Summary On 15 April 2012 twenty years have elapsed since the Czech National Council approved the Act No 246/1992 Coll., on the protection of animals against cruelty (the Animal Welfare Act). The last amendment to this Act and harmonisation with the European Union (EU) legislation was implemented so that it takes effect on 1 January 2013. The Bulletin gives the evaluation of activities and provides information for the period from the second half of 1993 to 2012, while the maps could only be generated starting with 1994. The presented results are based mostly on supervisory activities carried out by inspectors of the State Veterinary Administration and coordinating activities of the Ministry of Agriculture (MoA), the Animal Commodities Department, the Animal Welfare Unit, and of other state authorities. The information also refers to activities performed by the advisory body of the Ministry of Agriculture – the Central Commission for Animal Welfare (CCAW). The data were obtained from the Integrated Agricultural Register of the MoA, the Czech Statistical Office, the EU TRACES information system and the welfare module of the SVA information system. It has already become a tradition to offer an overview of valid legislation and methodology governing the supervisory activities which largely builds on the risk analysis of the “Multi-annual Plan of Inspections“. The evaluation of activities involving farm animals as well as the evaluation of the use of animals in experiments is presented in summaries required by the EU. For individual years a summary of data obtained from the Ministry of Justice is compiled which shows that from 1993 to the end of 2012 a total of 710 persons were prosecuted and 402 persons were convicted for cruelty to animals. The veterinary administration authorities in their supervision of the protection of animals and their welfare conducted a total of 226 862 inspections in the monitored period. In 2012 the inspectors of the Regional Veterinary Administrations (RVAs) carried out altogether 9 150 inspections, with the number of inspections of farm animals reduced to 5 383 based on the analysis of targeted reduction of the number of inspections of farm animals, while simultaneously their efficiency was increased to 6%, measured by the percentage of violation of the AWA. The municipalities with extended powers (MEP) received 136 motions, in 229 cases on-the-spot fines and monetary performance were imposed. It is also positive that in 2012 deficiencies were detected in a total of 766 inspections and as against 2011 (with 316 336 animals concerned ) involved fewer animals, i.e. 131 424 animals. The number of all the motions filed in line with the AWA to the MEP to initiate an administrative procedure in 2012 slightly decreased again, namely from 430 in 2011 to 385 in 2012. In companion animal establishments altogether 3 350 inspections were carried out, deficiencies were detected during 410 inspections and involved 4 624 animals, 2017 financial penalties were imposed and 237 motions were filed to the MEP. The supervision of activities involving wild animals was subject to a total 94 inspections with deficiencies identified in 10 inspections (dressage and other activities), 11 motions were investigated by the MEP. During regular inspections of 21 licensed zoological gardens no deficiencies were detected. In the category of laboratory animals during the total of 123 inspections the deficiencies were detected on one occasion only. In 2012 altogether 390 466 live animals were used for experiments (in 2010 – 366 007 animals; in 2011 – 375 091 animals), of which 78 032 laboratory mice, 31 683 laboratory rats, 7 484 rabbits, 2 949 guinea pigs, etc.; approximately 168 368 birds were banded. Experimental activities and vocational training focusing on animal welfare were performed mostly with funding provided from grants. The 19th “Animal Protection and Welfare” conference attended by foreign experts was traditionally held in Brno. Qualification courses for veterinary surgeons – SVA employees on the performance of supervision of animal protection (Section 26 of AWA) and courses concentrating on the management of experiments on animals (Section 17 para 1 of AWA) took place. With respect to the implementation of Council Directive 2007/43/EU more persons were trained who are responsible for the care of chickens kept for meat production, courses were also held for transporters in line with the requirements laid down in Council Regulation (EC) No 1/2005 on the protection of animals during transport and related operations. Vocational training of persons for the acquisition of qualification for the capture of stray animals and care of them was held and also a course took place in which the trainees acquired the competence of persons responsible for the care of handicapped animals. An accredited training course was also held for MEP employees. The nongovernmental organisation called the Foundation for the Protection of Animals evaluated the grants from the previous period and announced new grants on animal welfare for 2013. This foundation also organised the event called “Fill the bowls” in support of animal shelters for animals in need, which was a success story in the past. Other interest groups of activists held events promoting the protection of animals and their welfare. Generally speaking, though, the funding of such events and sponsorships significantly dropped. The presented data were obtained from the Integrated Agricultural Register of the MoA, the Czech Statistical Office, EU TRACES information system and the welfare module of the SVA information system. E 1. INTRODUCTION The “ANIMAL PROTECTION BULLETIN“, as always, contains information on the protection of animals and their welfare in the Czech Republic (CR). The Bulletin gives the evaluation of activities and provides information for the period from the second half of 1993 to 2012, while for technical reasons the maps could only be generated starting with 1994. Essential in terms of evaluation is the fact that on 15 April 2012 twenty years elapsed since the date of approval of the Act No 246/1992 Coll., on the protection of animals against cruelty (AWA) by the Czech National Council. The last amendment to this Act and harmonisation with the European Union (EU) legislation was implemented so that it takes effect on 1 January 2013. The presented results are based mostly on supervisory activities carried out by inspectors of the State Veterinary Administration and coordinating activities of the Ministry of Agriculture (MoA), the Animal Commodities Department, the Animal Welfare Unit, and of other state authorities. The information also refers to activities performed by the advisory body of the Ministry of Agriculture – the Central Commission for Animal Welfare (CCAW), chaired by Ing. Radim Fiala, a member of the Parliament of the CR. It has already become a tradition to offer an overview of valid legislation and methodology governing the supervisory activities which largely builds on the risk analysis of the “Multi-annual Plan of Inspections“. The information indicates that newly applied were the requirements laid down in the amended or new decrees implementing the referred to Act as well as the relevant directly applicable Community legislation. For the sake of evaluation of activities involving farm animals as well as evaluation of the use of animals in experiments summaries required by the EU are presented. Also a summary of data obtained from the Ministry of Justice for individual years is included, which indicates that from 1993 until the end of 2012 altogether 710 persons were prosecuted and 402 persons were convicted for cruelty to animals. The summary comprises also the penalties imposed during the administrative procedures in 2012. The supervisory activities are analysed in the respective chapters dedicated to individual groups of animals. The summary data covering the period of twenty years are given in charts and selected tables (e.g. number of inspections, number and species of animals used in experiments). Based on hands-on experience it may be stated that the increased incidence of deficiencies within the monitored period was always reported at the time of worse economic conditions for marketing the products of the given group of farm animals or across all the groups once a new law took effect. This suggests that more stress still has to be put on the provision of information and education to breeding community and other experts whose activities are related to the protection of animals and their welfare. It can be illustrated by data covering the whole period of twenty years. Bearing in mind the scope of animal transport, but also the high turnover of drivers and attendants, it is of importance that the certificate of competence for drivers and attendants of animal consignments, which is required by Council Regulation (EC) No 1/2005, on the protection of animals during transport, was acquired by 5 025 persons in the CR at six training centres and that the quality of care of animals has improved in this respect. The course for the acquisition of certificate of professional competence for the care of chicken kept for meat production pursuant to Section 12 para 7 of AWA was attended by the respective personnel of almost all the types of breeding establishments. In reality, these 416 persons ensure the application and inspection of the defined requirements and train in this respect the attendants working in their respective holdings. The vocational training of persons for the acquisition of qualification for the provision of capture of stray animals and care of them has been attended by 1 769 persons since 1995. After two years of holding the training courses, the certificate for professionals responsible for the care of handicapped animals in animal shelters has been acquired already by 75 persons. Earlier than required by Council Regulation No 1099/2009/EU on the protection of animals at the time of killing, the courses were prepared in cooperation with the associations of meat processors for personnel required to hold this qualification. Also other personnel, including expert advisors trained by the MoA, public administration officers – of municipal authorities, and others, are trained in conditions and requirements of animal protection and welfare. Since for the purpose of performance of supervisory activities the veterinary surgeons shall undergo a training course in compliance with Section 26 of the AWA, it shall be noted that since 1992 this certificate has gradually been acquired by 1 135 inspectors. Postgraduate training courses, including thematic seminars on topical matters, are held annually for inspectors performing supervisory activities. The instruction in the field of animal protection and welfare is a compulsory part of the curricula of veterinary study programmes at both the veterinary faculties of the University of Veterinary and Pharmaceutical Sciences in Brno (UVPS). The growing demand for experts with university qualification in the field of protection of animals against cruelty and in the field of active creation of appropriate conditions for animals and inspection of these conditions not only at the level of official veterinary surgeons led to the introduction of a new field of study called Animal protection and welfare at the FVHE of UVPS in Brno. This field of study was accredited in February 2012 and the instruction was launched in the 2012 / 2013 academic year. It is a three-year bachelor study concluded with the state Bachelor's examination, defence of a Bachelor's thesis and award of the academic degree of Bachelor (Bc.). It is followed by a two-year Master's study concluded with the state Master's examination, defence of a Master's thesis and award

