COMMUNICATION Jurisdictions that have strategic deficiencies with the AML/CFT standards as identified by the FATF and measures to be taken towards these jurisdictions 28 October 2011 This communication replaces previous communication of 24 June 2011. (1) FATF Public Statement of 28 October 2011. The FATF identified in its public statement of 28 October 2011 12 jurisdictions that pose a significant risk to the international financial system due to their lack of a comprehensive AML/CFT regime, among which 2 jurisdictions for which the FATF furthermore requires taking countermeasures. Taking into account the FATF’s public statement, and the ML/TF risks emanating from these jurisdictions, the persons and individuals subject to the Law of 11 January 1993 must apply enhanced customer due diligence measures for occasional transactions they carry out, or when entering into or maintaining a business relationship, with their customers when persons domiciled or established in one of these 12 jurisdictions or with any other links to these jurisdictions are involved in a transaction or a business relationship in whatever capacity (as a customer, proxy holder or beneficial owner). This list will be updated after each FATF plenary meeting, which usually takes place in October, February and June each year. It is therefore advisable to regularly check CTIF-CFI’s website, especially in October, February and June to make sure one has the new updated list of noncooperative jurisdictions and territories. Jurisdictions subject to a FATF call on its members and other jurisdictions to apply countermeasures to protect the international financial system from the ongoing and substantial money laundering and terrorist financing (ML/TF) risks emanating from the jurisdictions Iran The FATF reaffirms its call on members and urges all jurisdictions to advise their financial institutions to give special attention to business relationships and transactions with Iran, including Iranian companies and
financial institutions. In addition to enhanced scrutiny, the FATF reaffirms its 25 February 2009 call on its members and urges all jurisdictions to apply effective counter-measures to protect their financial sectors from money laundering and financing of terrorism (ML/FT) risks emanating from Iran. FATF continues to urge jurisdictions to protect against correspondent relationships being used to bypass or evade counter-measures and risk mitigation practices, and to take into account ML/FT risks when considering requests by Iranian financial institutions to open branches and subsidiaries in their jurisdiction. If Iran fails to take concrete steps to improve its AML/CFT regime, the FATF will consider calling on its members and urging all jurisdictions to strengthen counter-measures in February 2012. In this respect the CTIF-CFI also refers to the directly applicable restrictive measures, as well as the directly applicable counter-measures, imposed by the COUNCIL REGULATION (EU) No 961/2010 of 25 October 2010 on restrictive measures against Iran and repealing Regulation (EC) No 423/2007. Democratic People's Republic of Korea (DPRK) The FATF calls on its members and urges all jurisdictions to advise their financial institutions to give special attention to business relationships and transactions with the DPRK, including DPRK companies and financial institutions. In addition to enhanced scrutiny, the FATF further calls on its members and urges all jurisdictions to apply effective counter-measures to protect their financial sectors from money laundering and financing of terrorism (ML/FT) risks emanating from the DPRK. Jurisdictions should also protect against correspondent relationships being used to bypass or evade counter-measures and risk mitigation practices, and take into account ML/FT risks when considering requests by DPRK financial institutions to open branches and subsidiaries in their jurisdiction. In this respect the CTIF-CFI also refers to the directly applicable restrictive measures, imposed by the COUNCIL REGULATION (EC) No 329/2007 of 27 March 2007 concerning restrictive measures against the Democratic People's Republic of Korea. Jurisdictions with strategic AML/CFT deficiencies that have not made sufficient progress in addressing the deficiencies* or have not committed to an action plan developed with the FATF to address the deficiencies. The FATF calls on its members to consider the risks arising from the deficiencies associated with following jurisdictions. As mentioned here above, the persons and individuals subject to the Law of 11 January 1993 must apply enhanced customer due diligence measures

As part of its ongoing review of compliance with the AML/CFT standards, the FATF has to date identified the following jurisdictions which have strategic AML/CFT deficiencies for which they have developed an action plan with the FATF. While the situations differ among each jurisdiction, each jurisdiction has provided a written high-level political commitment to address the identified deficiencies. FATF welcomes these commitments. The FATF will continue to identify additional jurisdictions, on an ongoing basis, that pose a risk in the international financial system. Taking into account this information, and the ML/TF risks emanating from these jurisdictions, it is recommended that the persons and individuals subject to the Law of 11 January 1993 take into account within their risk assessment system the specific risks linked to the following countries: Algeria Angola Antigua and Barbuda Argentina Bangladesh Brunei Darussalam Cambodia

