Ez a dokumentum összegzi az Emberi Jogi Albizottság (DROI) hatodik parlamenti ciklus alatti tevékenységeit (2004–2009). Részletezi a különböző földrajzi régiók által érintett témák széles körét, számos tematikus kérdést és az emberi jogi terület fontos eseményeit. E jelentés összefoglalja az albizottság ötéves tevékenységének azon elemeit, amelyekkel jelentős mértékben hozzájárult az Európai Parlament munkájához.

Bevezetés Az Európai Parlament az emberi jogok és a demokrácia ügyének egyre fontosabb szószólójává vált. Állásfoglalásai, jelentései, harmadik országbeli missziói, emberi jogi rendezvényei, harmadik országokkal létrehozott parlamentközi küldöttségei és közös parlamenti bizottságai, írásbeli és szóbeli kérdései, egyedi kérdésekben való különleges meghallgatásai és az évenként odaítélt Szaharov-díj révén hozzájárul az emberi jogi politikák kialakításához, végrehajtásához és értékeléséhez. Ezen kívül az Európai Parlament elnöke rendszeresen tárgyal emberi jogi kérdésekről harmadik országok képviselőivel. Az Emberi Jogi Albizottság, amelyet a hatodik parlamenti ciklus kezdetekor 2004-ben Hélène Flautre (Zöldek/ALE) elnöklete alatt indítottak újra, az emberi jogi kérdésekkel kapcsolatos megbeszélések központjává vált a Parlamentben. Számos parlamenti kezdeményezést tett e témában, és állandó fórumot biztosított a többi uniós intézménnyel, az ENSZ különleges jelentéstevőivel és az ENSZ Fejlesztési Programjának (UNDP) képviselőivel, az Európa Tanáccsal, kormányképviselőkkel, emberi jogi aktivistákkal és nem kormányzati szervezetekkel az EU-n kívüli országok emberi jogi helyzetéről és demokratikus fejlődéséről folytatott megbeszélésekhez. Küldöttségei meglátogattak egyes EU-s tagságot kérelmező harmadik országokat (Törökországot és Horvátországot). Az albizottság egyik fő célja, hogy hozzájáruljon ahhoz, hogy az emberi jogi kérdéseket az EU külkapcsolatainak és az EP vonatkozó tevékenységeinek valamennyi vonatkozásában érvényre juttassák. Ezt többek között az EP harmadik országokkal létrehozott parlamentközi küldöttségei számára készített iránymutatásokkal próbálta megvalósítani. Nagy erőfeszítéseket tett az uniós emberi jogi eszközök végrehajtásának figyelemmel kísérésére és értékelésére. E tekintetben az albizottság különös hangsúlyt helyezett az „Európai Kezdeményezés a Demokráciáért és az Emberi Jogokért” uniós pénzügyi eszközének, valamint az emberi jogi kérdésekre vonatkozó európai uniós iránymutatások végrehajtására. A hatodik parlamenti ciklus alatt különösen a halálbüntetésről szóló iránymutatásokra, a kínzásról szóló iránymutatásokra és az emberi jogi párbeszédről szóló iránymutatásokra összpontosítottak.

Főbb érintett témák 1. Hatáskör és tagság - Hatáskörök Az Emberi Jogi Albizottságot (DROI) a Külügyi Bizottság albizottságaként indították újra 2004ben. Az albizottság fő hatáskörét az Európai Parlament eljárási szabályzata I. szakasza VI. mellékletének 5. pontja határozza meg. „- harmadik országokban az emberi jogokat, a kisebbségek védelmét és a demokratikus értékek támogatását érintő ügyek: Ezzel összefüggésben a [Külügyi] Bizottságot az Emberi Jogi Albizottság segíti. A vonatkozó szabályok sérelme nélkül az egyéb bizottságok, illetve szervek ezen területen hatáskörrel rendelkező képviselőit, illetve tagjait hívják meg az albizottság ülésein való részvételre.” - Tagság

Az albizottság az Európai Parlament 32 képviselőjéből állt, akiket 32 póttag képviselhet. Az albizottság munkájával kapcsolatos főbb határozatokat (napirendek, küldöttségek, megvitatandó kérdések) az albizottság kibővített Elnöksége hozta meg, amely Hélène Flautre elnökből, a négy alelnökből – Richard Howitt (PSE), Patrick Gaubert (PPE-DE), Sarah Ludford (ALDE), Jozef Pinior (PSE) – és hét koordinátorból állt, akik egy-egy képviselőcsoportot képviseltek: Laima Andrikiene (PPE-DE), aki 2007-ben Simon Coveney-t váltotta fel, Raimon Obiols i Germa (PSE), aki 2007-ben Elena Valencianót váltotta fel; Marco Cappato (ALDE), Raul Romeva i Rueda (Verts/ALE), Vittorio Agnoletto (GUE/NGL), Inese Vaidere (UEN) és Irena Belohorska (NI). 2. Az uniós emberi jogi eszközök végrehajtásának értékelése: a Bizottság és a Tanács elszámoltathatóvá tétele Az albizottság egyik fő feladata a demokrácia előmozdítása és az emberi jogok terén, uniós szinten hozzáférhető különböző eszközök (pénzügyi eszközök, emberi jogi iránymutatások, emberi jogi párbeszédek, valamint az EP és a Tanács jelentései) végrehajtásának elemzése és a megfelelő utólagos intézkedések meghozatala. Amellett, hogy az albizottság elemzi és értékeli az emberi jogok és a demokrácia területének uniós politikáját, feladata a Bizottság és a Tanács elszámoltathatóvá tétele is. Az albizottság ezért minden erőfeszítést megtett az Európai Bizottsággal és az Európai Unió Tanácsával való folyamatos párbeszéd fenntartásának biztosítása érdekében. Az albizottság megfogalmazta álláspontját az emberi jogi területen folytatott tevékenységeikkel kapcsolatban, ellenőrizte, hogy az emberi jogi terület gyakran közös megállapodásban rögzített prioritásait milyen mértékben teljesítették, és cselekvésre buzdította őket abban az esetben, amikor közös stratégiára vagy közös fellépésre volt szükség. A Bizottságot valamennyi ülésünkön a Külkapcsolatok (RELEX) Főigazgatóságának emberi jogi osztálya (B1) képviselte. Az EU egymást követő, hivatalban lévő elnökségei rendszeresen részt vettek az albizottság ülésein, akiket a Tanács emberi jogi kérdésekkel foglalkozó munkacsoportjának (COHOM) elnöke vagy az elnöklő tagállam más hivatalos személye képviselte. Javier Solana nevében Michael Matthiessen, majd 2007-től Dr. Riina Kionka a KKBP főképviselőjének emberi jogi személyes képviselője számos alkalommal jelen volt és aktívan részt vett az albizottság munkájában. 2004 óta arra is felkérik az albizottság elnökét, hogy vegyen részt a Tanács emberi jogi kérdésekkel foglalkozó munkacsoportjának (COHOM) ülésein, valamint a Tanács békével és biztonsággal foglalkozó munkacsoportjának (COPS) nem hivatalos üzleti ebédjein. Ugyancsak 2004-ben vezette be az albizottság azt az új eljárást, amely lehetővé teszi az egyes képviselők számára, hogy bizonyos emberi jogi témákban kérdéseket intézhessenek a Bizottsághoz. 2004 és 2009 között összesen 96 kérdést nyújtottak be, amelyek nagyrészt konkrét országokra (például Kubára, Kínára, Észak-Afrikára, Törökországra) vagy horizontális emberi jogi kérdésekre összpontosítottak, így például a büntetlenségre, a halálbüntetésre és egyes emberi jogok megsértésére. 3. Az emberi jogokról szóló uniós iránymutatás Az emberi jogok előmozdításának területén az Unió nyolc iránymutatást fogadott el: az emberi jogok védelmezői számára biztosított védelemről, a kínzás megelőzéséről, a halálbüntetés elleni küzdelemről, a gyermekek fegyveres konfliktusban való védelméről, a harmadik országokkal folytatott strukturált emberi jogi párbeszédekről, a nemzetközi humanitárius jogról (IHL), valamint legutóbb a gyermekek jogainak védelméről (2007-ben) és a nőkkel és kislányokkal szembeni erőszakról (2008-ban) szólókat. 2005-ben az albizottság eszmecserét folytatott az emberi jogok védelmezői számára biztosított védelemről szóló iránymutatásokról és megbeszélést tartott Hina Jilanival, az ENSZ emberi jogok védelmezőivel foglalkozó különleges jelentéstevőjével. 2006-ban az albizottság megkapta a kínzásról szóló iránymutatások végrehajtásáról készült tanulmányt. Ennek következtetéseiben számos konkrét javaslatot fogalmaztak meg a Bizottság számára valamennyi emberi jogi iránymutatás hatékonysága növelésének és átdolgozásának módjáról. Ennek eredményeképpen jó néhány előremutató fejlesztést hajtottak végre: az iránymutatásokat felülvizsgálták és módosították, az uniós küldöttségek és tisztviselők képzéseken vettek részt az iránymutatások hatékony alkalmazásával kapcsolatban, valamint több iránymutatást lefordítottak arab, kínai, farszi és orosz nyelvre. Mindazonáltal még sok tennivaló akad az iránymutatások végrehajtásának további fejlesztése terén.

