The underlying project plans are identical to those of the original application. The projects serve two purposes: the educational institution Dolfinarium and the accommodation centre for rehabilitation and research.

Under Section 10 of the Flora and Fauna Act, deliberately disturbing protected indigenous animal species is prohibited. Under Section 13(1) of the Flora and Fauna Act, transporting, bringing into or taking outside the territory of the Netherlands and keeping protected animal species are prohibited. Dispensotion Under Section 75(5) and (6)(a) and (c) ofthe Flora and Fauna Act, dispensation from Sections 9, 10 and 13(1) ofthis Act may be granted for purposes of research, education and the protection of flora and fauna, provided that this is not detrimental to the favourable conservation status ofthe species and there is no satisfactory alternative. The animals kept for educational purposes have been bred in captivity ortaken from their natural habitat, but are unsuitable for release. The favourable conservation status is not affected. The project plan 'Dolfinarium Education' shows that this approach is the correct one. Depending on their condition, the accommodated cetaceans, primarily porpoises, are released, permanently kept in captivity or euthanised. The animals kept in captivity are used forthe purpose ofconducting research in the context ofthe obligations imposed by the Habitats Directive, the Bern Convention and ASCOBANS. As appears from the project plans 'Accommodation and Rehabilitation at Dolfinarium' and 'Scientific Research at Dolfinarium Harderwijk', this contributes to the conservation of the species. Alternative solutions do not provide a better or comparable result.

Authorised persons must carry the authorisation with them when performing the operations for which the authorisation was granted. This authorisation must be attached to a copy of this dispensation. Authorised persons must show the authorisation when requested to do so by an authorised inspector or investigating officer.

The operations specified may only be performed in relation to the projects 'Accommodation and Rehabiiitation at Dolfinarium','Scientific Research at Dolfinarium Harderwijk'and'Dolfinarium Education', in accordance with the appendices attached to the application.

Only stranded, injured or weakened specimens of the porpoise (Phocoeno phocoena) may be captured, as referred
to in the project plan'Accommodation and rehabilitation at Dolfinarium'. Animalsthat have no chance of further survival may be euthanised.
8.
Captured specimens of cetaceans (Cetoceae) may be kept temporarily for rehabilitation purposes, wíth the aim of releasing them at a later stage. lf release is not possible, such animals may be kept permanently for the purpose of conducting scientific research that is relevant in the context of obligations imposed by the EU Habitats Directive, the Bern Convention and ASCOBANS. The scientific research has to be conducted in accordance with a research plan that must be submitted to the National Service forthe lmplementation of Regulations.

As soon as possible
after revalidation (and, where applicable, research), stranded and captured animals must be released into a suitable habitat as close as possible to the place where they were found.
10. Deceased
specimens of cetaceans (Cetaceo) must, after the cause of death has been established, be destroyed or made available to scientific institutions that have been granted dispensation for keeping these animals. To this end, Dr C. Smeenk, the curator of the National Museum of Natural History'Naturalis'in Leiden, must be contacted.

animal species listed in Annex A to Regulation (EC) 338/97 for predominantly commercial purposes, as referred to in Article 8(1) of that Regulation.

The dispensation for bringing or taking the animals into or outside the territory of the Netherlands applies only if the prior consent ofthe competent authorities ofthe countries involved has been obtained and the necessary CITES documents have been issued.

Geachte heer Van Beers, Op r4 oktober 2oo8 heb ik uw aanvraag voor een ontheffing ats bedoeld in artike[ 75, lid 5 en lid 6, onderdeel a van de Flora- en faunawet ontvangen. De aanvraag heeft betrekking op de projecten: Opvang en rehabilitatie op het Do[finarium, Wetenschappelijk onderzoek Dolfinarium Harderwijk en Dotfinarium Educatie. ln deze brief stel ik u op de hoogte van mijn beslissing.
Beslissing lk heb bestoten uw aanvraag goed te keuren. Hierbij verleen ik u de ontheffing die u heeft aangevraagd van de verbodsbepalingen genoemd in:

artikel 13, lid 1, van de Flora- en faunawet voor het onder zich hebben van maximaal 4o exemplaren van de tuimelaar (Tursiops truncotus), inctusief de geboren jongen, voor onderwijs;

