In deze zaak in beraad genomen op 24 januari 2012 spreekt de rechtbank volgend vonnis uit: De volgende procedurestukken werden op regelmatige wijze neergelegd: • het exploot van dagvaarding van 30/9/2005 ten verzoeke van eiseres betekend aan verweerders; • de conclusies van ESSENT, neergelegd ter griffie op 20/4/2006, 21/8/2006 en 21/11/2011; • de conclusies van de VREG,neergelegd ter griffie van deze rechtbank op 20/1/2006, 22/5/2006, 20/9/2006, 23/12/2011; • de conclusie van het VlAAMSE GEWEST, neergelegd ter griffie op 20/2/2006, 20/6/2006, 20/10/2006 en 23/12/2011; • de conclusie van de VlAAMSE GEMEENSCHAP,neergelegd ter griffie op 20/3/2006, 19/7/2006, 20/11/2006; • de stukkenbundel van ESSENT,neergelegd ter zitting van 24/1/2012; • de stukkenbundel van het VlAAMSE GEWESTjVlAAMSE GEMEENSCHAP/VREG,neergelegd ter zitting van 27/3/2008 en 24/1/2012 ; De advocaten van partijen werden gehoord in hun pleidooien ter openbare zitting van 24 januari 2012, waarna de zaak in beraad werd genomen.
I.
FEITEN
1. Het geding heeft betrekking op een administratieve boete die werd opgelegd aan Essentdoor de VREGvoor het jaar 2005. 2. Het wordt niet betwist dat Essent voor 2005 onderworpen was aan de in artikel 23, §1, van het Decreet van 17 juli 2000 (hierna: het Elektriciteitsdecreet) geformuleerde verplichting om jaarlijks vóór 31 maart een aantal groenestroomcertificaten voor te leggen aan de VREG.Dit diende voor de eerste maal te geschieden vóór 31 maart 2003. Ook vóór 31 maart van elk daaropvolgend jaar diende dit opnieuw te geschieden. Op 8 maart 2005 (stuk 1 bundel VREG) richtte de VREGeen aangetekend schrijven aan Essent waarin haar gewezen werd op de plicht om vóór 31 maart 2005 een bepaald aantal groenestroomcertificaten voor te leggen, 2
berekend overeenkomstig artikel 23, §2 van het Elektriciteitsdecreet, alsook een bepaald aantal warmtekrachtcertificaten, in uitvoering van artikel 9 van het Besluit van de Vlaamse Regering (hierna: BVR) van 5 maart 2004 houdende de openbare dienstverplichting ter bevordering van de elektriciteitsopwekking in kwalitatieve warmtekrachtinstallaties. Meer bepaald diende Essent 10.166 groenestroomcertificaten (later teruggebracht naar 10.165 - zie stuk 4 bundel VREG)in te leveren. Essent verklaarde zich bij brief van 17 maart 2005 akkoord met het opgegeven aantal certificaten, zoals berekend door de VREG(stuk 2 bundel VREG). In dit schrijven stelt Essent verder dat "zij aan het quotum [voldoet} middels de inlevering van de volgende stukken die voldoen aan de definitie van artikel 2 van het Decreet" en dat "elk certificaat/garantie een opgewekte hoeveelheid groene stroom van lMWh (1000 kWh) [vertegenwoordigt} en is geproduceerd met aanwending van een door het Decreet erkende hernieuwbare energiebron': 5828 groenestroomcertificaten afkomstig van producenten gelegen in het Vlaamse Gewest; 2 garanties van oorsprong afkomstig van een windenergieproducent in Nederland; 4332 garanties van oorsprong afkomstig van waterkrachtproductie in Noorwegen, 2 certificaten afkomstig van een windenergieproducent in het Waalse Gewest 2 certificaten afkomstig van een producent die elektriciteit opwekt uit biomassa in het BrusselseGewest. Met een schrijven van 22 maart 2005 antwoordde de VREG dat de certificaten afkomstig van productie-installaties. gelegen in het Brusselse Gewest, het Waalse Gewest, Nederland en Noorwegen, gelet op de huidige stand van de wetgeving, niet konden worden aanvaard (stuk 3 bundel VREG). Bij schrijven van 15 april 2005 besloot de VREG dan ook dat er 4.337 groenestroomcertificaten ontbraken en dat zij zodoende overwoog om een administratieve geldboete op te leggen van 4.337 X 125 euro = 542.125 euro: "1. Per 31 maart 2.005 heeft de VREG vastgesteld dat uw firma het volgend aantal groenestroomcertificaten wenste voor te leggen: - 5.258 groenestroomcertificaten afkomstig van producenten gelegen in het VlaamsGewest en dus uitgereikt door de VREG; - 4.337 certificaten afkomstig van producenten gelegen in het Brusselseen Waalsegewest, Nederland en Noorwegen,

De 5.258 groenestroomcertificaten afkomstig van producenten gelegen in het VlaamsGewest en dus uitgereikt door de VREGworden 'uiteraard aanvaard in het kader van de quotumverplichting, De overige certificaten, afkomstig van producenten, gelegen in het Brusselse en Waalse gewest, Nederland en Noorwegen kunnen wij helaas niet aanvaarden gelet op de huidige stand van de wetgeving. Dit werd u trouwens reeds voorspeld bij aangetekend schrijven van de VREGvan 22 maart 2005 met referte AP/LS/22.03.05/8879/23379. Artikel 25 van het Elektriciteitsdecreet machtigt de Vlaamseregering inderdaad om, na advies van de VREG,rekening houdende met het bestaan van gelijk of gelijkwaardige garanties inzake de aflevering van dergelijke certificaten, certificaten te aanvaarden voor groene stroom die niet geproduceerd is in het Vlaamsegewest. Op heden bestaat er echter geen besluit van de Vlaamseregering op basis van dit arokel 25 van het Elektriciteitsdecreet waarin bepaald wordt dat ook certificaten die werden toegekend voor groene stroom die werd geproduceerd buiten het Vlaams Gewest aanvaardbaar zijn. Bij gebreke hieraan dient bijgevolg geconcludeerd te worden dat op dit moment enkel Vlaamse groenestroomcertificaten aanvaardbaar zijn voor de certificatenverplichting, bedoeld in artikel 23 van het Elektriciteitsdecreet Artikel 15 van het besluit van de Vlaamseregering van 5 maart 2004 ,inzake de bevordering van elektriciteitsopwekking uit hernieuwbare energiebronnen, zoals gewijzigd door het besluit van 25 februari 2005, heeft - zoals u vermeldt de geografische beperking opgeheven voor de aanvaardbaarheid van groenestroomcertificaten in het kader van de quotumverplichting. Er is echter nergens een regeling die de criteria vastlegt voor de gelijkheid of de gelijkwaardigheid van certificaten uit andere gewesten of landen, zoals bedoeld in artikel 25 van het Elektriciteitsdecreet. Het door u aangehaalde Besluit van 25 februari 2005 vermeldt als rechtsgrond dan ook uitdrukkelijk artikel 24 § 1 van het Elektriciteitsdecreet, en niet artikel 25. De VREGkan hier niet omheen. Bovendien heeft het feit dat de VREG in het verleden in het kader van de gratis distributie of in het kader van de rapporteringsverplichting van de brandstofmix van de geleverde elektriciteit op de factuur, elders geproduceerde elektriciteit mee in aanmerking genomen heeft bij het bepalen van de hoeveelheid geleverde groene stroom niets te maken met de hier aan de orde zijnde quotumverplichting tot inleveren van groenestroomcertificaten. De VREG kan dan ook niet anders dan de certificaten die niet afkomstig zijn van producenten gelegen in het Vlaamse gewest, .waarmee u uw tekort aan ingeleverde Vlaamse groenestroomcertificaten poogde in te vullen, te weigeren, bij gebreke van een gedetailleerde wettelijke regeling aangaande de gelijkwaardigheid ervan met de certificaten uitgereikt door de VREG." Een hoorzitting vond plaats op 4 mei 2005. Bij schrijven van 24 mei 2005 werd door de VREG aan Essent medegedeeld dat zij op 17 mei 2005 beslist had om een boete op te leggen van 542.125,00 euro overeenkomstig artikel 37, §2 van het Elektriciteitsdecreet.

3. Eiseres stelde hieropvolgend een procedure in voor de Raad van State dd. 13 juni 2005 ter vernietiging van deze beslissing(en). De Raad van State heeft zich door middel van haar arrest van 1 februari 2010 met het nr. 200.294 onbevoegd verklaard om deze procedure te behandelen. De Vlaamse Gemeenschap, tweede tussenkomende partij, zou volgens eiseres via de Centrale Invorderingscel van haar Afdeling Financieel Management, op 5 september 2005 aan eiseres een ingebrekestelling, voorafgaand aan gedwongen uitvoering binnen dertig dagen, overgemaakt hebben inzake betaling van de opgelegde geldboete voor een bedrag van EUR542.125. Op 30 september 2005 heeft eiseres de VREG, het Vlaamse Gewest en de Vlaamse Gemeenschapgedagvaard voor deze Rechtbank.
11. VOORWERP VAN DE VORDERINGEN 4. De vordering van Essent zoals geformuleerd in haar aanvullende en synthesebesluiten, strekt ertoe: " Voorafgaand, overeenkomstig de beschikking genomen door Uw Rechtbank op grond van art. 30 Ger. W. huidige zaak, voor zover Uw Rechtbank dit nodig acht, samen te voegen met: • Essent Belgium t.jVREG - Groenestroom 2006: A.R. 10 - 9066. • Essent Belgium t./VREG- Groenestroom 2007: A.R. 10- 9067. • Essent Belgium t/VREG - Groenestroom 2008: A.R. 10 - 9068. • Essent Belgium t.jVREG - Groenestroom 2009: A.R. 10 - 9069. - Alvorens recht te spreken en voor zover uw Rechtbank dit nodig acht, op grond van artikel 19, al. 2 Ger. W. uw Rechtbank de volgende prejudiciële vragen te horen stellen aan het Europese Hof van Justitie: 1. Schendt de reglementering van een Lidstaat, in casu het Vlaamse decreet van 17 juli 2000 houdende de organisatie van de elektriciteitsmarkt in samenhang gelezen met het besluit van de Vlaamse regering van 25 februari 2005 inzake de bevordering van elektriciteitsopwekking uit hernieuwbare energiebronnen zoals toegepast door de VREG, die voor de quota inzake groenestroomcertificaten enkel certificaten voor groene stroom opgewekt in Vlaanderen aanvaardt en, louter op basis van de geografische oorsprong, certificaten toegekend aan gelijkwaardige groene stroom opgewekt in andere Lidstaten weigert, artikel 28 van het Verdrag tot oprichting van de Europese Gemeenschap en/or de beginselen van de interne energiemarkt voorzien in de toenmalige richtlijnen 96/92/EG betreffende de gemeenschappelijke regels voor de interne markt voor elektriciteit en 2003/54/EG van het Europees .Parlement en de Raad van 26 juni 1996 betreffende de gemeenschappelijke regels voor de interne markt voor elektriciteit en houdende intrekking van Richtlijn 96/92/EG, zeker wanneer deze autoriteiten zich, om een inbreuk tegen de regels betreffende de interne markt te vermijden, uitdrukkelijk voor de Europese Commissie

hebben verbonden om invoerders van elektriciteit de mogelijkheid te geven aan te tonen dat zij groene stroom hebben ingevoerd en bij de berekening van het aantal verplicht aan te kopen certificaten hiermee rekening te houden en de reguleringsinstantie hebben gemachtigd om de echtheid van de buiten het Vlaams Gewest afkomstige groenestroomcertificaten na te gaan door de certificaten van oorsprong van de elektriciteit te controleren? 2. Schendt de reglementering van een Lidstaat, in casu het Vlaamse decreet van 17 juli 2000 houdende de organisatie van de elektriciteitsmarkt in samenhang gelezen met het besluit van de Vlaamse regering van 25 februari 2005 inzake de bevordering van elektriciteitsopwekking uit hernieuwbare energiebronnen zoals toegepast door de VREG, die voor de quota inzake groenestroomcertificaten enkel certificaten voor groene stroom opgewekt in Vlaanderen aanvaardt en, louter op basis van de geografische oorsprong, certificaten toegekend aan gelijkwaardige groene stroom opgewekt in andere Lidstaten weigert, artikelen 1tot 6 van de toenmalige Europese richtlijn 2001/77/EG van het Europees Parlement en de Raad van 27 september 2001 betreffende de bevordering van elektriciteitsopwekking uit hernieuwbare energiebronnen op de interne elektriciteitsmarkt. 3. Schendt de reglementering van een Lidstaat, in casu het Vlaamse decreet van 17 juli 2000 houdende de organisatie van de elektriciteitsmarkt in samenhang gelezen met het besluit van de Vlaamse regering van 25 februari 2005 inzake de bevordering van elektriciteitsopwekking uit hernieuwbare energiebronnen zoals toegepast door de VREG, die voor de quota inzake groenestroomcertificaten enkel certificaten voor groene stroom opgewekt in Vlaanderen aanvaardt en, louter op basis van de geografische oorsprong, certificaten toegekend aan gelijkwaardige groene stroom opgewekt in andere Lidstaten weigert, het .gelijkheidsbeginsel en verbod tot discriminatie zoals onder meer vervat in artikel 12 van het Verdrag tot oprichting van de Europese Gemeenschapen artikel 3 van de toenmalige richtlijn 2003/54/EG van het Europees Parlement en de Raad van 26 juni 1996 betreffende de gemeenschappelijke regels voor de interne markt voor elektriciteit en houdende intrekking van Richtlijn 96/92jEG, zeker wanneer deze autoriteiten zich, om een inbreuk tegen de regels betreffende de interne markt te vermijden, voor de Europese Commissie hebben verbonden om invoerders van elektriciteit de mogelijkheid te geven aan te tonen dat zij groene stroom hebben ingevoerd en, voor de in aanmerking komende verdelers die kunnen bewijzen dat zij ingevoerde groene stroom hebben gekocht, bij de berekening van het aantal verplicht aan te kopen certificaten rekening te houden met dit feit? 4. Dienen artikel 34 van het Verdrag betreffende de Werking van de Europese Unie en de beginselen van de interne energiemarkt voorzien in richtlijnen 2003/54/EG betreffende de gemeenschappelijke regels voor de interne markt voor elektriciteit en 2009/72/EG van het Europees Parlement en de Raad van 13 juli 2009 betreffende de gemeenschappelijke regels voor de interne markt voor elektriciteit en 'houdende intrekking van Richtlijn 2003/54/EG zo te worden uitgelegd