Jurisdiction not making sufficient progress The FATF is not yet satisfied that the following jurisdiction has made sufficient progress on its action plan agreed upon with the FATF. The most significant action plan items and/or the majority of the action plan items have not been addressed. If this jurisdiction does not take sufficient action to implement significant components of its action plan by February 2012, then the FATF will identify this jurisdiction as being out of compliance with its agreed action plans and will take the additional step of calling upon its members to consider the risks arising from the deficiencies associated with the jurisdiction. Taking into account this information, and the ML/TF risks emanating from this jurisdiction, it is recommended that the persons and individuals subject to the Law of 11 January 1993 take into account within their risk assessment system the specific risks linked to Ghana Indonesia Pakistan

COMMUNICATION Pays avec des insuffisances stratégiques en matière de lutte contre le blanchiment de capitaux et le financement du terrorisme tels qu’identifiés par le GAFI et les mesures à prendre à l’égard de ces pays 28 octobre 2011 Cette communication remplace la communication précédente du 24 juin 2011. Dans sa déclaration publique du 28 octobre 2011, le GAFI a identifié 12 pays qui constituent un risque pour le système financier international dû à l’absence d’un dispositif complet de lutte contre le blanchiment de capitaux et le financement du terrorisme dont deux pays contre lesquels le GAFI exige la prise de contremesures. Tenant compte de cette déclaration publique du GAFI et des risques de blanchiment de capitaux et de financement du terrorisme qui découlent des insuffisances identifiées auprès de ces pays, les organismes et personnes visés par le dispositif de la loi du 11 janvier 1993 sont appelés à appliquer leurs obligations de vigilance accrue à l’égard des opérations occasionnelles qu’ils effectuent et des relations d’affaires qu’ils nouent ou entretiennent avec leurs clients, lorsque des personnes domiciliées ou établies dans un de ces 12 pays ou ayant d’autres liens avec ces pays, interviennent à quelque titre que ce soit (en qualité de client, de mandataire ou de bénéficiaire effectif) dans l’opération ou la relation d’affaires. Cette liste sera mise à jour après chacune des réunions plénières du GAFI, qui se tiennent régulièrement dans le courant des mois d’octobre, février et juin de chaque année. Il est dès lors recommandé de consulter régulièrement et plus particulièrement en octobre, février et juin le site de la Cellule pour s’assurer d’être en possession de la nouvelle liste PTNC mise à jour. Pays pour lesquels le GAFI appelle ses membres et les autres Etats à prendre des contremesures pour protéger leur système financier contre les risques importants et actuels de blanchiment de capitaux ou de financement du terrorisme Iran Le GAFI a réitéré sa demande à ses membres et aux autres Etats de recommander à leurs institutions financières de porter une attention particulière aux relations d’affaires avec l’Iran, et en particulier avec des 1
sociétés et des institutions financières iraniennes. En plus des mesures renforcées de vigilance, le GAFI réitère son appel du 25 février 2009 à ses membres et demande avec insistance à tous les Etats de prendre des contremesures efficaces afin de protéger leur secteur financier des risques de blanchiment de capitaux ou de financement du terrorisme émanant de l’Iran. Le GAFI encourage les pays à se protéger contre l’utilisation des relations de correspondance afin de contourner ou éviter les contremesures et les pratiques de réduction des risques, et à prendre en considération les risques de BC/FT lors de l’examen des demandes faites par des banques iraniennes d’ouvrir sur leur territoire des succursales et des filiales. Si l’Iran ne prend pas de mesures concrètes pour améliorer le dispositif anti-blanchiment et contre le financement du terrorisme, le GAFI évaluera la nécessité d’appeler tous les pays à renforcer en février 2012 ces contremesures. A cet égard la CTIF renvoie également aux mesures restrictives d’application directe, ainsi qu’aux contremesures d’application directe, imposées en vertu du RÈGLEMENT (UE) N° 961/2010 DU CONSEIL du 25 octobre 2010 concernant l'adoption de mesures restrictives à l'encontre de l'Iran et abrogeant le règlement (CE) N° 423/2007. République Populaire Démocratique de Corée Le GAFI demande à ses membres et aux autres Etats de recommander à leurs institutions financières de porter une attention particulière aux relations d’affaires avec la République Populaire Démocratique de Corée, et en particulier avec des sociétés et des institutions financières de la République Populaire Démocratique de Corée. En plus des mesures renforcées de vigilance, le GAFI demande avec insistance à ses membres et à tous les Etats de prendre des contremesures efficaces afin de protéger leur secteur financier des risques de blanchiment de capitaux ou de financement du terrorisme émanant de la République Populaire Démocratique de Corée. Dans le cadre du processus mené actuellement par le GAFI de révision des normes de lutte contre le blanchiment de capitaux et le financement du terrorisme, le GAFI a désigné à ce jour les pays suivants qui présentent des insuffisances en matière de lutte contre le blanchiment de capitaux ou le financement du terrorisme et qui ont mis au point un plan d’action. Bien que les situations d’un pays à l’autre diffèrent, chaque pays s’est engagé politiquement pour remédier aux insuffisances constatées. Le GAFI se réjouit de cet engagement. Le GAFI continuera à désigner les pays qui constituent un risque pour le système financier international. Tenant compte de cette information et des risques qui découlent des pays mentionnés ci-dessous, il est recommandé que les organismes et personnes visés par le dispositif de la loi du 11 janvier 1993 prennent en compte dans leurs analyses de risques les risques spécifiques identifiés auprès des pays mentionnés ci-dessous: Algérie 3

