1 Administratieve en wettelijke bepalingen 1.1 Algemeen 1.1.1
Afwijkingen van de algemene aannemingsvoorwaarden
1.4 “Bijzondere contractuele en administratieve bepalingen» van dit Bijzonder Bestek (BB) bevat bijzondere administratieve en contractuele bepalingen van toepassing op deze overheidsopdracht die afwijken van de Algemene Aannemingsvoorwaarden (AAV) of deze aanvullen of verduidelijken.
1.1.2
Aanbestedende dienst
De aanbestedende dienst van deze overheidsopdracht is de “Belgische Technische Coöperatie”, hierna BTC genoemd, naamloze vennootschap van publiek recht met sociaal oogmerk, met maatschappelijke zetel in de Hoogstraat 147, 1000 Brussel (ondernemingsnummer 0264.814.354, RPR Brussel). Als Belgisch ontwikkelingsagentschap steunt BTC, in opdracht van de Belgische regering, de ontwikkelingslanden in hun strijd tegen armoede. Naast deze taak van openbare dienstverlening voert BTC ook prestaties uit in opdracht van andere nationale en internationale organisaties die werken aan duurzame ontwikkeling1. Voor deze overheidsopdracht wordt BTC rechtsgeldig vertegenwoordigd door de heer Jean-Pierre Luxen, Directeur Sectorale en thematische expertise.
1.1.3
Institutioneel kader van BTC
Het algemene referentiekader waarin BTC werkt, is de Belgische wet van 25 mei 1999 op de internationale samenwerking2. Ook de ontwikkelingen op internationaal vlak vormen een rode draad in het werk van BTC. De voornaamste voorbeelden zijn: •
Op het vlak van internationale samenwerking: de millenniumdoelstellingen van de Verenigde Naties, de Verklaring van Parijs over de harmonisering en afstemming van de hulp;
•
Op het vlak van corruptiebestrijding: de wet van 8 mei 2007 houdende instemming met het VN3 verdrag tegen Corruptie, opgemaakt in New York op 31 oktober , evenals de wet van 10 februari 1999 betreffende de bestraffing van corruptie ter omzetting van het Verdrag inzake de bestrijding van corruptie van buitenlandse ambtenaren in internationale zakelijke transacties;
•
Op het vlak van respect voor de mensenrechten: de Universele Verklaring van de Rechten van de Mens van de Verenigde Naties (1948) evenals de 8 basisverdragen van de Internationale 4 Arbeidsorganisatie in het bijzonder gewijd aan het recht op vakbondsvrijheid (C. nr. 87), vrijheid van vereniging en collectieve onderhandeling (C. nr. 98), het verbod op dwangarbeid (C. nr. 29 en 105), het verbod op elke vorm van discriminatie op vlak van werk en verloning (C. n°100 en 111), de minimumleeftijd voor kinderarbeid (C. nr. 138), het verbod op de ergste vormen van kinderarbeid (C. nr. 182);

Op het vlak respect voor het milieu: de Agenda 21 (Top van Rio, 1992), het Implementatieplan van de Wereldtop voor duurzame ontwikkeling (Johannesburg 2002), en de initiatieven van de Europese Unie zoals de ‘EU-strategie voor duurzame ontwikkeling’ aangenomen in Göteborg.
1.1.4
Regels voor de opdracht
Op deze opdracht zijn onder meer toepasselijk: •
Wet van 24 december 1993 betreffende de overheidsopdrachten en sommige opdrachten voor 5 aanneming van werken, leveringen en diensten ;
•
KB van 8 januari betreffende de overheidsopdrachten voor aanneming van werken, leveringen en 5 diensten en de concessies voor openbare werken ;
•
KB van 26 september 1996 tot de bepaling van de algemene uitvoeringsregels van de 5 overheidsopdrachten en van de concessies voor openbare werken ;
•
De AAV, als bijlage bij het Koninklijk Besluit van 26 september 1996 tot bepaling van de algemene uitvoeringsregels van de overheidsopdrachten en van de concessies voor openbare werken;
•
De omzendbrieven van de Eerste Minister inzake overheidsopdrachten .

1.1.5
Definities
In het kader van deze opdracht moet worden verstaan onder: •
De inschrijver: de natuurlijke of rechtspersoon die een offerte indient;
•
De aannemer/de dienstverlener: de inschrijver aan wie de opdracht gegund wordt.
•
De aanbestedende dienst: BTC, vertegenwoordigd door de heer Jean-Pierre Luxen, Directeur Sectorale en Thematische Expertise;
•
De offerte: de verbintenis van de inschrijver om de opdracht uit te voeren tegen de voorwaarden die hij biedt;
•
Algemene Aannemingsvoorwaarden (AAV): bijlage bij het KB van 26.09.1996;
•
Bijzonder bestek: dit document evenals alle bijlagen en documenten waarnaar het verwijst;
•
Corruptiepraktijken: Elk voorstel voor een onrechtmatige betaling, een gratificatie of een commissie of elke instemming met het doen van een dergelijk voorstel, met als doel iemand aan te moedigen of te belonen voor het verrichten of het nalaten te verrichten van activiteiten die verband houden met de gunning van de opdracht of met de uitvoering van de door de aanbestedende dienst verstrekte opdracht;
•
Geschil: rechtsgeding.
1.1.6
Vertrouwelijkheid
De kandidaat, de inschrijver of de aannemer en BTC garanderen dat de informatie die binnen het kader van deze opdracht bekomen wordt, vertrouwelijk zal blijven en dat ze deze slechts aan derden zullen doorgeven na schriftelijk en voorafgaand akkoord van de andere partij. Zij zullen deze vertrouwelijke informatie enkel verspreiden onder de aangestelden die bij de opdracht betrokken zijn. 5

