INTRODUCTIE De oorlog in Syrië Vijf jaar aan oorlog hebben Syrië verwoest. De impact van deze oorlog op kinderen is enorm, aangezien zij het geweld van de oorlog, de verwoesting van de publieke infrastructuur en de economische achteruitgang mee maken. Momenteel zijn er dertien miljoen mensen die humanitaire hulp nodig hebben, onder wie zes miljoen kinderen. Van deze zes miljoen kinderen hebben meer dan twee miljoen Syrische kinderen geen reguliere toegang tot hulp, aangezien zij in gebieden leven die moeilijk bereikbaar of bezet zijn. Daarnaast gaan 2,8 miljoen kinderen niet naar school. Dit is de helft van het aantal kinderen dat de leeftijd heeft om naar school te gaan. Dit is mede veroorzaakt doordat een kwart van de scholen verwoest zijn, strategisch worden gebruikt in de oorlog als basis, detentiecentrum of martelkamer, of onderdak bieden aan ontheemde families. Geweld en traumatisering hebben ook de mogelijkheid voor kinderen om te leren drastisch beperkt. Kinderarbeid Kinderarbeid komt in Syrië in rap tempo vaker voor, nu dertien miljoen mensen humanitaire hulp nodig hebben en tachtig procent van de populatie in Syrië in armoede leeft. Waarnemingen in Syrië door VN Agentschappen, internationale en nationale hulp-organisaties, waaronder Terre des Hommes, bevestigen dat kinderen in Syrië worden gedwongen tot kinderarbeid om te kunnen overleven. Deze kinderen doen allerlei soort werk, betaald en onbetaald, zelf georganiseerd of in dienstverband. Al deze kinderen werken gemiddeld zestien tot twintig uur per dag. Daarnaast worden kinderen geronseld om als kindsoldaten deel te nemen aan de oorlog. Gewapende groeperingen geronselde kinderen op steeds jonger leeftijd. Al vanaf zeven jaar worden kinderen gerekruteerd.1 Wettelijke bepalingen om kinderen te beschermen van uitbuiting Het Verdrag inzake de Rechten van het Kind (IVRK) van de Verenigde Naties en Verdragen 138 en 182 van de International Labour Organisation (ILO) bieden een internationaal erkend juridisch kader waarbinnen kinderen worden beschermd tegen uitbuiting. Het begrip kinderwerk refereert aan de deelname van kinderen aan betaalde of onbetaalde economische activiteiten, of aan activiteiten waarin de familie of verzorgers worden ondersteund, welke niet schadelijk zijn voor de gezondheid en mentale en psychische ontwikkeling van het kind en die in overeenstemming met de internationale richtlijnen zijn. Kinderarbeid refereert daarentegen naar alle vormen van arbeid welke schadelijk zijn voor de psychische en mentale gezondheid van een kind en de educatieve en sociale ontwikkeling ondermijnen.

De ergste vormen van kinderarbeid refereren naar arbeid die plaatsvindt onder gevaarlijke omstandigheden, zoals seksuele uitbuiting en werk onder gedwongen omstandigheden. Zowel kinderarbeid als de ergste vormen daarvan zijn verboden onder het IVRK en de ILO 128 en 182. Doeleinden onderzoek Het doel van het onderzoek was om aandacht te vragen voor kinderarbeid, waaronder de ergste vormen van kinderarbeid, onder Syrische vluchtkinderen. In het rapport is het algemene beeld in kaart gebracht en zijn de push en pull factoren geanalyseerd die bijdragen aan kinderarbeid onder vluchtkinderen in Syrië, in naburige landen en in Europa. Ook hebben de onderzoekers gekeken hoe kinderen beschermd kunnen worden. Dit onderzoek is verricht door Terre des Hommes Duitsland. De missie van Terre des Hommes is om de rechten van kinderen te garanderen en ontwikkeling te stimuleren, onafhankelijk van afkomst, religie, politiek, cultuur of geslacht. Om dit doel te bereiken, ondersteunt en implementeert Terre des Hommes ontwikkelingsprojecten en humanitaire hulp projecten welke ontwikkeld zijn om de levensomstandigheden van kansarme kinderen en van hun families en gemeenschappen te verbeteren.