4. Emberi jogi párbeszédek és konzultációk Az albizottság által megrendelt, az Unió – Kínával, Oroszországgal, az AKCS-államokkal, a szomszédos országokkal, Latin-Amerikával és Iránnak folytatott – kétoldalú emberi jogi párbeszédjeiről és konzultációiról szóló hat tanulmánya, valamint a Parlament Jogi Szolgálatának jogi szakvéleménye alapján Elena Valenciano Martínez-Orozco (PSE) európai parlamenti képviselő elkészítette azt a parlamenti jelentést1, amelyben értékelte az Unió harmadik országokkal folytatott emberi jogi párbeszédjeinek és konzultációinak hatékonyságát. A jelentés részletesen elemezte az emberi jogi párbeszédek és konzultációk különböző fajtáit, például a Kínával folytatott strukturált párbeszédet, az Oroszországgal folytatott konzultációkat, az Üzbegisztánnal folytatott új, partnerségi és együttműködési megállapodáson alapuló párbeszédet, valamint az afrikai, karibi és csendes-óceáni országokkal (AKCS) folytatott politikai párbeszédet és esetleges, „a 96. cikk alapján folytatott konzultációkat”. A dokumentum a párbeszéd javítására irányuló ajánlásokat is tartalmazott, különösen az átláthatóság és a publicitás növelésével, valamint az EU intézményközi koherenciájának fejlesztésével és az Európai Parlament szerepének fokozásával. Az albizottság rendszeresen zártkörű megbeszéléseket szervezett az előkészületekről, majd újbóli megbeszéléseket a főbb párbeszédek eredményeiről, különösen Kínára, Oroszországra és Üzbegisztánra, valamint a déli szomszédos országokra összpontosítva, és néha eszmecserére hívta az EU-trojka képviselőit és a megfelelő interparlamentáris delegációk elnökét az albizottság rendes üléseinek részeként. Valenciano-jelentés ajánlásainak nyomon követéseként bevezettek egy új gyakorlatot, amely szerint nem hivatalos bizalmas megbeszéléseket folytatnak a párbeszédek fordulóiról, ahol a trojka képviselői bizalmas módon tájékoztatják az érdeklődő parlamenti képviselőket. A 2007–2008 közötti időszakban összesen öt ilyen ülést tartottak a Kínával, az Afrikai Unióval, az Egyiptommal, az Izraellel és az Üzbegisztánnal folytatott párbeszédekről. Az új eljárásnak köszönhetően az Európai Parlament tájékozottabbá vált és így nagyobb befolyást képes gyakorolni az Unió emberi jogi párbeszédeire és konzultációira. Emellett a titkárságot rendszeresen meghívták az EU és Kína között folytatott párbeszédek, valamint az Unió és a nem kormányzati szervezetek ülései alatt tartott jogi szemináriumokra az Oroszországgal folytatott konzultációkat megelőzően. 5. Emberi jogi záradékok A DROI/AFET-bizottságnak az Európai Unió harmadik országokkal kötött megállapodásaiban szereplő emberi jogi záradékokról szóló első saját kezdeményezésű jelentését2 Vittorio Agnoletto parlamenti képviselő készítette el 2006-ban, amelyben a képviselő a harmadik országokkal kötött megállapodásokban szereplő emberi jogi és demokráciazáradékok működését, azok hiányosságait elemezte, valamint javaslatokat tett azok hatékonyságának javítására. Az egyik főbb javaslat a Cotonou-i Megállapodás 9. és 96. cikkére épülő konzultációs eljárásra vonatkozó hatékonyabb 1

mechanizmusok kifejlesztésére irányult. 6. Az Unió emberi jogi politikájának részét képező szankciók 2008-ban az albizottság jelentéstervezetet készített az emberi jogok területének uniós szankcióiról3 (előadó: Hélène Flautre), amelyben a Parlament felhívta az Európai Uniót arra, hogy a szankciókat – mint a külpolitika eszközeit – ésszerűbben alkalmazza, hangsúlyozva, hogy nagyobb összhangra van szükség a szankciók alkalmazása tekintetében, amelyet például alaposabb elemzéssel és hatásvizsgálatokkal lehet elérni, valamint hogy szükség van az Unió szankcióinak hatékonyabbá tételére, többek között a szankciók elfogadása előtt minden egyes konkrét helyzet mélyreható elemzésével, valamint a szankciók felfüggesztésének feltételeit jelentő világos és egyedi viszonyítási pontok meghatározásával. Az emberi jogi záradékokról és párbeszédekről szóló jelentések mellett e jelentés az Unió külpolitikájának főbb emberi jogi eszközeit értékelő „trilógia” alapvető elemét képezi és alapját jelenti az e tekintetben tett előrelépések Európai Parlament általi jövőbeni ellenőrzésének. Az albizottság 2009 eleji ülésén a Bizottság kijelentette, hogy a parlamenti képviselőknek lényeges információkkal kell rendelkezniük a legújabban kiszabott vagy meghoszabbított szankciók vonatkozásában. A többi intézmény úgy vélte, hogy a független szakértők hálózatának hasznossága további vizsgálatot igényel. A szankciós jogalkotás (feketelistázás és listáról történő törlés) tekintetében a Bizottság bejelentette, hogy javaslatokat vagy szükség esetén lépéseket fog tenni annak érdekében, hogy a listára való felvételre vonatkozó eljárásokat összhangba hozza a vonatkozó esetjoggal. 7. Az EIDHR és a költségvetési ellenőrzés Az Európai Parlament a demokráciáért és az emberi jogokért indított európai kezdeményezés (EIDHR) albizottsági munkacsoportján keresztül arra használta költségvetési hatásköreit, hogy jelentősen növelje az olyan demokráciával és emberi jogokkal foglalkozó programokra elkülönített forrásokat, amelyeket külön költségvetési fejezetben finanszíroznak, és amelyeket az Európai Parlament kezdeményezésére hoztak létre „európai kezdeményezés a demokráciáért és az emberi jogokért” címmel. A külső támogatásokra vonatkozó új pénzügyi eszközökről szóló tárgyalások során az Európai Parlament megállapította, hogy a láthatóság és a rugalmasság érdekében a demokráciával és az emberi jogokkal, mint fő prioritásokkal kapcsolatos uniós fellépésre önálló rendeletnek kell vonatkoznia, és hangsúlyozta egy olyan eszköz fontosságát, amely a harmadik országok hatóságainak hozzájárulása nélkül működhet. 2006 ősze folyamán intenzív és eredményes intézményközi tárgyalásokat tartottak Hélène Flautre (Verts/ALE) elnök és Edward McMillanScott (PPE-DE) európai parlamenti társelőadók jelenlétében. E tárgyalások új eseti intézkedések bevezetését eredményezték, amelyek konkrét támogatást nyújtanak az emberi jogok védelmezői számára, és lehetőséget biztosítanak a nem bejegyzett civil társadalmi szervezetek támogatására. 3

A végül 2006. december 20-án létrehozott, a demokráciáról és az emberi jogokról szóló új európai eszköz4 demokratikus ellenőrzési folyamatán keresztül az Európai Parlament aktívan részt vesz ezen eszköz végrehajtásának felügyeletében. E célból külön munkacsoportot hoztak létre az albizottságon belül. 2007 és 2009 között a munkacsoport hat ülést tartott. Az EIDHR költségvetési forrásai – amelyek a 2007–2013 közötti időszakban 1104 millió euró – támogatást nyújtanak az olyan együttműködések számára, amelyek célja az emberi jogok és az alapvető szabadságok tiszteletben tartásának és betartásának erősítése, a demokrácia és a demokratikus reformok harmadik országokban történő elősegítése és megszilárdítása, az emberi jogok védelmezőinek, valamint az elnyomás és a visszaélés áldozatainak támogatása és a velük való szolidaritás biztosítása, az emberi jogok és a demokrácia elősegítése terén tevékenykedő civil társadalom erősítése, e területen a nemzetközi és regionális keret támogatása és erősítése, valamint a választási folyamatokba vetett bizalom kiépítése és azok megbízhatóságának erősítése, különösen a választási megfigyelési küldöttségek révén és az ezekben a folyamatokban részt vevő helyi civil társadalmi szervezetek támogatása által. 8. Az emberi jogi szempontok érvényesítése Az Európai Parlament egésze épít az albizottság munkájára az emberi jogok harmadik országokban történő előmozdításával kapcsolatos álláspontjainak kialakítása során, az ENSZ-szel folytatott munkájával és az új nemzetközi megállapodások ratifikálásával összefüggésben. Az albizottságnak ugyancsak szerepe van azon uniós politikák érvényre juttatásában, amelyek az emberi jogoknak és a demokráciának az Európai Parlament különböző szervein, többek között a parlamentközi küldöttségeken, a közös parlamenti bizottságokon és a többoldalú parlamenti közgyűléseken keresztül történő előmozdításával kapcsolatosak. E cél elérése érdekében az albizottság rendszeresen gondoskodott arról, hogy ezekre az ülésekre meghívják az albizottságban vizsgált országokkal foglalkozó különböző küldöttségek elnökeit és a konkrét országokkal kapcsolatos munkát folytató különböző előadókat. 