Zij garanderen dat die aangestelden behoorlijk ingelicht zullen zijn over hun verplichtingen i.v.m. het vertrouwelijk karakter van de informatie en dat ze die verplichtingen zullen naleven.
1.1.7
Deontologische verplichtingen
Elke poging van een kandidaat of van een inschrijver om vertrouwelijke informatie te bekomen, om verboden kartels te vormen met concurrenten of om het evaluatiecomité of de aanbestedende dienst tijdens de procedure van onderzoek, verduidelijking, evaluatie of vergelijking van de offertes te beïnvloeden, leidt tot de afwijzing van zijn kandidatuur of offerte. Om bovendien elke indruk van risico op partijdigheid of samenspanning te vermijden in de opvolging en controle van de uitvoering van de opdracht, is het de aannemer strikt verboden om rechtstreeks of onrechtstreeks geschenken, maaltijden of een ander materieel of immaterieel voordeel, ongeacht de waarde ervan, aan te bieden aan de aangestelden van de aanbestedende dienst, die rechtstreeks of onrechtstreeks betrokken zijn bij de opvolging en/of controle van de uitvoering van de opdracht, ongeacht hun hiërarchische rang. Elke offerte wordt verworpen of elk contract (overheidsopdracht) wordt geannuleerd zodra zou blijken dat de gunning van het contract of de uitvoering ervan aanleiding zou gegeven hebben tot het storten van ‘buitengewone commerciële kosten’. De buitengewone handelskosten betreffen elke commissie die niet vermeld staat in de hoofdopdracht of die niet voortvloeit uit een volgens de regels opgemaakt contract verwijzende naar deze opdracht, elke commissie die geen legitieme dienst vergoedt, elke commissie gestort naar een belastingparadijs, elke commissie gestort aan een niet duidelijk geïdentificeerde ontvanger of aan een bedrijf die een schijnbedrijf lijkt te zijn. De aannemer van de opdracht verbindt zich ertoe om op vraag van de aanbestedende dienst alle bewijsstukken m.b.t. de uitvoeringsvoorwaarden van het contract te leveren. De aanbestedende dienst zal kunnen overgaan tot alle vormen van controle, van stukken en ter plaatse, die hij nodig zou achten om bewijsmateriaal te verzamelen bij een vermoeden van ongewone commerciële kosten. Van de aannemer die ongewone commerciële uitgaven betaald heeft kan, volgens de ernst van de feiten, zijn contract opgezegd worden of hij kan op permanente wijze uitgesloten worden.
1.1.8
Toepasselijk recht en bevoegde rechtbank
De opdracht moet overeenkomstig het Belgisch recht worden opgevat en uitgevoerd. De partijen verbinden zich ertoe om te goeder trouw hun engagementen na te komen om de goede afloop van de opdracht te verzekeren. Bij geschillen of meningsverschillen tussen de aanbestedende dienst en de aannemer zullen beide partijen overleg plegen om een oplossing te vinden. Wanneer ze niet tot een akkoord komen, zijn alleen de rechtbanken van Brussel bevoegd om de geschillen te regelen (zie ook punt Geschillen).
1.2 Voorwerp en draagwijdte van de opdracht 1.2.1

Voorwerp van de overheidsopdracht
Deze opdracht bestaat uit: “Formulering van het Project “Improving training of btvet instructors, health tutors and secondary teachers in Uganda”

BTC zoekt via onderhavige opdracht 3 internationale experts (m/v) voor deze prestatie.
1.2.3
Percelen
De opdracht telt 3 percelen die elk een ondeelbaar geheel vormen. De inschrijver kan een offerte indienen voor een, meerdere of alle percelen. Een offerte voor een deel van een perceel is niet ontvankelijk. De percelen zijn: -
PERCEEL 1: een (01) international expert in teacher education & project formulation (De)Briefing : 2 x ½ jour formulatie missie: 34 jours Reporting : 25 jours

1.2.4
Duur
De uitvoeringstermijn gaat in de dag volgend op de dag van de betekening van de gunning van de opdracht, en loopt af ten laatste na de dienstverlening (definitieve oplevering), overeenkomstig de referentietermen (zie indicatieve planning van de referentietermen).
1.2.5
Varianten
Vrije varianten zijn niet toegelaten.
1.2.6
Hoeveelheden
Voor wat betreft het aantal dagen bevat deze opdracht een minimale hoeveelheid (zie referentietermen).
1.3 Procedure 1.3.1
Gunningswijze
Deze opdracht wordt gegund via een algemene offerteaanvraag op grond van artikel 13 en seq. van de wet van 24.12.1993.

1.3.2
Prijsbepaling
Opdracht met forfaitaire eenheidsprijzen.

Bekendmaking Officiële bekendmaking
De aankondiging van deze opdracht wordt gepubliceerd in het Bulletin der Aanbestedingen.
1.3.3.2
Officieuze bekendmaking
Onderhavig bestek wordt gepubliceerd op de website van BTC (www.btcctb.org).
1.3.4
Inlichtingen
De gunning van deze opdracht wordt gecoördineerd door de dienst Logistiek en Aankopen (L&A). Zolang de opdracht loopt, verlopen de contacten tussen de aanbestedende dienst en de (eventuele) inschrijvers omtrent deze opdracht uitsluitend via deze dienst en is het de (eventuele) inschrijvers verboden om op een andere manier contact op te nemen met de aanbestedende dienst omtrent onderhavige opdracht, tenzij in het bestek anders is bepaald. Tot en met 09.03.11 kunnen inschrijvers vragen stellen over het bijzonder bestek en de opdracht. De vragen worden schriftelijk gesteld aan Mevr. Léa Ingabire, (
[email protected]) en worden beantwoord naargelang ontvangst. Het volledige overzicht van de gestelde vragen zal ter beschikking staan op aanvraag aan het bovenvermelde adres. Tot de bekendmaking van de gunningsbeslissing, wordt er geen enkele inlichtingen gegeven over het verloop van de procedure. De inschrijver wordt geacht zijn offerte in te dienen, daarvan kennis genomen hebbend en rekening houdend met eventuele rechtzettingen betreffende de aankondiging van opdracht of het bestek die gepubliceerd worden in het Publicatieblad van de Europese Unie en/of in het Bulletin der Aanbestedingen of die hem in een individuele aangetekende zending of per fax/e-mail worden toegestuurd. Indien hij het bijzonder bestek in elektronische versie heeft gedownload, wordt hem ten stelligste aanbevolen zijn gegevens door te geven aan de hierboven vermelde dossierbeheerder overheidsopdrachten en inlichtingen in te winnen over eventuele wijzigingen of bijkomende informatie.
1.3.5 1.3.5.1
Offerte Vorm en inhoud
De offerte is opgemaakt aan de hand van de offerteformulieren die bij het bestek gevoegd zijn en moet alle gevraagde gegevens en documenten bevatten. De inschrijver wordt verzocht om de instructies om de offerte op te stellen (cf. punten 1.3.5.6 ‘Samenstelling van de offerte’ en 3.1 ‘Instructies om de offerte op te stellen’) aandachtig te lezen en nauwkeurig te volgen, om te vermijden dat zijn offerte wordt uitgesloten voor formele onregelmatigheid.
1.3.5.2
Draagwijdte van de offerte
De inschrijver moet zonder voorbehoud inschrijven op heel het bijzonder bestek. Indien hij in het bestek of in de aanvullende documenten van de opdracht zodanige vergissingen of leemten vaststelt

dat het hem onmogelijk is om een prijs te berekenen of dat de vergelijking van de offertes niet meer opgaat, geeft hij daarvan onverwijld schriftelijk kennis aan de aanbestedende overheid. Overeenkomstig art. 98 van het KB van 8 januari 1996, moet die ten minste tien dagen voor de dag van de opening van de offertes, behoudens zo de inkorting van de termijn voor het indienen van de offertes niet toelaat deze voorwaarden na te leven, verwittigd worden. Door een offerte in te dienen, verklaart de inschrijver af te zien van zijn eigen algemene (verkoops)voorwaarden. Elke andersluidende vermelding zal beschouwd worden als een voorbehoud met de onregelmatigheid van de offerte als gevolg.
1.3.5.3
Taal van de offerte
De offertes mogen in het Nederlands of het Frans of het Engels worden opgesteld.
1.3.5.4
Opgave van de prijzen
Alle prijzen in de offerte worden vermeld in euro tot twee cijfers na de komma. De opgegeven prijzen zijn prijzen exclusief BTW. Het percentage van de BTW moet expliciet en apart vermeld worden.
1.3.5.5
Gestanddoeningstermijn
De offertes die ingediend worden voor deze opdracht zijn onderworpen aan een gestanddoeningstermijn van ten minste 90 kalenderdagen, vanaf de dag volgend op de opening van de offertes, die eventueel gewijzigd werd door de aanbestedende overheid.
1.3.5.6