CONCLUSIE Binnen dit onderzoek is onderzocht of de conflicten in Syrië en in de regio hebben geleid tot een toename van kinderarbeid, inclusief de ergste vormen daarvan. Hierbij is voornamelijk gekeken naar vormen van kinderarbeid als negatief overlevingsmechanisme voor Syrische vluchtkinderen en hun families om zo de economische uitgaven te dekken die het gevolg zijn van hun vlucht naar buurlanden en via de Balkanroute naar Europa. Terre des Hommes heeft aangetoond dat Syrische vluchtkinderen inderdaad een hoger risico lopen om in de illegale kinderarbeid terecht te komen en geconfronteerd te worden met de ergste vormen daarvan in Syrië zelf, in de omliggende landen en gedurende hun vlucht door Europa. Kinderarbeid in Syrië In Syrië vinden dagelijks ernstige schendingen van kinderrechten plaats. Zo zijn in Syrië verschillende vormen van kinderarbeid geconstateerd, als negatief overlevingsmechanisme in een verwoeste wereld. Door ontbrekende data kan het aantal kindarbeiders niet worden vastgesteld. Wel is het duidelijk dat kinderen en hun families als gevolg van de oorlog geen toegang hebben tot middelen om te overleven en zich daardoor moeten wenden tot de meest drastische overlevingsmechanismen. Dit is voornamelijk het geval wanneer het spaargeld van de familie op is en de maatschappelijke hulp vanuit de gemeenschap daalt. Zo worden kinderen bijvoorbeeld geronseld om mee te vechten voor gewapende groeperingen en stijgt het aantal kinderen dat binnen de familie door omstandigheden wordt gedwongen om op te treden als broodwinner.

Kinderarbeid in omliggende landen: Libanon, Jordanië, Irak en Turkije Door de enorme toevloed van Syrische vluchtelingen in omringende landen zoals Libanon, Jordanië, Irak en Turkije, is in deze landen de socio-economische en politieke situatie flink verslechterd, zowel voor de vluchtelingen als voor de plaatselijke bevolking. De humanitaire hulp is onvoldoende om aan de behoeftes van alle vluchtelingen te voldoen. Hierdoor leeft een aanzienlijk deel van de Syrische bevolking in ondraaglijke omstandigheden, waardoor negatieve overlevingsmechanismes zijn toegenomen. Syrische vluchtkinderen dienen in veel gevallen de taak van de broodwinner in het familie op zich te nemen. Kinderen werken in de landbouwsector, de bouw of als kleinschalige verkoper. Bijna zestig procent van de kinderen binnen het onderzoek gaf aan dat zij meer dan zeven uur per dag werken en een derde van de kinderen gaf aan dat zij zeven dagen per week werken. Ook worden vluchtkinderen geronseld voor gewapende groeperingen. Kinderarbeid langs de Balkan route Het risico op kinderarbeid langs de Balkan route is toegenomen, doordat kinderen en families geen kant op kunnen door de gesloten grenzen. Sindsdien zijn al enkele gevallen van kinderarbeid gemeld. Push- en pull-factoren Verschillende push- en pull-factoren die bijdragen aan kinderarbeid onder Syrische vluchtkinderen zijn vastgesteld. Voornamelijk dragen de oorlog, economische redenen, het gebrek aan toegang tot onderwijs, de gezondheidsomstandigheden, de familiesituatie en het gebrek aan humanitaire hulp bij aan het verhoogde risico op kinderarbeid onder vluchtkinderen. Aanpak De aanpak van kinderarbeid is complex en vraagt om preventieve en beschermende maatregelen en een multidimensionale en grensoverschrijdende benadering. Terre des Hommes heeft een model ontwikkeld om kinderarbeid in het Nabije en Midden Oosten te bestrijden. Dit is een aanpak waarbij meerdere factoren tegelijk worden aangepakt, zo wordt er onder andere ingezet op veiligheid, onderwijs en ouders die goed naar de behoeften van hun ouders luisteren. AANBEVELINGEN Oproep om het lijden in Syrië te beëindigen Samen met meer dan 120 humanitaire organisaties en VN Agentschappen heeft Terre des Hommes de internationale gemeenschap opgeroepen om de Syrische crisis te beëindigen en strikte naleving te eisen van de internationale humanitaire wetgeving. Totdat er een diplomatieke oplossing is en het geweld is gestopt, dienen de volgende acties ondernomen te worden: ● Onbelemmerde en duurzame toegang garanderen voor humanitaire organisaties om onmiddellijke ondersteuning te bieden aan alle mensen in nood binnen Syrië; ● Realisatie van humanitaire pauzes en onvoorwaardelijke en gecontroleerde wapenstilstanden om voedsel en andere dringende hulp te bieden aan burgers; ● Het stoppen van aanvallen op de civiele infrastructuur;

● Garantie van de vrijheid van verkeer van alle burgers en de onmiddellijke opheffing van alle belegeringen.
