Terms and conditions 1. All Vendors and Purchasers will be deemed to have full knowledge of the terms and conditions and the Purchaser to have heard and understood the Auctioneers description of the Lot offered. 2. The Auctioneer may at his discretion refuse to accept or withdraw either entry or bidding from any persons or person. 3. The highest bidder for each Lot shall be the Purchaser save that, In the event of a dispute arising as to the final bid, the Lot shall be immediately put up for sale again at the last undisputed bidding. 4. No Lot shall be transferred to another person before the Purchaser has made full payment for the Lot. Every lot must be paid on the day of the auction. 5. Neither the Vendor nor the Purchaser of a Lot shall have any remedy against the Auctioneer in respect of the Lot. The Auctioneer acts as an agent only in inviting bids for the Lot. 6. Sales can be made privately, providing that the animal has first been offered by auction and an agreed fee is paid in to the office and a receipt is obtained. Any person, both buyer and seller failing to do this will be refused any further business and not allowed on the sale ground, and commission will be claimed on the reserve price of the Lot. 7. Persons buying or selling a Lot privately must satisfy themselves that commission has been paid to the office; otherwise the Lot in question will not be allowed to be taken from the sale yard until commission has been paid. 8. The Auctioneer does not give any warranty as to the seller's title or good right to sell, save that the entry has been accepted by the Auctioneer in good faith and without express knowledge of any defect in the Seller's title. 9. If any Purchaser fails to comply with any of these conditions or with any other conditions shown here, the Lot or Lots in respect of which such failure is made, may, if the Auctioneer thinks fit be put up again and resold. If upon such resale a lower price is obtained for any of such Lots than was obtained on the first sale, the difference in price plus all additional expenses shall be a debt due from the Purchaser in default upon the first sale. 10. WARRANTY. All entries sold with warranty: the Vendor declares that the given information (medical examination and/or x-rays) is truthful, complete and correct (see also 14.descriptions). Rigs, crib-biters, defects in wind and eyes, must be declared by the Vendor and must not be lame. Otherwise the

Terms and conditions Lot can be returned by the Purchaser by 2pm on the day following the sale. Complaints have to be made within 3 days before 5.00pm following the sale. There is no warranty whatsoever on unwarranted Lots. 11. All complaints regarding Lots sold with a Warranty must be notified by telephone: Tel. +44 7958 033573 or +32 496 651389 Office hours or Evenings and Weekends within the Warranty time as Rule 10. These times must be strictly adhered to. 12. Complaints made after the time stated will not under any circumstances be entertained and the Purchaser will be bound to keep the Lot and will have no claim for damages or otherwise against any person in respect of the Lot. 13. In the event of a complaint on any Lot and such complaint being upheld then the Lot must be immediately returned to the Auctioneer's premises at the sole cost of the Purchaser. No allowance will be made for the cost of transport or feed. Should the Purchaser or the Vendor request a qualified Veterinary opinion be required to settle any dispute, then payment for the opinion shall be recoverable from the person proved by the Veterinary Surgeon to be wrong or at fault (i.e. If the animal is proved to be lame, the vendor will be responsible for costs, if the animal is proved not to be lame then the purchaser will be liable for costs), should arbitration be required to settle any dispute. 14. DESCRIPTIONS. • Horses described as HUNTERS must be sound in wind and eyes, quiet to ride, and capable of being Hunted. Horses described as "regularly ridden and driven" must be quiet. • HACKS must be quiet to ride and sound in action. • HORSES described as "believed to be sound" or "believed in foal" shall NOT constitute a warranty. • The word "Sound" shall constitute a warranty of Sound in wind, eyes, heart and action only. Horses described as good or fine movers or having good action must not be lame. • Horses described as "quiet to ride" must be capable of being ridden and not lame. • Horses that have been de-nerved must be announced as such in the catalogue and must not be sold with any description that carries a warranty. Any horse which is tubed or otherwise operated on for unsoundness in wind must be de-

Terms and conditions scribed as such in the catalogue. • Horses described as "SHOW JUMPERS" must be capable of show jumping and not lame. • Horses described with X-RAYS must have x-rays taken by an official vet. Our auction vet can check these before the auction starts. The x-rays are as presented by the Vendor, ASW Equine does not warrant the results of the x -rays being good or not good. • Every warranted horse will do a trot up at the day of the auction and the auction vet will take a blood sample. • Should any horse be sent or entered in the catalogue with description not mentioned in this condition, the Auctioneer may decide as to whether it constitutes a warranty. 15. CATALOGUE The Auction will not be answerable in respect of any errors which may occur in the catalogue. Nor in respect of any condition, warranty, representation or description of any Lot sold, neither will the Vendor be answerable for any condition, warranty, representation or description representing any Lot for sale made otherwise than in the catalogue or by the Auctioneer at the time of sale. A missdescription of any horse as to age, height, sex, colour or pedigree shall not entitle the Purchaser to make any claim to compensation or return of the horse. Descriptions and pedigree are supplied by the Vendor who alone shall be responsible for their accuracy. 16. Any Lot taken from the sale before payment will be treated as stolen by the auctioneer and the matter reported to the Police. 17. Each Lot shall be entirely at the owners risk from entering the Lot at the Auction premises and shall be at the Purchasers risk immediately upon the fall of the hammer. The Auction and staff will not be responsible for loss or injury or death of any animal or article on the sale premises. 18. Payment will only be paid to the person who has entered the Lot in the sale and transfer to other persons will not be recognised. Purchasers must make full payment for Lots purchased and transfer of Lots to other persons before payment will not be permitted under any circum-

Notwithstanding a Lot having been knocked down to a Purchaser at the Auction neither the ownership nor the possession in the Lot shall pass to such Purchaser until the full purchase price has been paid. 20. Should a horse not be sold by the Auction, the Auctioneer reserves the right on the sale day to negotiate the sale of that Lot by private treaty to any interested party at the reserve price of the Lot without reference from the Vendor. 21. All Vendors will be deemed to have full knowledge of the Auctioneer rates of commission, which are obtained from the Auctioneer or the entry office or website. Full commission will be payable by the Vendor in respect of any Lot returnable under the conditions in respect of complaints and any subsequent arbitration. 22. Ill treatment of animals will not be tolerated therefore the use of whips and sticks are prohibited 23. All Lots must be cleared from the premises on the day of the sale unless alternative arrangements have been made with the Auctioneers. (please contact the auctioneers before the auction starts) 24. COMMISSION RATES Vendors: 10% (plus VAT at the current rate for corporate vendors) Buyers Premium 7% (plus VAT at the current rate for corporate vendors) 25. Cassidy's Father Commander (by Con air x Calvados) was ridden as a 7 year old by Christof Cleeren before he was sold to China. Her mother Pamira also gave Aruba van 't Winkenshof (Approved stallion by Amoroso van de Helle) who was sold to the USA by Lieven Van de Craen.