dat zij zich verzetten tegen de reglementering van een Lidstaat, in casu het Vlaamse decreet van 17juli 2000 houdende de organisatie van de elektriciteitsmarkt in samenhang gelezen met het besluit van de Vlaamseregering van 25 februari 2005 inzake de bevordering van elektriciteitsopwekking uit hernieuwbare energiebronnen zoals toegepast door de VREG, die voor de quota inzake groenestroomcertificaten enkel certificaten voor groene stroom opgewekt in Vlaanderen aanvaarden, louter op basis van de geografische oorsprong, titels toegekend aan gelijkwaardige groene stroom opgewekt in andere Lidstaten weigert, zeker wanneer deze autoriteiten zich, om een inbreuk tegen de regels betreffende de interne markt te vermijden, uitdrukkelijk voor de Europese Commissie hebben verbonden om invoerders van elektriciteit de mogelijkheid te geven aan te tonen dat zij groene stroom hebben ingevoerd en bij de berekening van het aantal verplicht aan te kopen certificaten hiermee rekening te houden en de reguleringsinstantie hebben gemachtigd om de echtheid van de buiten het Vlaams Gewest afkomstige groenestroomcertificaten na te gaan door de certificaten van oorsprong van de elektriciteit te controleren? In hoofdorde, inzake A.R. 05/11810/A: De vordering ontvankelijk en gegrond te verklaren en, bijgevolg, uw Rechtbank te horen zeggen naar recht dat de beslissingen van verweerster van 15 april 2005 en 24 mei 2005 houdende oplegging van een administratieve geldboete onwettig zijn en, ten gevolge hiervan, de aan eiseres opgelegde geldboetes ten bedrage van 542.125 EUR niet verschuldigd te horen verklaren en te horen verbieden deze administratieve geldboete uit te voeren; De tegenvordering van tussenkomende partij onontvankelijk, minstens ongegrond, te horen verklaren. Het tussen te komen tussenvonnis uitvoerbaar- bij voorraad te verklaren, met uitsluiting van borgstelling en de mogelijkheid tot kantonnement Tenslotte, Verweerster te horen verklaren alle nodige handelingen te stellen om zich te conformeren naar de beslissing van uw Rechtbank. In ieder geval, Verweerster te horen veroordelen tot betaling van de kosten van het geding, met inbegrip van de rechtsplegingvergoeding, voorlopig begroot in hoofde van eiseres op het wettelijk voorziene maximumbedrag van 11.000 EUR.'~ De VREGbesluit als volgt:
"De vordering van eiseres, voor zover ontvankelijk, af te wijzen als ongegrond, zodoende eiseres er van af te wijzen; Eiseres te veroordelen tot de kosten van het geding, inclusief de rechtsplegingsvergoeding, in hoofde van concluante begroot op 5.000 EUR.", Het VlaamseGewestvordert

De Vlaamse Gemeenschap vordert: \\Rechtdoende op de vordering tot tussenkomst; De dagvaarding nietig te verklaren gelet op art. 702, §3 Ger. Wbo en art 861 Ger. Wb; Minstens de vordering tot tussenkomst onontvankelijk belang in hoofde van de eisende partij; Voor het overige de hoofdvordering ongegrond

5. Hoewel ten dele dezelfde bepalingen en principes van toepassing zijn, is er geen aanleiding om in te gaan op de vraag van eiseres om de aangehaalde zaken samen te voegen. Samenhangveronderstelt immers dat er een zo nauwe band bestaat tussen de zaken dat het wenselijk is ze samen te behandelen ten einde oplossingen te vermijden die onverenigbaar kunnen zijn. Het feit dat een administratieve boete voor een bepaald jaar niet verschuldigd zou zijn, is niet onverenigbaar met het feit dat voor een ander jaar deze boete niet zou verschuldigd zijn en vice versa.
IV. BEOORDELING DE HOOFDVORDERING 1. Ontvankelijkheid Uitputting administratief beroep 6. De VREGvoert aan dat eiseres geen gebruik heeft gemaakt van de in artikel 37, §5 van het Elektriciteitsdecreet voorziene beroepsmogelijkheid. Daardoor zou de bestreden beslissing definitief zijn geworden en het tekort aan groenestroomcertificaten zou aldus vaststaan. 7. .. Uit de bestreden beslissing van 24 (17) mei 2005 blijkt dat het beroep bij de VREGdoor middel van een aangetekend schrijven binnen een termijn van tien dagen enkel is bedoeld" om technische fouten te vermijden zoals een rekenfout' (stuk 7 bundel VREG - p. 4). Nu het beroep van eiseres geen betrekking heeft op een technische fout - zoals blijkt uit de aangevoerde middelen, was zij niet gehouden om het administratief beroep van artikel 35, §7 van het Elektriciteitsdecreet uit te oefenen. Het stellen van de voorwaarde dat het administratief beroep eerst moet zijn uitgeput, is enkel zinvol indien de administratieve beroepsinstantie (in casu de VREG) een effectief wettigheidstoezicht kan uitoefenen en zij derhalve zelf een onwettige bestuurshandeling buiten toepassing kan laten (zie ALEN, A. en THEUNIS, J., Praktische vragen over de exceptie van onwettigheid in artikel 159 van de Grondwet, in X, Themis Cahier nr. 54, Staatsrecht, Brugge, Die Keure, 2009, p. 15). 8. Het loutere feit dat eiseres bewust een tekort heeft nagestreefd, is niet relevant. Het komt uitsluitend aan eiseres toe, in het kader van het door haar gevoerde beleid en haar handelingsvrijheid, om te beslissen welke certificaten zij op een bepaald ogenblik inlevert. Deze beslissing is niet v.atbaarvoor kritiek van verweerders, noch van de rechtbank. Nietigheid van de dagvaarding en de ontvankelijkheid van de vordering opzichtens het VlaamseGewest en de VlaamseGemeenschap 9. Het Vlaamse Gewest en de Vlaamse Gemeenschap stellen dat de dagvaarding nietig zou zijn, omdat daaruit niet zou blijken waartoe de tussenkomst zou strekken. Eiseres zou geen enkele vordering hebben

gesteld tegen het Vlaamse Gewest of de Vlaamse Gemeenschap. Het Gewest en de Gemeenschap beroepen zich aldus op de "exceptio obscuri libelli". De rechten van verdediging van het Vlaamse Gewest en/of de Vlaamse Gemeenschap zouden hierdoor zijn aangetast. Het Vlaamse Gewest 10. Eiseres stelt dat het Vlaamse Gewest werd gedagvaard in gemeenen bindendverklaring van het tussen te komen vonnis. Hoewel deze vordering niet uitdrukkelijk wordt vermeld in de dagvaarding, blijkt hieruit wel wat aan het Vlaamse Gewest wordt verweten, met name onder meer het in gebreke blijven te voldoen aan zijn Europeesrechtelijke verplichtingen (p. 28 van de dagvaarding) en het niet-respecteren van de beginselen van behoorlijk bestuur (p. 32 van de dagvaarding). Aldus blijkt duidelijk waarom het Vlaamse Gewest werd betrokken bij de zaak en is voldaan aan de vereisten van artikel 702, 30 Ger.W. 11. Het vereiste belang moet minder strikt worden uitgelegd in geval van een gedwongen tussenkomst strekkende tot gemeenverklaring, omdat geen veroordeling wordt nagestreefd. Er is sprake van een voldoende belang indien een latere vordering of een later rechtsmiddel niet uitgesloten zijn. De eiser dient aan te tonen dat hij er belang bij heeft zich tegenover de derde te" kunnen beroepen op het gezag van gewijsde. In casu valt niet uit te sluiten dat eiseres in Vlaamse Gewest zou aanspreken wegens rechtstreeks werkende verdragsbepalingen. In gesteld dat het Vlaamse Gewest volkomen betwisting tussen eiseres en de VREG.

Uit niets blijkt dat de tussenkomst louter dilatoir zou zijn, zoals het Vlaamse Gewest betoogt. Eiseres geeft aldus blijk van een voldoende belang ten aanzien van het Vlaamse Gewest. Vlaamse Gemeenschap 12. De Vlaamse Gemeenschap stelt dat de vordering onontvankelijk is daar zij geen enkele bevoegdheid heeft om in de procedure van artikel 23 van het Elektriciteitsdecreet en artikel 37,§2 van het Elektriciteitsdecreet tussen te komen. Zij stelt dat het energiebeleid tot de gewestelijke aangelegenheden behoort. 13. In dat verband bepaalt artikel 37 § 6 van het Elektriciteitsdecreet dat de Vlaamse regering de ambtenaren aanwijst die gelast zijn dwangbevelen te geven en uitvoerbaar te verklaren. Artikel 1 van het Besluit van de Vlaamse Regering betreffende de invordering van niet-fiscale schuldvorderingen voor het Vlaamse Gewest en de instellingen die eronder

ressorteren, zoals gewijzigd door het Besluit van de Vlaamse regering van 4 jull 2003, duidt de ambtenaren van de administratie Budgettering, Accounting en Financieel Management van het ministerie van de Vlaamse gemeenschap aan om de niet-fiscale schuldvorderingen in te vorderen. Uit deze bepaling kan evenwel niet worden afgeleid dat de Vlaamse Gemeenschap bevoegd zou zijn voor het innen van de opgelegde boete, zoals Essentvoorhoudt. Het Vlaamse Gewest en de Vlaamse Gemeenschap zijn onderscheiden rechtspersonen (artikel 3 en 82 van de Bijzondere wet van 8 augustus 1980 tot hervorming der instellingen. ). Artikel 1, §1 van de Bijzondere wet van 8 augustus 1980 tot hervorming van de instellingen bepaalt dat het Parlement en de Regering van de Vlaamse Gemeenschap bevoegd zijn voor de aangelegenheden bedoeld in artikel 59bis van de Grondwet en dat zij in het Vlaamse Gewest de bevoegdheden van de gewestorganen uitoefenen voor de aangelegenheden bedoeld in artikel 107quater van de Grondwet. Artikel 3 van dezelfde wet voorziet dat voor het Vlaamse Gewest de attributen van de rechtspersoonlijkheid overeenkomstig die wet, inzonderheid artikel 1, worden uitgeoefend. Het loutere feit dat het "Ministerie van de Vlaamse Gemeenschap" stappen heeft ondernomen voor het innen van de opgelegde boete (zie in dat verband stuk 7 bundel VREG - de andere "ingebrekestellingen" worden door geen van de partijen voorgelegd), heeft aldus niet tot gevolg dat de administratie van de Vlaamse Gemeenschap hiermee een (eigen) bevoegdheid heeft uitgeoefend. Het "Ministerie van de Vlaamse Gemeenschap" betreft een overkoepelende benaming voor de diensten van de Vlaamse Regering, die zowel gemeenschaps- als gewestbevoegdheden uitoefenen, naar gelang het geval. Eiseresbetwist overigens niet dat de Vlaamse Gemeenschapniet bevoegd is wat betreft het energiebeleid. Deze is aldus volkomen vreemd aan de betwisting tussen eiseres, de VREGen het Vlaamse Gewest. Uit hetgeen voorafgaat moet besloten worden dat de vordering opzichtens de Vlaamse Gemeenschap ongegrond is. De Vlaamse Gemeenschap moet dan ook buiten zake worden gesteld. 2. Ten gronde 2.1. Reglementair kader 14.
Op Europees niveau zijn de volgende wetgevende akten van belang: Richtlijn 96/92/EG van het Europees Parlement en de Raad betreffende gemeenschappelijke regels voor de interne markt voor elektriciteit; Richtlijn 2001/77/EG van het Europees Parlement en de Raad van 27 september 2001 betreffende de bevordering van elektriciteitsopwekking uit hernieuwbare energiebron-nen op de interne elektriciteitsmarkt;

Richtlijn 2003/54/EG van het Europees Parlement en de Raad van 26 juni 2003 betreffende gemeenschappelijke regels voor de interne markt voor elektriciteit en houdende intrekking van Richtlijn 96/92/EG; Richtlijn 2009/72/EG van het Europees Parlement en de Raadvan 13 juli 2009 betreffende gemeenschappelijke regels voor de interne markt voor elektriciteit en tot intrekking van Richtlijn 2003/54/EG (PB L 211 van 14.8.2009, blz. 55-93) 15. Op Vlaams gewestelijk niveau werd uitvoering gegeven aan deze akten door onder meer het Elektriciteitsdecreet. Het Elektriciteitsdecreet werd inmiddels opgeheven bij decreet van 8 mei 2009, met inwerkingtreding op 1 januari 2011. Artikel 23 van het Elektriciteitsdecreet voorzag in een quotum voor de inlevering van groenestroomcertificaten en luidde als volgt:
''§ 1. Iedere leverancier die elektriciteit levert aan eindafnemers aangesloten op het distributienet of het transmissienet is verplicht 'jaarlijks voor 31 maart aan de reguleringsinstantie het aantal groenestroomcertificaten voor te leggen dat bepaald wordt met toepassing van §2. Voor de elektriciteit die door de houders van een leveringsvergunning via het distributienet wordt geleverd aan eindafnemers, gebeurt de eerste voorlegging van groenestroomcertificaten in het jaar 2003. Voor de elektriciteit die door de leveranciers via het transmissienet wordt geleverd aan eindafnemers, gebeurt de eerste voorlegging van groenestroomcertificaten in het jaar 2004. In afwijking van §2 gebeurt voor de elektriciteit die door de netbeheerders wordt geleverd aan eindafnemers de eerste en laatste voorlegging van groenestroomcertificaten in 2003. De bepaling in het vierde lid is met van toepassing voor de levering van de hoeveelheid elektriciteit, bedoeld in artikel 18bis, als de netbeheerder zelf de elektriciteit levert. Voor de toepassing van het eerste lid worden de leveringen van de hoeveelheid elektriciteit, bedoeld in artikel 18bis, door een houder van een leveringsvergunning aan een eindafnemer van de netbeheerder, als een levering van deze houder van een leveringsvergunning aan de eindafnemer beschouwd. ,.§ 2. Het aantal groenestroomcertificaten dat door een leverancier in een bepaald jaar n moet worden voorgelegd, wordt vastgesteld met de formule: C=GxEv waarbij : C gelijk is aan het aantal voor te leggen certificaten, uitgedrukt in MWh (1 000 kWh); Ggelijk is aan : 1° 0,008 op 31 maart 2003; 2° 0,012 op 31 maart 2004; 3° 0,020 op 31 maart 2005; 4° 0,025 op 31 maart 2006; 5° 0,030 op 31 maart 2007; 6° 0,0375 op 31 maart 2008;

