Untuk perusahaan UK & UM apakah memerlukan SKT Jika delivery FCA dan menggunakan Master List, maka SKT Migas menjadi satu MIGAS bila menggunakan masterlist (delivery place persyaratan yang harus dipenuhi, meskipun jika hanya mengacu ke PTK007, disebutkan bahwa SKT Migas dibutuhkan untuk kategori UB. Untuk pengingat, PTK007 juga FCA) menyebutkan bahwa proses pengadaan juga harus mengacu ke peraturan pemerintah lainnya yang berlaku dan untuk keperluan Master List ini, instansi kepabeanan // mengacu pada Surat DIRJEN MIGAS No. 111/DJ/MIGAS/1974 tertanggal 13 April 1974 Should Small and Medium Sized Enterprise posses SKT jo . No. 7523/ 29.06/DJM.B/2003 tertanggal 31 December 2003 yang mengatur bahwa Migas when delivering material with master list (FCA perusahaan penunjang usaha pertambangan minyak dan gas harus mendaftarkan incoterm)? perusahaannya di DIRJEN MIGAS sehingga secara sistematis program yang digunakan oleh mereka mengharuskan data SKT Migas disampaikan pada saat pengajuan Master List. // If the delivery incoterm is FCA and using Master List, then SKT Migas is mandatory, eventhough PTK 007 stated that SKT Migas is required only for Large Size Enterprise (UB). Please be reminded that PTK 007 also states that procurement process shall also comply with other prevailing regulation. For Master List, the Custom Office use the reference of DIRJEN MIGAS Letter No. No. 111/DJ/MIGAS/1974 dated 13 April 1974 jo . No. 7523/ 29.06/DJM.B/2003 dated 31 December 2003 that requires supplier/contractor/company supporting oil and gas activities shall be registered in DIRJEN MIGAS therefore systematically their program requires SKT Migas when the proposal of Master List is submitted.

Sesuai dengan arahan dari Bank Indonesia, dalam hal diperlukan konversi kurs terkait kegiatan yang dilakukan, diminta menggunakan kurs JISDOR untuk menghitung harga Rupiah atas barang dan/atau jasa yang semula ditawarkan dalam valuta asing. Informasi mengenai JISDOR dapat dilihat pada website Bank Indonesia (www.bi.go.id). Kewajiban Penggunaan Rupiah ini merupakan Peraturan Bank Indonesia, dimana implikasi dan sanksi yang dapat diterapkan mengacu pada peraturan yang berlaku (PBI 17/3/2015). //

The obligation to use Rupiah as currency of contract is regulation from the Central Bank of Indonesia, where implication and sanction might applied refer to prevailing regulation (PBI 17/3/2015). Banyak kontraktor yang masih ragu menggunakan aturan Bid Bond baru (0.5%) untuk Domestic Company. Mohon penjelasannya mengenai aturan Bid Bond. // Many contractors unsure to use new Bid Bond value rule (0.5%) for Domestic Company case. Please advise on the Bid Bond value rule.

Scope masih dapat didiskusikan pada saat pre-bid meeting dan jika perubahannya telah dikonfirmasi oleh pihak pengguna barang/jasa, maka akan dituangkan dalam dokumen tender versi akhir sebelum memasuki masa submission penawaran. Fasilitas pembebasan bea masuk dengan masterlist itu hanya diberikan kepada KKKS (TEPI). Persetujuan masterlist dari MIGAS juga hanya menyebutkan nama TEPI, sebagai pihak yang memperoleh fasilitas masterlist tersebut. Oleh karenanya, dalam proses importasi (laporan PIB), kami hanya dapat mencantumkan nama TEPI selaku importir penerima fasilitas bebas bea masuk. // Exemption of import duties with Master List only given to PSC holder (TEPI). Master list approval from MIGAS only state TEPI, as the receiver of the said Master List. Therefore, in importation process (PIB report), only TEPI is stipulated as the receiver of import duties exemption. Dalam pre-bid meeting kontraktor sudah diberikan penjelasan mengenai jadwal pelaksanaan pekerjaan. Kontraktor harus melakukan penilaian atas kemampuan dirinya sendiri. Apabila kontraktor merasa jadwal tersebut sulit untuk dilaksanakan, kontraktor dapat meminta perubahan pada waktu pre-bid meeting atau dengan mengirimkan surat resmi selama masa tender (sebelum penyampaian dokumen penawaran). Perusahaan akan mempertimbangkan permintaan tersebut dalam kaitannya dengan kebutuhan operasional. Dengan menyampaikan penawaran, berarti kontraktor sudah setuju dengan ketentuan yang disebutkan dalam kontrak. Kontraktor sendiri yang menanggung resiko apabila salah menilai kemampuannya. Sehingga bila kontraktor tidak bisa memenuhi ketentuan kontrak maka akan dikenakan sanksi berdasarkan kontrak maupun aturan yang berlaku. // In the pre-bid meeting the contractor has been explained on the work implementation schedule. The Contractor shall conduct an assessment of the ability itself. If contractors find it difficult to execute the schedule, the contractor may request a change at pre-bid meeting or by sending an official letter during the tender period (prior to submission of bid documents). Pertanyaan Apakah semua dokumen untuk persyaratan SKTPM yang meminta bukti PO/kontrak yang telah selesai harus di unduh ke website Proccom, atau bisa sebagian dokumen saja?

Response Tidak harus seluruhnya. Yang di unggah hanya informasi yang relevan saja, sesuai dengan tender dan sub-bidang pekerjaan, seperti bukti dokumen bahwa pekerjaan telah selesai dilaksanakan dan tanda terima dari pemberi kontrak bahwa hasilnya memuaskan.