2005 júliusában az elnök Hélène Flautre találkozott a Küldöttségi Elnökök Értekezletének tagjaival. A találkozó célja az volt, hogy az európai parlamenti küldöttségek elnökei számára példákat mutassanak be az EU emberi jogi politikájának végrehajtására vonatkozó legjobb gyakorlatokkal és különösen az emberi jogokról szóló uniós iránymutatásokkal kapcsolatosan. Megállapodtak abban, hogy a tagok számára be kell mutatni egy legjobb gyakorlatokat tartalmazó útmutatót arról, hogy harmadik országokban tett látogatásaik során miként hatjható végre és követhető nyomon az emberi jogok és a demokrácia előmozdítására vonatkozó uniós politika. Ennek eredményeképpen 2006 januárjában az Elnökök Értekezlete jóváhagyta és elfogadta „Az Európai Parlament képviselőinek harmadik országokban tett látogatásaik során folytatott emberi jogi tevékenységeire vonatkozó egyedi iránymutatásokat”. 9. A 6. parlamenti ciklus alatt a Parlament által vizsgált egyéni esetekben többek között politikai foglyokról, meggyőződésük miatt bebörtönzöttekről, újságírókról, az interneten való véleménynyilvánításaik miatt üldözöttekről, tudósokról, szakszervezeti mozgalmak követőiről és az emberi jogok védelmezőiről van szó, akiket börtönbüntetés sújt, illetve zaklatják vagy fenyegetik őket. A legismertebbek közé tartozik a bolgár ápolónők és a palesztin orvos esete Líbiában, Anna Politkovszkaja meggyilkolása Oroszországban, a Szaharov-díjas Aung Suu Kyi házi őrizete Burmában, Dr. Aymar Nour egyiptomi és Hu Csia kínai bebörtönzése. Az esetek teljes körű felsorolását az Európai Parlament által évenként jóváhagyott emberi jogokról szóló éves jelentés I. melléklete tartalmazza. Az eseteket az Európai Parlament elnöke, az AFET vagy a DROI bizottságainak elnökei és/vagy az érintett európai parlamenti küldöttség elnöke által aláírt és a hatóságoknak címzett levélben vagy albizottsági ülések vitái során vetették fel, vagy az emberi jogokról szóló sürgős állásfoglalásokba foglalták bele (lásd lent). Az Elnök és magánhivatala esetenként bizalmas diplomáciai lépéseket is tett. Egy ilyen jellegű munka épít az Emberi Jogi Osztály, a bizottsági szakreferens és a Bizottság érintett országba látogató küldöttsége, valamint az egyes európai parlametni képviselők és amennyiben szükséges az Európai Parlament Jogi Szolgálata és időnként az EU elnöksége közötti eseti együttműködésre. A nem kormányzati szervezetektől is rengeteg információ érkezik.

A Parlament tevékenységeinek egyik fontos aspektusát azok a parlamenti állásfoglalások képezik, amelyek az emberi jogoknak bizonyos országokban elkövetett megsértésével, és különösen ezek egyedi eseteivel foglalkoznak, és amelyeket a havi plenáris üléseken a sürgős kérdések között tárgyalnak. Ezekben az esetekben fellépésre sürgetik a Tanácsot, a Bizottságot és az érintett nemzeti kormányokat. Az érintett kormányok reakcióiból arra lehet következtetni, hogy érzékenyek az Európai Parlament által megfogalmazott kritikákra. Az Emberi Jogi Osztály segítséget nyújt a képviselőcsoportok emberi jogi tanácsadóinak, mivel ők felelnek az Elnökök Értekezlete által kiválasztott témákban készülő állásfoglalások megfogalmazásáért (sürgősségi eljárás 115. cikk). A jelentés által lefedett ötéves időszak alatt a Parlament több mint 250 állásfoglalást fogadott el az emberi jogokkal kapcsolatos kérdésekben. A sürgősségi eljárásban tárgyalandó témák az Emberi Jogi Albizottság meghallgatásai során merülhetnek fel, vagy azokat annak keretei között, illetve eseti tényfeltáró parlamenti küldöttség révén kísérhetik nyomon. Az ily módon felmerült kérdéseket parlamentközi üléseken, illetve a nagykövetek és az Elnök megbeszélésein is felvethetik.

Az Emberi Jogi Albizottság megbízására készült hatástanulmány mélyreható elemzést tartalmaz azzal kapcsolatban, hogy ezek az állásfoglalások milyen hatást gyakoroltak az állásfoglalásokban említett, az emberi jogokat megsértő harmadik országokra, személyekre és csoportokra, valamint a bírósági eljárásokra és normákra. A tanulmány ajánlásai alapján az albizottság ellenőrizte az említett állásfoglalások nyomon követését, rögzítve a harmadik országok kormányainak reakcióit és az európai intézmények lépéseit. Emellett több olyan vitára is sor került a Bizottsággal és a Tanáccsal, amelyek nem vezettek állásfoglalás elfogadásához. Az EU harmadik országokkal tartott csúcstalálkozóinak előkészítése rendszeres alkalmat biztosít álláasfoglalások elfogadására, többek között emberi jogi kérdésekre való hivatkozással. Az Oroszországgal és Kínával megrendezett csúcstalálkozók alkalmával a Parlamentnek lehetősége nyílt arra, hogy erőteljes véleményt fogalmazzon meg például Csecsenföld és Tibet ügyében. 2. 2004 és 2009 között az Emberi Jogi Albizottság 11 európai parlamenti jelentést fogalmazott meg, amelyeket a Külügyi Bizottság vitatott meg és fogadott el. E jelentések plenáris ülés általi végleges elfogadásukat követően európai parlamenti állásfoglalásokká, az összes képviselő álláspontjává váltak. Az emberi jogokról szóló öt éves jelentés és az Emberi Jogi Tanács jelentése (előadó: Laima Andrikiené) mellett az Emberi Jogi Albizottság munkájának gerincét az alábbi jelentések alkották a 2009–2009 közötti időszakban: az emberi jogi záradékokról szóló jelentés (előadó: Vittorio Agnoletto), az emberi jogi párbeszédről szóló jelentés (előadó: Elena Valenciano), valamint a szankciókról szóló jelentés (előadó: Hélène Flautre). Éves jelentés Nagyjából az emberi jogokról szóló uniós jelentésnek – amelyhez az Aalbizottság tevékenységével jelentős mértékben hozzájárult – a Miniszterek Tanácsa általi közzétételével egyidőben az Európai Parlament megkezdte a világ emberi jogi helyzetéről és az EU emberi jogi politikájáról szóló éves jelentésének elkészítését. A jelentést 2005-ben Simon Coveney (PPE-DE) állította össze, a Tanács 2004. évi jelentéséről szóló állásfoglalás pedig régiók szerint áttekintette az egyes országokban tapasztalható emberi jogi problémákat, valamint kilenc konkrét tematikus kérdést vizsgált meg mélyebben. E kérdések a következők voltak: az emberi jogok, a terrorizmus elleni küzdelem, a gyermekek jogai, a konfliktusok nőkre és gyermekekre gyakorolt hatásai, a halálbüntetés, az ember- és szervcsempészet, gyermekprostitúció és gyermekmunka, a nemzetközi vállalkozások szerepe az emberi jogok terén, a büntetlenség, valamint a Nemzetközi Büntetőbíróság szerepe. Az elmúlt tíz évben szavazásra bocsátott európai parlamenti éves jelentések elemzése, valamint a hatástanulmány arra vonatkozó javaslatai alapján, hogy a jelentést tegyék az emberi jogok és a demokrácia terén alkalmazott uniós eszközök végrehajtása értékelésének valódi eszközévé, a jelentés előadója, Richard Howitt 2006-ban új megközelítést vezetett be az éves jelentés elkészítésekor: a jelentés az Európai Unió az emberi jogok terén végzett munkáját elemezte, amely javaslatokat tartalmazott a fellépések hatékonyabbá tételére. A tárgyalt kérdések között megtalálhatók az EU nemzetközi szervezetekben folytatott tevékenységei, továbbá az emberi jogok érvényesítése más politikák területén, többek között a kereskedelem, valamint az EU és harmadik országok között folyó emberi jogi párbeszéd terén. A 2007. évi jelentés előadójának ismét Simon Coveney-t (PPE-DE) nevezték ki, aki átvette a Richard Howitt által bevezetett horizontális megközelítés alkalmazását. A 2008. évi jelentés előadója Marco Cappato (ALDE), a 2009. évi jelentésé pedig Raimon Obiols i Germà (PES) volt. Vélemények IV. melléklet 2004 és 2009 között saját jelentései mellett az albizottság más