Aanvraag U vraagt een vertenging van de eerder aan het Dolfinarium Harderwijk verleende ontheffing onder nummer FF/75A/2oo3h75a. De onderliggende projectplannen zijn getijk aan de oorspronketijke aanvraag. Het doe[ van de projecten is tweeledig. De educatieve instelling Dolfinarium en het opvangcentrum voor rehabilitatie en onderzoek.
Overwegingen Wettetijk kader Beschermde soorten Op grond van artike[ 4, lid t onderdeel a van de Ftora- en faunawet zijn alte van nature in Nederland voorkomende zoogdieren beschermd, met uitzondering van bij AmvB aangewezen gedomesticeerde soorten en met uitzondering van de zwarte rat, bruine rat en huismuis. Verbodsbepolingen Op grond van artikel 9 van de Flora- en faunawet is het verboden om beschermde inheemse diersoorten te doden, verwonden, vangen, bemachtigen of met het oog daarop op te sporen. Op grond van artikel 10 van de Flora- en faunawet is het verboden om beschermde inheemse diersoorten opzettetijk te verontrusten. Op grond van artikel r3, lid t, van de Flora-en faunawetis hetverboden beschermde diersoorten te vervoeren, binnen of buiten het grondgebied van Nederland te brengen en het onder zich hebben.
Ontheffing Op grond van artikel 75, lid 5 en 6, onderdeeI a en c, van de Flora- en faunawet kan ontheffing worden verleend van de artikelen 9, 10 en 13, lid 1, van deze wet, voor onderzoek, onderwijs en de bescherming van flora en fauna. Van belang is dat geen afbreuk aan de gunstige staat van instandhouding van de soort wordt gedaan en er geen andere bevredigende oplossing bestaat. De voor onderwijs gehouden dieren zijn gefokt of aan de natuur onttrokken, maar ongeschikt om teruggezet te worden. De gunstige staat van instandhouding wordt niet ondermijnd. Het projectplan: Dotfinarium Educatie toont aan dat deze werkwijze de juiste is. De opgevangen walvisachtige, voornamelijk bruinvissen, worden afhanketijk van de conditie, teruggezet, definitief in gevangenschap gehouden of geëuthanaseerd. De in gevangenschap gehouden dieren worden voor het doen van onderzoek in het kader van de Habitatrichtlijn, Conventie van Bern en ASCOBANS opgelegde verplichtingen, gebruikt. De projectplannen: Opvang en rehabilitatie op het Dolfinarium en Wetenschappetijk onderzoek Dolfinarium Harderwijk tonen een bijdrage aan de instandhouding van de soort aan. Andere oplossingen geven geen beter of vergelijkbaar resultaat.

Bezwaar Het kan zijn dat u het met deze beslissing niet eens bent. U kunt dan (net als andere belanghebbenden) binnen zes weken na de verzenddatum van deze brief, bezwaar maken. Het bestuur van de ontheffinghouder dient toe te zien op de strikte naleving van deze ontheffing met de daarin verme[de a[gemene en specifieke voorwaarden.

De ontheffjnghouder dient atle door of namens de minister van Landbouw, Natuur en Voedselkwaliteit verstrekte of nog te verstrekken aanwijzingen in verband met de uitvoering van deze ontheffing nauwkeurig op te volgen.
4.
Voor het verrjchten van de in deze ontheffing genoemde handetingen, voor wat betreft artikel 9, 10 en 13, lid 1, van de Flora- en faunawet, mogen vaste medewerkers van de ontheffinghouder middets een machtiging gebruik maken van deze ontheffing. lndien de ontheffinghouder een ander dan een vaste medewerker machtigt, dan dient de ontheffinghouder een kopie van de verleende machtiging aan Dienst Regelingen, Postbus 19530, 25oo CM Den Haag te zenden. De machtiging vermeldt in ieder geval de vo[gende gegevens:

vottedige naam, adres, woonplaats en geboortedatum van degene aan wie de machtiging is verleend; soort(en) en eventuele aanta[[en waarvoor de machtiging getdt; kwatificatjes met betrekking tot deskundigheid op het gebied van beschermde soorten; de handelingen die mogen worden verricht; plaats(en) waar de handelingen mogen worden verricht; periode waarvoor de machtiging getdt naam en handtekening ontheffinghouder.
Cemachtigden dragen bij het verrichten van de handetingen waarvoor de ontheffing verteend is de machtiging bij zich. Deze machtiging dient te zijn gehecht aan een kopie van deze ontheffing. Gemachtigden dienen de machtiging op eerste vordering te tonen aan een bevoegd controleur of opsporingsambtenaa

De aangegeven hande[ingen mogen uitsluitend worden verricht voor de projecten: Opvang en rehabititatie op het Dolfjnarium, Wetenschappetijk onderzoek Dotfinarium Harderwijk en Dolfinarium Educatie, vo[gens de bij de aanvraag gevoegde bijtagen.

A[[één aangespoelde, gewonde of verzwakte exemplaren van de bruinvis (Phocoena phocoena) mogen worden gevangen, als bedoeld in het projectplan: Opvang en rehabilitatie op het Dotfinarium. lndien de dieren geen levenskansen meer hebben, mogen zij worden geêuthanaseerd.
8.
Gevangen exemptaren van walvisachtigen (Cetoceae) mogen tijdetijk onder zich gehouden worden ter revalidatie, met het doel deze later weer vrij te laten. Als weer vrij laten niet mogetijk is, mogen dergelijke dieren permanent onder zich gehouden worden voor het doen van wetenschappetijk onderzoek dat relevant is in het kader van door de EU-Habitatrichttijn, de Conventie van Bern en ASCOBANS opgelegde verplichtingen. Het wetenschappetijk onderzoek dient uitgevoerd te worden met behulp van een
onderzoeksplan welke naar Dienst Regetingen gestuurd moet worden.
9.
Aangespoelde en gevangen dieren dienen zo spoedig mogetijk na rehabilitatie (en eventueel onderzoek) te worden uitgezet in een geschikt teefgebied zo dicht mogetijk bij de vindptaats.
10. Overleden exemplaren van walvisachtigen (Cetacea) dienen, na vaststelljng van de doodsoorzaak, te worden vernietigd of ter beschikking te worden gesteld aan wetenschappetijke instituten die over een ontheffing voor het onder zich hebben van deze dieren beschikken. Hiertoe dient contact op te worden genomen met dhr. dr. C. Smeenk, conservator van het Nationaal Natuurhistorisch Museum Naturatis te Leiden.
11. Hetis niettoegestaan de diersoorten die vermeld staan op BijtageA van de Verordening (EC)ZZAtgl voor overwegend commerciële doeleinden, zoals bedoetd in artikel8, lid l van Verordening (EC) ]38197, te gebruiken.
12. Het is niet toegestaan de merktekens waarmee dieren indjvidueel herkenbaar zijn gemaakt, te verwijderen zonder toestemming van ondergetekende. 13. De ontheffing voor het binnen of buiten het grondgebjed van Nederland brengen van de dieren getdt uitstuitend indien hiervoor voorafgaand toestemming is verteend door de bevoegde jnstanties van de betrokken [anden en de benodigde CITES-documenten afgegeven zijn.

r+. Ontheffinghouder voldoet aan de eisen van houden, huisvesten en verzorgen van diersoorten als bedoeld in artiket 6 tot en met 11 van het Dierentuinenbesluit. rS. Ontheffinghouder voert een inzichtelijke administratie van de gehouden diersoorten, ats bedoetd in artikel 2 en 3 van de Regeling administratie bezit van en handel in beschermde dier- en plantensoorten. 16. De ontheffinghouder dient jaarlijks vóór r aprit schriftetijk aan Dienst Regelingen te rapporteren hoeveel tuimelaars (Tursiops truncatusl, bruinvissen (Phocoena phocoenol en eventuete andere walvisachtigen (Cetaceae) in het voorgaande jaar in bezit waren. Deze rapportage bevat de volgende gegevens:
