Bogor, 155 cases (98.10%) could be settled by mediators. In the case of termination of employment the role of mediators were relatively smaller, in Bekasi and Tangerang out of 942 cases mediators could only help solving 540 cases (57.32%).
Most of cases brought to the P-4P were on termination of employment. Out of 2,243 cases in the year of 2000 - June 2001, 690 cases (30.76%) were cases on mass termination of employment. Cases of appeal from P-4D on individual termination of employment were 1,468 (65.45%). The total number of cases on termination of employment were 2,158 (96.21%), and the rest of 85 cases (3.79%) were appeal cases from P-4D's on industrial disputes.
Under the Law no.05 of 1986 on the Court of Public Administration, decision of the P-4P can be charged to the High Court of Public Administration (PTTUN). Out of 2,143 cases which had been decided by the P-4P, 264 cases (12.32%) were charged to the PTTUN. Most of the charges, 193 cases (73.12%) were done by employers, and the remaining of 71 cases (26.88%) were conducted by workers. On the other side there was no case vetoed by the Minister.

Labour strikes and industrial disputes were frequently happened, the dominant cause of those cases in Bekasi, Tangerang, and Bogor were minimum wage, establishing of trade union, forming of CLA, over time payment,
social
security,
and
leave,
and some other condition of
employment such as wage Increase, meal allowance, and transportation allowance. The conclusion is that employers did not implement labour legislation well, and workers demanding better welfare.
B. Recommendations
1. System of recording, processing, and analyzing of data has to be improved in all levels of offices which are concern in the field of labour.
2. Conducting education programs on all aspect of trade unionism particularly on CLA for whom whose functions relate to labour subject, especially trade union leaders. This kind of education has also to be conducted for employers and government officials.
3. Publishing manual and guidance book on Bipartite Co-operation Body for being used by workers and employers.
4. Improving of law enforcement to avoid violation of law and regulation.
5. Encouraging the formation of Sectoral Tripartite Body at provincial, district and municipality level through socialization of this subject for the anticipation labour problems faced by the respective industrial sector concern.