bizottságok parlamenti jelentéseihez is kialakította és megfogalmazta állásfoglalását vélemények formájában. Az elkészült tíz vélemény közül hetet az Állampolgári Jogi, Bel- és Igazságügyi Bizottság (LIBE) részére készítettek. A fennmaradó három jelentés címzettje a Fejlesztési Bizottság (DEVE), az Alkotmányügyi Bizottság (AFCO) és a Nemzetközi Kereskedelmi Bizottság (INTA) volt. 3. Meghallgatások és egyéb események V. melléklet A jelentés által lefedett időszakban az Emberi Jogi Albizottság több mint 40 meghallgatást és eszmecserét szervezett emberi jogi kérdésekben. A meghallgatások egy-egy ország vagy földrajzi régió emberi jogi helyzetére, vagy olyan horizontális emberi jogi kérdésekre összpontosítottak, mint például a halálbüntetés, az emberi jogi védelmezőinek védelme, a kínzás, a gyermekek jogai, az átmeneti bíráskodás, a vállalatok társadalmi felelősségvállalása, a Nemzetközi Büntetőbíróság stb. Egy éves meghallgatást a török emberi jogi helyzetnek, egy másikat pedig az EU szomszédságpolitikájának szenteltek, ez utóbbi esetében különös figyelmet fordítva az emberi jogi kérdéseknek a keleti szomszédságpolitika országainak nemzeti cselekvési terveiben (Moldova2005, Azerbajdzsán-2007, Örményország-2008) és a déli szomszédságpolitika (Marokkó-2005, Egyiptom-2006, Izrael-2006, Jordánia-2007, Tunézia- -2008) országainak egy vagy két nemzeti CM\784298HU.doc

cselekvési tervében történő érvényesítésére. A kínai, oroszországi, üzbegisztáni/közép-ázsiai emberi jogi kérdések rendszeresen megjelentek az albizottság üléseinek napirendjén. A kubai, szíriai, iraki, iráni, kambodzsai, laoszi, vietnami, fülöp-szigeteki, pakisztáni, bangladesi, nepáli emberi jogi helyzetet, a mexikói és guatemalai nőgyilkosságoknak, valamint a vajdasági/szerbiai kisebbségek védelmének a kérdését szintén megvitatták. 2004-ben és 2005-ben az albizottságban lezajlott legfontosabb eszmecserék az Edward McMillanScottnak az EIDHR-ről szóló jelentésével, a Bizottságnak az emberi jogok területén folytatott tevékenységével, a különböző uniós eszközök hatásával, valamint az EIDHR Bizottság által készített, 2005–2006-ra szóló programozási dokumentumával kapcsolatos viták voltak. Mivel 2005 a mediterrán térség éve, a barcelonai folyamat tizedik évfordulója és az Euromediterrán Parlamenti Közgyűlés első ülésének éve volt, az albizottság nyilvános meghallgatást tartott a földközi-tengeri régióban (különösen Algériában) tapasztalt, erőszakos körülmények között történt eltűnésekről, egy másik nyilvános meghallgatást pedig a véleménynyilvánítás szabadságáról és a parlamenti demokrácia fejlődéséről az euromediterrán régióban. A rendszeres nyilvános meghallgatások mellett az albizottság több jelentős figyelemfelkeltő eseményen vett részt az emberi jogok terén. 2007 márciusában a velencei Európai Egyetemközi Központ szeminárium formájában bemutatta a DROI bizottság „Az aktivizmuson túl – az Európai Parlament állásfoglalásainak és egyéb tevékenységeinek hatásai az emberi jogok terén az Európai Unión kívül” című tanulmányának következtetéseit, az Európai Parlament elnökének részvételével. Az Európai Parlament épületében az ENSZ-szel és az Európai Bizottsággal közösen egy fontos konferencia keretében megemlékeztek az Emberi Jogok Egyetemes Nyilatkozatának 60. évfordulójáról, amelyen számos magas rangú személy és emberi jogi jogvédő vett részt a világ minden részéből. ,Az emberi jogokkal foglalkozó éves plenáris ülés (Szaharov-hét) decemberi megszervezése mellett az Emberi Jogi Osztály aktívan koordinálta a Szaharov-díj 20. évfordulójára időzített „20 év az emberi jogok aktív támogatásában: Szaharov-díjasok elmondják történetüket” című konferencia szervezését 2008 decemberében (további részletek a Szaharov-díjról szóló bekezdésben találhatók). Ezen a konferencián a Parlament elnöke, valamint Elena Bonner, Dr. Andrej Szaharov özvegye és a jelen lévő kitüntetettek megállapodtak abban, hogy egymás emberi jogokkal kapcsolatos tevékenységének kölcsönös támogatására létrehozzák a Szaharov-hálózatot. 4. Együttműködés más bizottságokkal Állampolgári Jogi, Bel- és Igazságügyi Bizottság (LIBE) Az emberi jogokkal kapcsolatos Európai Unión belüli kérdések az Állampolgári Jogi, Bel- és Igazságügyi Bizottság (LIBE) hatáskörébe tartoznak, amely az alapvető emberi jogok tiszteletben tartásának helyzetét kíséri figyelemmel. Az albizottság szorosan együttműködött a LIBE bizottsággal a belső politikák kifelé gyakorolt hatásainak nyomon követése érdekében, különösen a menedékkérők és migránsok kérdésével, valamint az ember- és szervcsempészet emberi jogi aspektusaival kapcsolatban. Az ideiglenes bizottság munkája alapján a Parlament 2007-ben elfogadta a Fava-jelentést, amely elemezte és mélyen elítélte az EU-tagállamok és más országok állampolgárainak titkos fogva tartási létesítményekben történő kínzását. A CIA által végrehajtott illegális kiadatások kérdésének nyomon követéseként a LIBE bizottság 2007 májusában ülést szervezett Michael Chertoff, az USA nemzetbiztonsági ügyekért felelős minisztere és az unió soros német elnöksége részvételével annak érdekében, hogy további tájékoztatást kapjon az ügyben. Az Emberi Jogi Albizottságot az ülésen Sarah Ludford képviselte. 2006 júliusában fontos közös meghallgatásra került sor Dick Marty-val, az Európa Tanács parlamenti közgyűlésének képviselőjével a titkos CIA légijáratokról és kiadatásokról készült jelentésével kapcsolatban. A DROI bizottságban több vitára is sor került, amelyek az alapvető jogok érvényesülésének előmozdítására és védelmére összpontosítottak az Európai Unióban. E vitákat az ügynökség igazgatójával folytatott eszmecsere keretében összegezték 2008-ban. Fejlesztési Bizottság (DEVE) Az Emberi Jogi Albizottság mellett a Fejlesztési Bizottságon belül létrehozott munkacsoport is rendszeresen találkozik az emberi jogokkal foglalkozó nem kormányzati szervezetekkel és az érintett kormányok képviselőivel a fejlődő országokban (pl. legutóbb Észak-Ugandában) tapasztalható emberi jogi helyzettel kapcsolatban, vagy olyan specifikus témákban, mint a gyermekkatonák és a gyermekrabszolgaság kérdése, vagy a dalitok helyzete Indiában. Közös érdekű ügyek esetén a két testület közös üléseket vagy nyilvános meghallgatásokat szervez, mint például 2007 júniusában, amikor egy ilyen meghallgatás keretében elemezték az emberi jogok helyzetét Etiópiában, két évvel az EU megfigyelése alatt lezajlott választások után. Az Elnökök Értekezlete 2007 júniusában egy másik közös találkozót is szervezett azzal a céllal, hogy hangot adjon a Parlament aggodalmainak az elhúzódó dárfúri (Szudán) konfliktussal kapcsolatban. Ebből az alkalomból Desmond Tutu érsek és a Nobel-békedíjjal kitüntetett Jody Williams beszédben fordult a Parlamenthez, és felszólította az európai parlamenti képviselőket, hogy tegyenek konkrét lépéseket a fegyveres konfliktus befejezése és a dárfúri lakosság szenvedésének megszüntetése érdekében. A találkozó folyományaként a Fejlesztési Bizottság kezdeményezésére az Európai Parlament 2007. július 12-én állásfoglalást fogadott el, amelyben aggodalmát fejezte ki a dárfúri emberi jogi helyzet miatt. Felszólította a tagállamokat, a Tanácsot és a Bizottságot, hogy tegyenek eleget kötelezettségeiknek és tegyenek meg minden lehetséges erőfeszítést a válság által sújtott emberek hatékony védelme érdekében. Parlamentközi küldöttségek Ezen felül a Parlament parlamentközi küldöttségei rendszeresen eszmét cserélnek emberi jogi kérdésekről más parlamentekkel a világ minden részéről. Az albizottság amellett, hogy iránymutatásokat fogalmaz meg az EP harmadik országokba indított valamennyi parlamentközi küldöttsége számára az emberi jogok általános érvényesítésére vonatkozólag, meghívta üléseire a küldöttségek elnökeit, hogy részt vegyenek az illető küldöttség célországával kapcsolatos vitában. AKCS-EU Közös Parlamenti Közgyűlés Az EP, valamint az afrikai, karib-tengeri és a csendes-óceáni parlamenti képviselők közötti politikai párbeszéd fő fóruma az AKCS-EU Közös Parlamenti Közgyűlés. Az emberi jogok rendszeresen szerepelnek az AKCS-EU Közös Parlamenti Közgyűlés elnökségének, valamint politikai bizottságának napirendjén. A jelentés által lefedett időszak alatt az AKCS-EU partnerség keretében és az Emberi Jogi Osztály támogatásával vitákat tartottak többek között a zimbabwei, a kongói, a szomáli-félszigeti, a szudáni/dárfúri, a fidzsi és a mauritániai helyzetről, továbbá jelentéseket készítettek az illegális migrációról, a gyülekezési jogról, valamint a halálbüntetésről. Euro-mediterrán Parlamenti Közgyűlés (EMPA) Az Euro-mediterrán Közgyűlés a földközi-tengeri térség országaival biztosít lehetőséget a demokráciáról és az emberi jogokról folytatott parlamenti párbeszédre. Ebben az összefüggésben meghallgatást tartottak a véleménynyilvánítás szabadságáról és a parlamenti demokrácia fejlődéséről az euro-mediterrán régióban. 