70 ~0450 op 31 maart 2009; ..80 ~0525 op 31 maart 2010; 90 ~0600 op 31 maart 2011; Ev gelijk is aan de totale hoeveelheid elektriciteit, uitgedrukt in MWh, die door de leverancier werd geleverd aan zijn eindafnemers in het jaarn-1. In afwijking van het eerste lid wordt Ev verminderd met de volgende hoeveelheden: lOper afnamepunt waaraan één of meerdere leveranciers in het jaar n-t in de eerste verbruiksschijf van 20.000 MWh tot 100.000 MWh heeft geleverd, 25% van het verschil tussen deze geleverde hoeveelheid elektriciteit uitgedrukt in MWh en 20.000 MWh; 20 per afnamepunt waaraan één of meerdere leveranciers in het jaar n-I in de tweede verbruiksschijf van meer dan 100.000 MWh heeft geleverd, 50% van het verschil tussen deze geleverde hoeveelheid elektriciteit uitgedrukt in MWh en 100.000 MWh." Overeenkomstig artikel 24 van het Elektriciteitsdecreet was het aan de Vlaamse Regering om de uitvoeringsregelen vast te stellen met betrekking tot de aflevering van groenestroomcertificaten alsook welke groenestroomcertificaten in aanmerking komen voor het voldoen van de quoturnverpltchtlnq : "De Vlaamse regering stelt de nadere toepassingsregels en procedures vast voor het toekennen van groenestroomcertificaten, vermeld in artikel 22, en bepaalt welke certificaten in aanmerking komen voor het voldoen aan de verplichting, bedoeld in artikel 23. De Vlaamse regering bepaalt onder welke omstandigheden het voorleggen van het aantal groenestroomcertificaten, bedoeld in artikel 23, § 2, geheel of gedeeltelijk kan worden vervangen door het voorleggen van een aantal groenewarmtecertificaten, als bedoeld in artikel 3, 230, van het decreet van 6 juli 2001 houdende de organisatie van de gasmarkt " Artikel 25 van het Elektriciteitsdecreet voorzag tenslotte ook in een afzonderlijke machtiging aan de Vlaamse Regering voor het aanvaarden van certificaten, uitgereikt in een andere lidstaat of in een ander gewest dan het Vlaamse Gewest: "Onverminderd artikel 23, §§ 1 en 2, wordt de Vlaamse regering gemachtigd om, na advies van de reguleringsinstantie, rekening houdende met het bestaan van gelijke of gelijkwaardige garanties "inzake de aflevering van dergelijke certificaten, certificaten te aanvaarden voor groene stroom die niet is geproduceerd in het VlaamseGewest./~ Artikel 37, §2 van het Elektriciteitsdecreet luidt als volgt: "§2. Onverminderd § 1, bedraagt het bedrag van de administratieve geldboete voor een overtreding van artikel 23, § 1, 75 euro per ontbrekend certificaat op 31 maart 2003 en 100 euro per ontbrekend certificaat op 31 maart 2004. Vanaf 31 maart 2005 wordt de boete

bepaald op 125 euro per ontbrekend certificaat. Vanaf 31 maart 2015 wordt de boete bepaald op 100 euro per ontbrekend certificaat" 16. Artikel 24 van het Elektriciteitsdecreet werd door de Vlaamse Regering uitgevoerd bij artikel 8 van het Besluit van de Vlaamse Regering (BVR) van 28 september 2001 van de Vlaamse regering inzake de bevordering van elektriciteitsopwekking uit hernieuwbare energiebronnen: ''§ 1. Voor het voldoen aan de verplichting opgelegd aan de netbeheerders en houders van een leveringsvergunning ingevolge artikel 23 van het Elektriciteitsdecreet, aanvaardt de reguleringsinstantie enkel de groenestroomcertificaten die worden toegekend voor elektriciteit opgewekt in het Vlaams Gewest of in gebieden zoals bedoeld in artikel 6 van de wet van 29 april 1999 betreffende de organisatie van de elektriciteitsmarkt door middel van: 1°zonne-energie; 2° windenergie; 3° waterkracht < 10 MW; 4° getijdenenergie en golfslagenergie; 5° geothermie; 6° biogas dat voortkomt uit de vergisting van organisch-biologische stoffen hetzij in storten, hetzij in vergistingsinstallaties; 7° dierlijke mest, inclusief het daaruit opgewekte biogas; 8° biomassa, inclusief het daaruit opgewekte biogas, indien ze niet samen met restafval verwerkt wordt; "'9° de energie opgewekt uit organisch-biologische stoffen afkomstig van de volgende afvalstromen die niet onder de definitie van biomassa vallen, inclusief het daaruit opgewekte biogas, en indien die stoffen niet samen met restafval verwerkt worden: a) dierlijk afval; b) bermmaaisel; c) groente-, fruit- en tuinafval; d) groenafval; e) organisch-biologisch afval dat selectief ingezameld wordt of dat gesorteerd wordt uit restafval; f) zuiveringsslib; g) frituuroliën. § 2. Groenestroomcertificaten worden slechts aanvaard tijdens het productiejaar dat op het certificaat vermeld staat en de vijf daaropvolgendejaren. Elke certificaatplichtige is evenwel verplicht alle certificaten in zijn eigendom in te leveren voor zover nodig om te voldoen aan artikel 23 van het Elektriciteitsdecreet of nodig voor de verkoop van groene stroom zoals bepaald in artikel 13. § 3. Elke certificaatplichtige is verplichtjaarlijks vóór 31 december aan "de reguleringsinstantie de registratienummers van de groenestroomcertificaten mee te delen die hij wenst in te leveren om te voldoen aan de verplichting, bepaald in artikel 23 van het Elektriciteitsdecreet" (onderstreping door de rechtbank).

Verder voorzag dit besluit inzake de verkoop van groene stroom in artikel 13 oorspronkelijk dat: "De verkoop in het VlaamseGewest van een hoeveelheid elektriciteit aan eindafnemers onder de benaming « groene stroom » of onder soortgelijke benamingen is enkel toegestaan overeenkomstig de extra groenestroomcertificaten die de betrokken leverancier heeft ingeleverd, boven op de certificaten die hij heeft ingeleverd volgens artikel 8, §1, om geheel of gedeeltelijk te voldoen aan de verplichting van artikel 23 van het Elektriciteitsdecreet. De extra certificaten moeten voldoen aan de voorwaarden, genoemd in hoofdstuk IV. -Dere certificaten mogen echter toegekend zijn voor elektriciteit, opgewekt buiten het Vlaamse Gewest of buiten de gebieden, genoemd in artikel 6 van de wet van 29 april 1999 betreffende de organisatie van de elektriciteitsmarkt, op voorwaarde dat in het land of de regio waarin de certificaten werden toegekend, eveneens een minimum aantal certificaten ingeleverd moet worden," Dit besluit werd vervangen door het Besluit van de Vlaamse Regering van 5 maart 2004 (inwerkingtreding 2 april 2004) inzake de bevordering van elektriciteitsopwekking uit hernieuwbare energiebronnen. Artikel 15 van voormeld Besluit bepaalt welke certificaten in aanmerking konden worden genomen om te voldoen aan de verplichting van artikel 23 van het Elektriciteitsdecreet. "§1. Voor het voldoen aan de certificatenverplichting aanvaardt de VREGenkel de groenestroomcertificaten die worden toegekend voor elektriciteit, opgewekt in het Vlaamse Gewest of in gebieden zoals bedoeld in artikel 6 van de wet van 29 april 1999 betreffende de organisatie van de elektriciteitsmarkt door middel van: 1 °Zonne-energie; :'2° Windenergie; 3° Waterkracht < 10 MW; 4° Getijdenenergie en golfslagenergie; 5° Aardwarmte; 6° Biogas voortkomend uit de vergisting van organisch-biologische stoffen . a) in vergistingsinstallaties; b) in stortplaatsen; 7° Energie opgewekt uit volgende organisch-biologische stoffen : a) producten, bestaande uit plantaardige materialen of delen daarvan van landbouw of bosbouw; b) dierlijke mest; c) organisch-biologischeafvalstoffen die selectief ingezameld werden en niet in aanmerking komen voor materiaalrecyc/age of worden verwerkt conform de bepalingen van het van toepassing zijnde sectorale uitvoeringsplan; d) organisch-biologische afvalstoffen die gesorteerd worden uit restafval en niet in aanmerking komen voor materiaalrecyc/age of worden verwerkt conform de bepalingen van het van toepassing zijnde sectorale uitvoeringsplan; '. e) het organisch-biologisch deel van restafval, op voorwaarde dat de

betrokken verwerkingsinstallatie door energierecuperatie een primaire energiebesparing realiseert van minstens 35 % van de energie-inhoud van de afvalstoffen verwerkt in de installatie. §2. De groenestroomcertificaten die naar het buitenland werden uitgevoer~ worden niet aanvaard voor het voldoen aan de certificatenverplichting." (onderstreping door de rechtbank). Bij Besluit van 25 februari 2005 (inwerkingtreding 8 maart 2005) werd het artikel 15 van het BVR van 5 maart 2004 vervangen door de volgende bepaling:
"§1. Voor het voldoen aan de certificatenverplichting aanvaardt de VREGenkel de groenestroomcertificaten die worden toegekend voor elektriciteit, opgewekt door middel van: 1°Zonne-energie; .. 2° Windenergie; 3° Waterkracht < 10 MW; 4° Getijdenenergie en golfslagenergie; 5° Aardwarmte; 6° Biogas voortkomend uit de vergisting van organisch-biologische stoffen: a) in vergistingsinstallaties; b) in stortplaatsen; 7° Energie opgewekt uit volgende organisch-biologische stoffen : a) producten, bestaande uit plantaardige materialen of delen daarvan van landbouw of bosbouw; b) dierlijke mest; c) organisch-biologische afvalstoffen die selectief ingezameld werden en niet in aanmerking komen voor materiaalrecyc/age of worden verwerkt conform de bepalingen van het van toepassing zijnde ~wmkwwremg~m~ . d) organisch-biologische afvalstoffen die gesorteerd worden uit restafval en niet in aanmerking komen voor materiaalrecyclage of worden verwerkt conform de bepalingen van het van toepassing zijnde sectorale uiwoeringsplan; .: e) het organisch-biologisch deel van restafval, op voorwaarde dat de betrokken verwerkingsinstallatie door energierecuperatie een primaire energiebesparing realiseert van minstens 35 % van de energie-inhoud van de afvalstoffen verwerkt in de installatie. §2. De groenestroomcertificaten die naar het buitenland werden uitgevoer~ worden niet aanvaard voor het voldoen aan de certificatenverplichting.". Partijen zijn het er kennelijk over eens dat het deze bepaling is, in werking getreden op 8 maart 2005, die van toepassing is op het onderhavige geding (zie onder meer de verwijzing naar dit Besluit in de brief van Essent van 17 maart 2005 (verkeerdelijk gedateerd op 17/3/2004) en de brief van de VREG van 22 maart 2005 - stukken 2 en 3 bundel VREG). Eiseres heeft tegen onder meer artikel 15 van het Besluit van de Vlaamse Regering van 5 maart 2004 (in zijn oorspronkelijke versie) een schorsingsberoep en een annulatieberoep ingesteld bij de Raad van State,

dat gedeeltelijk is gesteund op dezelfde middelen als deze die thans worden aangevoerd. In de zaak A. 150.409jIX-4480 van de Raad van State is bij arrest nr. 138.837 van 23 december 2004 de schorsing van de tenuitvoerlegging van de artikelen 15 en 18 van het besluit van de Vlaamse regering van 5 maart 2004 bevolen, en is de vordering tot schorsing van eiseres voor het overige verworpen. In dit arrest overwoog de Raad: "4.3.1 Overwegende dat artikel 18 van het bestreden besluit nog altijd de kosteloze distributie van groene stroom beperkt nu niet meer tot de elektriciteit opgewekt in een installatie die aangesloten is op een distributienet gelegen in het Vlaams Gewest, maar wel tot de elektriciteit opgewekt in een productie-installatie die haar elektriciteit rechtstreeks injecteert in een in België gelegen distributienet,· dat uit de door de verwerende partij overgelegde bewijsgegevens niet opgemaakt kan worden dat, in de nieuwe regeling, producenten uit het Waalse en het Brusselse Gewest die stroom injecteren op het distributienet binnen hun Gewest het voordeel van de nieuwe regeling -kunnen genieten, aangezien zij geen tegenbewijs levert van het door verzoekster uiteengezette standpunt dat er feitelijke belemmeringen bestaan om stroom die in Wallonië of Brussel op het distributienet geplaatst is uiteindelijk langs het Vlaams distributienet bij de eindgebruiker te brengen; dat met andere woorden, verzoekster terecht stelt dat de nieuwe regeling in feite geen verandering brengt in de situatie die door de Raad van State strijdig bevonden is met de bijzonder wet tot hervorming der instellingen; dat voorts de partijen ook geen bijkomende gegevens voorleggen die de Raad van State er zouden toe nopen het in het arrest nr. 127.031 van 12januari 2004 uiteengezette standpunt aangaande de invloed van het engagement dat het Vlaams Gewest heeft aangegaan inzake de vermindering van de uitstoot van broeikasgassen, te heroverwegen; dat, om de redenen uiteengezet in de overwegingen 4.5. van het arrest nr. 127.031, het eerste onderdeel van het middel om die reden ernstig wordt bevonden; 4.3.2. Overwegende dat, binnen hetzelfde reglementair kader, de verplichting die door artikel 15, § 1, van het bestreden besluit aan de leveranciers van elektriciteit wordt opgelegd om het voldoen aan hun -decretete verplichtingen te bewijzen met certificaten toegekend voor elektriciteit opgewekt in het Vlaams Gewest of in het zeegebied waarover Belgiëjurisdictie heeft, op dezelfde wijze het artikel 6, § 1, V.z;.BWHI miskent in de mate dat de certificaten voor stroom opgewekt in het Brusselse of het Waalse Gewest door de Vlaamse overheid worden geweigerd; dat in de huidige stand van het geding het eerste onderdeel van het middel ook te dien aanzien ernstig is'. In zijn arrest van 19 mei 2010 heeft de Raad ten gronde één middel van eiseres tegen deze bepaling verworpen en vervolgens de debatten heropend ten einde de auditeur toe te laten de andere middelen van eiseres te onderzoeken.