Elke offerte moet ten laatste op 15/03/2011 om 11u00 bij de voorzitter van de openingszitting van de inschrijvingen toekomen. Ze wordt ingediend in een definitief gesloten omslag met de vermelding: Offerte BXL1016 Formulering van het Project “Improving training of btvet instructors, health tutors and secondary teachers in Uganda” De offerte mag ingediend worden: 1.3.5.8.1 Met de post (normale of aangetekende zending) In dat geval wordt die gesloten omslag in een tweede omslag geschoven die verstuurd wordt naar:

1.3.6
Opening offertes
Op 15/03/2011 om 11h00 wordt op het adres, zaal Tana, Hoogstraat 147, 1000 Brussel in een openbare zitting overgegaan tot opening van de voor deze opdracht ingediende offertes. Toegelaten personen: openbare zitting. Bekendmaking van de prijzen: Prijzen worden niet voorgelezen.
1.3.7
Kwalitatieve selectie
Alvorens de aanbestedende dienst kan overgaan tot het regelmatigheidsonderzoek van de offertes en aan de evaluatie op basis van het (de) gunningscriterium(-a), zullen de inschrijvers die bepaalde minimale kwalitatieve voorwaarden niet naleven, uitgesloten worden van de procedure en er zal niet worden overgegaan tot het onderzoek van hun offerte. Met oog op de kwalitatieve selectie van de inschrijvers, overeenkomstig art. 69 e.v. van het KB van 8 januari 1996, moet de inschrijver bij zijn offerte een selectiedossier voegen met de in gevraagde informatie over zijn eigen situatie, zijn financiële capaciteit en zijn technische bekwaamheid voor deze opdracht.
1.3.8 1.3.8.1
Beoordeling van de offertes Regelmatigheid van de offertes
Alvorens over te gaan tot de evaluatie en de vergelijking van de offertes, onderzoekt de aanbestedende dienst of de offerte geen formele of materiële gebreken bevat die deze evaluatie zouden kunnen verstoren of verhinderen. In een offerteaanvraag moeten de offertes zo zijn opgesteld dat de aanbestedende dienst haar keuze kan maken zonder in onderhandeling te treden met de inschrijver. Om die reden en om de offertes op gelijke voet te kunnen beoordelen, is het essentieel dat de offertes volledig overeenstemmen met de bepalingen van het bestek, zowel op formeel als materieel vlak. De offertes die een voorbehoud maken op het bijzonder bestek, die formele fouten bevatten (bijv. niet ondertekend zijn), onvolledig, onnauwkeurig of onduidelijk zijn of offertes die elementen bevatten die niet overeenstemmen met de werkelijkheid, kunnen uit de procedure verwijderd worden. Wanneer de onregelmatigheid substantieel is d.w.z. wanneer de non-conformiteit over een essentiële bepaling gaat en/of een objectieve vergelijking van de offertes definitief in gevaar brengt, wordt de offerte automatisch uitgesloten. In de andere gevallen beslist de aanbestedende dienst vrij en in het licht van de omstandigheden, rekening houdend met de gelijke behandeling van de inschrijvers, welke niet-conforme offertes worden uitgesloten.

1.3.8.2
Gunningscriteria
De aanbestedende dienst zal de regelmatige offerte kiezen die het voordeligst wordt geacht, rekening houdend met de volgende criteria: Methodologie: 60 % In de technische offerte zal de inschrijver de voorgestelde methodologie omschrijven. Hij zal de methodologie van de Referentietermen verbeteren en zijn goed begrip ervan aantonen + voorstel voor gedetailleerd kalender. Gunning van de opdracht
De opdracht wordt gegund aan de inschrijver die de voordeligste regelmatige offerte heeft ingediend. Er moet wel opgemerkt worden dat overeenkomstig art. 18 van de wet van 24 december 1993, de aanbestedende dienst geenszins verplicht is om de opdracht te gunnen. De aanbestedende dienst kan zowel afzien van het gunnen van de opdracht als de procedure herbeginnen, desnoods op een andere wijze.
1.3.9
Sluiten van de overeenkomst
Overeenkomstig art. 117 van het KB van 8 januari 1996 komt de opdracht tot stand door de gekozen inschrijver op de hoogte te brengen van de goedkeuring van zijn offerte. Het volledige contract bestaat dan uit een opdracht, door BTC gegund aan de inschrijver die gekozen werd overeenkomstig: •
dit bestek en zijn bijlagen
•
de offerte en al haar bijlagen
•
de aangetekende brief met de kennisgeving van de gunningsbeslissing;
•
desgevallend de eventuele latere documenten, aanvaard en ondertekend door beide partijen.
1.4
Bijzondere contractuele en administratieve bepalingen
Dit hoofdstuk van het bestek omvat de bijzondere administratieve en contractuele bepalingen ter herhaling, aanvulling of verduidelijking van de AAV. De hierboven vermelde artikels verwijzen naar de artikels van die AAV. Bij gebrek aan aanwijzingen zijn de relevante bepalingen van de AAV integraal van toepassing.
1.4.1
Leidend ambtenaar (art. 1)
De leiding van en het toezicht op de uitvoering van de opdracht zijn toevertrouwd aan Mvr Wendy