Pays n’ayant pas fait de progrès suffisant Le GAFI n’est pas encore convaincu que le pays suivant a fait assez de progrès dans son plan d’action mis au point avec le GAFI. Les points les plus importants du plan d’action et/ou la majorité des points de ce plan d’action n’ont pas été mis en œuvre. Si ce pays ne prend pas les mesures adéquates afin de remédier aux points majeurs de son plan d’action avant février 2012, le GAFI considèrera que ce pays n’aura pas exécuté le plan d’action comme convenu et le GAFI demandera à ses membres de prendre en compte les risques émanant des lacunes en lien avec ce pays. Tenant compte de cette information, et des risques qui découlent des insuffisances identifiées auprès du pays mentionné ci-dessous, il est recommandé que les organismes et personnes visés par le dispositif de la loi du 11 janvier 1993 prennent en compte dans leurs analyses de risques les risques spécifiques identifiés auprès du pays mentionné ci-dessous:

MEDEDELING Landen met strategische tekortkomingen op het gebied van de bestrijding van witwassen en financiering van terrorisme zoals vastgesteld door de FAG en de te nemen maatregelen voor deze landen 28 oktober 2011 Deze mededeling vervangt de voorgaande mededeling van 24 juni 2011. (1) FATF Public Statement of 28 October 2011. De FAG heeft in haar publieke verklaring van 28 oktober 2011 12 landen benoemd die een aanzienlijk risico vormen voor het internationale financiële stelsel wegens het ontbreken van een allesomvattend stelsel ter bestrijding van witwassen en financiering van terrorisme, waaronder 2 landen waarvoor de FAG vereist dat er tegenmaatregelen worden genomen. Rekening houdende met de openbare verklaring van de FAG, en de risico’s van witwassen en financiering van terrorisme die van deze landen uitgaan, moeten de instellingen en personen bedoeld in de wet van 11 januari 1993 verscherpte klantenonderzoeksmaatregelen toepassen voor de occasionele verrichtingen die ze uitvoeren met, en voor de zakenrelaties die ze aangaan of in stand houden met, hun cliënten wanneer personen gedomicilieerd of gevestigd in een van deze 12 landen of die andere banden hebben met deze landen die in welke hoedanigheid dan ook tussenkomen (als cliënt, lasthebber of uiteindelijke begunstigde) bij de verrichting of de zakenrelatie. Deze lijst zal worden bijgewerkt na elke plenaire vergadering van de FAG die gewoonlijk elk jaar in de maanden oktober, februari en juni plaatsvindt. Het is daarom noodzakelijk regelmatig de webstek van de Cel te raadplegen, in het bijzonder in oktober, februari en juni om zeker over de nieuwe bijgewerkte lijst van niet-meewerkende landen en gebieden te beschikken. Landen waarvoor de FAG haar leden en andere landen opriep om tegenmaatregelen te nemen om hun financiële stelsel te beschermen tegen de voortdurende en aanzienlijke risico's van witwassen en de financiering van terrorisme die uitgaan van Iran De FAG bevestigt de oproep aan haar leden en verzoekt alle landen met aandrang hun financiële instellingen aan te raden bijzondere aandacht te besteden aan zakelijke relaties met Iran, waaronder Iraanse
vennootschappen en financiële instellingen. Naast verhoogde waakzaamheid herhaalt de FAG eveneens haar oproep van 25 februari 2009 aan haar leden en verzoekt ze alle landen met aandrang doeltreffende tegenmaatregelen te nemen om hun financiële sector te beschermen tegen de risico's van witwassen en financiering van terrorisme die uitgaan van Iran. De FAG dringt er nog steeds op aan dat landen zich dienen te beschermen tegen correspondentrelaties die gebruikt worden om de tegenmaatregelen te omzeilen en te vermijden en tegen praktijken ter vermindering van risico's. Zij moeten rekening houden met de risico's van witwassen en financiering van terrorisme wanneer ze verzoeken van Iraanse financiële instellingen in overweging nemen om bijkantoren en dochterondernemingen in hun rechtsgebied te openen. Indien Iran geen concrete maatregelen neemt om het stelsel ter bestrijding van witwassen en financiering van terrorisme te verbeteren zal de FAG overwegen haar leden opnieuw op te roepen en alle landen met aandrang verzoeken de tegenmaatregelen in februari 2012 te verstrengen. In dit verband verwijst de CFI ook naar de rechtstreeks toepasselijk beperkende maatregelen, alsook de rechtstreeks toepasselijke tegenmaatregelen, opgelegd in de VERORDENING (EU) Nr. 961/2010 VAN DE RAAD van 25 oktober 2010 betreffende beperkende maatregelen ten aanzien van Iran en tot intrekking van Verordening (EG) nr. 423/2007. Democratische Volksrepubliek Korea De FAG roept haar leden op en verzoekt alle landen met aandrang hun financiële instellingen aan te raden bijzondere aandacht te besteden aan zakelijke relaties met de Democratische Volksrepubliek Korea, waaronder vennootschappen en financiële instellingen uit de Democratische Volksrepubliek Korea. Naast verhoogde waakzaamheid roept de FAG eveneens haar leden op en verzoekt ze alle landen met aandrang doeltreffende tegenmaatregelen te nemen om hun financiële sector te beschermen tegen de risico's van witwassen en financiering van terrorisme die uitgaan van de Democratische Volksrepubliek Korea. Landen dienen zich ook te beschermen tegen correspondentrelaties die gebruikt worden om de tegenmaatregelen te omzeilen en te vermijden en tegen praktijken ter vermindering van risico's. Zij moeten rekening houden met de risico's van witwassen en financiering van terrorisme wanneer ze verzoeken van financiële instellingen uit de Democratische Volksrepubliek Korea in overweging nemen om bijkantoren en dochterondernemingen in hun rechtsgebied te openen. Landen met strategische tekortkomingen op het gebied van de bestrijding van witwassen en financiering van terrorisme die onvoldoende vooruitgang boekten bij het wegwerken van deze tekortkomingen* of het actieplan dat met de FAG werd overeengekomen om deze tekortkomingen weg te werken niet nakomen. De FAG waarschuwt haar leden voor de risico’s die voortvloeien uit de tekortkomingen die met deze landen verbandhouden. Zoals hierboven vermeld moeten de instellingen en personen bedoeld in de wet van 11 januari 1993 verscherpte klantenonderzoeksmaatregelen toepassen voor de occasionele verrichtingen die ze uitvoeren met, en voor de zakenrelaties die ze aangaan of in stand houden met, hun cliënten wanneer personen gedomicilieerd of gevestigd in deze landen of die andere banden hebben met deze landen die in welke hoedanigheid dan ook tussenkomen (als cliënt, lasthebber of uiteindelijke begunstigde) bij de verrichting of de zakenrelatie.