2.2. Controlebevoegdheid van de rechtbank 17, Partijen zijn het oneens over de vraag hoever de controlebevoegdheid van de rechtbank in het kader van het onderhavige geding reikt ten aanzien van de bestreden beslissingen. De VREGen het Vlaamse Gewest zijn van oordeel dat de VREG bij het nemen van een beslissing aangaande de door eiseres ingeleverde groenestroomcertificaten over een gebonden bevoegdheid beschikt op grond van artikel 37, §2 van het Elektriciteistdecreet. Zij verwijst in dat verband naar een arrest van het Grondwettelijk Hof van 28 september 2005.
Eiseres is het hier slechts gedeeltelijk mee eens en stelt dat de gebonden bevoegdheid enkel slaat op de bepaling van het bedrag van de geldboete. De VREG zou daarentegen over een discretionaire bevoegdheid beschikken om niet-Vlaamse groenestroomcertificaten te aanvaarden en had derhalve kunnen beslissen om de door eiseres voorgelegde certificaten te aanvaarden, nu zij - nog volgens eiseres - voldeden aan de omschrijvingen en vereisten van groenestroomcertificaten vervat in artikel 1 van het Besluit van 25 februari 2005 van de Vlaamse Regering tot wijziging van artikel 15 van het BVR van 5 maart 2004 inzake de bevordering van elektriciteitsopwekking uit hernieuwbare energiebronnen. 18. ... Voor 2005 waren de volgende bepalingen in voege: Artikel 25 van het Elektridteitsdecreet bepaalde: "Onverminderd artikel 23, §§ 1 en 2, wordt de Vlaamseregering gemachtigd om, na advies van de
reguleringsinstantie, rekening houdende met het bestaan van gelijke of gelijkwaardige garanties inzake de aflevering van dergelijke certificaten, certificaten te aanvaarden voor groene stroom die niet is geproduceerd in het VlaamseGewest", Artikel 15 van het BVR van 5 maart 2004, zoals vervangen bij BVR van 25 februari 2005, luidde: "'§1. Voor het voldoen aan de certificatenverplichting aanvaardt de
VREGenkel de groenestroomcertificaten die worden toegekend voor elektriciteit, opgewekt door middel van: 1 °Zonne-energie; 2° Windenergie; 3° Waterkracht < 10 MW; 4° Getijdenenergie en golfslagenergie; 5° Aardwarmte; ... 6° Biogas voortkomend uit de vergisting van organisch-biologische stoffen: a) in vergistingsinsta/laties; b) in stortplaatsen; 7° Energie opgewekt uit volgende organisch-biologische stoffen : a) producten, bestaande uit plantaardige materialen of delen daarvan van landbouw of bosbouw; b) dierlijke mest;

c) organisch-biologische afvalstoffen die selectief ingezameld werden en niet in aanmerking komen voor materiaalrecyclage of worden verwerkt conform de bepalingen van het van toepassing zijnde sectorale uitvoeringsplan; d) organisch-biologische afvalstoffen die gesorteerd worden uit restafval en niet in aanmerking komen voor materiaalrecyclage of worden verwerkt conform de bepalingen van het van toepassing zijnde sectorale uitvoeringsplan; :', e) het organisch-biologisch deel van reststvst. op voorwaarde dat de betrokken verwerkingsinstallatie door energierecuperatie een primaire energiebesparing realiseert van minstens 35 % van de energie-inhoud van de afvalstoffen verwerkt in de installatie. §2. De groenestroomcertificaten die naar het buitenland werden uitgevoerd, worden niet aanvaard voor het voldoen aan de certificatenverplichting. '~ Partijen zijn het er kennelijk over eens dat het deze bepaling is die van toepassing is op het onderhavige geding. 19. In de eerste plaats is op te merken dat in elke hypothese de rechtbank dient na te gaan of de regels waarop de VREG zich heeft gesteund bij het nemen van haar beslissingen, niet in strijd zijn met hogere rechtsnormen en met name met de Grondwet en regelen van internationale verdragen die rechtstreekse werking hebben in de interne rechtsorde, zoals wordt aangevoerd door eiseres. In voorkomend geval zal derhalve toepassing moeten worden gemaakt van artikel 159 G.W., dan wel van het beginsel van voorrang van het verdraqsrecht. 20. Uit de bepaling van artikel 15 van het BVRvan 5 maart 2004, zoals van toepassing op het onderhavige geding, vloeit kennelijk geen enkele geografische beperking voort met betrekking tot de oorsprong van de groenestroomcertificaten, noch wordt het aan de Vlaamse Regering overgelaten om de nadere voorwaarden te bepalen waaronder groenestroomcertificaten uit een andere land of gewest kunnen worden aanvaard zonder beperking inzake de plaats waar de daarop betrekking hebbende groene stroom werd geproduceerd. Vanaf de inwerkingtreding van het besluit van 25 februari 2005 (zijnde vanaf 8 maart 2005) worden derhalve enkel inhoudelijke criteria bepaald voor de aanvaarding van groenestroomcertificaten. In dat verband stelde de Raad van State afdeling wetgeving in zijn advies betreffende het BVR van 8 juli 2005 (advies 38.369/1 van de Raad van State, gegeven op 12 mei 2005 met toepassing van artikel 84, § 1, eerste lid, 10, van de gecoördineerde wetten op de Raadvan State, stuk 16 bundel eiseres): .."Artikel 25 van het Elektriciteitsdecreet machtigt de VlaamseRegering , om, na advies van de reguleringsinstantiel' rekening houdend met het bestaan van gelijke of gelijkwaardige garanties inzake de toekenning van dergelijke certificaten, certificaten te aanvaarden voor groene

stroom die niet is geproduceerd in het Vlaamse Gewest. In tegenstelling tot wat de gemachtigde voorhoudt, veronderstelt de toepassing van deze bepaling niet dat er voordien door de Vlaamse Regering een uitvoeringsbesluit wordt genomen. '~ In zijn arrest van 19 mei 2010, waarnaar 'de VREG zelf uitdrukkelijk verwijst, stelde de Raad aangaande artikel 15 van het BVR van 5 maart 2004, zoals gewijzigd bij BVR van 25 februari 2005 (punt 8.6.2 io. 31):
"8.6.2 Artikel 15 van het besluit van de Vlaamseregering van 5 maart 2004 is vervangen bij besluit van de Vlaamse regering van 25 februari 2005, met ingang van 8 maart 2005. Zoals voorheen, bepaalt paragraaf 1 van het nieuwe artikel 15 de voorwaarden waaraan groenestroomcertificaten moeten voldoen om door de VREG te worden aanvaard, voor het voldoen aan de verplichting opgelegd bij artikel 23 van het Elektriciteitsdecreet. Anders dan voorheen, wordt in de inleidende zin van artikel 15, § 1, niet meer vereist dat de elektriciteit moet zijn "opgewekt in het Vlaamse Gewest of in gebieden zoals bedoeld in artikel 6 van de wet van 29 april 1999 betreffende de organisatie van de eektndteltsmerkt": Artikel 15is later opnieuw vervangen bij besluit van de Vlaamse regering van 8 juli 2005, en gewijzigd bij besluiten van de Vlaamse regering van 20 april 2007 en 5 juni 2009. Aan de inleidende zin van artikel' 15, § 1 (thans, ingevolge de toevoeging van een tweede lid bij het laatstgenoemde besluit: inleidende zin van artikel 15, § 1, eerste lid) is echter niets gewijzigd. (..) [Aangaande de exceptie van verlies van belang in de loop van het geding} In zoverre het beroep is gericht tegen artikel 15 van het besluit van de Vlaamse regering van 5 maart 2004, moet vastgesteld worden dat die bepaling van kracht is geweest van 2 april 2004 tot aan het schorsingsarrest nr. 138.837 van 23 december 2004. Nadien is dat artikel 15 vervangen bij het besluit van de Vlaamseregering van 25 februari 2005, met ingang van 8 maart 2005. Volgens de nieuwe bepaling aanvaardt de VREG alle groenestroomcertificaten die aan bepaalde inhoudelijke voorwaarden voldoen, zonder beperking inzake de plaats waar de daarop betrekking hebbende groene stroom is geproduceerd. Voortaan kan de VREG dus ook certificaten aanvaarden die zijn toegekend in een ander' gewest of in het buitenland." (onderlijning
en benadrukking door de rechtbank)
Geen enkele bepaling lijkt de VREG aldus te kunnen hebben verhinderen om een onderzoek te voeren naar de gelijke of gelijkwaardige garanties die werden geboden door groenestroomcertificaten uit andere gewesten of

andere landen, zelfs bij afwezigheid van nadere criteria vastgelegd door de Vlaamse Regering. Indien het zo is, zoals de VREGvoorhield in haar brief van 12 mei 2006, dat bij gebrek aan uitvoeringsbesluiten geen (groenestroom)certificaten uit andere landen of gewesten konden worden aanvaard, moet worden vastgesteld dat deze toepassing van artikel 15 van het BVR van 5 maart 2004, zoals later vervangen bij BVR van 25 februari 2005, de facto niet verschilt van de toepassing van het oorspronkelijke artikel 15 van het BVR van 5 maart 2004, dat door de Raadvan State werd geschorst bij arrest van 23 december 2004 wegens schending van artikel 6, §1, VI, van de Bijzondere Wet tot hervorming van de Instellingen. Nochtans stelde de VREGin haar Jaarverslag van 2005 het volgende:' ''Nadat de Raad van State de artikelen 15 en 18 van het Besluit hernieuwbare energiebronnen schorste in een arrest van 23 december 2004, moest het Herstelbesluit Groenestroomcertificaten van 25 februari 2005 het groenestroomcertificatenmechanisme herstellen. [ ..] Het Herstelbesluit groenestroomcertificaten voorziet enkel technologische criteria voor de aanvaarding van de certificaten in het kader van de certificatenverplichting op te nemen in het Besluit hernieuwbare energiebronnen" (Jaarverslag van de VREG 2005, Hoofdstuk 2.2.1.1.) (onderstreping door de rechtbank) Volgens de VREG zelf was het aldus de uitdrukkelijke bedoeling van de Vlaamse Regering om door middel van het BVR van 25 februari 2005 te verhelpen aan de onwettigheid, die was vastgesteld in het arrest van de Raad van State van 23 december 2004. Het kan bezwaarlijk de bedoeling zijn geweest om de vermeende onwettigheid te remediëren door het aannemen van een nieuwe bepaling die louter formeel verschilt van de oorspronkelijke bepaling, maar in feite op dezelfde wijze wordt toegepast, met name doordat certificaten uit andere landen en gewesten niet kunnen worden aanvaard ter voldoening van de quotumverplichting. In het ene geval is de niet-aanvaarding het gevolg van de uitdrukkelijke tekst van het Besluit, in het andere geval is de niet-aanvaarding het gevolg van het gebrek aan uitvoering van de formeel gewijzigde bepaling. '"
Uit hetgeen voorafgaat lijkt te moeten worden afgeleid dat de VREGten aanzien van de ingeleverde groenestroomcertificaten uit andere landen of gewesten beschikte over een discretionaire bevoegdheid met betrekking tot de aanvaarding van deze certificaten. Zij heeft evenwel nagelaten dienaangaande enig onderzoek te voeren, hoewel zij minstens wat betreft de andere gewesten wel degelijk beschikte over de daartoe noodzakelijk gegevens (zie advies van de VREGstuk nr. 21 bundel Essent). Hieraan wordt geen afbreuk gedaan door het feit dat het Besluit van 25 februari 2005, blijkens de inleidende overwegingen ervan, enkel zou zijn gesteund op artikel 24, eerste lid van het Elektriciteitsdecreet, vermits het Besluit zelf geen enkele geografische beperking inhoudt wat betreft de aanvaarding van de certificaten uit andere landen of gewesten en de Vlaamse Regering evenmin voorbehoud heeft gemaakt om de criteria voor