[email protected] Eenmaal de opdracht gegund is, is de leidend ambtenaar de voornaamste gesprekspartner van de dienstverlener. Alle briefwisseling en vragen omtrent de uitvoering van de opdracht worden aan haar gericht, tenzij uitdrukkelijk anders vermeld in dit bestek. De leidend ambtenaar heeft volledige bevoegdheid om de opdracht op te volgen, met inbegrip van het toekennen of verwerpen van voorlopige en/of definitieve opleveringen en het vrijgeven van de borgtocht,het geven van dienstorders, het opstellen van verslagen en stand van zaken, de goedkeuring van diensten, voortgangsstaten en afrekeningen. Zij kan alle wijzigingen aan de opdracht bevelen die over het voorwerp van de opdracht gaan en binnen de beperkingen van de opdracht blijven. Vallen niet onder haar bevoegdheid: het ondertekenen van aanhangsels evenals elke andere beslissing of overeenkomst die een afwijking op de essentiële clausules en voorwaarden van de opdracht inhouden. De aanbestedende dienst wordt voor dergelijke beslissingen vertegenwoordigd zoals bepaald in punt 1.1.2.
1.4.2
Borgtocht (art. 5)
Overeenkomstig art. 5 van de AAV, wordt een borgtocht gevraagd van 5 % van het geraamde maandelijks bedrag van de opdracht, verzesvoudigd, afgerond naar het hoger tiental. De aannemer moet, binnen dertig kalenderdagen, volgend op de dag van de gunning van de opdracht, het bewijs leveren dat hij of een derde de borgtocht gesteld heeft op een van de wijzen vermeld in art. 5 van de AAV. De borgtocht wordt gesteld conform de hieronder beschreven procedure. 1.4.3
Vrijgave van de borgtocht (art. 9)
De borgtocht kan in één keer vrijgegeven worden na de voorlopige oplevering van alle diensten.
1.4.4
Derden (Art. 10)
§ 1. De aannemer blijft aansprakelijk ten opzichte van de aanbestedende dienst wanneer hij de uitvoering van zijn verbintenissen geheel of gedeeltelijk aan derden toevertrouwt. De aanbestedende overheid erkent geen contractuele band met derden. In elk geval blijft alleen de aannemer, wat de uitvoering van de opdracht betreft, aansprakelijk ten opzichte van de aanbestedende dienst. De aannemer kan de opdracht of een deel van de opdracht uitbesteden.
1.4.5
Prijsherziening (art. 13)
De prijzen zijn vast en niet herzienbaar voor de hele duur van de opdracht.
1.4.6
Intellectuele rechten (art. 14)
§ 2. De aannemer verbindt zich ertoe om geen reclame te maken over de opdracht zonder voorafgaand schriftelijk akkoord van de aanbestedende dienst. Hij mag wel de opdracht als referentie vermelden in het kader van een overheidsopdracht, op voorwaarde dat hij de staat ervan (bijv. ‘in uitvoering’) eerlijk vermeld en in zoverre de aanbestedende dienst die toestemming niet heeft ingetrokken omwille van een slechte uitvoering van de opdracht.
1.4.7
Betalingen (art. 15)
De betaling gebeurt overeenkomstig art. 15 § 2 en volgende van de AAV en binnen een termijn van 50 kalenderdagen, na ontvangst van de factuur. De factuur wordt ingediend in twee exemplaren, waarvan een exemplaar met de vermelding ‘origineel’ en het andere met de vermelding ‘kopie’ of ‘duplicaat’, met vermelding van de titel van de prestatie (Formulering van het Project “Improving training of btvet instructors, health tutors and secondary teachers in Uganda”), het nummer van het bestek (Bxl 1016) en de naam van de leidend ambtenaar (Wendy Braeken). Beide exemplaren worden verstuurd naar het volgend adres: Belgische Technische Coöperatie, ‘Directie Financiën’, Hoogstraat 147, 1000 Brussel. Deze factuur zal ondertekend en gedagtekend zijn en zal het volgende vermelden: “voor echt en waarachtig verklaard en vastgesteld op de totale som van € ….. (bedrag voluit geschreven)” De inschrijver kan geen voorschot vragen. De betaling wordt uitgevoerd na ontvangst en goedkeuring van het eindrapport. Indien BTC de aanvraag uitbreidt, wordt de betaling verricht na goedkeuring van het product door BTC, op basis van een factuur die wordt berekend naargelang het aantal gepresteerde dagen. De aannemer kan geen enkel voorschot vragen.

1.4.8
Geschillen (Art. 18)

1.4.9
Opleveringen (art. 19)
De aanbestedende dienst beschikt na de dienstverlening over een termijn van 30 kalenderdagen om na te gaan of de prestaties zijn uitgevoerd conform de bepalingen van onderhavig bestek, en conform de regels van de kunst. Wanneer de reactie van de aanbestedende dienst binnen die termijn uitblijft, worden de verleende diensten als aanvaard beschouwd.
1.4.9.1
Gedeeltelijke voorlopige oplevering
De goedkeuring van het voorlopig verslag of van de aide-mémoire wordt per post meegedeeld aan de internationale consultant 15 kalenderdagen na ontvangst.
1.4.9.2
Definitieve Oplevering
In voorkomend geval wordt de goedkeuring van het eindverslag per post meegedeeld aan de internationale consultant 15 kalenderdagen na ontvangst.
1.4.9.3
Keuring
De aanbestedende dienst behoudt zich het recht voor om de dienstverlener op eender welk moment van de opdracht een activiteitenverslag te vragen (gehouden vergaderingen, ontmoete personen, bezochte instellingen, overzicht resultaten, problemen die zich gesteld hebben en onopgeloste problemen, afwijking ten opzichte van de planning en afwijkingen ten opzichte van de referentietermen, enz.)
1.4.10 Middelen van optreden van de aanbestedende dienst (art. 20) § 1 De ontoereikendheid van de dienstverlener wordt niet enkel beoordeeld op basis van de diensten zelf maar ook op basis van het geheel van zijn verplichtingen. Om elk risico van partijdigheid of samenspanning te vermijden in de opvolging en controle van de uitvoering van de opdracht, is het de dienstverlener strikt verboden om rechtstreeks of onrechtstreeks geschenken, maaltijden of een ander materieel of immaterieel voordeel, ongeacht de waarde ervan, aan te bieden aan de aangestelden van de aanbestedende dienst, die rechtstreeks of onrechtstreeks betrokken zijn bij de opvolging en/of controle van de uitvoering van de opdracht, ongeacht hun hiërarchische rang. In geval van overtreding kan de aanbestedende dienst de dienstverlener per overtreding een forfaitaire boete opleggen die kan oplopen tot het drievoudige van de som van de (geschatte) waarden van het voordeel aangeboden aan de aangestelden en van het voordeel dat de inschrijver