2007-ben a közgyűlés plenáris ülését Tunéziában rendezték meg, kiemelt figyelmet szentelve a kultúrák közötti párbeszéd kérdésének. A közgyűlés különböző bizottságai gyakrabban üléseztek és olyan kérdésekkel foglalkoztak, mint az arabizraeli konfliktus, a terrorizmus, a szegénység mérséklése, valamint a nők helyzetének javítása az euro-mediterrán országokban. A Politikai, Biztonsági és Emberi Jogi Bizottság olyan gyakorlatot alakított ki, hogy minden ülés napirendjére felkerült egy emberi jogokkal kapcsolatos napirendi pont. EuroLat Parlamenti Közgyűlés Az albizottság a latin-amerikai országokkal az emberi jogokról folytatott parlamenti párbeszédet szolgáló EuroLat Parlamenti Közgyűléssel is együttműködött. Uniós nemzeti parlamentek 2008 júniusában az EU-tagállamok emberi jogi bizottságai az albizottság egyik ülése keretében találkozót tartottak az Európai Parlamentben, amely találkozó az EU egyik prioritásával, a kínzás elleni küzdelemmel foglalkozott a kínzás áldozatainak támogatására rendezett nemzetközi nap összefüggésében. Manfred Nowak, az ENSZ kínzásokat kivizsgáló különmegbízottja jelenlétében a jelen lévő képviselők nyilatkozatban állapodtak meg e kérdéssel kapcsolatban, amelyben többek között kijelentik, hogy a tagállamoknak rehabilitációs központokat kell finanszírozniuk a kínzások áldozatai számára és alá kell írniuk a kínzás elleni egyezmény fakultatív jegyzőkönyvét (OPCAT). A DROI bizottság elnökének tevékenységei Az albizottság emberi jogok terén végzett munkájának támogatását célzó további tevékenységként Hélène Flautre elnök rendszeresen kétoldalú bizalmas találkozókon vett részt emberi jogi jogvédőkkel, nagykövetekkel és a civil társadalom képviselőivel, amely találkozókra a kibővített Elnökség tagjai, valamint a képviselőcsoportok és az Emberi Jogi Osztály képviselői is meghívást kaptak. Ezek a találkozók az információcserére és az emberi jogok védelméért küzdő személyek és szervezetek támogatására összpontosítottak. 5. szabadságáért járó Szaharov-díjat, amellyel olyan személyeket vagy szervezeteket tüntetnek ki, amelyek komoly erőfeszítéseket tesznek az emberi jogok és alapvető szabadságok védelmében, illetve az elnyomás és az igazságtalanság ellen. A 2004. évi Szaharov-díjat a Parlament a Belarusz Újságíró-szövetségnek ítélte oda. A 2004-es év kiemelkedő jelentőségű eseménye volt az 1995. évi Szaharov-díj kitüntetettje, Leyla Zana volt kurd parlamenti képviselő tiszteletére rendezett különleges rendezvény. Amikor a Parlament kitüntette őt a díjjal, Leyla Zana már egy éve börtönben volt, és nem vehette át a díjat személyesen. Miután 10 évet töltött börtönben, 2004. június 9-én szabadlábra helyezték és e különleges esemény alkalmával 2004. október 14-én felszólalhatott az Európai Parlament plénuma előtt. 2005-ben a Szaharov-díjat megosztva az alábbiak kapták: az „Asszonyok fehérben” nevű mozgalom, a kubai politikai foglyok érdekében tett tevékenységéért, Hauwa Ibrahim a saría (iszlám jog) alapján perbe fogott nigériai nők és gyermekek védelmében végzett ügyvédi munkájáért, valamint a „Riporterek határok nélkül” nevű szervezet a sajtószabadságért világszerte folytatott küzdelme elismeréseképpen. A Szaharov-díj általános hatásának fokozása érdekében a hatástanulmány ajánlásai alapján a Parlament 2006-ban felülvizsgálta a Szaharov-díj odaítélésére vonatkozó szabályzatot. Az Emberi Jogi Osztály aktívan részt vett ebben a folyamatban. Az egyik jeletős előrelépés a jelölési eljárás átláthatóbbá tétele volt azáltal, hogy azontúl nem csak a képviselőcsoportok, hanem egyszerre legalább 40 képviselő is jelölhet. Az új szabályok értelmében csak egyetlen díjazott lehet, akit a Fejlesztési Bizottság és a Külügyi Bizottság közösen szavaz meg, titkos szavazáson. A következő évben, 2006-ban a díjat Aljakszandr Milinkevics kapta a demokratikus jogok és a politikai szabadság érdékében Belaruszban folytatott küzdelméért. Aljakszandr Milinkevics 2006 márciusában több, a tisztességtelen elnöki választások ellen irányuló tömegtüntetés vezetője volt, és több alkalommal letartóztatták a szólás- és gyülekezési szabadság alapvető jogának követelésére való buzdításért. A díjat 2007-ben Szálih Mahmúd Oszmán szudáni ügyvéd kapta a dárfúri mészárlások áldozataiért folytatott küzdelméért. Az első díjátadó alkalmával a nyilvánosság sajnos csak korlátozott mértékben értesült az eseményről. Ez a helyzet 2008-ra megváltozott, nem csak a médiának e digitális korban tapasztalható folyamatos jelenléte, hanem a díj huszadik évfordulója miatt is. Ebből az alkalomból a Parlament elnöke az összes még élő korábbi kitüntetettet meghívta, akik nagy része részt vett a 2008. december 17-i plenáris ülésen. Albizottság egyik nyilvános, a 2008. évi olimpiai játékok előtti kínai helyzettel foglalkozó meghallgatásán beszélt az Európai Parlament képviselői előtt. A beszéd közvetlen folyományaként letartóztatták és „államhatalom felforgatására való felbujtással” vádolták meg, majd három és fél év börtönbüntetésre ítélték. A 2008. december 17-én tiszteletére rendezett díjátadó ünnepségen előre rögzített videoüzenetet vetítettek le, amelyet Hu Csia nevében a felesége rögzített otthoni számítógépén. 6. Az albizottságnak lehetősége van saját küldöttségi látogatásainak megszervezésére. Az albizottság tagjai az EP eseti küldöttségeiben is részt vesznek. A hatodik jogalkotási ciklus során az albizottság tagjai különböző küldöttségek keretében több eseményen vettek részt, például az EU és a nem kormányzati szervezetek éves emberi jogi fórumán, a halálbüntetés elleni harmadik világkongresszuson, valamint az EBESZ által szervezett többoldalú konferenciákon. Az albizottság emellett minden évben küldöttséget indított Törökországba. Egy másik bizottság Horvátországban tett látogatást 2007-ben. A választási megfigyelő missziókban való részvételük révén az albizottság tagjai fokozottan hozzájárultak az emberi jogok és a demokrácia harmadik országokban történő megerősítéséhez. Az ENSZ Emberi Jogi Tanácsa (HRC) Az emberi jogok területén folytatott együttműködés egyik jelentős szerve az ENSZ genfi székhellyel újonnan létrehozott Emberi Jogi Tanácsa (HRC), amelynek alapítását az albizottság nagy érdeklődéssel és várakozással kísérte. Az EU küldöttsége első ízben 2004-ben utazott Genfbe, majd ezt követően a látogatás minden évben megismétlődött, vagy egyszer, a fő ülés alkalmával, vagy pedig kétszer, a különös érdeklődésre számot tartó kérdések megvitatásakor. A képviselők általában találkoztak az EU elnökségével, a tagállamok és más országok nagyköveteivel, valamint nem kormányzati szervezetek képviselőivel. Az EP többször is megismételte, hogy támogatja egy erős Tanács kialakítását, amely képes hatékony választ adni a világban történő emberi jogi jogsértésekre egy olyan időszakban, amikor éppen a különböző eljárási szabályzatok és munkamódszerek kialakítása zajlik. 2007-ben a DROI bizottság képviselői egy tényfeltáró misszió részeként részt vettek az ENSZ-közgyűlés harmadik bizottságának ülésén.