aanvaarding nader te bepalen, terwijl het toch kennelijk in de bedoeling lag om .te verhelpen aan de geografische beperking vervat in het oorspronkelijke artikel 15 van het BVRvan 5 maart 2004. 21. Nergens in het BVR van 5 maart 2004, zoals gewijzigd bij BVR van 25 februari 2005, noch in het Elektriciteitsdecreet wordt gewag gemaakt van garanties van oorsprong. Artikel 5 van de Richtlijn 2001/77/EG stelt dat garanties van oorsprong moeten - vermelden uit welke energiebronnen de elektriciteit is geproduceerd, met de datum en plaats van productie, en geven in het geval van waterkrachtcentrales het vermogen aan; - de producenten van elektriciteit uit hernieuwbare energiebronnen in staat stellen aan te tonen dat de elektriciteit die zij verkopen elektriciteit uit hernieuwbare energiebronnen in de zin van de Richtlijn is. De lidstaten dienden uiterlijk op 27 oktober 2003 er zorg voor te dragen dat de oorsprong van elektriciteit uit hernieuwbare energiebronnen in de zin van deze Richtlijn als zodanig kan worden gegarandeerd volgens objectieve, transparante en niet-discriminerende criteria die door iedere lidstaat worden vastgesteld. Artikel 1, §1, 3° van het BVRvan 5 maart 2004 verklaart de definities van het Elektriciteitsdecreet van toepassing. In het Elektriciteitsdecreet wordt "groenestroomcertificaat" gedefinieerd als "een overdraagbaar immaterieel goed dat aantoont dat een producent in een daarin aangegeven jaar een daarin aangegeven hoeveelheid groene stroom, uitgedrukt in kWh, heeft opgewekt". Deze definitie is kennelijk voldoende ruim dat zij ook garanties van oorsprong, zoals omschreven in de Richtlijn, kan omvatten, zelfs al moeten eigenlijke groenestroomcertificaten (zoals bedoeld in de overwegingen van de Richtlijn en zoals de VREGen het Vlaamse Gewest terecht stellen) duidelijk worden onderscheiden van garanties van oorsprong gelet op hun verschillende finaliteit. Overigens is op te merken dat in artikel 25 van het Elektriciteitsdecreet niet enkel wordt verwezen naar groenestroomcertificaten, maar in algemene termen naar" certificaten (..) voor groene stroom die niet is geproduceerd in het Vlaamse Gewest'.
Verder kan worden verwezen naar de goedkeuring door de Europese Commissievan de steunmaatregel nr. N 550/2000 (zie verder). Aldus lijkt te moeten worden besloten dat de VREG ten aanzien van de ingeleverde certificaten (garanties van oorsprong) uit andere landen of gewesten eveneens beschikte over een discretionaire bevoegdheid met betrekking tot de aanvaarding van deze certificaten. Ten overvloede is vast te stellen dat de VREGin de bestreden beslissingen geen enkel onderscheid heeft gemaakt tussen de aanvaarding van certificaten uit andere gewesten (groenestroomcertificaten) en garanties

van oorsprong uit Noorwegen en Nederland aangaande de redenen van de weigering om deze in aanmerking te nemen. 22. Het arrest van het Grondwettelijk Hof van 28 september 2005, waarnaar de VREG verwijst om aan te tonen dat zij slechts over een gebonden bevoegdheid beschikte, kan niet tot een andere conclusie leiden. Het Hof heeft zich in zijn arrest immers enkel gesteund op de bepalingen van het decreet van 7 mei 2004 houdende wijziging van het Elektriciteitsdecreet van 17 juli 2000, wat betreft het groenestroomcertificatensysteem, en tot interpretatie van artikel 37, § 2, van ditzelfde decreet, zonder rekening te houden met de wijze waarop de bepalingen ervan werden uitgevoerd. Het Besluit van 5 maart 2004 werd immers gewijzigd bij BVR van 25 februari 2005 precies op het punt van groenestroomcertificaten uit andere gewesten of andere landen.
2.3.
Onderzoek van de aangevoerde middelen
23. Eiseres voert aan dat de betwiste beslissingen duidelijk het artikel 15 van het BVR van 5 maart 2004 toepassen, zoals geschorst door de Raad van State. De bestreden beslissingen vormen volgens eiseres dan ook onomstotelijk een belemmering voor het handelsverkeer in de Belgische Economische Unie en werken aldus, door toedoen van verweerster, marktprotectionisme in de hand. Eiseres vervolgt dat aangezien de bevoegdheidsverdelende regels een zekere graad van autonomie aan de Gewesten verschaffen, de gewestelijke wetgevers een verschillend beleid voeren inzake de bevordering van hernieuwbare energie. Logischerwijze bestaan er bijgevolg verschillen tussen het certificatensysteem in Vlaanderen en dat van Wallonië of het Brussels Hoofdstedelijk Gewest. Doch deze onderscheiden bevoegdheden mogen niet leiden tot een belemmering van het vrij verkeer tussen de deelgebieden van de Staat. 24. Het door eiseres aangevoerde middel is uit zijn aard beperkt tot de aanvaarding van groenestroomcertificaten uit andere gewesten, vermits geen garanties van oorsprong werden ingeleverd uit andere gewesten. 25. Het Grondwettelijk als volgt:

Hof oordeelde in zijn arrest van 28 oktober 2010
\\8.5.2. De uitoefening door een gewest van zijn eigen fiscale bevoegdheid mag geen afbreuk doen aan de algehele staatsopvatting, zoals die tot uiting komt in de opeenvolgende staatshervormingen en in de respectieve bijzondere en gewone wetten tot bepaling van de onderscheiden bevoegdheden van de federale overheid, de gemeenschappen en de gewesten. Uit het geheel van die bepalingen, inzonderheid uit artikel 6, § 1, VI, derde lid, van de bijzondere wet van 8 augustus 1980 ingevoegd bij artikel 4, § 8, van de bijzondere wet van 8

augustus 1988 -, en uit artikel 49, § 6, derde lid, van de bijzondere wet van 16 januari 1989 betreffende de financiering van de gemeenschappen en de gewesten blijkt dat het Belgische staatsbestel berust op een economische en monetaire unie, die wordt gekenmerkt door een geïntegreerde markt en door de eenheid van de munt. Hoewel artikel 6, §1, V.z;. derde lid, van de bijzondere wet van 8 augustus 1980 past in het kader van de toewijzing van bevoegdheden aan de gewesten wat de economie betreft, geldt die bepaling als de uiting van de wil van de bijzondere wetgever om een eenvormige basisregeling van de organisatie van de economie in een geïntegreerde markt te handhaven. Het bestaan van een economische unie impliceert in de eerste plaats het vrije verkeer van goederen en productiefactoren tussen de deelgebieden van de Staat. Wat het goederenverkeer betreft, zijn de maatregelen die autonoom door de deelgebieden van de unie - in casu de gewesten - worden vastgesteld en het vrije verkeer belemmeren, niet bestaanbaar met een economische unie." (GWH, 28 oktober 2010, www.constcourt.be, ov. B.5.2; zie ook GWH, 8 juli 2010, ibidem). 26. Zoals uitdrukkelijk wordt bepaald in artikel 2, 17°, van het Elektriciteitsdecreet, zijn groenestroomcertificaten overdraagbare immateriële goederen. Artikel 16, § 1, van het Besluit van 5 maart 2004 bepaalt dat ze "vrij verhandelbaar" zijn. Groenestroomcertificaten zijn dan ook goederen waarvoor binnen de Belgischeeconomische unie het beginsel van het vrij verkeer van goederen geldt (in dezelfde zin: Raad van State 19 mei 2010, punt 40.1). Een maatregel die formeel geen enkel onderscheid maakt tussen goederen uit het Vlaamse Gewest en goederen uit andere gewesten (in casu groenestroomcertificaten), maar die van aard is om rechtstreeks of onrechtstreeks, daadwerkelijk of potentieel, de handel binnen de Belgische economische unie te belemmeren, is een maatregel van gelijke werking als een kwantitatieve invoerbeperking. In casu wordt de handel binnen de unie belemmerd, doordat de gebruiksmogelijkheden binnen het Vlaams Gewest van certificaten uit andere gewesten beperkt worden, doordat ze niet in aanmerking genomen kunnen worden ter voldoening van de in het Vlaamse Gewest geldende certificatenverplichting Essent stelt aldus terecht dat, hoewel artikel 15 van het BVR van 5 maart 2004, zoals gewijzigd door het BVR van 25 februari 2005, formeel gezien geen enkel onderscheid maakt tussen groenestroomcertificaten uit het Vlaamse Gewest en dergelijke certificaten uit andere gewesten of andere landen, de aangepaste versie van artikel 15 van BVR van 5 maart 2004 (zoals van toepassing vanaf 8 maart 2005) op dezelfde wijze wordt toegepast als de oorspronkelijke versie van dit artikel, waarin was bepaald dat enkel groenestroomcertificaten toegekend voor elektriciteit, opgewekt in het Vlaamse Gewest of in gebieden zoals bedoeld in artikel 6 van de wet van 29 april 1999 betreffende de organisatie van de elektriciteitsmarkt,

konden worden aangewend tot voldoening van de quotumverplichting. Uit de bestreden beslissingen blijkt immers dat ook onder de nieuwe bepaling volgens de toenmalige stand van de wetgeving certificaten uit andere gewesten onder geen enkele voorwaarde (die betrekking heeft op de ingeleverde certificaten zelf) kunnen worden aanvaard. De bepaling van artikel 15 van het BVRvan 5 maart 2004, zoals vervangen bij het BVR van 25 februari 2005 en zoals toegepast door de VREG in de bestreden beslissingen, is dan ook te aanzien als een maatregel die het vrije verkeer tussen de gewesten belemmert en derhalve als een maatregel van gelijke werking als een kwantitatieve invoerbeperking. 27. Aangenomen moet worden dat een beperking van het vrij verkeer van g()ederen kan worden toegestaan, indien ze kan worden verantwoord door' dwingende vereisten van algemeen belang, voor zover de maatregel niet onevenredig is ten aanzien van de nagestreefde doelstellingen. De rechtbank erkent dat het stelsel van de groenestroomcertificaten in het algemeen tot doel heeft de productie van elektriciteit uit hernieuwbare energiebronnen aan te moedigen. Om ervoor te zorgen dat de beoogde milieudoelstellingen worden bereikt, mag de bevoegde overheid van het Vlaamse Gewest de voorwaarden bepalen waaraan groenestroomcertificaten moeten voldoen om in aanmerking te kunnen worden genomen ter voldoening van de bij Elektriciteitsdecreet opgelegde verplichting om een minimum aantal certificaten voor te leggen. Die overheid kan in beginsel ook besluiten dat alleen certificaten die zijn afgegeven door welbepaalde overheden, met toepassing van regelingen waaruit blijkt dat voor de afgifte van certificaten aan de gestelde voorwaarden is voldaan, in aanmerking genomen.kunnen worden. Evenwel stelde de Raad van State nog het volgende in zijn arrest van 19 mei 2010: "Om verenigbaar te zijn met het beginsel van de economische unie dient de bedoelde regeling echter ook evenredig te zijn met het beoogde doel. Een regeling die het op volstrekte en algemene wijze onmógelijk zou maken om certificaten uit andere deelgebieden in aanmerking te nemen, zou een onevenredige belemmering van het vrij verkeer van certificaten inhouden, en zou dan ook strijdig zijn met het beginsel van de Belgische economischeunie.". In casu blijkt dat certificaten uit andere gewesten dan het Vlaamse Gewest, niettegenstaande de libellering van artikel 25 van het Elektriciteistdecreet en artikel 15, §1 BVR van 5 maart 2004 (zoals vervangen bij het BVRvan 25 februari 2005), onder geen enkele voorwaarde konden worden aanvaard ter voldoening van de quotumverplichting, zelfs niet indien de randvoorwaarden voor uitwisselbaarheid, zoals vooropgesteld door de VREG zelf (zie advies van 1 februari 2005 - stuk 20 eiseres) waren vervuld. Enerzijds, stelt de VREGdat bij gebrek aan een machtigingsbesluit van de Vlaamse Regering geen certificaten uit andere gewesten konden worden aanvaard, terwijl, anderzijds, de Vlaamse Regering evenmin het nodige heeft gedaan uitvoering te geven aan artikel 25 van het Elektricitreitsdecreet (voor zover nodig - zie hoger).

Er kan enkel worden vastgesteld dat artikel 25 van het Elektriciteitsdecreet meer dan tien jaar na haar inwerkingtreding nog steeds niet ten uitvoer werd gelegd (voor zover dit nog nodig was - zie hoger), terwijl het Elektriciteitsdecreet zelf inmiddels werd opgeheven en vervangen door het decreet van 8 mei 2009. Aldus staat het vast dat gedurende de volledige geldingsduur van het Elektriciteitsdecreet onder geen enkele voorwaarde certificaten uit andere gewesten konden worden aanvaard ter voldoening van de quotumverplichting. De betrokken maatregel is dan ook kennelijk onevenredig met de nagestreefde doelstelling en derhalve in strijd met het beginsel van de Belgischeeconomische unie. Het is overigens de maatregel die het vrije verkeer belemmert die moet worden verantwoord in het licht van de dwingende vereisten van algemeen belang (in casu de niet-aanvaarding van certificaten uit andere gewesten) en niet het groenestroomcertificatensysteem op zich. Er wordt geen andere rechtvaardiging aangevoerd dan de bescherming van het leefmilieu (zie in dat verband de overwegingen van de Raadvan State), doch vermits ook de certificatensystemen van het Brusselse Hoofdstedelijk Gewest en het Waalse Gewest eenzelfde (minstens vergelijkbaar) doel nastreven, is deze rechtvaardiging kennelijk niet pertinent en onevenredig. Er kan niet worden ingezien waarom in een ander gewest geproduceerde elektriciteit uit hernieuwbare energiebronnen niet in dezelfde mate zou bijdragen aan vermindering van de gasuitstoot in het Vlaamse Gewest als in dit gewest geproduceerde elektriciteit uit hernieuwbare energiebronnen. In beide gevallen zal de eigen elektriciteitsproductie uit conventionele energiebronnen, en de bijbehorende vervuiling, in dezelfde mate worden. verminderd. Het leefmilieu - dat per definitie grensoverschrijdend is - wordt niet méér of in hogere mate beschermd, doordat de energie uit hernieuwbare energiebronnen wordt opgewekt in het Vlaamse Gewest. In dit opzicht is de maatregel niet proportioneel (vgl. A-G Jacobs, PreussenElektra, nr. 236). De VREGen het Vlaamse Gewest voeren niet aan (en tonen evenmin aan) dat het groenestroomcertificatensysteem, zoals uitgewerkt in het Elektriciteitsdecreet, niet of niet zou functioneren als steunmaatregel in geval van aanvaarding van certificaten uit andere gewesten of landen. Dit blijkt" ook niet uit de stukken en wordt niet aangetoond. Bovendien bevestigt artikel 25 van het Elektriciteitsdecreet uitdrukkelijk dat certificaten uit andere gewesten (en andere landen) kunnen worden aanvaard onder bepaalde voorwaarden, zodat mag worden aangenomen dat met de eventuele invoer van certificaten uit deze andere gewesten of landen afdoende rekening werd gehouden bij de uitwerking van de steunregeling. Deze aanvaarding werd aan geen andere inhoudelijke voorwaarden onderworpen dan het bestaan van gelijke of gelijkwaardige garanties inzake de toekenning van dergelijke certificaten.
28. De VREGverwijst in het kader van de bespreking van het middel van een schending van de economische unie van België naar een arrest van het Hof van Justitie inzake PreussenElektra.