hoopte te bekomen door het voordeel aan de aangestelde aan te bieden. De aanbestedende dienst zal soeverein oordelen over de toepassing van die boete en van het bedrag. Die bepaling doet geen afbreuk aan de eventuele toepassing van andere opgelegde maatregelen van ambtswege die voorzien zijn in de AAV, meer bepaald de eenzijdige opzegging van de opdracht en/of de uitsluiting van de opdrachten van de aanbestedende dienst voor een bepaalde duur.
1.4.10.1 Gebrekkige uitvoering De aannemer blijft in gebreke bij de uitvoering van de opdracht: •
Wanneer de prestaties niet geheel voltooid zijn binnen de contractueel bedongen uitvoeringstermijn (leveringstermijn) of op de verschillende voor de gedeeltelijke voltooiingen vastgestelde data;
•
ongeacht het ogenblik, wanneer de prestaties niet zodanig vorderen dat zij op de vastgestelde data volledig kunnen worden voltooid;
•
wanneer hij de geldig gegeven schriftelijke bevelen van de aanbestedende dienst niet naleeft;
•
wanneer de prestaties niet uitgevoerd worden volgens de voorschriften (bepaald in de opdracht).
Alle tekortkomingen aan de bepalingen van de opdracht, daarbij inbegrepen het niet in aanmerking nemen van de bevelen van de aanbestedende dienst, worden vastgesteld in een proces-verbaal waarvan een kopie onmiddellijk aan de opdrachtnemer wordt overgemaakt per aangetekend schrijven. De aannemer is gehouden onmiddellijk in te grijpen. Hij kan zijn verweermiddelen meedelen per aangetekend schrijven gericht aan de aanbestedende dienst binnen de vijftien kalenderdagen die volgen op de dag, die wordt bepaald door de postdatum, van de verzending van het proces-verbaal. Zijn stilzwijgen na die termijn geldt als een erkenning van de vastgestelde feiten.
1.4.11 Elementen die in de prijzen zijn inbegrepen (art. 67) De dienstverlener wordt geacht in al zijn prijzen alle kosten en heffingen die op de diensten wegen te hebben inbegrepen, met uitzondering van de belasting op de toegevoegde waarde. In die forfaitaire eenheidsprijzen zijn ingerekend: de honoraria, de per diem, de overnachtings-, verzekerings-, visa- en communicatiekosten, de administratie- en secretariaatskosten, de kosten voor de documentatie betreffende de diensten en die eventueel door de aanbestedende dienst wordt geëist, de levering van documenten of van stukken die gepaard gaan met de uitvoering van de diensten, tol- en accijnsrechten betreffende de gebruikte producten en materieel, verpakkingskosten, keurings- en opleveringskosten, alle personeels- en materiaalkosten die nodig zijn om deze opdracht uit te voeren, de vergoeding voor auteursrechten, de aankoop of huur bij derden van diensten die nodig zijn voor de uitvoering van de opdracht. Indien de opdracht verlengd wordt, blijven de forfaitaire eenheidsprijzen zoals vermeld in de offerte van toepassing. De kosten verplaatsingen (H/T in economy class) tussen de woonplaats en het partnerland en tussen de woonplaats en Brussel voor de (de)briefings worden door de inschrijver gedragen. BTC organiseert en draagt de kosten van plaatselijke verplaatsingen (in het partnerland) enkel binnen het kader van de uitvoering van de opdracht. De kosten voor workshops worden niet door BTC betaald. De kosten voor internationale reisdagen worden niet door BTC gedragen.

1.4.12 Briefwisseling met de dienstverlener (art. 68) De kennisgevingen worden door de aanbestedende dienst naar in de offerte vermelde de woonplaats of maatschappelijke tenzij het bestek de dienstverlener na het sluiten van de opdracht verplicht een andere woonplaats te kiezen.
1.4.13 Plaats van dienstverlening (art. 70) Zie “Referentietermen”
1.4.14 Aansprakelijkheid van de dienstverlener (art. 73) § 1. De dienstverlener draagt de volle aansprakelijkheid voor de fouten en nalatigheden die in de verleende diensten voorkomen, inzonderheid in de studies, de berekeningen, of in alle andere ter uitvoering van de opdracht door hem voorgelegde stukken. De dienstverlener is volledig aansprakelijk voor de fouten en nalatigheden die de verleende diensten aantasten. § 2. De dienstverlener vrijwaart de aanbestedende dienst bovendien tegen elke schadevergoeding die deze aan derden verschuldigd is op grond van zijn vertraging of in gebreke blijven.

2.2 Context of the formulation 2.2.1 Introduction This project is part of the Indicative Cooperation Programme (ICP) between Belgium and Uganda, signed on 7 November 2008. The identification file for the project was approved on 24 September 2010 at the partner committee meeting between Belgium and Uganda. The present document aims at defining the terms of reference (ToR) for the formulation of the project, based on the preliminary work done during the identification exercise.
2.2.2 General context The Government of Uganda (GoU) considers education the key to national development and is strongly committed to providing appropriate levels of investment in it. The Ministry of Education and Sports (MoES) recognizes the notion that “No Education system can be better than the quality of its teachers/instructors, nor can a country be better than the quality of its education”. 6
In 1997, Uganda introduced a key policy reform of Universal Primary Education (UPE) , in line with the EFA goals and fulfilling MoES’ mission statement of “quality education and access for all”. As a consequence, enrolment in primary education soared. To ensure sustainability of the gains realized from the UPE programme, GoU launched the Universal Post Primary Education and Training (UPPET) strategy in February 2007, as a national programme to reform post primary education. UPPET aims to provide quality options for the increasing numbers of students completing primary education and seeking a secondary education. Among those options: additional and better-trained teachers. The Universal Secondary Education (USE) strategy was then put into action in 7 2007, leading to an instant increase in enrolment figures in secondary as well . A second pillar of the UPPET strategy relates to the development and expansion of the Business, Technical Vocational Education and Training (BTVET). Since mid 2010, MoES embarked a process to formulate a strategic plan for BTVET development in the coming 10 years.
2.2.3 Teacher training for secondary school teachers As stated in the Education Sector Strategic Plan (ESSP) 2009 – 2015 there is a need to strengthen pre-service training and in-service support for teachers in order to improve the quality of teaching and learning in Uganda. Secondary school teachers in Uganda are trained at two-levels, in public National Teachers’ Colleges (NTCs) and in public/private Universities. Student teachers at NTCs study for two full time years to obtain a Diploma in Education Secondary (DES); while university students take a three-year Degree programme. Provision of teachers is the single most important input in ensuring quality delivery of the

UPPET programme. Therefore, revitalising NTCs will enhance the quality and efficiency of secondary teacher education in Uganda. MoES is designing a programme for secondary school teachers, the Secondary Teacher Development Management System (STDMS). To ensure provision of adequate teachers for lower secondary, the sector considers (i) rehabilitation and/or expansion of the infrastructure, (ii) increased enrolment levels in USE core subjects, and (iii) teacher continuous professional support in NTCs as the most cost effective way. Currently, there are five government owned NTCs in Uganda. The current facilities are only adequate to meet about 40% of the required raining training needs. Three NTCs receive already support from other development partners (World Bank – WB, Islamic Development Bank – IDB). The 2 other NTCs, Kaliro and Muni, are in need of rehabilitation, expansion and equipment. Given the need for additional Diploma Teacher Holders for the UPPET programme, there is also need to provide additional classrooms, science laboratories, libraries, and other basic facilities to enhance the training capacities of these NTCs. The NTCs require investment in other areas such as ICT. Uganda is currently oversupplied with secondary school teachers in some areas of the 8 curriculum and under-supplied in others, particularly the sciences and mathematics . Current teacher education programs are ‘front-end-loaded’ with a relatively small (by international standards) school practice and the post-training probationary period, although it exists, does not seem to have much meaning. This, together with the minimal support for continuous professional development, implies that teacher training is seen as once-off process; a teacher once trained is trained for life. According to a study on teacher education, commissioned by MoES and World Bank, “Teacher quality is hampered by the poor quality of student teachers entering Teacher Education (TE) programs, weak pedagogical training in TE institutions, poor motivation, and lack of professional development. It results in poor planning, under-utilization of instructional time, dominant teachers, use of inappropriate methodology, lack of focus on 9 active learning and practical work” . Further, the authors state, “the country will need to develop teacher education standards against which the effectiveness of teachers and professional development programs can be evaluated. A sound foundation for quality in 10 teaching and learning should be used” . The study concludes: “the above issues provide impetus for the vicious circle of substandard teaching, poor quality of students from Secondary Schools, and poor intake in TE programs, shortage of qualified teachers, and poor teaching. Measures need to be put in place to break this vicious circle. Strengthening TE programs, providing professional development opportunities for teachers (e.g. through Teacher Professional Councils) and strengthening school management to include management (e.g. to address absenteeism of teachers), support and appraisal mechanisms for teachers seem priorities in this 11 respect” .

