INDEPENDENT AUDITOR’S REPORT We have audited the accompanying statement of financial position of The Association for Community and EcologicBased Law Reform as of December 31, 2011 and 2010, the related statements of activities and cash flows for the years then ended. These financial statements are the responsibility of the Foundation’s management. Our responsibility is to express an opinion on these financial statements based on our audits.

Kami telah mengaudit laporan posisi keuangan Perkumpulan untuk Pembaharuan Hukum Berbasis Masyarakat dan Ekologis 31 Desember 2011 dan 2010, dan laporan aktivitas serta laporan arus kas untuk tahuntahun yang berakhir pada tanggal-tanggal tersebut. Laporan keuangan adalah tanggung jawab Pengurus. Tanggung jawab kami terletak pada pernyataan pendapat atas laporan keuangan berdasarkan audit kami.

We conducted our audit in accordance with auditing standards established by the Indonesian Institute of Certified Public Accountants. Those standards require that we plan and perform the audit to obtain reasonable assurance about whether the financial statements are free of material misstatement. An audit includes examining, on a test basis, evidence supporting the amounts and disclosures in the financial statements. An audit also includes assessing the accounting principles used and significant estimates made by management, as well as evaluating the overall financial statement presentation. We believe that our audit provide a reasonable basis for our opinion.

Kami melaksanakan audit berdasarkan standar auditing yang ditetapkan Institut Akuntan Publik Indonesia. Standar tersebut mengharuskan kami merencanakan dan melaksanakan audit agar kami memperoleh keyakinan yang memadai bahwa laporan keuangan bebas dari salah saji yang material. Suatu audit meliputi pemeriksaan, atas dasar pengujian, bukti-bukti yang mendukung jumlah-jumlah dan pengungkapan dalam laporan keuangan. Audit juga meliputi penilaian atas prinsip akuntansi yang digunakan dan estimasi signifikan yang dibuat oleh manajemen serta penilaian terhadap penyajian laporan keuangan secara keseluruhan. Kami yakin bahwa audit kami memberikan dasar memadai untuk menyatakan pendapat.

In our opinion, the financial statements referred to above present fairly, in all material respects, the financial position of The Association for Community and Ecologic-Based Law Reform as of December 31, 2011 and 2010 and the results of its activities and its cash flows for the years then ended in conformity with Indonesian financial accounting standard for NonPublicly-Accountable Entities.

Menurut pendapat kami, laporan keuangan yang kami sebut diatas menyajikan secara wajar, dalam semua hal yang material, posisi keuangan Perkumpulan untuk Pembaharuan Hukum Berbasis Masyarakat dan Ekologis tanggal 31 Desember 2011 dan 2010, dan hasil aktivitas serta arus kas untuk tahun-tahun yang berakhir pada tanggal-tanggal tersebut sesuai dengan standar akuntansi keuangan entitas tanpa akuntabilitas publik (PSAK ETAP).

A. GENERAL

A. UMUM

The Association for Community and Ecology Based Law Reform (on behalf "HuMa") was founded in Gadog, West Java dated October 19, 2001 and formalized in Jakarta dated October 29, 2001 by notarial deed no.19, made and executed by H. Abu Jusuf, SH., number 23, dated 23 Oktober 2001. The deed was changed accordance to the notary deed no. 24 dated October 18, 2005, made and executed by H. Abu Jusuf, SH.

Perkumpulan untuk Pembaharuan Hukum Berbasis Masyarakat (selanjutnya disebut "HuMa") didirikan di Gadog, Jawa Barat pada tanggal 19 Oktober 2001 dan disahkan di Jakarta dengan Akta Notaris H. Abu Jusuf, SH., nomor 23 tanggal 29 Oktober 2001. Akta ini berubah sesuai dengan Akta Notaris H. Abu Jusuf, SH., nomor 24 pada tanggal 18 Oktober 2005.

Vision of HuMa is to accomplish the community-based legal system underline by human right values, justice, cultural diversity and ecosystem conservation in the Indonesian Archipelago.