In dat verband merkt eiseres terecht op dat er een aantal verschillen bestaan tussen de onderhavige zaak en de feiten die aanleiding hebben gegeyen· tot het arrest. Het arrest betrof immers (onder meer) de verenigbaarheid met het toenmalige artikel 30 EGvan een regeling van een aan de elektriciteitsbedrijven opgelegde afnameverplichting voor elektriciteit die is geproduceerd uit hernieuwbare energiebronnen binnen de werkingssfeer van de betrokken wet, en in het respectieve distributiegebied van elke betrokken onderneming. De belemmering van het handelsverkeer vloeide aldus voort uit het feit dat hierdoor de betrokken ondernemingen werden verhinderd een deel van hun behoeften te dekken bij subjecten in andere lidstaten. Het Hof legde sterk de nadruk op de betrokken maatregel de milieubescherming ten goede komt, omdat aldus wordt bijgedragen tot een vermindering van de uitstoot van broeikasgassen, die één van· de belangrijkste oorzaken is van klimaatverandering. In casu moet niet worden nagegaan wat de door het Vlaamse groenestroomcertificatensyteem nagestreefde doelstelling is, maar wel wat de doelstelling is van de regeling of maatregel, die het handelsverkeer tussen de gewesten belemmert of kan belemmeren. Die maatregel bestaat erin dat enkel groenestroomcertificaten worden aanvaard uit het Vlaamse Gewest ter voldoening van de quotumplicht. Deze maatregel wordt niet verantwoord door de doelstelling van de bescherming van het leefmilieu, vermits de certificatensystemen uit de andere gewesten kennelijk eenzelfde doelstelling nastreven (zie in dat verband verder). Bovendien is het wetgevend kader sedert het arrest van het Hof grondig gewijzigd. Waar het Hof uitspraak heeft gedaan op grond van Richtlijn 96/92/EG van het Europees Parlement en de Raad betreffende gemeenschappelijke regels voor de interne markt voor elektriciteit, werden inmiddels de volgende richtlijnen aangenomen: Richtlijn 2001/77/EG van het Europees Parlement en de Raad van 27 september 2001 betreffende de bevordering van elektriciteitsopwekking uit hernieuwbare energiebron-nen op de interne elektriciteitsmarkt; Richtlijn 2003/54/EG van het Europees Parlement en de Raad van 26 juni 2003 betreffende gemeenschappelijke regels voor de interne markt voor elektriciteit en houdende intrekking van Richtlijn 96/92/EG; Richtlijn 2009/72/EG van het Europees Parlement en de Raadvan 13 juli 2009 betreffende gemeenschappelijke regels voor de interne markt voor elektriciteit en tot intrekking van Richtlijn 2003/54/EG (PB L 211 van
14.8.2009, blz. 55-93). Verder verwijst de VREG naar de mededeling van de Commissie van 2005 "Steun voor Elektriciteit uit hernieuwbare energiebronnen" (COM, 2005, 627 def).· De door de VREG geciteerde overwegingen betreffen evenwel de rechtvaardiging van de door de lidstaten in het leven geroepen steunmaatregelen, zoals systemen van groenestroomcertificaten. 29. De VREG voert verder aan dat (1) artikel 25 van het Elektriciteitsdecreet niet werd uitgevoerd en dat (2) Brusselse en Waalse certificaten geen groenestroomcertificaten zijn in de zin van artikel 15, §1 van het BVR van 5 maart 2004 en de certificaten die worden afgeleverd

door het Waalse Gewest en het Brusselse Hoofdstedelijk gewest niet als gelijkwaardig kunnen worden aanzien. (1) Afwezigheid van uitvoeringsbesluit 30. Hoger werd er reeds op gewezen dat uit de bepaling van artikel 15, §1 van het BVRvan 5 maart 2004 (zoals van toepassing op het onderhavige geding) geen enkele geografische beperking lijkt voort te vloeien met betrekking tot de oorsprong van de groenestroomcertificaten, noch wordt het aan de Vlaamse Regering overgelaten om de nadere voorwaarden te bepalen waaronder groenestroomcertificaten uit een andere land of gewest kunnen worden aanvaard zonder beperking inzake de plaats waar de daarop betrekking hebbende groene stroom is geproduceerd. Vanaf de inwerkingtreding van het BVRvan 25 februari 2005 (8 maart 2005) worden derhalve enkel inhoudelijke criteria bepaald voor de aanvaarding van groenestroomcertificaten . De VREG had derhalve de gelijkwaardigheid van de ingeleverde groenestroomcertificaten uit andere gewesten kunnen onderzoeken' alvorens ze te verwerpen als zijnde niet-aanvaardbaar. 31. In de mate dat toch een uitvoeringsbesluit nodig zou zijn geweest om uitvoering te geven aan artikel 25, §1 van het Elektriciteitsdecreet, is de afwezigheid hiervan uitsluitend te wijten aan het stilzitten van het Vlaamse Gewest. De VREGstelt dat er volgens de Vlaamse Regering niet voldoende garanties voorhanden waren aanqaande de gelijkwaardigheid van zulke certificaten (p. 3~ syntheseconclusieVREG). Het Vlaamse Gewest stelt dat er in casu voor werd geopteerd om nog geen uitvoering te geven aan de bepalingen van artikel 25 van het Elektriciteitsdecreet wegens (i) de niet-gelijkwaardigheid ervan en (ll) zeker gelet op het marktregulerend karakter van het groenestroomcertificatensysteem op de elektriciteitsmarkt. (i) Volgens het Vlaamse Gewest voorziet het Elektriciteitsdecreet enkel in de mogelijkheid en dus niet de verplichting om certificaten uit andere gewesten te aanvaarden. Uit geen enkel stuk blijkt evenwel dat het Gewest enig onderzoek heeft gevoerd naar de gelijkwaardigheid van' Brusselse of Waalse certificaten, hoewel minstens de VREGbeschikte over alle noodzakelijke gegevens (zie stuk 20 bundel eiseres). Inmiddels is het Elektriciteitsdecreet niet langer in werking, zodat het vaststaat dat gedurende de gehele geldingsduur van het Elektriciteitsdecreet geen Brusselse of Waalse certificaten konden worden aanvaard. De Uitvoerende Macht (uitgeoefend in het Vlaamse Gewest door de Vlaamse Regering) dient verder de verordeningen en besluiten te nemen die voor de uitvoering van de wetten (of decreten) nodig zijn, zonder ooit

de wetten zelf te mogen schorsen of vrijstelling van hun uitvoering te mogen verlenen (vgl. Artikel 108 gec.G.W.). De stelling van het Vlaamse Gewest gaat er vanuit dat de aanvaarding van certificaten uit andere gewesten niet voortvloeit uit hogere rechtsnormen, zoals in casu het vrij verkeer in de Belgischeeconomische unie. Hoger werd reeds aangenomen dat de regeling, zoals van toepassing op het onderhavige geding, wel degelijk het beginsel van vrij verkeer schendt, zodat er wel degelijk een verplichting bestond voor de Vlaamse Regering om uitvoering te geven aan de bepaling van artikel 25 van het Elektriciteitsdecreet en in beginsel certificaten uit andere gewesten te aanvaarden, behoudens in geval van objectieve verantwoording. Tenslotte kan enkel worden vastgesteld dat de Vlaamse Regering ingevolge het schorsingsarrest van de Raad van State van 23 december 2004 het BVR van 25 februari 2005 heeft aangenomen, waarbij elke geografische beperking in artikel 15 van het BVR van 5 maart 2004 werd weggelaten. Deze wijziging zou echter volkomen zonder voorwerp zijn geweest, indien de Vlaamse Regering kon volstaan - zoals zij thans lijkt voor te houden ~ met het verder uitsluitend aanvaarden van Vlaamse groenestroomcertificaten, terwijl louter formeel ook certificaten uit andere gewesten konden worden aanvaard. (ii) In de Memorie van Toelichting staat te lezen: "Verder wordt voorsten dat de Vlaamseregering de beslissing kan nemen ook niet in het Vlaamse Gewest geproduceerde groenestroomcertificaten te aanvaarden, rekening houdende met de garanties die gegeven worden op dergelijke certificaten (oa. betrouwbaarheid, manier van opwekking, enzoverder) en met nieuwe Europese richtlijnen.". Aldus wordt hierin geen gewag gemaakt van het marktregulerend karakter van certificaten uit andere gewesten of landen, zoals het Vlaamse Gewest verkeerdelijk stelt. Het is de rechtbank niet duidelijk wat wordt bedoeld met het "marktregulerend karakter", waaraan het Waalse en Brusselsesysteem niet zouden beantwoorden. Het Elektriciteitsdecreet, noch het BVR van 5 maart 2004 hebben de aanvaarding van certificaten uit andere gewesten afhankelijk gemaakt van het afsluiten van een samenwerkingsakkoord met de andere gewesten, zodat de afwezigheid hiervan artikel 25, §1 van het Elektriciteitsdecreet niet vermag buiten werking te stellen. Indien de verschillen tussen de regelingen in de verschillende gewesten zo groot en asymmetrisch zijn als de VREG en het Vlaamse Gewest thans· voorhouden, stelt zich de vraag of een samenwerkingsakkoord tussen de gewesten binnen het bestaande regelgevend kader wel kan leiden tot de uitwisselbaarheid van certificaten. In elk geval sluit het loutere feit dat geen uitvoering werd gegeven aan artikel 25 van het Elektriciteitsdecreet, niet uit dat deze bepaling en de uitvoering en toepassing ervan kunnen worden aangemerkt als een maatregel die niet bestaanbaar is met de economischeunie van België.

(2) Gelijk(waardig)heid 32. De VREGstelt dat er voor de "BIM"- en "CWaPE"-certificaten "in de verste verté' geen sprake is van voldoende garanties aangaande de gelijkwaardigheid en betrouwbaarheid en dat daardoor" de ganse economie van het groenestroomcertificatenste/se/ binnen Vlaandered' onderuit zou halen. 33. Indien evenwel het Vlaamse Gewest en/of de VREG van oordeel waren of zijn dat certificaten uit een ander gewest niet in aanmerking kunnen worden genomen wegens een gebrek aan gelijkwaardigheid, dan was er niets dat hen kon verhinderen om de niet-aanvaardbaarheid van deze certificaten en de redenen hiervoor vast te stellen in een uitvoeringsbesluit. Door dit niet te doen hebben zij de facto de aanvaardbaarheid van certificaten uit andere gewesten in het geheel onmogelijk gemaakt en de toetsing van de toegepaste en gehanteerde criteria onttrokken aan elke juridische controle. DeVREG voert aan dat Waalse en Brusselse certificaten geen groenestroomcertificaten zijn, zoals deze worden afgeleverd door de VREG. Eiseres beweert dit ook niet, maar stelt dat de door andere gewesten afgeleverde certificaten gelijkwaardig zijn. In de Mededeling van de Commissievan 7 december 2005 (COM 2005, 627 final, bijlage 2) wordt wat België betreft het groenestroomcertificatensysteem in Wallonië in één adem vernoemd met het Vlaamse systeem, hetgeen doet vermoeden dat beide systemen minstens vergelijkbaar zijn. Het moet herhaald worden dat uit artikel 15, §1 van het BVR van 5 maart 2004, zoals van toepassing op het onderhavige geding, geen enkele geografische beperking voortvloeit met betrekking tot de oorsprong van de groenestroomcertificaten, noch wordt het aan de Vlaamse Regering overgelaten om de nadere voorwaarden· te bepalen waaronder groenestroomcertificaten uit een andere land of gewest kunnen worden aanvaard zonder beperking inzake de plaats waar de daarop betrekking hebbende groene stroom is geproduceerd. Nu de door eiseres ingeleverde certificaten uit Wallonië en Brussel werden afgeleverd voor energie opgewekt door wind en biomassa (hetgeen niet wordt betwist), voldoen deze certificaten minstens formeel aan de voorwaarden vervat in artikel 15, §1 BVR van 5 maart 2004, zoals van toepassing op het onderhavige geding. Het is dus oniulst, minstens ongenuanceerd, te stellen dat de ingeleverde certificaten "in de verste verte" niet als groenestroomcertificaten zouden kunnen worden aanzien. 34. In verband met de gelijkwaardigheid van de ingeleverde certificaten, . is op te merken dat de VREG in zijn advies van 1 februari 2005 (stuk 21 bundel Essent) zelf heeft uiteengezet onder welke voorwaarden er sprake kan zijn van uitwisselbaarheid tussen de verschillende certificaten:

"Volgens de VREG moet aan volgende voorweerden voldaan zijn om certificaten uit Wallonië en Brussel te aanvaarden voor de Vlaamse certificatenverplichting: Technischegelijkwaardigheid van de certificaten: • de certificaten in het andere gewest moeten zijn uitgereikt voor een gelijke hoeveelheid netto elektriCiteit als in Vlaanderen • deze hoeveelheid moet op dezelfde wijze zijn berekend Financiëlegelijkwaardigheid: • Gelijke boetes bij te weinig ingeleverde certificaten voor de certificatenverplichting· wederzfdse aanvaarding van certificaten voor de certificatenverplichting Vermijding van verstoring van de gewestelijke certifcatenmarkten. Aanpassing van de doelstellingen kan léäen tot verstoring. Als Vlaanderen buitengewestelijke certificaten aanvaardt, zal artikel 23, §3 van het Elektriciteitsdecreet moeten worden geschrapt om wille van deze reden (...)". Daarbij is op te merken dat enkel de technische gelijkwaardigheid in het Elektriciteitsdecreet is opgenomen. De overige voorwaarden zijn niet decretaal bepaald en derhalve hoogstens te aanzien als "de lege feranda". In de Memorie van Toelichting wordt uiteengezet welke criteria voor "het bestaan van gelijke of gelijkwaardige garanties inzake de aflevering van dergelijke certificaterf' in andere gewesten in aanmerking kunnen worden genomen, met name de betrouwbaarheid en de wijze van opwekking (VI. Pari, St. 1999-2000, 285-1). Eiseresvoegt hier zelf aan toe: de invloed van de EU en de finaliteit van het certificatensysteem. De betrouwbaarheid van het systeem Er zijn geen redenen om aan te nemen dat certificaten uit andere gewesten minder betrouwbaar zouden zijn dan de Vlaamse certificaten. De wijze van opwekking In dit verband wordt niet betwist dat certificaten in de andere gewesten worden toegekend op basis van de vermindering van C02, terwijl in het Vlaamse Gewest de certificaten worden toegekend per MWh groene stroom. Terecht verwijst eiseres naar een mededeling van de VREGvan 17 januari 2005, waarin uitdrukkelijk wordt gesteld dat het Vlaamse systeem principieel vergelijkbaar is met het Brusselse en Waalse systeem. De VREG heeft zelf de vergelijking uitgevoerd in haar advies van 1 februari 2005 (stuk 20 bundel eiseres - tabel p. 6). Met betrekking tot de CWaPE-certificaten stelt eiseres dat in geval van elektriciteit opgewekt door middel van windenergie steeds een groenestroomcertificaat toegekend wordt per MWh geproduceerde elektriciteit. In Vlaanderen wordt eveneens een groenestroomcertificaat

toegekend aan de producent van elektrldteit voor elke geproduceerde MWuur elektriciteit. De door eiseres uiteengezette analyse wordt bevestigd in het advies van de VREG van 1 februari 2005 (stuk 20 bundel eiseres tabel p. 6). In Wallonië wordt voor windenergie 1 certificaat toegekend per Mwh. Aldus is voldaan aan de technische "Voorwaarden voor ultwisselbaarheld", vooropgesteld door de VREG zelf in haar advies (p. 7 van het advies). Er kan niet worden ingezien om welke reden CWaPE certificaten "onder geen beding" kunnen worden beschouwd als groenestroomcertificaten in de zin van artikel 15 van BVR 5 maart 2004, zoals van toepassing op het onderhavige geding. Het loutere feit dat het Waalse systeem andere criteria vooropstelt voor de aflevering van groenestroomcertificaten, volstaat niet om de gelijkwaardigheid van deze certificaten af te wijzen. Artikel 25 van het Elektriciteitsdecreet doelt immers enkel op inhoudelijke criteria voor de aanvaarding van certificaten uit andere gewesten. Met betrekking tot in het Brussel Hoofdstedelijk Gewest (BIM) door middel van biomassa opgewekte elektriciteit (onder bepaalde voorwaarden in verband met de brandstof) worden 1,160 groenestroomcertificaten toegekend per MWh. Eiseres besluit dat aangezien in Vlaanderen slechts een groenestroomcertificaat toegekend wordt per MWh, verwerende partij de certificaten afkomstig uit het Brussels Hoofdstedelijk Gewest voor 86,21 % van hun oorspronkelijke waarde in rekening had dienen te nemen (100/1,160). Aldus is voldaan aan de technische "Voorwaarden voor uitwisselbaarheid", vooropgesteld door de VREG zelf in haar advies (p. 7 van het advies). Finaliteit van het systeem De VREG stelt dat de doelstelling van het Vlaamse systeem is om de "lokale productie aan de hand van hernieuwbare energiebronnen te stimuleren'. Eiseres merkt terecht op dat deze restrictieve doelstelling in geen enkel stuk of akte enige steun vindt en met name niet in het Elektriciteitsdecreet. Bovendien stelt zich de vraag of de stimulatie van de lokale productie een legitiem doel kan zijn in het kader van een economische unie, vermits een dergelijke unie wordt gekenmerkt door het principe van vrij verkeer. In elk geval kan een dergelijke finaliteit niet worden aanzien als een "dwingende vereiste van algemeen belang", vermits de eindgebruiker er in beginsel geen belang bij heeft dat groene stroom enkel lokaal wordt geproduceerd. In tegenstelling tot hetgeen de VREG voorhoudt, is de doelstelling van het Vlaamse systeem dezelfde als de doelstelling die ten grondslag ligt aan de Waalse en Brusselse systemen, met name de bevordering van het gebruik van hernieuwbare energiebronnen met het oog op de bescherming van het leefmilieu doordat dit bijdraagt tot de emissies van broeikasgassen (Zie in dat verband tevens punt 1 (p. 1-2) van de beoordeling van de steunmaatregel nr. N 550/2000: "Dit systeem heeft ten doel het aandeel
van de duurzame energie en kwalitatieve warmtekrachtkoppeling in de totale Vlaamse elektriciteitsproductie te verhogen. De maatregel zal een bijdrage leveren tot de Belgische toezeggingen inzake de vermindering van de C02-emissies in het kader van het Kyoto-protocol'). De stimulering van

productie van elektriciteit uit hernieuwbare bronnen en de vermindering van de C02 uitstoot zijn immers niet het einddoel van de betrokken regelingen. Dit blijkt overigens ook uit de overwegingen van de Richtlijn 2001/77, waaraan het Elektriciteistdecreet uitvoering heettqeqeven: H(1) In de Gemeenschap wordt thans onvoldoende van de mogelijkheden voor benutting van hernieuwbare energiebronnen gebruikgemaakt De Europese Gemeenschap erkent dat het nodig is =de bevordering van hernieuwbare energiebronnnen als prioritaire maatregel aan te merken, daar zulks bijdraagt tot bescherming van het milieu en duurzame ontwikkeling. Het kan bovendien plaatselijk tot meer werkgelegenheid leiden, een gunstig effect hebben op de sociale samenhang, bijdragen tot de continuileitvan de voorziening en het mogelijk maken om sneller de doelstellingen van Kyoto te bereiken. Daarom is het nodig dat dit potentieel in het kader van de interne elektriciteitsmarkt beter wordt benut. (2) De Gemeenschap heeft, zoals aangegeven in het witboek over duurzame energiebronnen, hierna "witboek" te noemen, aan de bevordering van de elektriciteitsopwekking uit hernieuwbare energiebronnen zowel omwille van de.continuïteit en de diversificatie van de voorziening, als om milieubeschermingsredenen en met het oog op de sociale en economische samenhang, een hoge prioriteit toegekend. Dat is onderschreven door de Raad in zijn resolutie van 8 juni 1998 betreffende hernieuwbare energiebronnen en door het Europees Parlement in zijn resolutie over het witboek. (3) Een groter gebruik van elektriciteitsopwekking uit hernieuwbare energiebronnen is een belangrijk onderdeel van het pakket van . .rnestreçelen die moeten worden getroffen om aan het Protocol van Kyoto bij het Raamverdrag van de Verenigde Naties inzake klimaatverandering te voldoen, en van beleidsmaatregelen om latere verplichtingen na te komen." Het door de Raad van State in zijn arrest van 19 mei 2010 vermelde en door verweerders aangehaalde onderscheid in finaliteit tussen het Vlaamse certificatensysteem, enerzijds, en het Waalse en Brusselse certificatensysteem, anderzijds - dat zou toelaten te besluiten dat Vlaamse groenestroomcertificaten en Waalse en Brusselse groenestroomcertificaten niet als gelijkwaardig kunnen worden beschouwd, met name de stimulering van hernieuwbare energiebronnen in het Vlaamse Gewest en C02besparing in het Waalse Gewest en het BrusselseHoofdstedelijk Gewest, is een kunstmatig onderscheid, vermits zowel de stimulering van hernieuwbare energiebronnen als de vermindering van C02 uiteindelijk wegen zijn die leiden tot eenzelfde einddoelstelling: de bescherming van het leefmilieu door een vermindering van emissiesvan broeikasgassen. 35. Tenslotte voert de VREG nog aan, onder verwijzing naar twee artikelen dat in de andere gewesten geen onderscheid wordt gemaakt tussen warmtekrachtcertificaten en groenestroomcertificaten;

dat niet elke productie-installatie aan wie in een bepaald gewest certificaten worden uitgereikt, indien ze in een ander gewest zouden gelegen zijn in dat gewest in aanmerking komen voor certificaten. Nu eiseres Waalse en Brusselse certificaten voorlegt uit windenergie en biomassa, die ook in Vlaanderen aanleiding zouden hebben gegeven tot het afleveren van certificaten (zie artikel 15; §1,2° en 7° BVR 5 maart 2004, zoals vervangen), stellen de aangehaalde problemen zich niet. Om die redenen de gelijkwaardigheid van alle Waalse en Brussel certificaten verwerpen, is kennelijk onevenredig met de nagestreefde doelstelling. 36. Gelet op het voorgaande kan niet worden aangenomen dat door de CWaPEafgeleverde certificaten en door de BIM afgeleverde certificaten niet als gelijkwaardig zouden kunnen worden beschouwd. 37. De schending van het beginsel van de Belgische economische unie staat vast en wordt niet gerechtvaardigd door vereisten van dwingend algemeen belang. Het middel is gegrond.
38. In het tweede onderdeel van het eerste middel voert eiseres aan dat de bestreden beslissingende artikelen 34 en 36 VWEUschenden, met name dat deze maatregelen van gelijke werking als kwantitatieve invoerbeperkingen uitmaken in de zin van deze bepalingen. Nog volgens eiseres kan de VREG, aangezien er een Europese regeling ontbreekt betreffende groenestroomcertificaten, overeenkomstig het Dassonvlllearrest, slechts redelijke maatregelen nemen ter voorkoming van oneerlijke mededinging en mogen deze maatregelen geen verkapte beperking van de handel tussen de lidstaten vormen. De VREG stelt dat niet is bewezen de bestreden beslissing(en) de intratommunautraire handel zouden belemmeren, door te beslissen dat Noorse en Nederlandse certificaten niet kunnen worden aanvaard voor het voldoen van de quotumverplichting. 39. Aangaande de belemmering van de intracommunautaire handel kan mutatis mutandis worden verwezen naar de bovenstaande overwegingen in verband met het eerste onderdeel van het eerste middel en de overwegingen dienaangaande van de Raad van State (mutatis mutandis) in zijn arrest van 19 mei 2010, waarnaar de VREGzelf verwijst: "Zoals uitdrukkelijk wordt bepaald in artikel 2, 17/, van het Elektriciteitsdecreet, zijn groenestroomcertificaten overdraagbare immateriële goederen. Artikel 16,. §. 1, van het bestreden besluit bepaalt dat ze ''vrij verhandelbaar" zijn. Groenestroomcertificaten zijn dan ook goederen waarvoor binnen de Belgische economische unie het beginsel van het vrij verkeer van goederen geldt (zie daarover nr. 20.2).

De verwerende partij voert aan dat de certificaten afgegeven door de overheden van de andere gewesten vrij in Vlaanderen ingevoerd en verhandeld kunnen worden. Dit neemt niet weg dat de gebruiksmogelijkheden binnen het Vlaams Gewest van dergelijke certificaten beperkt worden, doordat ze niet in aanmerking genomen kunnen worden ter voldoening van de in het Vlaamse Gewest geldende certificatenverplichting. Aldus moet worden aangenomen dat artikel 15, § 1, van het bestreden besluit de handel in groenestroomcertificaten kan belemmeren en dus een maatregel van gelijke werking als een kwantitatieve invoerbeperking inhoudt 1/
Inzoverre de leveranciers van elektriciteit in het Vlaamse Gewest gehouden zijn groenestroomcertificaten afgeleverd door de VREG(of de CREG)aan te kopen - vermits de certificaten uit andere gewesten of landen niet worden aanvaard, worden zij verhinderd een deel van hun behoeften aan certificaten te dekken bij subjecten in andere lidstaten (Vgl. HVJEU, PreussenElektra, 21 maart 2001, C-379/78, r.o. 70). In die zin is er aldus prima- facie sprake van een maatregel van gelijke werking als een kwantitatieve invoerbeperking in de zin van artikel 34 VWEU en artikel 11 EER-Overeenkomst. 40. Het thans door de VREGverdedigde standpunt valt niet te rijmen met het standpunt vertolkt door het Vlaamse Gewest in het kader van de goedkeuring van het groenestroomcertificaten als steunmaatregel door de EuropeseCommissie: ''[1.8eschrijving van de maatregel] De groenestroomcertificaten worden gekocht van producenten die stroom opwekken uit hernieuwbare bronnen of producenten met kwalitatieve warmtekrachtinstallaties. Deze producenten moeten niet gevestigd zijn in het Vlaams Gewest. De reguleringsinstantie gaat de echtheid van de van buiten het Vlaams Gewest afkomstige groenestroomcertificaten na door de certificaten van oorsprong van de elektriciteit te controleren. De reguleringsinstantie zal gebruik maken van het kader dat thans wordt ontwikkeld in de verwachte EU-richtlijn betreffende de bevordering van elektriciteit en hernieuwbare energiebronnen op de interne elektriciteitsmarkt. (..j. [3.4 Duur van de maatregel} Om een inbreuk tegen de regels betreffende de interne markt te vermijden, hebben de Vlaamse autoriteiten zich ertoe verbonden om invoerders van elektriciteit de mogelijkheid te geven aan te tonen dat zij groene stroom hebben ingevoerd. Voor de in aanmerking komende verdelers die kunnen bewijzen dat zij ingevoerde groene stroom hebben gekocht, zal bij de berekening van het aantal verplicht te kopen Vlaamse groenestroomcertificaten, rekening worden gehouden met dit feit. De reguleringsinstantie controleert de oorsprong van de groene certificaten die afkomstig zijn van buiten het Vlaams Gewest De reguleringsinstantie zal waar mogelijk het kader gebruiken dat momenteel wordt ontwikkeld in de komende EU-richtlijn betreffende de bevordering van elektriciteit uit hernieuwbare energiebronnen op de interne elektriciteitsmarkt Voorts is overleg gaande tussen de Vlaamse autoriteiten en de autoriteiten van