2.3 Training for BTVET instructors and Health tutors Education in Uganda throughout the missionary days up to the colonial period was oriented to white-collar jobs. It produced mainly clerical and administrative personnel required by the church and the colonial administration. Business, Technical Vocational Education and Training (BTVET) was very small and designed to produce manual workers, who were predominantly drawn from the underprivileged sections of society. This was the beginning of social stigmatization of BTVET. The immediate post-colonial education policies did little to change these trends. Currently, educational models in tertiary institutions are founded on the ivory tower approach and are neither sufficiently labour market oriented, nor are they flexible enough, to solving societal problems, providing services for the community, the private sector and for national development. It is critical that GoU integrates capacity building models and invests in BTVET institutions in order to build a modern, integrated, self-sustaining economy. Uganda is committed to expand the BTVET sector and improve the quality of BTVET, which is considered essential for children and youth to acquire employable knowledge, skills and attitudes allowing them to improve their living conditions and those of their families. Ultimately, “this will allow them to participate actively in the development of knowledge and skills for enhancing capacity to determine the rate at which Uganda will diversify its economy, modernize the agricultural sector, industrialize the production 12 system and finally eradicate poverty” . The Government of Uganda intends to expand and equip the Mulago Health Tutors’ Training College and Abilonino Instructors College, which is in line with the ESSP and the UPPET strategy. Both colleges are in dire need of rehabilitation and have to date no specific support. Mulago Health Tutors’ Training College is the only institution training Health Tutors in Uganda. Health tutors teach in the 69 Health Training Institute (HTI) all around the 13 country . The shortage of health tutors is currently at an alarming level. The supply of more and better tutors and appropriate teaching and learning equipment will improve the quality of skills training for health workers. GoU intends to expand, rehabilitate and equip Mulago Health Tutors’ Training College, and also to introduce new learning methods that are more oriented to practical learning. Abilonino Instructors College is the only institution training Instructors for BTVET technical institutions in the country. GoU is making many efforts to expand and improve the quality of BTVET. Support to Abilonino Instructor College would allow all BTVET institutions countrywide to have more and better trained instructors, with optimal linkages to the world of work. There is a need to introduce new learning methods in the curriculum that are more oriented to practical learning.

2.4 STRATEGIC AND OPERATIONAL FRAMEWORK The Government of Uganda and the Belgian Government have agreed to support an education project geared towards the improvement of (a) BTVET Instructors & Health Tutors Training and (b) Secondary Teacher Education. Below, we outline and comment the major strategic and operational orientations of the future project as described in the identification file (cf. annex 1).
2.4.1 Overall and specific objectives According to the identification file, the overall objective is “to contribute to the expansion of equitable access and quality at Post Primary Education and Training, as part of the on going reforms targeting Universal Post Primary Education and Training (UPPET) that will enhance both the quality and efficiency of Secondary Teacher and Training Education and that of Tutor and Instructor Training in Uganda. The proposed project shall also focus respectively on the improvement of pedagogical leadership especially in vocational and core subjects of the Secondary School Curriculum for the NTCs and the acquisition of competencies outlined in the new “strategic plan for the development and management of instructor and health tutors” that is being developed for the TVET institutions”. The specific objective of the project is “the proposed institutions will be rehabilitated, expanded and fully equipped for providing a modernized teaching and practice-oriented learning environment”. To guarantee a feasible ambition level of the project (in terms of expected outcome and impact), the formulation team will analyse these objectives, work on the results chain, and if needed, reformulate the specific and overall objectives.
2.4.2 Expected Results According to the identification file, the expected outputs of the project include: For the component “Improvement of BTVET instructors and health tutors’ training”:

Although these outputs/results provide a good indication of the overall strategic and operational orientation of the project, they would benefit from a thorough re-examination and will be further refined during the formulation.
2.4.3 Institutional anchorage and localisation According to the identification file, the Permanent Secretary (MoES) will be the Accounting Officer, responsible for the overall organisation, coordination, supervision and management of the project. The project implementation will be aligned to the existing structures at the Ministry of Education and Sports. Relevant departments and units for this project as defined in the identification file are: •

We have identified some departments and units that are not listed in the identification file but need to be involved actively in the project implementation. Moreover, since the project will support institutions in distant areas, the formulation will have to explore options and opportunities to include decentralised structures in the management or monitoring of the project (e.g. relevant District Education Offices - DEO). During the formulation phase, the optimal institutional anchorage will be examined. On top of that, essential formal linkages during project implementation with other sectors such as Health, Industry, and Labour will be further explored. The involvement of relevant line ministries such as Ministry of Health will be organised through the Inter-Ministerial Committee.
2.4.4 Beneficiaries The identification file mentions the following direct beneficiaries: teacher training institutions (2 NTC – Kaliro and Muni, Mulago Health Tutors’ Training College, and Abilonino Instructors College), schools, health facilities, skill training centres and

individuals that will have received training in these institutions. The indirect beneficiaries are people in Uganda who will access services from both the institutions and graduates. The identification file is not exhaustive or entirely clear with respect to direct and indirect beneficiaries. During the formulation, this will be addressed in the light of the final orientation of the project.
2.4.5 Duration The project will cover a period of 3 years. However, according to the identification file the period may be validated during the formulation process. A duration of 3 years will probably not be enough because of the multitude of activities in different parts of the country, and the complexity of similar system reforms. The time needed will be defined in accordance with the workload and the set objectives. Absorptive capacity of the partner institutions and the management team will be another important 18 element in this regard .
2.4.6 Budget The available budget for the whole project is 17.502.993 EURO. The respective allocation of the budget to the different cost centres and supported institutes will be determined during the formulation mission. The appropriate financial modalities will be determined during the formulation. The GoU counterpart funding to the project will be 10% of the total amount allocated to the project. This Ugandan contribution comes in addition to the whole budget allocated by the Belgian government. The steering committee meeting of 3 December 2010 proposed that “10% of GoU counterpart funding of the project should be earmarked for FY nd 2011/2012, with a larger portion made in the 2 half of the financial year”. It was also decided in that same meeting to “anchor the planned expenditures to the chart of accounts of Ministry of Finance, Planning and Economic Development for better harmonised coordination and reporting”.
2.5 Objectives of the formulation The formulation will validate, complement and / or redirect the data from the identification file with the aim of defining a sound intervention strategy and to prepare the Technical and Financial File (TFF) of the project. Below we give an overview of the main tasks of the formulation team, as well as some specific issues that have been flagged.