Visi dari HuMa adalah mewujudkan sistem hukum yang berbasis masyarakat dan didasari oleh nilai-nilai hak-hak asasi manusia, keadilan, keanekaragaman budaya dan kelestarian ekosistem di seluruh Nusantara.

As HuMa established by a number of individuals who are originated from various NGOs, both national and local, and academics who have been working on alternative law fields for sometime, the program were designed to complement their ongoing efforts. The implementations of the planned activitiesare subject to strong coordination with the members and partners organization in each particular region. At the national level, HuMa implement it's program both individually and also through the various network organizations.

Pembentukan HuMa merupakan inisiatif dari dan hasil proses releksi bersama antar beberapa penggiat dari berbagai wilayah dan nasional, proses-proses tersebut melibatkan organisasi non pemerintah yang bergerak dalam kegiatankegiatan pengembangan sumber daya hukum rakyat khususnya yang berkaitan dengan isu tanah dan sumber daya alam lainnya, dan akademisi progresif yang diyakini akan mampu membangun sinergi sehingga dapat berperan secara strategis dalam proses pembaharuan hukum di Indonesia.

B. RINGKASAN KEBIJAKAN AKUNTANSI

A summary of significant accounting policies adopted by the HuMa, which affect the determination of its financial position and results of its activities, is present below:

Berikut ini adalah pokok-pokok kebijakan akuntansi yang penting yang diterapkan HuMa, yang sangat memberikan pengaruh terhadap posisi keuangan dan hasil aktivitas, disajikan sebagai berikut: 4

Financial statements presentation

The HuMa’s books and accounts are presented on a historical cash concept. The financial statements are prepare in accordance with the Statement of Financial Accounting Standards No. 45 (revised 2009), Financial Reporting of Non-Profit Organization.

Pencatatan dan pembukuan HuMa dengan konsep “historical cash”. Laporan keuangan dibuat sesuai dengan Pernyataan Standar Akuntansi Keuangan (revisi 2009) Nomor 45 tentang Pelaporan Keuangan untuk Entitas Nirlaba.

The financial statement based on PSAK 45 was preparing and classifying based on whether or not there are restrictions imposed by donors, namely (1) permanent restricted, (2) temporary restricted, and (3) unrestricted.

Laporan keuangan menurut PSAK 45 akan menyajikan jumlah masing-masing kelompok aset bersih berdasarkan ada tidaknya pembatasan oleh penyumbang, yaitu (1) terikat permanent, (2) terikat sementara, dan (3) tidak terikat.

Permanent restricted means any restrictions on resources use that confirm by donors in order to those resource can be preserved permanently.

Pembatasan yang bersifat permanen adalah pembatasan penggunaan sumber daya yang ditetapkan oleh penyumbang agar sumber daya tersebut dipertahankan secara permanen.

Temporary restricted means any restrictions on resources use that confirm by donors in order to those resource can be preserved permanently for specific period or time until a specific condition is met.

Pembatasan yang bersifat sementara adalah pembatasan penggunaan sumber daya oleh penyumbang yang menetapkan agar sumber daya tersebut dipertahankan untuk periode tertentu atau sampai terpenuhinya keadaan tertentu.

Unrestricted donation is means a donation that no restriction resources use by donors.

Sumbangan tidak terikat adalah sumber daya yang penggunaannya tidak dibatasi untuk tujuan tertentu oleh penyumbang.

The statement of cash flow have been prepared using indirect method by classifying cash flows into operating, investing and financing activities.

Laporan arus kas disusun menggunakan metode tidak langsung dengan mengelompokkan arus kas dari aktivitas operasi, investasi dan pendanaan.

The reporting currency used in the financial statements in Indonesian Rupiah.

Mata uang pelaporan yang digunakan dalam laporan keuangan adalah Rupiah.

Accounting basis

The accounting basis used to present the financial statement is a Accrual Basis. 3.

Basis akuntansi Basis akuntansi yang digunakan untuk menyajikan laporan keuangan adalah Basis Akrual.