of the Master's degree (Mgr.). Similarly, at agricultural universities ever more fields of study cover the topics of animal protection and welfare. At the UVPS in Brno the 19th “Animal Protection and Welfare” conference attended also by foreign experts was held. Moreover, the 27th technical seminar “Topical Issues of Bioclimatology of Animals“ took place. Other specialised seminars focusing on animal welfare were held at agricultural universities / faculties in Prague, Brno and České Budějovice. Also the interest associations of breeders organised various education and outreach activities. Similarly, courses were held for personnel of the municipal authorities of municipalities with extended powers. The topics of animal welfare and ensurance of minimum standards were on the agenda of regional courses and seminars for breeders. Multiple events concentrating on animal welfare took place also on other occasions. The non-governmental organisation called Foundation for the Protection of Animals evaluated the grants for 2011 and announced more grants in the field of protection of companion animals. Development of research and other activities funded from grants is connected to the education and training of experts with university qualification in the field of management, conduct and control of experiments on animals. The course for the acquisition of this certificate pursuant to Section 17 of the AWA was successfully completed by 3 385 university students. Technical matters related to this field were also addressed at conferences held by the Czech Society for Laboratory Animal Science and the Commission for Alternative Methods to Experiments on Animals. Also important is the attention paid to these matters by social sciences which is proven e.g. by seminars called “Topical legal issues related to the amendment to the AWA” held by the Institute of State and Law of the Academy of Sciences of the CR. The expert institutions, including the universities, continued to cooperate and events were held dedicated to the protection of animals with respect to biodiversity and compliance with international treaties (e.g. CITES). Successful was also the seminar organised by the Society for Animals of the Czech Union for Nature on animal protection intended for interest association members. The interest groups of activists held protests against long lasting transport of animals to the third countries, farm breeding of fur animals, and Christmas market sale of fish, and another campaign was launched requesting the setting out of European standards for dairy cows. The activities planned for 2013 comprise the inspection of Cross-compliance requirements in the field of animal welfare pursuant to Article 124 para 5 letter b) of Council Regulation (EU) No 73/2009 establishing common rules for direct support schemes for farmers under the common agricultural policy and establishing certain support schemes for farmers, which constitutes the basic condition for the provision of direct payments and support. It concerns the requirements that shall be subject to inspection ensuing from Council Directive No 2008/119/EC laying down minimum standards for the protection of calves, Council Directive No 2008/120/EC laying down minimum standards for the protection of pigs, and Council Directive No 98/58/EC concerning the protection of animals kept for farming purposes. All the controlled requirements laid down in the above referred to directives are implemented through the AWA and Decree No 208/2004 Coll., on minimum standards for the protection of farm animals. An analysis is being carried out in order to streamline the supervisory activities, including the changes in the multiannual plan which is now in the pipeline. For these reasons and in line with the new EU requirements also a change in reporting the activities in this field can be anticipated which will most likely result also in discontinuation of publishing of this bulletin which in its updated version provided information required based on the methodology valid before the CR joined the EU and in the years after until 2012.
E 2. BRIEF OVERVIEW OF LEGISLATION OF THE CR RELATED TO ANIMAL PROTECTION (status as of 31 January 2013) The animal protection is currently laid down to a higher or lower level of detail in a number of legislation. This body of legislation is so extensive that it is useful to divide it into two categories. It is therefore possible and generally accepted in the field of animal protection to divide it into the so called direct and indirect protection of animals against cruelty. Direct protection of animals against cruelty covers the protection of animals as stipulated by legislation defining, prohibiting and penalising activities considered to be the cruelty to animals. Indirect protection of animals against cruelty covers the protection of animals as stipulated by legislation laying down the care of their health, governing the breeding conditions and handling the animals, including the breeding and stirpiculture, quality and safety of feedstuffs, environmental protection and protection of wild animal species, including the specific conditions of zoological gardens and protection of animals during game management, fishery, trade in animals, and by multiple other public laws. That means the legislation the main aim of which is not the protection of animals against cruelty, which nevertheless through its provisions contribute to the protection of animals.

The above mentioned conventions, including the relevant “Recommendations” constitute the basis for animal protection legislation also in the European Union and their general principles are also enshrined in the Czech legislation.
E 2.4. Changes in legislation governing the protection of animals against cruelty in 2012 The first quarter of 2012 marked the completion of the legislative process related to the proposal for amendment to Decree amending Decree No 208/2004 Coll., on minimum standards for the protection of farm animals, as amended, that had started at the end of 2011. In the framework of setting the minimum standards for the protection of cattle for fattening, the proposal aimed to allow for keeping the cattle with horns in groups together with cattle without horns provided the cattle is allowed access to range or pasture. This provision helps cattle breeders reduce the costs associated with cattle fattening and thus increase their competitiveness. The amendment to Decree was promulgated in the Collection of Laws on 12 March 2012 in Chapter 28 as Decree No 78/2012 Coll., amending Decree No 208/2004 Coll., on minimum standards for the protection of farm animals, as amended. The Decree took effect on 1 April 2012.

In 2012 works continued primarily on another amendment to Act No 246/1992 Coll., on the protection of animals against cruelty, as amended, the preparation of which had commenced already at the end of 2010. The main reason behind this amendment was the necessity to incorporate Council Regulation (EC) No 1099/2009 of 24 September 2009 on the protection of animals at the time of killing in the Czech body of law and to transpose Directive 2010/63/EU of the European Parliament and of the Council of 22 September 2010 on the protection of animals used for scientific purposes. In January 2012 the proposal for amendment to Act on the protection of animals against cruelty was following the discussion by the Government submitted to the Chamber of Deputies of the Parliament of the Czech Republic. The Chamber of Deputies discussed the government bill and adopted some amendments proposed by the Committee on Agriculture of the Chamber of Deputies, and finally adopted the proposal at its 38th session. On 13 June 2012 the government bill was discussed by the Senate of the Parliament of the Czech Republic at its 23rd session, which returned the submitted document with certain proposed amendments to the Chamber of Deputies. The Chamber of Deputies took a vote on the proposal of the Senate on 19 September 2012 and approved the original wording of the bill, which was subsequently referred to the Senate. On 9 October 2012 the proposal for amendment to the Act was signed by the President. On 29 October 2012 the Act was promulgated in the Collection of Laws in Chapter 134 as Act No 359/2012 Coll., amending Act No 246/1992 Coll., on the protection of animals against cruelty, as amended, Act No 634/2004 Coll., on administrative fees, as amended, and Act No 166/1999 Coll., on veterinary care and amending certain related laws (Veterinary Act), as amended. Therefore the amendment to the Act on protection of animals against cruelty became effective on 1 January 2013, which was the deadline for incorporation of the regulation and transposition of the directive into the Czech body of law. Council Regulation (EC) No 1099/2009 of 24 September 2009 on the protection of animals at the time of killing took effect on 1 January 2013. This regulation lays down the rules for the killing of animals bred or kept for the production of food, wool, skin, fur or other products as well as the killing of animals for the purpose of depopulation and for related operations. Directive 2010/63/EU of the European Parliament and of the Council of 22 September 2010 on the protection of animals used for scientific purposes imposes upon the Member States the obligation to adopt and publish by 10 November 2012 the laws, regulations and administrative provisions necessary for the compliance with this Directive. These laws shall be applied from 1 January 2013. This directive establishes measures for the protection of animals used for scientific or educational purposes. Its wording was incorporated in the proposal for amendment to the AWA and resulted in extensive changes in those parts of the Act related to experimental animals. Council Directive 2008/120/EC of 18 December 2008 laying down minimum standards for the protection of pigs in Article 6 imposes upon the Member States to ensure that any person who employs or engages persons to attend to pigs ensures that the person attending to the animals has received instructions and guidance and also to ensure that appropriate training courses are available. This obligation was not stipulated in the AWA, which is why it was later incorporated in the proposal for the amendment to the AWA. The amendment to the AWA also responds especially to ever more stringent EU requirements for the qualification of staff killing the animals or working with experimental animals, and stipulates the minimum requirements for education and vocational training of these persons in order for them to acquire, maintain and document the required qualification, and it also stipulates the requirements placed on the training centre. Apart from that it also introduces new penalties, namely the prohibition of animal breeding and forfeiture of abused animals or seizure of abused animal with the view to effectively prevent the breeder from future cruelty to animal. The amendment, on the other hand, abolishes the rules for the protection of animals during public performance, which will reduce the administrative burden of organisers of public performances as well as of municipalities. The amendment to Act No 246/1992 Coll., on the protection of animals against cruelty, as amended, was accompanied by works on related legislation – the implementing legislation. Decree No 418/2012 Coll., on the protection of animals at the time of killing, was promulgated in the Collection of Laws in Chapter 153 on 4 December 2012. The Decree stipulates for example the way of documenting the appropriate work practice for persons involved in animal slaughter or in killing fur animals, specimen of various certificates, but also requirements for animal stunning. Carried over from the existing decree are the provisions concerning the determination of the weight of selected species of live fish and water ratio (stocking density) in tubs and portable tanks, including the lowest oxygen levels in water and water temperature. This Decree also follows from the directly applicable EU legislation – Council Regulation (EU) No 1099/2009 of 24 September 2009 on the protection of animals at the time of killing, and fully replaces the preceding Decree No 382/2004 Coll. on the protection of farm animals at the time of slaughter, killing or other ways of putting to death, as amended, which was repealed as of 1 January 2013.