Az Emberi Jogi Tanácshoz tervezett küldöttségi látogatás előkészületeként az albizottság rendszeresan találkozott a Tanács soros elnökével és más fontos tisztviselőkkel, például ez ENSZ különleges előadóival. Tevékenysége első évében az albizottság – a Külső Politikák Főigazgatósága politikai főosztályával szorosan együttműködve szakértői költségvetését több mint 40 külső tanulmány finanszírozására használta, különböző témakörökben. E tanulmányok parlamenti jelentések (például az emberi jogi záradékokról, párbeszédekről és szankciókról), vagy küldöttségi látogatások alapjául szolgáltak, illetve további megvitatást igényelő kérdéseket vetettek fel. 2004ben az albizottság különleges tanulmány készítésére adott megbízást az Európai Unió számára a harmadik országokban végzett emberi jogi tevékenységek finanszírozására rendelkezésre álló eszközökről, külön hivatkozással a demokráciáért és az emberi jogokért indított európai kezdeményezésre. A jelentéstételi időszakban öt tanulmány készítésére adtak megbízást a halálbüntetéssel kapcsolatban (a Nagy Tavak régiójában, a Fülöp-szigeteken, Szingapúrban, az Amerikai Egyesült Államokban és az Amerika-közi rendszerben) és hét tanulmányt az emberi jogokról folytatott párbeszédről és konzultációkról (Iránnal, Kínával, Oroszországgal, Közép-Amerikával, valamint az európai szomszédságpolitika, a Cotonou-i Megállapodások és egy szintetikus tanulmány keretében). Fontos tanulmány készült a kínzásról és más kegyetlen, embertelen és megalázó bánásmódról vagy büntetésről szóló uniós iránymutatások végrehajtásáról, melynek kapcsán a megbízott szakértő több országot felkeresett és vizsgálatokat folytatott. Az ezt követő években az albizottság számos eszmecserét tartott a HRDN-nel és annak képviselőit csaknem az összes albizottsági ülésre meghívta annak érdekében, hogy megfogalmazhassák véleményüket és a parlamenti képviselőkkel együtt részt vehessenek a vitákban. 2008-ban, a hatodik jogalkotási ciklus végén a HRDN kiáltványt tett közzé, amelyben javaslatokat fogalmaztak meg a hetedik jogalkotási ciklus képviselői számára. 9. Emberi Jogi Osztály Az Európai Parlament Külkapcsolatok Főigazgatóságának e horizontális osztályát jelenleg Geoffrey Harris vezeti. Az osztály hat adminisztrátorból, egy asszisztensből, négy titkárból áll, és időnként belső és külső gyakornokok segítségét is igénybe veszi. Report on the Annual Report on Human Rights in the World 2008 and the European Union's policy on the matter (2008/2336 (INI)); rapporteur: Raimon Obiols I Germa (PSE, ES); adopted on 7/5/2009 in plenary The report considers that better information should be provided for the assessment of previous policies and that guidelines should be proposed to modify the general approach as well as to adjust the policy priorities on a country-by-country basis, with a view to the adoption of a Country Strategy on human rights or a human rights chapter in the Country Strategy Papers; calls on the Council and the Commission to develop specific quantifiable indices and benchmarks in order to measure the effectiveness of its human rights policies; calls on the EU Member States to ratify the 1990 International Convention on the Protection of the Rights of All Migrant Workers and Members of their Families, which none of the Member States has ratified, and calls for prompt ratification of the United Nations Convention on the Rights of Persons with Disabilities by the European Community and its Member States; calls on the EU Presidencies to mention the status of the ICC cooperation in all summits with third countries; welcomes the new priority status to women's issues in the context of the EU's action in the field of human rights, stressing, in particular, the need to tackle the tragic phenomena of violence against women and femicide; welcomes the ratifications of the Rome Statute by Madagascar, Cook Islands and Suriname; demands the Czech Republic, (the only remaining European Union Member State) to ratify the Rome Statute without further delay; urges Romania to rescind its Bilateral Immunity Agreement with the United States. Report on the development of the UN Human Rights Council, including the role of the EU (2008/2201 (INI)); rapporteur Laima Liucija Andrikienė (PPE-DE); adopted on 02/12/2008 in AFET, on 14/01/2009 in plenary Welcomes the work carried out by the UN Human Rights Council in its first two years of existence but regrets that it has not yet achieved more in improving the UN's human rights record; calls on the EU to play a more prominent role in promoting a clear vision, political agenda and long-term strategy for the UN body, regretting, despite some achievements such as the EU's call for special sessions on Darfur, Myanmar and the East of the Democratic Republic of Congo, the rather defensive attitude adopted by the EU in the UNHRC, in particular its reluctance to put forward resolutions on country situations; urges EU countries to make better use of their potential influence as the leader of a group of democratic countries with solid human rights records. Comments on impact of AFET work in the 6th parliamentary term On the basis of the work of AFET and, in particular, its Subcommittee on Human Rights, Parliament has been following developments in and at the level of the UNHRC since its setting-up, through resolutions on EP priorities for specific sessions and regular delegations to observe the UNHRC's work. After almost 3 years of functioning of the UNHRC during which the institutional reform was fine-tuned, the report was a means of assessing the achievements of the Council as well as ways in which the EU could improve its influence in the HRC and, by doing so, give a new impetus to the Council. Given the review procedure of the Council five years after its creation, i.e. in 2011, this report was a useful benchmarking exercise, to be repeated possibly just before the review.
