Considering
:
whereas in order to implement the provision of Article 27 paragraph (5) Government Regulation Number 55 Year 2005 concerning Balancing Fund, there is a need to stipulate Regulation of the Minister of Finance concerning Estimated Profit Sharing Fund Allocation of Natural Resources of Petroleum Mining for Fiscal Year 2013;

REGULATION OF THE MINISTER OF FINANCE OF THE REPUBLIC OF INDONESIA CONCERNING ESTIMATED PROFIT SHARING FUND ALLOCATION OF NATURAL RESOURCES OF PETROLEUM MINING FOR FISCAL YEAR 2013 Article 1 Estimated Profit Sharing Fund Allocation of Natural Resources of Petroleum Mining (DBH SDA Migas) for Fiscal Year 2013 is based on estimated revenue of SDA Migas as set forth in Act Number 19 Year 2012 concerning State Budget for Fiscal Year 2013. Article 2 (1) Estimated allocation of SDA DBH Migas as referred to in the Article 1 is for Rp32,139,690,090,000.00 (thirty two trillion one hundred and thirty-nine billion six hundred and ninety million ninety thousand rupiah) in the following detail: a. DBH SDA of Oil in a portion of 15.5 % (fifteen point five percent) for Rp18,017,455,989,000.00 (eighteen trillion seventeen billion four hundred and fifty-five million nine hundred and eighty-nine thousand rupiah) consisting of: 1. DBH SDA of Oil in a portion of 15% (fifteen percent ) for Rp17,442,624,380,000.00 (seventeen trillion four hundred and forty-two billion six hundred and twenty-four million three hundred and eighty thousand rupiah); and 2. DBH SDA of Oil in a portion of 0.5% (zero point five percent) for Rp574,831,609,000.00 (five hundred seventy-four billion eight hundred and thirty-one million six hundred and nine thousand rupiah) which is referred to the use of additional

DBH SDA of Gas in a portion of 30.5 % (thirty point five percent) for Rp14,122,234,101,000.00 (fourteen trillion one hundred and twenty-two billion two hundred and thirty-four million one hundred and one thousand rupiah) consisting of: 1. DBH SDA of Gas in a portion of 30% (thirty percent) for Rp13,897,093,074,000.00 (thirteen trillion eight hundred and ninety-seven billion ninety-three million seventy-four thousand rupiah); and 2. DBH SDA of Gas in a portion of 0.5% (zero point five percent) for Rp225,141,027,000.00 (two hundred and twenty-five billion one hundred and forty-one million twenty-seven thousand rupiah) which is referred to the use of additional education budget. (2) Estimated allocation of DBH SDA Migas is a part of DBH SDA Migas as set forth in Act Number 19 Year 2012 concerning the State Budget for Fiscal Year 2013, which is set forth in consideration of revenue realization of SDA Migas per region for the last three (3) fiscal years. (3) The detail of estimated allocation of SDA DBH Migas for Fiscal Year 2013 to provinces and regencies/municipalities are denoted in the Appendix, as an integral part of this Ministerial Regulation. (4) In case of a change in the assumption of macroeconomic indicators, the estimated allocation of SDA DBH Migas as referred to in paragraph (1) shall be necessarily adjusted. Article 3 (1) Distribution of SDA DBH Migas shall be made on a quarterly basis. (2) Distribution of SDA DBH Migas for the First Quarter and Second Quarter shall be made for twenty percent (20%) of the estimated allocation ceiling as denoted in the Appendix, an integral part of this Ministerial Regulation. (3) Distribution of DBH SDA Migas as referred to in paragraph (2) is further calculated with the revenue

-4realization of DBH SDA Migas for the third and fourth quarters. (4) Distribution of DBH SDA Migas as referred to in paragraph (1) shall be based on the calculation of data reconciliation mechanism between the central government and the producing region. (5) The distribution procedure of SDA DBH Migas shall be made in accordance with regulation of law. Article 4 In the event the estimated allocation ceiling of DBH SDA Migas for Fiscal Year 2013 is insufficient for the distribution or realization exceeding the State Budget ceiling for Fiscal Year 2013, the Government shall distribute the allocation of DBH SDA Migas based on revenue realization in accordance with regulation of law. Article 5 This Regulation of the Minister of Finance shall come into force on the date of its promulgation. For public cognizance, this Regulation of the Minister of Finance shall be promulgated by placing it in State Gazette of the Republic of Indonesia.