Als onderdeel van haar lopende herziening van de naleving van de normen ter bestrijding van witwassen en financiering van terrorisme, benoemde de FAG tot op heden de volgende landen die strategische tekortkomingen vertonen op het gebied van de bestrijding van witwassen en financiering van terrorisme, waarvoor ze met de FAG een actieplan ontwikkelden. Hoewel de situatie voor elk land verschilt, heeft elk land zich schriftelijk politiek geëngageerd om de genoemde tekortkomingen aan te pakken. De FAG is verheugd met dit engagement. De FAG zal bijkomende landen blijven benoemen die een risico vormen voor het internationale financiële stelsel.

Landen die nog onvoldoende voortgang boekten De FAG is er nog niet van overtuigd dat het onderstaande landen voldoende vooruitgang boekten betreffende het actieplan dat met de FAG werd overeengekomen. De belangrijkste onderdelen en/of het merendeel van de onderdelen van het actieplan werden niet aangepakt. Indien deze landen niet de nodige maatregelen nemen om belangrijke onderdelen van het actieplan voor februari 2012 uit te voeren acht de FAG dat deze landen het overeengekomen actieplan niet nakomen en zal de FAG haar leden waarschuwen voor de risico’s die voortvloeien uit de tekortkomingen die met deze landen verband houden.

Landen die nog onvoldoende voortgang boekten De FAG is er niet van overtuigd dat de onderstaande landen voldoende vooruitgang boekten betreffende het actieplan dat met de FAG werd overeengekomen. De belangrijkste onderdelen en/of het merendeel van de onderdelen van het actieplan werden niet aangepakt. Indien deze landen niet de nodige maatregelen nemen om belangrijke onderdelen van hun actieplan voor juni 2011 uit te voeren acht de FAG dat deze landen hun overeengekomen actieplan niet nakomen en zal de FAG haar leden waarschuwen voor de risico’s die voortvloeien uit de tekortkomingen die met dit land verband houden.