3. Report on the evaluation of EU sanctions as part of the EU's actions and policies in the area of human rights (2008/2032 (INI)); rapporteur Hélène Flautre (VERTS/ALE); adopted on 15/07/2008 in AFET, on 04/09/2008 in plenary Calls on the European Union to improve the way it uses sanctions as a foreign policy instrument, highlighting the need for greater coherence in the use of sanctions, including better analysis and impact assessments, to make EU sanctions more effective such as in-depth analysis of each specific situation prior to the adoption of sanctions and clear and specific benchmarks as conditions for the lifting of sanctions; recommends the creation by the Commission of a 'network of independent experts' to advise on sanctions; urges to include in the reasons for imposing sanctions the voluntary and irreversible degradation of the environment; accent on necessity to make sanctions part of a coherent human rights strategy; targeted sanctions preferred so as to spare populations and urge that they be systematically accompanied by positive measures to support CM\784298HU.doc

civil society, human rights defenders; calls to review the existing procedure for blacklisting and delisting, in order to respect blacklisted individuals' and entities' procedural and substantive human rights. Comments on impact of AFET work in the 6th parliamentary term Alongside the reports on Human Rights Clauses and Dialogues, this report constitutes a fundamental element of the 'trilogy' assessing the main human rights instruments of EU foreign policy and a basis for future scrutiny by the EP of developments in this respect. Following a short-term follow-up to the report by the Subcommittee on Human Rights, the Commission forwarded to members the relevant information regarding recent sanctions imposed or prolonged, and assured DROI it would continue to do so in the future. While stating that the usefulness of a network of independent experts would require further examination, the Commission announced, as regards sanctions legislation (blacklisting and de-listing), that it would make proposals or take action as necessary to bring the listing procedures in line with relevant case-law. 4. Report on the Annual Report on Human Rights in the World 2007 and the European Union's policy on the matter (2007/2274 (INI)); rapporteur: Marco Cappato (ALDE, IT); adopted on 14/04/2008 in AFET, on 08/05/2007 in plenary The report deplores the fact that that the EU is still far from conducting a coherent and hard-hitting policy to uphold and promote human rights around the world; calls on the member states to strengthen the EU's common foreign and security policy (CFSP), which is often hampered by the predominance of Member States' national interests, with the aim of ensuring that the promotion of human rights is regarded as a priority; calls on the Council and the Commission to make greater efforts to improve the ability of the EU to respond rapidly to breaches of human rights by third countries, not least by mainstreaming human rights policy into all external EU policies vis-à-vis such countries and systematically addressing human rights issues within the framework of the political dialogue at all levels; reaffirms that human rights are universal and indivisible, effective respect for which is an essential means of guaranteeing the enforcement of international law and order, and the promotion of peace, freedom, justice and democracy; calls on the EU to support judicial institutions at all levels, and in particular to provide support for international courts; proposes that a European Conference on Non-Violence be convened in 2009 and that 2010 be designated 'European Year of Non-Violence'; calls on the Member States to endeavour, under the auspices of the United Nations, to ensure that the 'Decade of Non-Violence 2010-2020' is proclaimed; calls on the Council and the Commission to identify the 'countries of particular concern' where it is particularly difficult to promote human rights and, to that end, to develop criteria by which to measure countries by reference to their human rights score. of 2008; expresses disquiet at the possibility that the death penalty might again start to be enforced in Guatemala, and are concerned about China as the latter still carries out the greatest number of executions worldwide; condemns the practising of the death penalty in Belarus, and also condemns the Iranian regime's increasing use of capital punishment. The report calls on the Council and the Commission to enhance the cooperation with the Council of Europe for the purposes of creating a Europe-wide zone free from torture and other forms of illtreatment (as a clear signal that European countries are firmly committed to eradicating these practices also within their borders). Requests the regular presence of the Presidency or the Council Secretariat in the relevant United Nations Committees as well as further cooperation with the Council of Europe and its Committee for the Prevention of Torture in order to achieve useful material input into decision-making concerning demarches towards certain countries; calls on the Council and the Commission to engage in a more transparent implementation of the European Union Guidelines on Human Rights Defenders; points out the lack of EU demarches on behalf of human rights defenders in certain countries (in China, Tunisia, Ethiopia, Iran and Russia), appears to reflect a lack of consensus among EU Member States, with individual Member States prioritising different foreign policy interests and thus making collective action impossible; regrets the lack of results from the European Union-Russia consultations on human rights and regrets that the European Union has not succeeded in bringing about policy change in Russia, particularly in Chechnya and other Caucasian Republics; protests against the deplorable situation regarding human rights in the Maghreb countries (in Syria and in Uzbekistan), in Burma, Sudan and Pakistan. Calls on the Council, the Commission and Member States to use the human rights clause to make combating all forms of female genital mutilation a priority issue in relations with non-Member States (particularly those States that have preferential relations with the EU within the framework of the Cotonou Agreement; urges the Commission, within its EU foreign trade, investment and development policies, to ensure that the economic activities of EU private companies in third countries abide by international human rights standards (as regards the exploitation of natural resources and the international obligation to obtain the prior and informed consent of local communities and indigenous people affected). 5. Report on the functioning of the Human Rights Dialogues and consultations on Human Rights with Third countries (INI/2007/2001); rapporteur Elena Valenciano Martínez-Orozco (PSE); adopted on 30/07/2007 in AFET, on 06/09/2007 in plenary Stresses that the universality, individuality and indivisibility of human rights, meaning not only civil and political rights but also social, environmental, economic and cultural rights, must be upheld and promoted; highlights that human rights issues should be placed at the highest political level in order to give more political weight to human rights concerns. with the EU. Notes that there is a wide variety of dialogues and consultations, each based on different structures, formats, frequencies, and methodologies, but that neither the Council nor the Commission has devised a method for organising and systematising these dialogues and consultations, making the results impossible to view from an overall perspective. In order to increase coherence, stresses to find ways of improving coordination among the different EU institutions by establishing an interinstitutional trialogue on the political dialogue and the human rights dialogues and consultations; recommends increasing coherence with other states and international organisations. Makes a series of recommendations to the Council and to the Commission: to include in each Country Strategy Papers and other Strategy documents a specific strategy on human rights and the situation pertaining to democracy and to use it as a framework for political dialogue; to ensure that, within the staff serving at any given time in each EU delegation in a third country, an EU official is in charge of the human rights dialogue and consultations; to ensure coherence between Election Observation Missions (especially as regards the post-electoral strategy) and the process of human rights dialogues and consultations. Calls on the Commission to put in place, together with the European Parliament and third countries concerned, a post-electoral protocol mechanism to monitor and support the democratisation process, which includes the involvement of civil society at all stages, in the implementation of post-electoral recommendations; to apply and use the results of human rights dialogues and consultations in drawing up yearly strategies providing a basis for implementation of projects under the European Instrument for Democracy and Human Rights (EIDHR) and systematically to link those two tools. Suggests measures with the aim of increasing the transparency of, and publicity given to, human rights dialogues and consultations. Calls on the Council to ensure that, before the EU sets the specific goals to be attained by entering into a dialogue or consultation with the country in question, consultations are first held with all interested parties, especially with Parliament and NGOs. In addition, calls on the Council to set clear criteria for the initiation, suspension or termination of a dialogue or consultation and to establish effective follow-up mechanisms to deal with the points raised and in the final recommendations. Suggests a series of measures for enhancing the role of the European Parliament and moved on to discuss the functioning of the various forms of human rights dialogues and consultations with third countries, including the structured dialogues with China and Iran, the consultation with Russia, dialogues based on the Cotonou Agreement, dialogues with Central Asia dialogues based on a partnership and cooperation agreement under the Neighbourhood Policy, with Latin America, dialogues based on trade and cooperation agreements, and, ad hoc dialogues. Comments on impact of AFET work in the 6th parliamentary term Alongside the reports on Human Rights Clauses and Sanctions, this report constitutes a fundamental element of the 'trilogy' assessing the main human rights instruments of EU foreign policy and a basis for future scrutiny by the EP of developments in this respect. Following several interinstitutional discussions on the follow-up to the report, the Commission and Council ensured that interested Members received regular briefings and debriefings on the most important human rights dialogues and consultations in an informal confidential manner, enabling Parliament to have increased influence and oversight over the dialogues. Report on the Annual Report on Human Rights in the World 2006 and the EU's policy on the matter (2007/2020 (INI)); rapporteur: Simon Coveney (PPE-DE, IE); adopted on 10/04/2007 in AFET, on 26/04/2007 in plenary The report focuses on assessment of the five sets of EU Human Rights Guidelines on the death penalty, children in armed conflict, human rights dialogues, torture and human rights defenders; Focuses on the EU's role in the new UN body dealing with human rights: the UN Human Rights Council (UNHRC); notes the high degree of politicisation of UNHRC special sessions, and cautions that the UNHRC 'must not become a political forum for conflict between different geographical and ideological blocks globally'. Highlights the weakness of the UNHRC resolution on Darfur and urges the UNHRC to adopt appropriate and strong measures