Decree No 419/2012 Coll., on the protection of experimental animals, is also linked to the amendment to Act on the protection of animals against cruelty and just like the previous Decree it was promulgated in the Collection of Laws in Chapter 153 on 4 December 2012. This Decree replaced the preceding Decree No 207/2004 Coll. on the protection, breeding and use of experimental animals, as amended. Apart from setting the specimen of various applications or statistical tables, it also defines the requirements for the function and layout of spaces and equipment of facilities in which the experiments on animals are conducted, including the breeding and operating premises, and it also lays down the requirements for the environment and its control (ventilation and temperature, lighting, noise, alarm systems). Also stipulated are the requirements for care of experimental animals and their housing, handling the captured wild animals intended for experiments, and numerous other situations, including the ways of killing of individual species of experimental animals. The Decree took effect on 1 January 2013. At the end of 2012 works were completed on the Decree laying down the conditions for breeding dogs and cats, and first and foremost also on the Decree on education and training in the field of protection of animals. These Decrees are ready to be signed by the Minister and subsequently at the beginning of 2013 to be promulgated in the Collection of Laws.
E 3. ANIMAL PROTECTION PROGRAMME The Central Veterinary Administration of the State Veterinary Administration (hereinafter referred to as the “CVA SVA “) in the field of animal protection pursuant to Section 22 para 1 letter a) of the AWA draws up and implements the animal protection programme and pursuant to letter g) keeps and publishes information on the programme on the SVA website. It is based on provisions stipulating that the activities pursuant to Section 2 letter f) of Act No 166/1999 Coll., on veterinary care and amending certain related laws, as amended (hereinafter referred to as the “Veterinary Act”) comprise the supervision of compliance with conditions and requirements set out by the referred to Act and special legislation (interalia also the AWA) or directly applicable EC legislation [e.g. Council Regulation (EC) No 1/2005 of 22 December 2004 on the protection of animals during transport and related operations and amending Directives 64/432/EEC and 93/119/EC and Regulation (EC) No 1255/97], especially by Regulation of the European Parliament and of the Council (EC) No 882/2004 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules. The methodology of the programme also reflects the requirements and recommendations of DG(SANCO) missions. In order to achieve a uniform procedure of veterinary administration authorities in the field of protection of animals against cruelty and animal welfare, the Methodological Guideline “Animal Protection Programme” (hereinafter referred to as the “MG-AP Programme”) was published, the amendment to which took effect on 1 June 2011. Towards the end of that year with respect to the referred to “MG-AP Programme“ by SVA letter Ref. No 6739/2011 of 21 December 2011 the Multi-annual Plan of Inspections for 2012 was revised and a summary was presented of individual areas of inspections, stating the minimum frequency of inspections and specifying the way of record keeping of the conducted inspection in the framework of SVA Information System (hereinafter referred to as the “RVA IS”). The focus of inspections on farm animal welfare in breeding establishments in 2012 was defined based on the risk analysis. In line with the methodological guidelines the professional activity in the field of animal welfare and protection of animals against cruelty, particularly the methodological guidance of supervision and its performance in selected cases, regular evaluation of activities and submission of measures and professional proposals are at the CVA SVA conducted by the Department of Animal Health and Welfare – Welfare Division of the State Veterinary Administration of the CR. The performance of supervision of the observance of duties imposed upon breeders and other natural and legal persons pursuant to the Veterinary Act, the AWA and the directly applicable EC legislation is entrusted to the competent Regional Veterinary Administrations and the Municipal Veterinary Administration in Prague (hereinafter referred to as the “RVAs“). The qualification prerequisite for the authorization to perform the referred to supervisory and professional activities is the compliance with conditions of Section 26 of the AWA evidenced by a certificate. It is assumed that for the performance of supervisory activities the animal welfare inspector is equipped with personal protection equipment and relevant measuring devices (for measuring the dimensions, temperature, etc.) and aids necessary for the performance of supervision (flashlight, measuring instruments, etc.). The RVA in line with its organisational structure shall designate an officer – Chief Inspector of the RVA for animal welfare, and entrust

him with the management and control of professional activities in this field. It shall also authorise the RVA inspectors – veterinary surgeons to perform the supervision of animal welfare within the respective technical units of their workplace (e.g. veterinary hygiene centres – VHC, slaughterhouses, assembly centres) or within their defined area of responsibility. The Chief Inspector of the RVA for animal welfare is responsible for the management of technical aspects of animal welfare and for the supervision of animal protection at the level of RVA. He manages the technical activities of inspectors – RVA veterinary surgeons for animal welfare, assigns them specific tasks in line with the methodological guideline (hereinafter referred to as the “MG”). As laid down in the MG, he cooperates with the heads of RVA departments in matters concerning animal welfare, coordinates this activity and regularly updates the RVA management or the CVA SVA on his activities. He draws up and checks the plan of inspections carried out in the field of animal welfare. He keeps and archives the technical documents associated with safeguarding animal protection and welfare. He is responsible for record keeping and checking the data on inspections in the database of the welfare module of the SVA IS client. The RVA inspectors – official veterinary surgeons in the field of animal welfare protection, to the extent laid out in the assignment and instructions of the Chief Inspector of the RVA for animal welfare, shall perform the supervision of animal protection and welfare at their workplace (e.g. assembly centre, slaughterhouse) or within their defined territorial responsibility. They keep technical documents relevant for the ensurance of animal protection and welfare within their area of responsibility. They ensure record keeping, checking and archiving of inspections in the database of the welfare module of SVA IS client. They evaluate the results obtained in the respective area under their territorial responsibility. In keeping with the set guidelines they provide written or other topical information on their activities to the Chief RVA inspector for animal welfare, particularly in case of inspection findings of violation of animal protection legislation where they are involved in the preparation of supporting documents for further procedure. The RVA inspectors – veterinary surgeons in the field of veterinary hygiene and public health (hereinafter referred to the “VHC inspectors”) ensure specific professional and supervisory activities in the framework of protection of animals against cruelty and animal welfare by: a) regular (“daily“) checks on animal protection and welfare during the transport of animal consignments to slaughterhouses, b) regular (“daily”) checks on animal protection and welfare at the time of slaughter, c) regular (at least once every quarter) evaluation of findings detected in the inspections of meat and organs, d) checks on “ritual slaughters“ – at every slaughter, e) random checks on the seasonal sale of live fish – 5 % at least, f) at least quarterly inspection focused on records held by the operator on the arrivals and unloading of animal consignments, checks on the slaughtering devices and equipment used, etc. The data is recorded in accordance with principles as defined in the user’s manual entitled Methodological support of the SVA Department for information and communication technologies for work with the Client of the SVA Information system – Explanation of control points in record keeping of welfare inspections in the welfare module of the SVA IS Client (hereinafter referred to as the “DICT manual”). The above presented basic division of the specific professional and supervisory activities in the framework of protection of animals against cruelty and animal welfare within the RVA does not exclude the substitutability of inspectors and performance of other activities than those defined by the plan (e.g. extraordinary inspections of the CVA SVA or RVA). Nonetheless, it is sought to observe the principles of the referred to system because of links between the supervisory activities in the protection of animals and core professional activities as well as other vocational training and provision of organisational and professional information. It is also possible that based on specific conditions also another RVA officer may become involved in the performance of supervision provided he satisfies the qualification requirements. In the conduct and evaluation of the scope of supervisory activities the differences between the activities in individual regions shall be respected, such as different intensity and specific level of agricultural production and other professional specifics of the administrative area (e.g. predominance of supervisory activities in companion animals in large towns and cities). The determination of frequency of inspections and planning of the activities follow the methodology of the Multi-annual Plan of Inspections (MPI) for the given year. The RVA inspectors for the field of animal welfare, apart from the documents in PC database, complete and in compliance with the prescribed requirements archive the “Protocol on control findings” and other prescribed documentation (e.g. the copies of documents on approval of vehicles, type-1, type-2 certificates of approval of vehicles).