2.5.1 Analysis and validation of the identification •
Analyse, validate and update the project strategy and institutional framework as presented in the identification file.
•
Analyse the legal, strategic and policy documents, and ensure the project corresponds with the requirements and priorities defined in these documents.
•
Ensure the link with other initiatives that have a direct relation with teacher education improvement and BTVET in Uganda, in accordance with the Education Sector wide approach (SWAp).
•
Develop synergies between the different initiatives supported by the Belgian cooperation across the sectors in Uganda (portfolio-approach).
•
Meet and discuss with development partners involved in education, and in particular in BTVET and teacher education, to ensure optimal harmonisation and to examine potential synergies.
•
Evaluate the technical and institutional capacity of the potential partners and stakeholders in the implementation of project activities.
•
Propose mechanisms and activities that are conducive for ensuring sustainability of the project (i.e. technical, financial, managerial and administrative impact).
•
Ensure the integration of transversal priority areas of the Belgian development cooperation (cross-cutting themes), and more specifically: gender, HIV/AIDS and environment.
2.5.2 Preparation of project implementation •
Define the intervention strategy, stipulate the preliminary conditions for project start-up, and elaborate an indicative work plan (incl. inception phase).
•
Formulate the logical framework of the project: validate and update the overall and specific objectives and define the expected results and activities, as well as their cost-efficiency. Define the objectively verifiable indicators (quantitative and qualitative), the sources of verification, the risks and hypothesis.
•
Define the most adequate and feasible management and implementation mechanisms (execution modalities) and determine the roles and responsibilities of the different parties involved in technical, financial and institutional terms, as well as on policy dialogue.
•
Define the modalities for reporting and M&E, in line with Uganda Government and Belgian rules, regulations and practices. The proposed M&E framework should include all key stakeholders including the beneficiary institutions for more effective monitoring of the project at national and institutional levels.
•
Elaborate the project budget including the proposed activities and timeframe, as well as the assessment of the human, financial and material resources needed.
2.5.3 Specific issues The formulation team will pay particular attention to the following issues:

•
A comprehensive problem and situation analysis is needed. A comprehensive and updated problem analysis will allow the formulation team to make informed and appropriate choices. This includes the collection and analysis of information on the Education Sector from a system-perspective: primary, secondary, higher education, technical education in Uganda giving for each stage the actual and projected number of schools, institutes and universities, age of enrolment and number of students and teachers. To prepare this analysis, a needs assessment of the 4 institutions that will be supported by the project is currently ongoing (funded on the study fund). This study will identify needs in terms of works, utilities and equipment and other learning facilities.
•
Elaborate clear sustainable linkages with policy / central level (policy development, capacity development and institutional strengthening, system improvement, …)
•
Institutional analysis of the potential partner institutions at all tiers of the education system (organisational structure, legal status, mandates, departments, responsibilities of each division or department, number of disciplines, training of staff, budget for the past and coming 3 years, experience in implementation, operation and maintenance of similar projects).
•
The formulation will assess the options for introducing international best practices in teacher education reform, including: -

The practicum part of pre-service teacher training and the concept of application schools where the aspirant teachers will be able to practice what they learn in the pre-service training institutions. Induction of newly trained teachers / instructors / tutors Linkages with in-service training and continuous professional development Modernisation of the teacher education curriculum and the development of new training modules Inspection services Training of head teachers and other relevant education managers to improve teacher management and pedagogical leadership and supervision at the school and BTVET institutions.
•
The identification file proposes a system of scholarships (demand side intervention). Recently, interesting conceptual and practical work has been done on ‘voucher systems’ for demand-side interventions in education. During the formulation, the feasibility of introducing this system will be analysed.
•
Harmonisation & coordination - The formulation will consult actively with other similar projects (mainly WB and IDB) and explore existing opportunities for a (gradual) evolution towards a joint or coordinated support to teacher education involving other development partners.
•
Monitor a balance between software and hardware aspects. With respect to the hardware investments, there is a need to prioritise them in function of the (limited) budget available for this type of activities.

2.6 Methodology 2.6.1 Phases of the formulation Phase 0: Preliminary studies Currently, 2 studies in the education sector are commissioned by the Belgo-Ugandan study fund. The output of both studies will serve as an important input for the formulation, and can be considered as preliminary studies. (1) Support to the formulation of a BTVET Strategic Plan
Mid 2010, the GoU, with support from the Belgian Development Cooperation (BTC) and World Bank, embarked a process to formulate a BTVET Strategic Plan, which will provide the framework for BTVET development over the next ten years. An expert team comprising 5 international and 6 national consultants has been commissioned to support GoU in this. The team is expected to undertake a BTVET sector analysis and to support the preparation of the Strategic Plan. On 22 October 2010, the team presented their inception report. From 24 – 28 January 2011 a workshop is planned in Kampala bringing together the stakeholders. By mid-February 2011 they will submit a Draft Strategic Plan. (2) Needs assessment study in preparation of the Belgo-Ugandan project “Improving training of BTVET instructors, health tutors and secondary teachers in Uganda”
The purpose is to undertake a needs assessment of the 4 institutions that will be supported by the project. This includes identifying needs in terms of works, utilities and equipment and other learning facilities. By assessing major needs, the preliminary study will serve as an input for the formulation. The assessment report will provide indicative information for determining the cost of rehabilitation, expansion and equipment at the selected institutions. It will allow the formulation team to make informed and appropriate choices. The aim of the needs assessment is not to develop advanced and detailed designs, but rather to focus on identifying needs. The work is expected to be completed by February 2011, and will be presented at a debriefing session in Kampala. Ideally, the formulation manager will participate in the debriefing sessions of both studies during an exploratory mission to Kampala in January – February 2011(provided they occur more or less at the same time).
Phase 1: Exploratory mission (1 week) The formulation manager will organise an exploratory mission to Kampala in January – February 2011. During this exploratory phase, the terms of reference of this formulation will be fine-tuned and a detailed work plan will be agreed with the members of the Steering Committee. This mission will allow for collecting data, meeting the main stakeholders (MoES, EDPs, beneficiary institutions) and for preparing the next phases of the formulation. The formulation manager will also participate in the debriefing sessions of