andere lidstaten, in het bijzonder Nederland en Luxemburg, om overeenkomsten inzake de wederzijdse erkenning van groenestroomcertificaten ten uitvoer te leggen. Tenslotte hebben de Vlaamse autoriteiten zich ertoe verbonden de verkoop van Vlaamse groenestroomcertificaten te verbieden wanneer de betrokken, in het Vlaams Gewest geproduceerde groene stroom wordt uitgevoerd, en dit tot het tijdstip waarop de voormelde wederzijdse erkenning van groenestroomcertificaten van kracht wordt Derhalve concludeert de Commissie dat het aangemelde systeem in overeenkomst is met de EUregels inzake de interne markt". Niet alleen blijkt hieruit dat de regelen van de interne markt van toepassing blijven, zelfs bij gebrek aan een geharmoniseerd systeem van groenestroomcertificaten. Bovendien ging het Vlaamse Gewest er kennelijk zelf van uit dat, indien verdelers zouden bewijzen dat zij ingevoerde groene stroom hebben gekocht, rekening zou worden gehouden met dit feit bij de berekening van het aantal verplicht te kopen Vlaamse groenestroomcertificaten. In de praktijk werd en wordt echter geen rekening gehouden met deze certificaten uit andere landen en werd er geen enkel onderzoek gevoerd naar de gelijke of gelijkwaardige garanties inzake de aflevering van deze certificaten. De bepalingen van de Richtlijn 2001/77 regelen de erkenning van garanties van' oorsprong niet op exhaustieve wijze en doen derhalve geen afbreuk aan de regelen van het vrij verkeer van goederen in de interne markt. 41. De VREGstelt verder dat de door eiseres ingeleverde certificaten "geen enkel uitstaans hebben" met het groenestroomcertificatensysteem, doch enkel garanties van oorsprong betreffen. Volgens de VREGis er een fundamenteel verschil tussen beiden. De VREGverwijst in dat verband naar de definitie van garanties van oorsprong vermeld in artikel 5 van Richtlijn 2001/77. Garanties van oorsprong strekken er - nog volgens de VREG- toe de handel in elektriciteit uit hernieuwbare energiebronnen te ondersteunen, doch vooral de transparantie voor de verbruiker in zijn keuze tussen elektriciteit uit niet hernieuwbare bronnen en elektriciteit uit hernieuwbare energiebronnen te vergroten. Deze garanties van oorsprong houden op zich niet het recht in gebruik, te maken van de in de verschillende lidstaten bestaande steunregelingen. Zij verwijst in dat verband onder meer naar de overweging 10 van de Richtlijn 2001/77: "(10) Deze richtlijn verlangt niet van de lidstaten dat zij de verwerving van een garantie van oorsprong van andere lidstaten of de overeenkomstige aankoop van elektriciteit erkennen als bijdrage tot de vervulling van een nationale quotumverplichting. Voorde bevordering van de handel in elektriciteit uit hernieuwbare energiebronnen en dê vergroting van de transparantie voor de keuze van de verbruiker tussen elektriciteit uit niet-hernieuwbare en elektriciteit uit hernieuwbare energiebronnen is een garantie van de oorsprong van die elektriciteit evenwel noodzakelijk. Regelingen voor het bewijs van oorsprong houden op zich niet het recht in om van de in verschillende lidstaten bestaande nationale steunregelingen gebruik te maken. Het is van belang dat alle vormen van elektriciteit uit hernieuwbare energiebronnen onder een dergelijke garantie van oorsprong vallen N.

De VREGbesluit: garanties van oorsprong zijn geen groenestroomcertificaten; garanties van oorsprong dienen niet te worden aanvaard in het kader van de inleveringsplicht; . garanties van oorsprong geven geen recht om gebruik te maken van de nationale steunmaatregelen. 42. Eiseres stelt terecht dat een "groenestroomcertificaat" als volgt is gedefineerd in artikel 1, 17° van het Elektriciteitsdecreet: "170 groenestroomcertificaat: een overdraagbaar immaterieel goed dat aantoont dat een producent in een daarin aangegeven jaar een daarin aangegeven hoeveelheid groene stroom, uitgedrukt in kWh, heeft opgewekt'. Garanties van oorsprong worden nergens Elektriciteitsdecreet. Ze worden zelfs niet vermeld.

Artikel 1, 14° van het BVRvan 5 maart 2004, zoals ingevoegd door het BVR van 8 juli 2005 (in werking getreden op 27 februari 2006), omschrijft garanties van oorsprong als volgt: "140 garantie van oorsprong: bewijsstuk om aan te tonen dat een aan eindafnemers geleverde hoeveelheid elektriciteit afkomstig is uit hernieuwbare energiebronnen.". De definitie van groenestroomcertificaat in het decreet is voldoende ruim dat zij ook garanties van oorsprong, zoals omschreven in de Richtlijn, kan omvatten, zelfs al moeten eigenlijke groenestroomcertificaten (zoals bedoeld in de overwegingen van de Richtlijn) duidelijk worden onderscheiden van garanties van oorsprong gelet op hun verschillende finaliteit. De nauwe verwantschap tussen garanties van oorsprong en groenestroomcertificaten blijkt verder uit het feit dat in artikel 15, quater, §2, tweede lid BVRvan 5 maart 2004, zoals vervangen door het BVRvan 8 juli 2005, dat betrekking heeft op de aanvaarding van garanties van oorsprong, uitdrukkelijk wordt verwezen naar artikel 25 van het Elektriciteistdecreet, hoewel in deze bepaling enkel sprake is van "certificaten (...) voor groene stroom die niet is geproduceerd in het Vlaamse Gewest' en deze laatste bepaling niet werd gewijzigd. Met deze certificaten worden dus kennelijk niet enkel groenestroomcertificaten sensu stricto bedoeld. Indien in de Richtlijn 2001/77/EG is opgenomen dat "zij niet verlangt van de lidstaten dat zij de verwerving van een garantie van oorsprong van andere lidstaten of de overeenkomstige aankoop van elektriciteit erkennen als bijdrage tot de vervulling van een nationale quotum verplichting./~ moet worden vastgesteld dat de Richtlijn het ook niet alsdusdanig heeft uitgesloten of verboden en dat de Lidstaten aldus vrij zijn om deze al dan niett-e aanvaarden. Bij gebrek aan uitvoeringsmaatregelen enjof criteria op grond waarvan de garanties van oorsprong uit andere landen kunnen worden aanvaard, was

het - volgens de VREG - echter onmogelijk om certificaten uit andere landen in aanmerking te doen nemen voor het voldoen van de quotumverplichting. 43. Het is niet duidelijk wat de VREGprecies bedoelt met de stelling dat garanties van oorsprong geen recht geven om gebruik te maken van de nationale steunmaatregelen. Het volstaat in dat verband te verwijzen naar artikel 25 van het Elektriciteitsdecreet, dat uitdrukkelijk voorziet dat certificaten uit andere gewesten (en andere landen) kunnen worden aanvaard onder bepaalde voorwaarden. 44. Wat betreft de certificaten uit Noorwegen en Nederland (wijze van opwekking, betrouwbaarheid, ...) werden in deze stand van het geding geen opmerkingen geformuleerd (zie onder meer de niet-weersproken overwegingen van eiseres p. 96 van haar aanvullende en syntheseconclusie). 45. De rechtbank is van oordeel dat voor de beoordeling van het geschil het noodzakelijk is dat het Hof van justitie van de Europese Unie zou worden bevraagd aangaande de uitlegging van artikel 34 en/of 36 VWEUen de overeenstemmende bepalingen van de EER-Overeenkomst. Wat betreft de eventuele schending van de "beginselen van de interne energiemarkt voorzien in de toenmalige richtlijnen 96/92/EG betreffende de gemeenschappelijke regels voor de interne markt voor elektriciteit en 2003/54/EG van het Europees Parlement en de Raad van 26 juni 1996 betreffende de gemeenschappelijke regels voor de interne markt voor elektriciteit en houdende intrekking van Richtlijn 96/92/EG' blijkt onvoldoende welke bepalingen precies van deze richtlijnen volgens eiseres in casu werden geschonden, zodat het stellen van een prejudiciële vraag dienaangaande niet is verantwoord. Wat betreft de bepalingen van Richtlijn 2001/77 moet de prejudiciële vraag worden beperkt tot artikel 5 van deze Richtlijn. 46. Het Vlaamse Gewest stelt dat indien het middel gesteund op de schending van het beginsel van de economische unie van België gegrond zou worden verklaard, de voorgestelde prejudiciële vragen aan het Hof van Justitie zonder voorwerp zouden zijn. Nochtans hebben de bestreden beslissingen betrekking op de inlevering, enerzijds, van Waalse en Brusselse groenestroomcertificaten, en, anderzijds, op de inlevering van Noorse en Nederlandse garanties van oorsprong. De onwettigheid van de bestreden beslissingen inzoverre zij Waalse en Brusselsecertificaten weigeren in aanmerking te nemen blijft in beginsel zonder uitwerking op de wettigheid van de andere onderdelen van de bestreden beslissingen. Op grond van artikel 159 G.W. dienen de besluiten en verordeningen slechts buiten toepassing te worden gelaten in zoverre zij niet met de hogere rechtsnormen overeenstemmen (ALEN,A. en J. THEUNIS, l.c., p.17).

47. Eiseres voert als tweede grief de schending van het gelijkheidsbeginsel aan zoals vervat in artikel 18 VWEU, artikel 4 EEROvereenkomst, artikel 3 van de Richtlijn 2003/54/EG, artikel 5 van de Richtlijn 2001/77, artikel 10 en 11 van de Grondwet en artikel 25 van het Elektriciteitsdecreet. Eiseres stelt dat de grootste hindernis voor het realiseren van de interne markt is het bestaan van discriminerende regelingen en praktijken waarmee de regeringen van de Lidstaten hun eigen producenten tegenover buitenlandse mededinging beschermen. Artikel 3.1 van Richtlijn 2003/54/EG verplicht de Lidstaten om zich te onthouden van discriminatie bij de institutionele organisatie van de elektriciteitsmarkt. Verder voert eiseres aan dat de Lidstaten de verplichting hebben op basis van Richtlijn 2001/77/EG om een systeem van garanties uit te werken en de garanties van andere lidstaten enkel te weigeren op grond van objectieve, transparante en niet-discriminerende criteria. Tenslotte stelt zij dat de VREG weigert groenestroomcertificaten die niet afkomstig zijn van producenten gelegen in het Vlaams Gewest te aanvaarden om te voldoen aan de bepaling van artikel 23 Elektriciteitsdecreet. Aldus worden certificaten afgeleverd door andere gewesten of landen afgeleverd voor groene stroom die aldaar wordt opgewekt en die aldaar aan dezelfde voorwaarden voldoen zonder meer en louter op basis van hun oorsprong uitgesloten van het systeem van de quotumplicht. Gelijke gevallen worden aldus niet op gelijke wijze behandeld enkel omwille van het feit dat ze niet in het Vlaamse Gewest zijn gelegen. 48. De rechtbank is van oordeel dat ook omtrent de uitlegging van de deze bepalingen een prejudiciële vraag moet worden gesteld.
*** 49. De behandeling van de zaak wordt opgeschort in het licht van de hlernavolqende prejudiciële vragen. De uitspraak omtrent de kosten wordt aangehouden. "1. Is een nationale regeling, zoals vervat in het Vlaamse Decreet van 17 juli 2000 houdende de organisatie van de elektriciteitsmarkt, zoals uitgevoerd door het Besluit van de Vlaamse Regering van 5 maart 2004, gewijzigd door het Besluit van de Vlaamse Regering van 25 februari 2005 inzake de bevordering van elektriciteitsopwekking uit hernieuwbare energiebronnen, waarbij . aan leveranciers van elektriciteit aan eindafnemers aangesloten op het distributienet of het transmissienet de verplichting wordt opgelegd om jaarlijks een bepaald aantal groenestroomcertificaten in te leveren bij de Reguleringsinstatie (artikel 23 van voormeld Decreet); aan leveranciers van elektriciteit aan eindafnemers aa.ngesloten op het distributienet of het transmissienet een administratieve geldboete wordt opgelegd door de Vlaamse Reguleringsinstantie voor de Elektriciteits- en Gasmarkt (VREG), wanneer deze leverancier onvoldoende groenestroomcertificaten heeft ingeleverd ten einde te voldoen aan een opgelegde quotumverplichting inzake groenestroomcertificaten (artikel 37, §2 van voormeld Decreet) de Reguleringsinstantie geen garanties van oorsprong uit Noorwegen en Nederland kan of wil in aanmerking nemen en dit bij gebrek aan uitvoeringsmaatregelen van de Vlaamse Regering, die de gelijkheid of gelijkwaardigheid van de aflevering van deze certificaten heeft erkend (artikel 25 van voormeld Decreet en artikel 15, §1 van het Besluit van 5 maart 2004), zonder dat de gelijkheid of gelijkwaardigheid in concreto werd onderzocht door de Reguleringsinstantie; in feite gedurende de hele tijd dat het Decreet van 17 juli 2000 in werking was enkel certificaten voor de productie van groene stroom opgewekt in het Vlaamse Gewest in aanmerking werden genomen om na te gaan of was voldaan aan de quotumverplichting, terwijl er voor leveranciers van elektriciteit aan eindafnemers aangesloten op het distributienet of het transmissienet geen enkele mogelijkheid bestond om aan te tonen dat de ingeleverde garanties van oorsprong voldeden aan de voorwaarde van het bestaan van gelijke of gelijkwaardige garanties inzake de toekenning van dergelijke certificaten, verenigbaar met artikel 34 van het Verdrag betreffende de Werking van de Europese Unie en artikel 11 van de EEROvereenkomst en/of artikel 36 van dit Verdrag en artikel 13 van de EER-Overeenkomst?"