Based on the ascertained findings the CVA SVA develops topical overviews of activities in the field of protection of animals against cruelty and animal welfare. Monthly, no later than on 15th of the following month, it publishes the results of inspections in the requested scope on the SVA website. The annual results of the “AP Programme” are presented to the MoA. In accordance with requirements of international treaties and conventions (in bilingual version), the results of this Programme are also submitted to the Standing Committee on the Food Chain and Animal Health of the EC. Professional control of the accomplishment of supervisory activities by individual RVA inspectors with the defined territorial responsibility and by VHC inspectors in the field of supervision of animal welfare is conducted by the RVA Chief Inspector for animal welfare, or the RVA inspector designated by the RVA Director at least once a year. This professional control comprises the verification of the professional standard, including the conduct of physical check of activities performed by individual inspectors during a selected inspection. Professional control of the accomplishment of the MPI, MG – AP Programme and other guidelines by individual RVAs is conducted by the head of the Animal Welfare Division of the CVA SVA, or an inspector designated by the CVA SVA Department of Animal Health and Welfare Director. This control is supported by audits carried out in line with the schedule by the Control Unit of the CVA SVA staff.
E 4. SUPERVISORY AND CONTROL ACTIVITIES The presented information on the number of animals was obtained from the Integrated Agricultural Register, the Czech Statistical Office, MoA, EU TRACES information system and the welfare module of the SVA Information System. Inspections in the field of animal welfare were conducted at farms, in animal breeding establishments (i.e. breeding of companion animals, animals requiring special care) or at places of animal gathering and other activities involving animals (slaughterhouses, animal gatherings, public performances, pet stores, animal shelters and rescue stations for handicapped animals, zoological gardens, circuses and establishments conducting experiments on animals). Subject to inspections was also animal welfare during national and international transport. At slaughterhouses animal transport and standard and ritual slaughters were checked. The supervisory activities included also multiple partial inspections carried out simultaneously at a single establishment, namely when e.g. different types of breeding technology and different categories of animals had to be inspected. The core supervisory activities in 2012 consisted in planned inspections. The number and the type of planned inspections was determined by the MPI which lays down the minimum annual frequency of inspections or the minimum percentage of inspected entities of the total number of entities. The animal welfare inspections carried out at farm animal establishments were planned based on the centrally conducted risk analysis updated always for the given year. The rate of risk was assessed based on the criteria such as the number of animals in the establishment, the species of farm animals kept, the date of the last inspection, the deficiencies detected during the inspections, and the number of animals moved to slaughterhouses and rendering plants in the previous year. For the year 2012 the significance (weight) of individual parameters was modified. The inspections were scheduled based on the number of establishments at the beginning of the year. The Plan of Inspections was continuously monitored and modified. Over and above the planned inspections also unplanned and extraordinary inspections took place, in response to changes made and new requirements imposed in the course of the year (e.g. motions and complaints filed, based on similar negative findings in other areas of animal husbandry) or as follow-up checks of the fulfilment of instructions imposed in order to remedy the identified deficiencies, the so called corrective measures. There were also extraordinary inspections organised by the SVA or RVA, or inspections required by other authorities (MoA, MoE, etc.). In the framework of supervision of the protection of animals and their welfare, the veterinary administration bodies carried out 226 862 inspections throughout the period concerned (1993 – 2012). In this Bulletin the evaluation of these activities is presented in charts and maps. The presented maps (see Supplements 23 – 31) show the distribution of supervisory activities and compare the situation in 1994 and 2012. (This comparison is influenced by the fact that for technical reasons the maps could be generated and presented only starting with 1994). In 2012 the RVA inspectors conducted a total of 9 150 inspections (see Supplements 1 – 2), while based on the analysis the number of inspections in farm animals was intentionally reduced to 5 383, while their effectiveness judging from the share of law violations rose to 6%. The authorities of municipalities with extended powers (MEP) received 136 motions, on-the-spot fines were inflicted and monetary performance was made in 229 cases.

It is also positive that in 2012 deficiencies were identified during a total of 766 inspections and compared to 2011, when 316 336 animals of all species were involved, they concerned a smaller number of animals, i.e. 131 424 animals; It shall however be noted that in these cases the suffering of animals was more severe. The number of all the motions to initiate the administrative procedure pursuant to the AWA submitted to the MEP in 2012 slightly decreased from 430 in 2011 to 385 in 2012. Based on the data provided by the Ministry of Justice, a summary of judicial proceedings of criminal cases is given (see Supplement 13), according to which a total of 710 persons were prosecuted and 402 persons were convicted for cruelty to animals from 1993 to the end of 2012. In the last three years the number of convictions exceeded 20 cases annually. In 2012, 13 persons were prosecuted, 10 persons were charged, 21 persons were heard in summary pre-trial proceedings, 20 persons were proposed for punishment, and 23 persons were convicted. The number of inspections, administrative acts, including penalties, is presented in a breakdown by region and RVA territorial responsibility in Supplement 14. The penalties reflected the specific control findings detected during the supervisory activities of individual RVAs and were, as shown in the summary, addressed at various levels of administrative procedure. It shall be pointed out that during a single inspection the inspector can control multiple animal categories in different husbandry technologies and multiple kinds of activities involving animals. Potential legal actions, if initiated as a consequence of such inspections, are then related to the inspection as a whole. It is impossible to assign them explicitly to one single inspected animal category only or to one single inspected activity involving animals. When examining the presented tables, one should bear in mind that sums total in one table cannot be compared (e.g. for the reason of simultaneous violation of several provisions of the law in a single establishment) with those given in other tables, arrived at by different methodology. The differences in numbers are also caused for example by the prescribed evaluation methodology e.g. in case of tables for the EC etc. The Supplement 7a, in accordance with the European Commission requirements, provides “Information on inspections of selected animal species and categories pursuant to Directive No 98/59/EC” in percentage (see Supplement 7b). Similar data on inspections of other selected animal species and categories pursuant to Directive No 98/59/EC in percentage are provided in Supplements 8a, 8b. Also Supplements 9a, 9b “Annual report on the protection of animals during transport” are drafted in line with the EC requirements. The summary of deficiencies detected during inspections pursuant to the AWA, the Veterinary Act and Council Regulation (EC) No 1/2005 (see Supplements 10a, 10b; 11; 12) comprises the violations of individual provisions of the respective Act or Regulation. The codes given in the respective table correspond with the designation of sections, paragraphs and letters of the referred to Act or the articles, paragraphs and letters of the Regulation. Due to the amendment to legislation this list keeps expanding. For the sake of clarity and to make the text shorter, the publication includes only the codes of sections that had been violated. Apart from non-compliances with conditions of animal protection and animal welfare, the inspections also detected 310 deficiencies in identification and registration of farm animals (Act No 154/2000 Coll.) that are crucial for the performance of inspection as such and that have been addressed in line with effective rules and regulations. When evaluating the individual categories of animals (individual activities involving animals), the results are automatically assigned to all the categories of animals (activities involving animals) that were subject to inspection. The Supplements 17 – 22 illustrate the dynamics of development since the beginning of the monitored period, i.e. since 1993. An increase in the number of inspections and of course also in the number of penalties can be reported e.g. in case of targeted inspections. Based on the results of individual groups of animals the highest percentage of recommended measures has since the beginning of monitoring always been reported.
E 4.1. Supervision of the protection of farm animals In 2012 a total of 5 383 inspections involving more than 17 million animals (see Supplement 1) were carried out in the framework of supervision of the group of farm animals. The deficiencies were detected during 326 inspections and concerned 126 601 animals. A total of 136 motions were submitted to municipal authorities of MEP, 22 on-the-spot fines were inflicted, monetary performance was imposed in 191 cases in administrative procedure In 2012 a total of 3 323 inspections were conducted in farm animal breeding establishments, of which 1 656 planned and 1 663 unplanned ones. In 2012 all the planned inspections were carried out. The extent of conducted supervisory activities shall be judged in light of the data on population of farm animals in the CR as reported pursuant to the prescribed methodology by the Czech Statistical Office (CSO) always as of 1 April of the given year. A different methodology for determining the number of animals in individual months is used by the Integrated Agricultural Register (IAR), these figures are used in some tables. It shall be