the 2 preliminary studies (provided they occur more or less at the same time). Key outputs of this exploratory mission are: (1) situation & problem analysis, (2) overview of similar interventions, (3) detailed work plan for the next phases of the formulation, and (4) agreed terms of reference for the national consultants.
Phase 2: Preparation of the formulation During this phase, the formulation mission will be prepared. This involves fine-tuning of the terms of reference and the composition of the formulation team (including sourcing of external experts, both international and national). The formulation team will critically review available documents (the present ToR, needs assessments, relevant studies in the sector) and conduct a brief desk study on best practices on teacher education and BTC experiences in the implementation of similar projects in other countries (e.g. Burundi, Vietnam, Cambodia, Rwanda, Ethiopia).
Phase 3: Formulation mission (5 weeks) The formulation mission will be dedicated mainly to elaborating the Technical and Financial File. Through targeted field visits, meetings, observations and interviews, the formulation team will conduct an institutional & sector analysis, analyse the problems, build consensus on key issues to be addressed and prepare the implementation of the project. The team will start with a briefing session with representatives from MoES, MoFPED, the Belgian Embassy, and BTC Kampala to present the work plans. The formulation team will undertake field visits to the 4 proposed project sites, application schools, BTVET & Health training institutions, and hold meetings with all relevant stakeholders in the field (school management, students, PTA, district education managers). In Kampala, the team will organise extensive consultations with MoES, MoFPED, BTC, Belgian Embassy, the Education Development Partners (EDPs), Teacher Unions and other relevant Civil Society Organisations. At the end of the mission, the formulation team will present their findings and conclusions in a feedback workshop with the main stakeholders, serving mainly as a platform for giving decision makers the opportunity of familiarising themselves with the proposed intervention strategy and to give their first hand appreciation. During this workshop, the aide memoire of the mission team will be presented (see 7.1 for content requirements of the aide memoire).
Phase 4: Drafting of the formulation report, including the technical and financial file (TFF) The formulation team will prepare a formulation report (FR) containing the Technical and Financial File (TFF). These reports will respect the BTC format (see 7.2). The formulation report and TFF will take into account the outcome of the discussions in Uganda during the previous phases. A draft version will be submitted to the major stakeholders for comments

and negotiation. At the same time, the FR and TFF will be peer-reviewed in Brussels according to BTC internal processes (internal validation at BTC and external peer review).
Phase 5: Validation mission in Uganda (3 days) The Technical and Financial File will be presented for technical validation and final negotiation during a validation workshop in Kampala. The formulation manager will represent the formulation team during this validation workshop.
Phase 6: Approval of the formulation file This phase covers the steps for formal approval of the final project document: •

2.7 Calendar The formulation process follows the calendar indicated below. This planning takes into account less activity, and maybe unexpected tensions, during the election period from January – March 2011. The formulation mission will be performed from 04/04/2011 to 08/05/2011. We accept a week of flexibility around the beginning date.

2.10.2 Formulation report The formulation team will produce a complete formulation report, composed of the following documents : •
The analysis and validation of the information given in the identification document and if this is the case, in its update or other supporting documents.
• The Technical and Financial File (TFF) The formulation report will be presented according to the following model: 1 – Description of the approach This part will present the approach used for the formulation, taking into account the formulation file elaborated by the partner authority; the different phases and steps followed to reach the final result, as well as the lessons learned. 2 – Analytical project sheet resuming the intervention This project will contain administrative information, the DAC data and the items of the thematic checklists. 3 – Sector context The following information will be given: •
Reference to the national policy of the partner country or territory which forms the framework for the intervention

Analysis of the institutional framework
•
Analysis of the Belgian strategy for the sector and the operational experience made
•
Analysis of the interventions undertaken by other donors, as well as the key lessons learned and the possible synergies with these interventions.
4 – Additional studies Additional studies (such as Feasibility Studies, thematic in-depth analyses, analyses addressing the dimension of conflict) may be undertaken in order to guide the choice of the strategy orientations. 5 – Technical and Financial File The Technical and Financial File is a separate document, which will be attached to the Specific Agreement. The TFF has to contain the following chapters: Chapter 1: Situation analysis This analysis will focus on the situation, which has formed the basis of the strategic choices (SWOT analysis: Strengths, weaknesses, opportunities and threats). Chapter 2: Strategic orientations of the intervention

Here will be defined: the type and lines of intervention, the beneficiaries, the partner organizations, the geographic location of the intervention. Chapter 3: Operational planning The planning comprises the objectives of the intervention, the results, the activities, the indicators and means of verification, preliminary conditions, assumptions and risks. The planning has also to show the roles of the actors who take part in project implementation (including eventual non-state actors). Chapter 4: Financial planning The financial planning has to take into account all the ressources, which are necessary in order to execute the operational planning and it has to establish a link with the planned results and activities. Chapter 5: Implementation modalities The modalities of implementation, defined on the basis of the ICP and of the risk analysis, and respecting the principles of a) making the partners responsible of the initiative, b) harmonization and c) alignment, will cover the following aspects: •

2.10.3 Timing for the receipt of the outputs : •
The first draft of the Technical and Financial File (TFF) and the Formulation Report (FR) will be available within 15 days after the field mission.

Finalization of the TFF and the FR on the base of the BTC comments: the final version will be available within 3 days after the receipt of the BTC comments.

3 Formulieren 3.1 Instructies om de offerte op te stellen In principe moet de offerte opgesteld worden op de originele offerteformulieren die bij het bestek gevoegd zijn. Indien zij evenwel opgesteld is op andere formulieren (bijv. op een gescande versie van die formulieren), dient de inschrijver te verifiëren of die formulieren overeenstemmen met de originele formulieren en moet hij op elke pagina vermelden dat de gebruikte formulieren conform de originele offerteformulieren zijn. De offert formulieren zijn beschikbaar in het Frans en het Nederlands. Slechts een versie (Frans OF Nederlands) moet ingevuld worden. De louter technische gedeelten mogen echter opgesteld worden in het Frans, Nederlands, Duits of Engels. De offerteformulieren moeten ingediend worden in twee exemplaren, waarvan een de vermelding ‘origineel’ en het ander met de vermelding ‘duplicaat’ of ‘kopie’. origineel moet ingediend worden in een papieren versie. Het duplicaat mag eenvoudige kopie zijn, maar kan ook ingediend worden op cd-rom onder de vorm een of meerdere pdf-bestanden.

De verschillende delen en bijlagen van de offerte moeten genummerd zijn. Alle prijzen worden vermeld in euro (€) tot twee cijfers na de komma. Indien nodig kunnen ze nauwkeuriger vermeld worden tot vier cijfers na de komma. Naast elke doorhaling, overschrijving, aanvulling of wijziging in de offerteformulieren moet een handtekening staan. 3.3 Selectiedossier Met oog op de kwalitatieve selectie van de inschrijvers, moeten de hierna vermelde inlichtingen en documenten bij de offerte gevoegd worden (zie ‘Kwalitatieve selectie).