Algemene aanbevelingen ● Een holistische en multidimensionale grensoverschrijdende benadering is nodig in de strijd tegen kinderarbeid onder vluchtkinderen; ● Het recht tot onderwijs moet voor alle vluchtkinderen gerealiseerd worden als een middel tegen kinderarbeid, waaronder ook informeel onderwijs en vakopleidingen vallen; ● Kinderen hebben het recht om gehoord te worden in beslissingen die invloed op hen hebben. In het proces waarin wordt gezocht naar een oplossing voor kinderarbeid moet hieraan voldaan; ● Alle maatregelen moeten rekening houden met symptomen van stress, trauma en post-traumatische stress syndromen bij de kinderen en moeten toegang bieden tot professionele hulp en begeleiding bij traumaverwerking. Rehabilitatie- en reïntegratiediensten moeten beschikbaar gemaakt worden voor kinderen die zijn gerekruteerd door gewapende groeperingen; ● Werkende kinderen moeten niet gecriminaliseerd worden, aangezien kinderarbeid uit nood is geboren; ● Het beschikbaar maken van data van kinderarbeid onder vluchtkinderen is cruciaal voor het ontwikkelen van gerichte actie; ● Staten dienen aanvullende financiering te verstrekken om het gat te dichten - aangezien slechts 25 procent van het UN Regional Refugee and Resilience Plan e n achttien procent van het Humanitarian Response Plan gegarandeerd zijn. Aanbevelingen aan de Europese Unie Terre des Hommes is zeer bezorgd dat de overeenkomst tussen de EU en Turkije het risico op kinderarbeid verhoogt en dat voorbijgegaan wordt aan de verplichtingen op het gebied van mensenrechten. Dus: ● De EU moet preventie- en beschermingsmechanismes opzetten voor vluchtkinderen, speciaal gericht op slachtoffers van kinderarbeid; ● De EU moet controleren hoe lidstaten beschermingsmaatregelen voor kinderen implementeren en kinderarbeid voorkomende maatregelen vaststellen en deze te delen; ● Samenwerking tussen Europese lidstaten moet verbeterd worden om vluchtkinderen te beschermen tegen kinderarbeid, bijvoorbeeld door het opzetten van een samenhangend registratiesysteem en arbeidsinspectie; ● De EU dient toegang tot werk en onderwijs te stimuleren en mogelijkheden te bieden voor jonge mensen om diploma´s te halen en hun werkgelegenheid te vergroten. Aanbevelingen aan de nationale overheden Terre des Hommes roept alle staten op om het Kinderrechtenverdrag na te leven en interventies op te zetten op basis van de VN-aanbevelingen in het kader van ´The Rights of All Children in the Context of International Migration´. Terre des Hommes heeft de volgende aanvullende aanbevelingen voor nationale overheden en beseft tegelijkertijd dat er vanuit de Europese Unie toezicht noodzakelijk zal zijn om te controleren of lidstaten zich eraan houden.

● Alle staten hebben de verplichting om de internationale mensenrechtenverdragen te implementeren en op de naleving ervan toe te zien, met name de ILO-Verdragen 138 en 182 en het Kinderrechtenverdrag; ● Staten moeten zich extra inzetten om het recht van ieder kind te beschermen tegen economische uitbuiting, tegen alle vormen van seksuele uitbuiting en misbruik en tegen andere vormen van uitbuiting indruisend tegen hun welzijn en op de naleving ervan toezien; ● Staten moeten verzekeren dat nationale kinderbeschermingssystemen een holistische benadering volgen en zich richten op vluchtkinderen die het risico lopen om tot kinderarbeid gedwongen te worden; ● Het is de verantwoordelijkheid van staten om alleenstaande kinderen te beschermen.
Aanbevelingen aan Non-Gouvernementele Organisaties ● Alle organisaties die diensten verlenen aan vluchtkinderen moeten effectieve voorzorgsmaatregelen nemen om kinderen te beschermen tegen misbruik, kinderarbeid en uitbuiting; ● Alle organisaties die zich richten op vluchtkinderen moeten alle beschermings- en preventieprogramma´s coördineren, bijvoorbeeld via het N o Lost Generation i nitiatief; ● Organisaties moeten ervoor zorgdragen dat hun acties niet het risico verhogen dat familieleden van elkaar gescheiden raken, waardoor kinderen een hoger risico lopen op gedwongen kinderarbeid; ● Alle betrokken organisaties moeten zich extra inzetten om publieke bewustwording en begrip te creëren voor de achterliggende oorzaken van kinderarbeid onder vluchtkinderen. Aanbevelingen aan bedrijven en vakbonden ● Alle bedrijven - de detailhandel, grote merken en importeurs - moeten hun verantwoordelijkheid nemen voor de bescherming van mensenrechten in hun internationale distributie ketens. Dit betekent dat ze moeten voorkomen dat de rechten van anderen - in het bijzonder kinderen - worden beperkt en dat zij eventuele negatieve impact voorkomen; ● Werkgeversorganisaties moeten de bewustwording van hun leden vergroten zodat zij geen kinderen - nationaal of vluchteling - in dienst nemen, en de ILO-Verdragen 138 en 182 te volgen; ● Vakbonden moeten bewustwording onder hun leden te vergroten zodat zij gevallen van kinderarbeid rapporteren; ● Werkgevers moeten hun inzet verhogen om jeugdwerkloosheid aan te pakken en vakopleidingen voor jonge mensen - nationaal of vluchteling - aanbieden.