Does SKTPM require vendors to provide and upload all completed PO/Contract document or acceptable to upload partially/part of it ?

Not necessary all. The requirement is only to upload any relevant information related to tender and sub-sector of the service, such as evidence that the service has been performed and the acceptance from the client stated that the result is satisfactory.

Berkaitan dengan penerapan sanksi hitam. Bagaimana bila harga penawaran yang diajukan 80% dibawah HPS tetapi supplier dapat menyelesaikan kontraknya?

Baru berupa usulan, perlu dibicarakan lebih lanjut, untuk supplier yang sering tidak dapat berpartisipasi dalam tender karena permasalahan SKTPM yang belum selesai. // Just an idea, need to be arranged, for supplier that often cannot participate in tender because of invalid SKTPM.

Informasi tentang Pelatihan dan sertifikasi TKDN, apakah gratis dan bagaimana cara mendapatkan informasinya? // Local Content (TKDN) training & certification : Free of Charge and how to obtain the information

Pelatihan diadakan oleh DIRJEN MIGAS dengan biaya tertentu, TEPI akan menginformasikan brosur pelatihannya. Informasi tambahan dari C&P: sehubungan dengan perhatian yang serius dari Pemerintah terhadap TKDN, SKK MIgas meminta penerapan TKDN beserta dengan konsekwensi secara administratif dan finansial. Pelatihan TKDN akan diadakan untuk supplier TEPI dan akan diatur kemudian. // It will be done by DIRJEN MIGAS with cost relevant, TEPI may provide leaflet & brosur Additional remark from C&P, due to serious government focuses on TKDN, SKKMIGAS already asked for TKDN realization. Sudah dilakukan melalui ARIBA. Sebagian besar untuk pengadaan material. Hanya sedikit partisipasi untuk pengadaan jasa, terutama untuk e-RA. Tergantung pada kesiapan penyedia jasa untuk menggunakan e-bidding.

Bagaimana dengan kontrak-kontrak yang berjalan dalam hubungannya transisi ke Pertamina? // Contract side with regards of transition to Pertamina.

// Already have with ARIBA. Mostly for material. But participant for services is quite few, especially for e-RA. It will depend on the service supplier if they ready we can use ebidding. Saat ini yang TEPI sudah lakukan adalah perencanaan pengadaan hanya sampai 2017, tender/kontrak yang ada diupayakan untuk dimungkinkan tetap dilanjutkan hingga periode di atas 2017. untuk kontrak yang diterapkan hingga periode di atas 2017, maka periode yang diberikan adalah opsional setelah 2017, yaitu kondisi dimana kontraktor memiliki kemungkinan melanjutkan kontrak dengan periode yang lebih panjang. kontraktor akan diberikan info sebelumnya dan pernyataan tersebut akan terdapat dalam perjanjian dengan TEPI, kontraktor dan operator yang baru. // What we’ve done… plan of procurement until only 2017In term of tender/contract systematically will try if it is possible to extend the period of contract beyond 2017.If we adapt this approach to your contract, it will be optional period to beyond 2017, where contractor may have longer period of contract. Bagaimana untuk masa berlaku 'Bid bond', untuk tender dengan sistem 2 amplop apabila masa berlakunya akan habis pada tahap evaluasi harga, apakah perlu diperpanjang? //

Bid bond validity – For tender with 2 (two) envelopes system, if the validity is about to expire during commercial stage. Do we need to renew the Bid Bond? PT. PERFORINDO Masa berlaku HSE PQF 2 adalah 2 tahun. Apakah dimungkinkan untuk diproses tanpa keikutsertaaan dalam tender untuk menghindari terjadinya keterbatasan waktu saat diproses? // HSE PQF 2 validity is 2 years. Is it possible to renew the update without participation on tender, to avoid limited time of PQF 2 renewal process?

PTK007 Revisi 3 memiliki lebih sedikit pilihan sub bidang untuk material dibandingkan PTK007 Revisi 2. Oleh karena itu, ketika sub bidang yang sesuai tidak tersedia, TEPI menggunakan tingkat pembagian bidang usaha yang lebih tinggi sehingga lebih banyak penyedia barang yang dapat berpartisipasi untuk memperlebar kompetisi. // PTK007 Revision 3 has less option of sub sector for material than PTK007 Revision 2. Therefore, when the correct/precise sub sector is not available, TEPI use the higher level of business sector to allow more bidders to participate and enlarge the competition. Ya, untuk peserta tender yang lulus evaluasi teknis, masa berlaku bid bond perlu diperpanjang sesuai yang diminta selama masa evaluasi harga hingga penunjukan calon pemenang. // Yes, for bidders that passed technical evaluation, the validity needs to be extended whenever required to cover commercial evaluation phase until appointment of potential tender winner. Pada dasarnya dimungkinkan, tetapi dengan mempertimbangkan efisiensi biaya inspeksi dari tim TEPI, program pembaruan PQF 2 dilakukan dengan sistem penyaringan berdasarkan pengadaan jenis jasa yang akan ditenderkan dalam waktu 1 tahun kedepan dan memilih perusahaan yang berpotensi sebagai peserta. Untuk perusahaan yang tidak tersaring tapi mendaftar dalam tender, pembaruan PQF 2 akan dilakukan sesuai dengan persyaratan dari tender dan diselesaikan sebelum masa pemasukan penawaran. // It is possible, but cosidering the cost efficiency, this PQF II renewal program is done by selecting the potential bidders on future tender of service in the next one year. For new company that register in tender, the renewal program will be conducted as per ITB and will be settled before the end of bid submission closing date.