Advance payment

Advance payment represent payment of operating and program activities which have not been declared by the employee. These advance payment will be charged to operation for the year after declaration.

Uang muka adalah pengambilan uang untuk kebutuhan operasional dan program yang belum dipertanggungjawabkan. Uang muka akan dibebankan apabila uang muka tersebut telah digunakan dan telah dipertanggungjawabkan.

Fixed assets

Aset tetap

Fixed assets were stated at cost, less accumulated depreciation. However, the recognition of fixed asset following the restrictions that exist under PSAK 45.For the restrictions that are permanent and temporary, the purchase of fixed asset funded from the donors has not been recognized as fixed assets during the applicable restriction period. The fixed assets will be recognized when the restriction period ends and transfer of ownership from the donors to the HuMa.

Aset tetap diakui sebesar harga perolehan, setelah dikurangi akumulasi penyusutan. Namun demikian, pengakuan aset tetap mengikuti pembatasan yang ada menurut PSAK 45. Untuk pembatasan yang bersifat permanen dan sementara, pembelian aset tetap yang didanai dari penyumbang belum diakui sebagai aset tetap selama periode pembatasan yang berlaku. Aset tetap baru diakui pada saat periode pembatasan berakhir dan terjadi pengalihan kepemilikan dari penyumbang ke HuMa.

The cost of maintenance and repairs were charged to operation as incurred; significant renewals and betterments were capitalized. When assets were retired or otherwise disposed, their carrying values and the related accumulated depreciation were removed from the accounts. Any resulting gain or loss was reflected in the current operations.

Aset tetap yang tidak dipergunakan lagi atau yang dijual dikeluarkan dari kelompok aset tetap berikut akumulasi peyusutannya. Keuntungan dan kerugian dari penjualan set tetap dibukukan ke dalam laporan laba rugi tahun berjalan.

Receive and disbursement

Penerimaan dan pengeluaran

The HuMa receipt consist of incoming money from donation/grant and revenue. Receive is recognized when the agreement has an approved both of third parties and HuMa.

Penerimaan HuMa terdiri dari uang masuk dari sumbangan/ hibah dan pendapatan. Penerimaan diakui pada saat kontrak perjanjian ditandatangani kedua belah pihak.

The HuMa disbursement represent all of expense for program, operational and fundraising. Disbursement is recognized as accrual when these are incurred.

Pengeluaran HuMa merupakan biaya untuk program, operasional dan penggalangan dana. Biaya dibebankan secara akrual pada saat terjadi transaksi.

Taxation

Based on law no. 10 year 1994 with recently had been amended with the law no.36 year 2008 concerning the estimated income tax, the donation receipt from the grant or donor for foundation or similar organization is not a tax object as long it does not have connection between the donor and receiver.

Perpajakan Berdasarkan Undang-undang nomor 10 tahun 1994 yang telah diubah dengan Undang-undang nomor 36 tahun 2008 tentang pajak penghasilan, bantuan atau donasi yang diterima dari donor bagi yayasan maupun organisasi sejenis bukan merupakan objek pajak sepanjang tidak memiliki hubungan antar pemberi dan penerima donor.

Foreign currency transactions

Transaksi mata uang asing

The HuMa's transactions invoiving foreign currencies are recorded at the rate of exchange prevailling at the date of transactions are made. At balance sheet date assets and liabilities denominated in foreign currencies are adjusted to reflect the rate exchange prevailing at such date. The resulting gains or losses on foreign exchange transaction and translation balance sheet items are credited or charged to current operation.

HuMa menyelenggarakan pembukuannya dalam mata uang rupiah. Transaksi-transaksi dalam mata uang asing yang terjadi sepanjang tahun dicatat dengan nilai kurs pada saat realisasi transaksi. Pada tanggal neraca, seluruh aktiva dan kewajiban dalam mata uang asing dijabarkan ke dalam rupiah dengan menggunakan nilai kurs tengah yang ditetapkan oleh Bank Indonesia. Selisih yang timbul akibat penjabaran tersebut dicatat sebagai laba atau rugi tahun berjalan.