to respond to the humanitarian catastrophe in Darfur; urges the EU to back 'an international peacekeeping force' and 'the enforcement of the no-fly zone over Darfur'. Emphasises the need to improve and strengthen EU-China human rights dialogue, and urges the Council and Commission to raise the Tibet question in talks with the Beijing government. Calls on the Council to express concern about the situation in all its contacts with the Iranian government and also calls on the Commission to use the European Initiative for Democracy and Human Rights (EIDHR) to promote contacts and cooperation with Iranian civil society. Reserves strong criticism for the Russian government, 'regretting' that the EU has had 'only limited success in bringing about policy change as a result of raising difficult issues', such as the situation in Chechnya, the treatment of human rights defenders (remains 'appalled' at the murder of Anna Politkowskaja' and is concerned about allegations of Russian involvement in the poisoning of Alexander Litvinenko and of the mistreatment of Mikhail Khodorkovsky while in detention), and freedom of expression. The Parliament urges the Commission and Council to raise such cases with the Russian authorities at the highest level and in the new PCA with Russia. Welcomes Chad as the most recent signatory to the Rome statute of the International Criminal Court; urges the Czech Republic, as the only remaining EU Member State not have ratified the Statute, to do so without delay, and discourages the United States from actively preventing other countries from ratifying this statute. Recognises attempts to set up a human rights dialogue with Uzbekistan (considers that such a dialogue should not automatically lead to the lifting of sanctions, if no progress is made in the area of human rights and democracy). Calls on the Council and the Commission to urge the US government to 'charge or release' Guantánamo detainees 'in accordance with international law'; shows its concern about the 'limited progress' on human rights issues in Turkey and encourages the Ankara government to change Article 301 of the Penal Code. EU Presidencies to continue the approach of promoting the abolition of the death penalty; 7. Extension of the European Initiative for Democracy and Human Rights and the European Instrument for Democracy and Human Rights Worldwide (CNS/2004/0807); rapporteur Edward McMillan-Scott (EPP); adopted on 26/11/2004 in AFET, on 16/12/2004 in plenary, and (COD/2006/0116); rapporteur Edward McMillan-Scott (EPP) and Hélène Flautre (VERTS/ALE); adopted on 10/10/2006 in AFET, on 12/12/2006 in plenary Awaiting the agreement on the reform of all external financial instruments, the report adopted in 2004 was mainly an extension for a further two years (until 31.12.2006) of the period of validity of Council Regulation 976/1999/EC. The same was done for the parallel regulation (975/99/EC) on respect for human rights within the framework of development cooperation, as the EIDHR was split into two regulations for legal reasons. The new EIDHR, (Regulation EC 1889/2006) is part of the new structure of the financial instruments. Initially, it was proposed to be a thematic programme under the Development Cooperation Instrument, but the European Parliament, for reasons of visibility and independence, pushed for a separate instrument. Overall, this Instrument will provide assistance in the area of cooperation aimed at:
enhancing respect for and observance of human rights and fundamental freedoms, promoting and consolidating democracy and democratic reform in third countries, providing support and solidarity to human rights defenders and victims of repression and abuse, and strengthening civil society active in the field of human rights and democracy promotion;
supporting and strengthening the international and regional framework in this area;
building confidence in and enhancing the reliability of electoral processes, in particular through election observation missions, and through support for local civil society organisations involved in these processes.
Through a call for proposals, published by Headquarters in Brussels and at local level by the EC delegations, almost 400 projects have so far been financed under the new instrument, mainly in cooperation with civil society. Some targeted projects, together with the Council of Europe, or contribution to the UN Office of the High Commissioner for Human Rights, are also financed under this instrument, as well as all the EU EOMs. Comments on impact of AFET work in the 6th parliamentary term As for all the other external financial instruments, the supervisory role of the EP regarding the legal as well as the democratic scrutiny of this regulation was increased. A working group, consisting of 1 member from each political group (2 for PPE and PSE) was created, including the two rapporteurs. This working group has met regularly with the Commission services, mainly to discuss the Strategy Paper and further on the Annual Action Plans, as well as to have a regular update on the implementation of the instrument. The adoption of the policy documents has been dealt with through exchanges of letters, where the comments and proposals of the European Parliament have been expressed. Report on the Annual Report on Human Rights in the World 2005 and the EU's policy on the matter (2005/2203(INI)); rapporteur: Richard Howitt (PSE, UK); adopted on 06/05/2006 in AFET, on 18/05/2006 in plenary The report singles out areas where the Council's activity was deserving of praise (the UK Presidency's efforts to combat the death penalty and promote freedom of expression, and the Austrian Presidency's promise to 'continue the practice of demarches in respect of all of the EU's international partners regarding the ratification of international conventions banning the use of torture'); Congratulates the Council and the Commission for the substantial diplomatic success in achieving the referral by the UN Security Council of the case of Darfur in Sudan to the ICC; at the same time expresses concern at the deteriorating security situation in Darfur, and urges the international community to act immediately to stop the violence, while providing substantial support to the African Union as well as a sufficient level of humanitarian aid to the population affected. Welcomes the inclusion of human rights issues in the European Neighbourhood Policy (ENP), and commends the 'increasing effectiveness of EU electoral observation activities.' Praises the Council for imposing sanctions on Uzbekistan, and reiterated their condemnation of the violent repression in Ethiopia and human rights abuses in Tunisia; 'continuing reports of a long list of human rights abuses' in China, the 'extrajudicial killings, disappearances and torture in custody in Chechnya,' and 'Iran's poor human rights record'; welcomes for EU support for the new government in Iraq; asks Council and Commission to 'call upon the US government immediately to close the Guantanamo detention centre' and give the prisoners a fair trial; calls for a 'clear system of sanctions' to be applied to countries that violate the human rights clause in agreements with the Union; Welcomes the first year of activities of the Subcommittee on Human Rights within the Foreign Affairs Committee, which had created a focal point for activities on human rights which was absent during the last parliamentary term. Calls on the Subcommittee to consider setting up small informal working groups to follow each set of Guidelines, so as to be better able to follow the Council's work in this regard and to submit proposals; Calls the Commission to designate at least one permanent post in each third-country delegation as having responsibility for monitoring the human rights situation in the country concerned, promoting international human rights standards and being in charge of relations with civil society, such as relations with human rights defenders. 9. Report on the Human Rights and Democracy Clause in European Union agreements (INI/2005/2057); rapporteur Vittorio Agnoletto (GUE/NGL); adopted on 23/11/2005 in AFET, on 14/02/2006 in plenary In this report the EP welcomed the European Community's general practice of incorporating human rights and democracy clauses – the so-called 'essential elements' and 'non-execution' clauses – into its international agreements since 1992. agreements, such as those on textiles, agriculture and fisheries, as well as agreements with developed countries, still lack the clause. Parliament stated that it was no longer prepared to give its assent to new international agreements that do not contain a human rights and democracy clause. One of the factors that has compromised the application of the clause, was, according to the resolution, the generic nature of its wording: this does not spell out detailed procedures for 'positive' and 'negative' interventions under EU/third country cooperation. Parliament advocated the drafting of a new 'model clause' to correct the current wording, and a clear mechanism based on Articles 9 and 96 of the Cotonou Agreement. Parliament requested an increased role both in defining the negotiation mandate, the process leading up to the decision of the suspension of an agreement and in the monitoring, by being associated with the Association Councils and with the subcommittees on human rights. It also argued for an increased role for the civil society. Comments on impact of AFET work in the 6th parliamentary term The Subcommittee on Human Rights has tried to provide a continuous follow-up to the report. Several of the requests of the report have been taken up in the Annual Report on Human Rights and the inclusion of human rights clauses in sectoral agreements has been repeated in responses to legislative programmes. The role of the clauses has been emphasized in all agreements, and sometimes, the human rights aspects have played a crucial role for the conclusion or postponement of an agreement, such as in the case for Turkmenistan. The Council is currently looking into the possibility of using Articles 9 and 96 as a model for all clauses. 10. Report on the Annual Report on Human Rights in the World 2004 and the EU's policy on the matter (2004/2151(INI)); rapporteur: Simon Coveney (PPE-DE, IE); adopted on 30/03/2005 in AFET, on 28/04/2005 in plenary The report focuses on issues in different regions and countries (the EU's Eastern Neighbourhood; Russia as a neighbour; the EU's Southern and South-Eastern Neighbourhood; Asia; Africa and the Americas) highlighting human rights abuses, and progress; Addresses a number of wider themes, including human rights and the fight against terrorism, children's rights, the impact of conflict on women and children, abolishing the death penalty, trafficking in humans and human organs, the sex industry and child labour, the role of international business in human rights and impunity and the role of the international criminal court; calls for the European Union to provide balanced leadership between the responsibility for human rights and the fight against international terrorism; Urges strongly the Member States to use their influence to press countries to abolish the death penalty (in China, the USA, Saudi Arabia and others). Welcomes the efforts to address the plight of victims of past human rights abuses in Morocco, particularly the establishment of the Equity and Reconciliation Committee; recognises the right of Israel to take measures to provide security for Israelis, and reminds the latter that any counterterrorism measures taken cannot ignore human rights considerations; expresses concern at the existence and scale of a security fence and separation barrier in large parts of the West Bank and its implications for the human rights of local populations; recognises the difficulties faced by the PE423.953v02-00