noted that due to the application of different methodology these sets may substantial differ in the reported data. For the sake of evaluation also the number of animals slaughtered in the CR is given (see Supplement 15). The analysis of inspections conducted in farm animal establishments (see Supplement 16) indicates that 81 % of inspected animals were poultry. In terms of the number of conducted inspections, however, only 7 % of inspections concerned poultry. On the contrary, due to the size of establishments a fairly large percentage of inspections (35 %) had to be carried out in cattle establishments, whereas the cattle constituted only 1 % of inspected animals. Similar figures are seen in pig, sheep and goat farms. The presented charts show the distribution of supervisory activities performed in the period from 1993 to 2012. The number of inspections of monitored activities suggests that in recent years the number of inspections involving farm animals keeps dropping due to the decreasing number of heads of cattle and simultaneous intentional reduction of administrative burden of breeders (see Supplement 17 – 18). The number of recommended measures and violations of the AWA on the contrary increased (see Supplement 21 – 22). Generally speaking, it may be stated that the higher number of deficiencies and lower standard of animal welfare in case of farm animals is usually reported in the period of lower economic interest in products of the given animal species (e.g. decrease in farmgate prices of meat, milk, etc.). The long-term monitoring suggests that the increase in the number of deficiencies is generally revealed in specifically targeted inspections or once some new laws take effect. This underlines the necessity of timely provision of information to breeders. Activities involving cattle. Many different ways of using the cattle (see Supplement 3) were subject to 2 673 inspections (in 2011: 1 979; in 2010: 5 201; in 2009: 6 464) involving a total of 263 256 animals of all categories (in 2011: 274 861; in 2010: 697 708; in 2009: 353 284), which represented 35% of the total number of inspected farm animals (see Supplement 16). The given data do not include the data of daily welfare checks in consignments of animals at slaughterhouses and the same applies to all the other animal species mentioned below. Deficiencies were detected during 116 inspections (in 2011: 118; in 2010: 149; in 2009: 155) and involved 3 730 heads of cattle (in 2011: 3 883; in 2010: 5 032; in 2009: 2 541) – see Supplement 3. In line with requirements laid down in Directive 98/58/EC, the inspections in cattle breeding establishments focused on various age categories of animals. The IAR does not monitor the husbandry technology used which would facilitate the reporting of the number of holdings with calves on milk nutrition and the number of holdings with calves on plant nutrition. Therefore the given value refers only to the category of “calves” and subsequently the findings are reported with the use of the Client welfare module which provides the classification into the respective categories. Thus it is stated (see Supplement 7 a, b) that pursuant to EU methodology, of 9 585 holdings keeping calves 643 holdings with calves on milk nutrition were inspected (in 2011: 708) and deficiencies were detected in only 15 holdings (in 2011: 21). Moreover, 752 holdings with calves on plant nutrition were registered and inspected (in 2011: 824) and deficiencies were identified in 27 holdings (in 2011: 32). Of the total of 18 779 cattle holdings (in 2011: 22 518) registered as of 1 January 2012 as active with cattle rearing altogether 1 632 holdings were subject to inspections (in 2011: 1937) and deficiencies were identified in 94 holdings (in 2011: 106) – see Supplement 8. Most of the cases of non-compliance with legislative requirements consist in deficiencies when ensuring appropriate conditions for the care of animals. In winter and spring particularly inappropriate feeding and watering is detected (frozen water supply, insufficient daily ration). In summer season the most frequently detected shortcomings relate especially to the failure to provide adequate animal hygiene conditions, or the failure to provide the required aids (aids necessary for partuition, etc.) Moreover, the prescribed daily checks failed to be carried out and the detected shortcomings were not removed by breeders. The inspections were made more difficult due to the concurrent identified deficiencies associated e.g. with non-compliance with the requirements for registration and identification of animals. Activities involving pigs. Diverse activities involving pigs were subject to 1 434 inspections (in 2011: 668; in 2010: 1 642; in 2009: 1 834) involving 262 281 pigs (in 2011: 313 598; in 2010: 628 237; in 2009: 849 691) – see Supplement 3. During 122 inspections carried out in holdings deficiencies were detected (in 2011: 80) and involved 3 730 pigs (in 2011: 7 740 pigs). The share of inspected heads of pigs represented 3 % of the total number of inspected pigs, whereas the share of the number of inspections in pig holdings in the total number of inspections accounted for 20 % (see Supplement 16). Not even in this year did the IAR make it possible to monitor the different husbandry technology in order to facilitate the reporting of holdings with group pens and individual pens in individual categories of pigs (see Supplement 7). The results of inspections for the purpose of evaluation in accordance with Directive No 96/58/EC were therefore analysed only based on the information given in inspection protocols, with the group housing technology of pigs (in pens) being inspected in 711 holdings (in 2011: 577; in 2010: 806) and the individual

housing in 466 holdings (in 2011: 314; in 2010: 332). The share of detected deficiencies based on this methodology thus represented 3.2 % and 2.8 % respectively (see Supplement 8). Activities involving sheep and goats (see Supplement 4) were in 2012 inspected in farm animal breeding establishments and companion animal establishments during 1 605 inspections (in 2011: 791; in 2010: 1663, in 2009: 868) involving 43 714 sheep and goats (in 2011: 5 388; in 2010: 83 440). Deficiencies were detected during 144 inspections (in 2011: 67) and involved 2 082 animals (in 2011: 725). The CSO again registered an increase of 108 % in registered sheep and of 102% in goats. Pursuant to the EU methodology (see Supplement 8), at the beginning of the year 14 058 (in 2011: 19 028) sheep breeding establishments were registered. Inspections of a total of 967 holdings (in 2011: 1 041) were carried out and deficiencies were detected in 92 holdings (in 2011: 88). Similarly, 5 645 (in 2011: 9 230) goat breeding establishments were registered, which were subject to 485 (in 2011: 557) inspections with deficiencies identified in 3 holdings (in 2011: 65). Activities involving horses (see Supplement 4). A total of 723 (in 2011: 791) inspections of horse breeding establishments involving 11 892 (in 2011: 5 388) horses were carried out, during which deficiencies were detected in 82 (in 2011: 67; in 2010: 45) inspections and concerned 898 (in 2011: 725; in 2010: 604) horses. Altogether 136 inspections (in 2011: 161) were conducted on the occasion of horse races, exhibitions and other public performances with horses and involved 7 327 (in 2011: 7 157) horses. It shall be reiterated that due to different methodology the individual data sources report different numbers of registered horses. Pursuant to the CSO methodology there are 33 175 horses (in 2010: 29 887) used for farming purposes which means a 107 % increase. As mentioned above, the IAR monitors the number of all the registered horses and reports a total of 74 926 horses. The number of deficiencies rose to 76 (in 2011: 16), especially in companion animal establishments and they involved 822 horses (in 2011: 17). Deficiencies consisted mostly in improper or negligent care of horses (malnutrition, persisting injury) and use of unsuitable aids. There were 82 doping controls (in 2011: 131), all with a negative result (in 2011: 3 positive findings). In the monitored period the highest number of positive doping controls was reported in 2003, namely in 5 cases. In 2004, 2006, 2008 the doping controls in horses were negative in all the cases. Activities involving poultry. A total of 504 inspections (in 2011: 290; in 2010: 607; in 2009: 886) were carried in gallinaceous poultry and water fowl (see Supplement 6) involving 241 841 birds (in 2011: 10 724 016 birds; in 2010: 19 207 518; in 2009: 21 270 902). Deficiencies were found in 16 cases (in 2011: 14; in 2010: 17). It shall be noted that also farms with less than 350 laying hens were subject to this set of inspections. In laying hens and broilers holdings, the inspections covering husbandry and other activities involving poultry concentrated also on the implementation of Salmonellosis eradication programme. Similarly to previous years, particularly in summer season the inspections revealed difficulties with ensuring animal hygiene conditions (e.g. overheating of houses lacking adequate ventilation, microclimate defects, moist litter). No deficiencies were detected during the inspections carried out at exhibitions and similar public performances, just as in the previous years. In laying hen establishments the evaluation pursuant to the methodology laid down in Council Directive No 98/58/EC (see Supplement 7) was performed in 2012. The inspections of laying hens establishments with more than 350 birds in cage systems focused on the compliance with conditions of enriched cage technology. Also conducted were 9 unplanned inspections of establishments which had notified the cessation of activities in unenriched cages. Of 9 inspected establishments 8 were converted to other purposes, in one of the premises the unenriched cages were not removed, nevertheless no poultry was kept there. In holdings with other categories of domestic fowl (see Supplement 8a) a total of 663 establishments were registered (in 2011: 537), inspections were conducted in 61 holdings (in 2011: 84) and deficiencies were detected in 3 holdings (in 2011: 2) – see Supplement 8. The inspections were carried out to some extent in connection with inspections of poultry slaughtering. For the sake of implementation of Council Directive 2007/43/EC, a total of 30 persons were trained in 2012, which means that altogether 416 persons responsible for the care of chickens kept for meat production have been trained so far, by which the requirement for sufficient training was met. The identified deficiencies were qualified as breeding in unsuitable premises (insufficient ventilation, smothering of birds, etc.) and as non-compliance with the requirements for husbandry practices (e.g. non-compliance with animal hygiene conditions). Goose holdings: in 1 holding deficiencies were detected in feeding and watering, altogether 11 farms (in 2011: 17; in 2010: 31) were inspected. Duck breeding establishments: 22 establishments were inspected (in 2011: 20) and deficiencies were detected once in housing premises and once in husbandry practices. Turkey farms: During 6 inspections (in 2011: 84) no deficiencies were identified. Ratites – ostrich farms: During 19 inspections (in 2011: 19) 1 case of inappropriate housing was detected (small space, insufficient range areas).

Activities involving rabbits. The inspections focused first and foremost on companion animal establishments, 38 inspections were carried out (in 2011: 40; in 2010: 35) at exhibitions and other public performances and involved 6 256 rabbits. As against the year 2010 when in 7 cases deficiencies were detected (failure to meet the requirements laid down in the rules, failure to apply for the approval by the municipality, animal escape), no deficiency was identified in the last two years and the conditions of the rules of protection of animals at public performance were met. Activities involving fur animals. There are no companion animal establishments registered, according to the ascertained facts, however, in the course of the year more establishments were closed as a consequence of the required change in technology consisting in larger space requirements in cages and the obligation to acquire a certificate for killing these animals starting with 2013. No deficiencies were detected during 5 planned inspections and visits performed by the MoA Animal Welfare Unit staff on red fox and mink farms based on the initiative of activists through media coverage. Activities involving freshwater fish intended for human consumption (see Supplement 5). The control of this category of fish consisted in a total of 332 inspections (in 2011: 444; in 2010: 371) involving more than 2.2 million fish. The largest number of inspections (155) concerned the fish slaughtering with deficiencies were detected in 3 cases. Even though especially the Christmas market sale of fish was consistently supervised and the incidence of deficiencies is minimum, the activists as every year organised their protests.
E 4.1.1. Supervision of the protection of animals at slaughter The summary of the number of slaughtered animals in the CR in 2011 and 2012 based on the SVA data is presented in Supplement 15. With the exception of an increase reported in the number of slaughtered poultry to 117 million birds (in 2011: 114 million), the number of slaughtered animals of all the other animal species declined. Comprehensive inspections at slaughterhouses. In terms of the protection of animal welfare at slaughter (inspection of the equipment of slaughterhouses with respect to animal welfare, inspection of record keeping, care of animals, potential accommodation of animals for slaughter, conditions for stunning and bleeding, etc.) in 2012, apart from regular daily checks of animal welfare at slaughterhouses, a total of 825 comprehensive inspections were conducted (see Supplement 2; the chart in Supplement 19). The minimum total number of planned inspections was adhered to and in majority of RVAs the number of these inspections was even higher for reasons of addressing the previous deficiencies, motions, complaints, audit results, implementation of corrective measures and binding instructions. Included in these comprehensive inspections is also the regular evaluation of pathological-anatomical findings at slaughterhouses. Apart from inspections carried out at slaughterhouses, in 2012 altogether 188 inspections focused on slaughtering farm animals outside the slaughterhouses (e.g. slaughtering of farmed game, killing the fish during market sale, home slaughtering of cattle). Following 17 comprehensive inspections a motion to initiate the administrative procedure was submitted to authorities of the MEP. Additional measures taken are included in Supplement 2. Daily inspections of consignments at slaughterhouses in terms of animal protection consist in the inspection of documentation accompanying the consignment, inspection of compliance with the set conditions of transport (duration of transport, distance, prescribed rest periods), including the inspection of the status of vehicle, ante-mortem inspection of animals and evaluation of their clinical status, checks of handling the animals at slaughterhouses and the actual slaughtering of animals as well as checks of its effectiveness. In the next section the selected deficiencies detected in individual types of animals for slaughter will be listed. Slaughtering the cattle for slaughter. In the set called “Daily inspection of animal welfare at slaughterhouses by place of slaughter” a total of 101 423 inspections were registered (in 2011: 102 239; in 2010: 106 360). Altogether 17 consignments of cattle for slaughter were considered non-compliant (in 2011: 40; in 2010: 70), of which in 13 cases the health status of cattle (injuries, fractures) was found non-compliant plus there was 1 case of inadequate and 1 case of insufficient stunning and bleeding. Slaughtering the pigs for slaughter. Of 57 065 inspected consignments (in 2011: 64 705; in 2010: 70 226) a total of 336 consignments were non-compliant (in 2011: 440; in 2010: 395). Most frequently the reason in 226 consignments was the death of pigs during or after transport and during 101 inspections the pigs were found unfit for transport (transport of inadequate weight categories, etc.). Shortcomings in unloading were identified during 5 inspections. Slaughtering the poultry for slaughter. Inspections were carried out in 6 602 consignments (in 2011: 6 968; in 2010: 7 848). Deficiencies were registered in 6 means of transport (non-compliance with capacity standards, failure to reduce the adverse weather conditions, etc.). In 49 consignments higher number of deaths occurred.

Horse slaughtering. Since horse slaughters are more closely followed by the general public than the slaughtering of other animals, a summary is presented for 2008 – 2012 period (in 2008: 287 horses; in 2009: 332; in 2010: 328; in 2011: 432). In 2012 a total of 407 slaughtered horses were registered (see Supplement 15). During 4 comprehensive inspections the facilities and equipment of slaughterhouses authorised to slaughter this animal species were inspected as well as the slaughter of 5 horses. No deficiencies, however, were detected. inspection. These data prove that the slaughtering of horses occurs only exceptionally in the CR and adequate care is paid thereto. Slaughtering the animals outside the slaughterhouses (e.g. slaughtering the farmed game, killing the fish at the market sale, home slaughters of cattle) was in 2012 inspected during 188 inspections. “Ritual slaughters”. Specific slaughterhouses have been granted the authorisation by the MoA to perform ritual slaughters for the purposes of churches and religious societies in the CR, namely based on inspections of approved slaughtering technologies. In 2012, there were 15 valid exceptions/authorisations for the total of 14 slaughterhouses (some slaughterhouses were authorised to perform both the kosher and halal slaughters). In 2012, a total of 16 inspections were performed within the control of the ritual way of slaughtering, also conducted were 3 comprehensive inspections of “ritual slaughters”.
E 4.1.2. Supervision of the protection of animals during transport The conditions of animal transport (road and railway) in all the animal species were inspected in accordance with Council Regulation (EC) No 1/2005. The Supplement 2 gives the number of deficiencies and imposed penalties for all the animal species transported by road, rail and air. The Supplements 9a, b provide an overview and percentage of deficiencies detected in the transport of farm animals by the EC methodology in line with requirements laid down in the referred to Regulation. This set of inspections covers also the daily checks of consignments of animals transported to slaughterhouses. Number of exported and imported animals can be monitored by animal species. National transport of farm animals In 2012 a total of 318 inspections were conducted focusing on the compliance with conditions and requirements for national transport of animals laid down in Council Regulation No 1/2005. The inspections concentrated primarily on the transport of farm animals intended for breeding or animals transported to animal gatherings. Subject to inspections were the fitness and clinical status of animals, equipment and maintenance of the means of transport, professional competence of attendants and other requirements stipulated in the referred to Regulation. International transport of farm animals Similarly also the international transport of farm animals was inspected. In total 544 inspections were carried out. Apart from animals and equipment of the means of transport also inspected were the approvals of vehicles for this type of transport (type-2 certificate) and their registration, and professional competence of attendants. The most frequent reason for unplanned inspections was the notification by a competent authority of another EU Member State or non-governmental organisations. These inspections concerned the Czech transporters or transport of consignments by a foreign transporter across the territory of the CR. Special attention was paid to monitoring the conditions of transport of animals to the third countries, cattle to Turkey in particular. When inspecting these consignments the deficiencies that according to the information provided by interest animal protection organisations had been allegedly detected outside the EU territory were not confirmed. Transport of other animals (except for farm animals) In total, 121 inspections were carried out focusing on the conditions of animal welfare, equipment of the means of transport, registration of vehicles and professional competence of attendants. Also in this group of animals conditions of animal transport in international trade within the EU Member States were inspected. The inspections concerned the transport of animals by Czech transporters as well as transporters holding the authorisation from another Member State. Even though the EC conducted an evaluation of implementation of Regulation No 1/2005, due to still unclear technical requirements difficulties prevail concerning the checks of compliance with and practical implementation of the provisions of this Regulation, especially during inspections of transit transport and approval procedure. At 6 training centres 28 additional training courses were held for the acquisition of certificate of competence for drivers and attendants pursuant to Article 17 para 2 of Council Regulation No 1/2005, last year a total of 583 persons were trained and obtained the certificate. Since the beginning of their existence the courses have been attended by 5 025 trainees.

The SVA personnel also participated in special meetings at the level of EU held in order to coordinate the implementation of Council Regulation No 1/2005 and in training courses on the transport of animals under the “Better Training for Safer Food“ project.
E 4.2. Supervision of the protection of companion animals E 4.2.1. Companion animal establishments except for animal species requiring special care The activities involving companion animals (see Supplement 1) were subject to 3 350 inspections (in 2011: 3 491; in 2010: 3 615) involving 943 087 animals (in 2011: 2 163 287; in 2010: 2 223 549). Deficiencies concerning 4 624 animals (in 2011: 48 243; in 2010: 6 365) were detected during 410 inspections (in 2011: 448; in 2010: 398). The size of these sets is influenced by the fact that activities involving companion animals in some cases concern large groups of animals such as aquarium fish, small rodents and bird species kept as companion animals. The Supplement 1 gives the number of imposed penalties. In 2012, a total of 1 655 inspections (in 2011: 3 491; in 2010: 3 615) were carried out directly at companion animal establishments (see Supplement 1). The inspections are most frequently carried out upon initiatives of citizens (suspected cruelty to animals or other law violations), and as follow-up inspections following the detection of deficiencies (the most often detected deficiency were inappropriate breeding conditions). The data concerning activities involving dogs are included in Supplement 5. Repeatedly, several dog breeding establishments with considerable number of animals (canine commercial breeding establishments) kept under non-compliant conditions were identified. The media covered several cases of injured persons, which pointed at poor training of dogs by their keepers, or inappropriate care of a larger number of animals. Several cases of poisoning of dogs were dealt with at various places. Supervision of activities involving domestic cats consisted mainly in inspections carried out mostly upon initiatives of citizens. Deficiencies were detected in 18 cases. No deficiencies were detected during inspections at exhibitions of exotic birds, aquarium fish and reptiles. This has proven that the introduction of the rules of protection of animals at public performances helped improve the quality in majority of activities involving companion animals.
E 4.2.2. Breeding of animals requiring special care In total 521 inspections (in 2011: 519; in 2010: 419) were carried out. Beyond the planned inspections included in the MPI (to be conducted once a year), unplanned inspections were conducted in the event of setting up a new entity, upon initiative of administrative authorities pointing at an unauthorised breeding establishment, or upon initiatives of citizens (suspected cruelty to animals). Moreover follow-up inspections were carried out once the deficiencies were detected. Deficiencies were detected during 18 inspections and involved 210 animals, the overview of the imposed penalties is given in Supplement 1.
E 4.2.3. Shelters for stray and abandoned animals In 2012 (see Supplement 2) altogether 166 inspections were carried out (in 2011: 146; in 2010: 117) involving 4 404 animals (in 2011: 4 703; in 2010: 4 233). Contrary to the years before no deficiencies were identified (in 2011: 3; in 2010: 3). With the view to provide qualified persons for capture of animals in line with the requirements stipulated in the Veterinary Act the vocational training in the form of courses on capture of stray and abandoned animals and their handling continued to be held, the content of which is defined in Decree No 296/2003 Coll., on animal health and its protection, on movements and transport of animals and on authorisation and professional competence to perform certain professional veterinary activities. The courses took place at the UVPS Brno as has been the case every year ever since 1995, and the certificate for the delivery of these activities has been acquired already by 1 769 persons. An outstanding issue is represented by unregistered shelters and various associations providing an umbrella for natural persons who in order to rescue the animals take care of stray and abandoned animals at their dwellings and fail to observe the basic rules stipulated by the AWA and the Veterinary Act. Thus, often times they put at risk the reputation of traditional establishments and also the epizootic status in the territory of the CR (imports of unvaccinated dogs of poor health transported from abroad).

E 4.2.4. Pet stores In 2012 altogether 758 inspections were carried out in pet stores (see Supplement 2). Apart from the planned inspections in pet stores, included in the MPI, also unplanned inspections were carried out in the event of setting up a new entity, upon initiative and complaints pointing at non-compliant conditions of sold animals, and follow-up inspections. When discussing the amendment to the AWA proposals were submitted to introduce a set of new penalties and special measures pursuant to Section 28a which would help improve activities of the MEP authorities. Also a proposal was submitted to define the conditions of dog establishments keeping higher number of dogs or doing business in this field, which however was not adopted by law makers.
E 4.2.5. Other activities related to the protection of companion animals Scientific papers and outcomes of research were presented at the traditional 19th Protection of Animals and Welfare 2012 conference held at UVPS in Brno, at the 27th technical seminar “Topical Issues of Bioclimatology of Animals 2012 and at the seminar held by The Society for Animals of the Czech Union for Nature on animal protection which was intended for interest organisations. The Foundation for the Protection of Animals has again evaluated the grants for 2011 and announced more grants for 2012 in order to improve the conditions of companion animal establishments and controlled regulation of stray animal population. Considered a success story was also the event called “Fill the bowls” organised also by this Foundation, the aim of which was to collect feedstuffs for shelters for animals in need. A series of lectures and presentations of breeders with animals were given at the “Pro Pet 2012” trade fair in Prague dedicated to breeding and protection of companion animals.
E 4.3. Supervision of the care of wild animals The supervision of activities involving wild animals consisted in a total of 294 inspections involving 35 775 animals (in 2011: 70 913; in 2010: 56 143; in 2009: 57 911) and deficiencies were detected during 10 inspections (in 2011: 12; in 2010: 26; in 2009: 13) involving 198 animals (in 2011: 270; in 2010: 729). Altogether 11 motions (in 2011: 10; in 2010: 19; in 2009: 9) to initiate the administrative procedure were submitted to the municipal authorities of the MEP, the penalties imposed are included in Supplement 1. The rescue stations for handicapped animals were subject to 43 inspections involving 1 918 animals. No deficiencies were detected. Another training course was held and thus a total of 75 persons, who successfully passed the examination, acquired the necessary qualification and were granted the certificate of professional competence of persons responsible for the care of handicapped animals. Zoological gardens. In 2012 altogether 30 inspections were carried out in ZOOs, many of which were conducted in connection with control in the framework of licensing procedure. A total of 8 unplanned inspections were performed due to the necessary control of conditions of care of animals in ZOOs and in order to obtain the approval certificate of new pavilions, including the inspections related to the building permit procedure. Together with the MoE and the Czech Environmental Inspectorate (CEI) the SVA made efforts to extend the cooperation in the field of seizure of protected animals, the trade in which is prohibited, and their placement in rescue centers, which due to the conditions of transport and often unknown epizootic status poses a risk in terms of animal health and welfare. Animal training (dressage). As concerns the animal welfare inspections in circuses in 2012 a total of 13 inspections focused on conditions of animals kept in circuses' winter quarters, 68 inspections focused on public performances of establishments performing animal training. Transport of circus animals was subject to 12 inspections. During 6 inspections involving 104 animals a failure to announce the organisation of a performance or non-compliance with the set conditions were identified. Certain shortcomings were detected in the observance of deadlines for the approval of the rules of animal protection at public performance, namely in case of persons and circuses from abroad. Gamekeeper's game farms, zoo corners and similar establishments. Upon initiatives of citizens, or sometimes in cooperation with the CEI 152 inspections were conducted in these establishments in 2012. During 4 inspections deficiencies were detected which were subsequently addressed by the municipal authority of the MEP. Also a few cases of poaching and wild animal intoxication were investigated, often involving a group of protected birds of prey.

E 4.4. Supervision of breeding and use of experimental animals The Supplement 32, in line with the set EU methodology, gives an overview of the number of experimental animals used in the CR since 1994. The overview shows that in 2012 a total of 390 466 live animals were used for experiments (in 2010: 366 007; in 2011: 375 091), of which 78 032 laboratory mice, 31 683 laboratory rats, 7 484 rabbits, 2 949 guinea pigs, etc.; approximately 168 368 birds were banded. Data concerning the individual types of experiments pursuant to the stipulated EU methodology are presented in Supplements 31 – 37. Laboratory animals establishments (see Supplement 1) were subject to 131 inspections and just as in the preceding years (2011, 2010) no deficiencies were detected. In 2009 following 137 inspections a fine was inflicted in two cases under the administrative procedure. In connection with the administrative procedure granting the accreditation to persons operating user establishments and issuing the certificates to persons operating breeding and supplying establishments, inspections were conducted always also prior to the respective procedure. In the framework of supervision of experiments on animals (see Supplement 2) a total of 72 inspections were carried out (in 2011: 105; in 2010: 117; in 2009: 132) involving 41 383 animals (in 2011: 67 991; in 2010: 44 040; in 2009: 77 694). Where a deficiency was detected a motion was filed to the MEP. At UVPS and CULS 6 qualification courses on the topic of conduct and management of experiments on animals (Section 17 para 1 of the AWA) were held. The qualification necessary for management, control and conduct of experiments was acquired by 391 experts with university degree in natural sciences, which means that altogether 3 385 persons acquired this qualification throughput the monitored period until the end of 2012.
E 5. ACTIVITIES PERFORMED BY THE ANIMAL WELFARE UNIT (a part of the Animal Commodities Department of MoA) IN 2012 At the Ministry of Agriculture the animal protection falls under the responsibility of: Animal Commodities Department, Animal Welfare Unit (MoA-AWU) as the animal protection authority, Central Commission for Animal Welfare (CCAW) as a professional advisory body to the Minister of Agriculture. The reason for the amendment is the necessity to incorporate Council Regulation (EC) No 1099/2009 on the protection of animals at the time of killing and to transpose Directive of the European Parliament and of the Council 2010/63/EU on the protection of animals used for scientific purposes. The amendment to the AWA was promulgated in the Collection of Laws under No 359/2012 Coll. with effect from 1 January 2013. 4. Conduct of administrative procedures on approval of the rules of animal protection at a public performance pursuant to Decree No 5/2009 Coll., on the protection of animals at a public performance and in breeding – in 2012, a total of 96 administrative procedures were closed upon a final judgment (96 rules were approved, 0 rules were not approved). 5. Conduct of administrative procedures on granting accreditations to persons operating user establishments and on issuing certificates to persons operating breeding and supplying establishments in line with Act No 246/1992 Coll., on the protection of animals against cruelty, as amended, and in line with Decree No 207/2004 Coll., on the protection, breeding and use of experimental animals, as amended, and cooperation with evaluators in this field – in 2012, a total of 25 administrative procedures were closed upon a final judgment, in all the cases the accreditation or certificates were granted. 6. Conduct of administrative procedures on approval of experimental projects pursuant to Act No 246/1992 Coll., on the protection of animals against cruelty, as amended, and in line with Decree No 207/2004 Coll., on the protection, breeding and use of experimental animals – in 2012 a total of 43 administrative procedures were closed upon a final judgment, with positive result. 7. Conduct of administrative procedures on granting the authorisation to perform slaughtering of animals for the purposes of churches and religious societies, whose religious rituals require special methods of animal slaughter in line with Act No 246/1992 Coll., on the protection of animals against cruelty, as amended – in 2012 one authorisation was granted and one additional decision was issued. 8. Preparation of CCAW meetings and CCAW Council meetings – 4 meetings of CCAW and 4 meetings of CCAW Council were held. Material and technical preparation of meetings, elaboration of supporting documents for these meetings, taking minutes thereof, cooperation in the accomplishment of CCAW tasks. 9. The composition and manner of decision making of CCAW is stipulated by the Statute and the Rules of Procedure of CCAW. In accordance with its Statute, the CCAW gives opinions on matters concerning the protection of animals against cruelty. The committees accomplish the tasks in individual areas of animal protection within their responsibility, develop materials and supporting documents for meetings of CCAW, CCAW Council and relevant MoA units. In line with its Rules of Procedure, the CCAW issues opinions, calls and resolutions concerning the discussed items on the agenda of the meetings and upon request of the relevant MoA unit provides opinions in the administrative procedure concerning the approval or non-approval of the rules of protection of animals in breeding, the rules of protection of animals at a public performance, and when adopting a decision on the withdrawal of an approval based on a request or by virtue of office, and on granting, modifying, suspending or withdrawing a certificate of a person operating a breeding or a supplying establishment or accreditation of a person operating a user establishment. The CCAW Council adopts opinions, calls and resolutions concerning the discussed items on the agenda of the CCAW Council meeting. In 2012 altogether 4 meetings of CCAW and 4 meetings of CCAW Council were convened. Ranking among the core activities were the following: The CCAW addressed many diverse issues in the broad field of protection of animals against cruelty, such as matters concerning the welfare of pig housing, castration of boars, castration of animals in rescue stations, conditions for slaughtering animals during “ritual slaughters”, matters concerning the transport of animals to the third countries (outside the EU) such as transports of cattle exported to Turkey, the Freedom for Animals campaign for abolishment of fur animal farms in the CR, protests against the Christmas market sale of carps, etc. Ing. Šonková attended the EuroFAWC (association of European governmental organisations operating in the field of animal protection) meeting in Dublin.

The CCAW also issued the Opinion of the CCAW on addressing the findings of red-eared slider (Trachemys scripta elegans) in the wild nature in the CR. This document was posted on the MoA animal protection website.
E 7. CONCLUSIONS The publication presents results of coordination activities performed by the MoA, SVA and other competent state authorities as well as results of supervisory activities conducted by the SVA inspectors in 2012. The selected parameters in charts and maps make it possible to monitor the progress in activities over the period of 20 years since of the AWA took effect, whereas for technical reasons majority of data could be monitored and evaluated only starting with the second half of 1993 (in case of maps from 1994). The publication provides information on the implementation of the AWA and directly applicable EU legislation, including the activities of the Animal Welfare Unit of the Animal Commodities Department of the MoA and CCAW activities, it presents a list of legislation in force and the methodology governing the supervisory activities. Summaries required by the EU are compiled and published, namely concerning the evaluation of conditions of activities involving farm animals and pursuant to the prescribed methodology governing the evaluation of the use of animals in experiments. The individual chapters contain systematic evaluation regarding individual animal species and groups of farm, companion, wild and experimental animals. The presented results suggest that the professional as well as social attention paid to animal protection and animal welfare of farm animals, companion animals, wild animals and also experimental animals brings about a number of problems which tend to pertain and have to be consistently addressed. So far the results of animal protection and welfare have been analysed and evaluated by individual fields or by groups and types of activities involving animals based on the methodology for processing the results which had been recommended to the CR already prior to its accession to the EU. In line with this methodology information was requested and provided to the Czech competent authorities, Council of Europe and EU bodies and also to the general public. The reason behind the application of the same methodology was the effort to produce conclusive results. For the sake of protection of animals and their welfare, including systematic collection of data and their evaluation, the methodological guidelines were drawn up and regularly updated and the SVA information system was used. This is why even after 20 years of evaluation it may be declared that despite more requirements laid down by the referred to legislations, including directly applicable EU legislation, the situation has improved. Similarly, it can also be stated that in the last year the detected deficiencies still concerned in total more than 131 thousand animals. It can also be documented that throughout the monitored period the detected deficiencies involved around 500 000 animals. In this light also the public opinion has to be perceived, mainly because despite the tangible achievements which are not sufficiently disseminated, from time to time isolated extreme cases of gross neglect in the care of animals occur, which are naturally heavily covered by media and have a negative effect on the situation. Currently, the task which now influences not only the animal welfare but also the economic aspects of animal husbandry is the necessity to take an active part in creation and implementation of conditions laid down by the new EU legislation. New findings will also result from following the Cross Compliance requirements in the field of animal welfare pursuant to Article 124 para 5 letter b) of Council Regulation (EC) No 73/2009 establishing common rules for direct support schemes for farmers under the common agricultural policy and establishing certain support schemes for farmers, which constitutes the basic condition for the provision of direct payments and supports. Measures to be taken based on the analysis of results: In the field of animal protection and animal welfare, attention shall be paid to technical and organisational tasks ensuing from the discussions held within THE EU bodies. More comments will be raised and analytical findings presented to the competent authorities in relation to drafting the laws at the EU level and during discussions on enforcement of existing legislation. The SVA shall in its activities follow the “Community Action Plan on the Protection and Welfare of Animals”. When amending the legislation and inspecting the implementation of the existing legislation, account will be taken of the requirements laid down in the EU legislation, particularly in Council Regulation (EC) No 1099/2009 on the protection of animals at the time of killing, Directive 2010/63/EU of the European Parliament and of the Council on the protection of animals used for scientific purposes and Council

Directive 2008/120/EC laying down minimum standards for the protection of pigs. Specific activities will focus on the issuance of laws (decrees) in line with the authorisations as defined in the AWA and on the amendment to guidelines for activities performed by RVA inspectors. In 2012 inspections of animal welfare were conducted in breeding establishments of farm animals based on the risk analysis. The results of inspections, or risks identified in other areas will help modify or identify other important risks in farm animal welfare and will be taken into account in the conduct of inspections. The number of planned inspections is intended to be reduced so that there is more space for unplanned inspections performed in justified cases. Stress shall be put on the quality of conducted inspections and the conduct of follow-up inspections in the event deficiencies are detected. In other animal welfare areas frequency of inspections in individual types of entities is set out. Based on various parameters, with account taken of results of previous inspections and knowledge of local specifics, the individual RVAs draft a plan of selected entities to be inspected by particular workplaces in 2013. For 2013 activities are planned comprising the inspection of requirements of Cross Compliance in the field of animal welfare pursuant to Article 124 para 5 letter b) of Council Regulation (EC) No 73/2009 establishing common rules for direct support scheme for farmers under the common agricultural policy and establishing certain support schemes for farmers, and which constitutes the basic condition for the provision of direct payments and support. These are requirements to be checked ensuing from Council Directive No 2008/119/EC laying down minimum standards for the protection of calves, Council Directive No 2008/120/EC laying down minimum standards for the protection of pigs, and Council Directive No 98/58/EC concerning the protection of animals kept for farming purposes. All the requirements to be checked laid down by the above referred to directives are incorporated in the AWA and Decree No 208/2004 Coll., on minimum standards for the protection of farm animals. In 2013 inspections will be continued to be carried out in projects submitted under the Rural Development Programme. They concern approved applications for support, namely under Measure I.1.1 Modernisation of agricultural holdings (e.g. construction and reconstruction of stalls) and also Measure I.3.2 Setting up of young farmers. The MoA, SVA and competent authorities shall prepare conditions for successful cooperation and discussions with experts during the scheduled DG SANCO missions. The SVA shall ensure the verification of compliance with the conditions of supervision of protection of animals and animal welfare by selected RVAs; inspections will be conducted pursuant to the methodological guideline “AP Programme” and in accordance with the “Guideline for the conduct of audit of the SVA official control system“ comprising the best practice for the verification of effectiveness of official controls and follow-up measures. SVA shall analyse and evaluate the “AP Programme“ at the meetings of RVA Chief inspectors for animal welfare. The information on the evaluation of activities in the field of farm animals breeding, inspections of transport and use of experimental animals will be forwarded to the EU bodies, in 2013 the SVA shall arrange for ongoing updates and possibly also improvements in the established “Client-Welfare” information system module.
